HomeMy WebLinkAbout1943_11_10 Town Board Minutes SPECIAL MEETING OF THE TOWN BOARD TONN OF MAMARONECK, NEW YORK HELD NOVEMBER 10 , 1943 In the Council Room of the Weaver Street Firehouse , Town of Pamaroneck, New York. The meeting was called to order by Supervisor Yandeville at 8:15 p.m. (Eastern War Time) . Present: Supervisor Mandeville Councilmen Griffin, Stiner and Keeler Absent: Councilman Brewer The presence was also noted of Town Clerk Payne , Attorney Delius , Comptroller Orsino and Accountant Finson. The Supervisor reported that he had received a proposition from Edward Petigor , President of Larchmont Estates , Inc. , in which Mr. Fetigor stated he believed his company could pay the sum of $7,500 on account of all unpaid taxes due both Town and Village upon three parcels of property now under foreclosure. He requested that further action in the foreclosure proceedings be postponed un- til May 30, 1944. The proposition is in writing and is as follows : Larchmont Estates , Inc. 19 West 44th Street New York New York November 10th, 1943 Town of Mamaroneck, and Village of Mamaroneck. Dear Sirs:- In consideration of your withholding further steps in the pending tax liens foreclosure action against us , and keeping the same in statu quo to Play 30th, 1944, we will do either one of the following two things:- (a) on or before said May 30th , 1944, pay $7, 500. in full settlement and payment of all taxes now outstanding against the properties involved in such foreclosure action, which payment is to be apportioned ratably between the Town of Yamaroneck and the Village of Mamaroneck; or (b) In default of such payment we will deliver a bargain and sale deed , duly executed and in due form for recording, of the properties involved in such fore- closure action, conveying marketable title to the Town of Mamaroneck and Village of Mamaroneck, subject only to unpaid taxes and zoning restrictions. Very truly yours , LARCHMONT ESTATES , IT'C. , (Signed) by Edward Petigo President. an On motion made by Councilman Stiner , seconded by Council- man Keeler , it was unanimously RESOLVED, that the Town Attorney is hereby instructed to enter into a stipulation with Larchmont Estates , Inc. , providing that the answer to the complaint , which has been filed , be withdrawn, that the foreclosure proceeding proceed to judgment in the usual way but that no further proceedings be taken and that the publication of the referee ' s notice of sale be postponed until Bray 30, 1944, and if, at the time , the sum of $7, 500 is paid. by Larch- mont Estates , Inc. in accordance with its offer now made , the foreclosure proceeding shall be settled and discon- tinued without costs and that otherwise , the property be sold in adcordance with the judgment of foreclosure and sale. The Supervisor asked if any of the members of the Board wished to offer their reports. Councilman Stiner reported that it would be necessary to obtain the consent of the mortgagee on the property of Robert P. Guthrie on Forest Avenue , to install the buttress to the retaining wall supporting the road-bed of Forest Avenue. He added that the Highway Department was doing the work which would require about $100.00 for poured concrete and that it was a very necessary oper- ation. The members of the Board agreed that it should be done. Councilman Griffin reported on a letter which was referred to him at the last meeting concerning the Larchmont Public Library , and following some discussion the Town Clerk was directed to advise Pfayor Goeckler that the Town Board could find no way to increase the Town' s contribution to the Larchmont Public Library. Councilman Keeler discussed with the members of the Board ways and means of providing for the duplication of assessment records and following some study it was decided that the work could be done at very low cost and that it could be considered out of the budget for the Department of Assessor after the 1944 budget had been approved. The Supervisor suggested that the Board proceed to consider the Preliminary budget for 1944. The Board prepared the followinl- itemized statement in writing of the estimated revenues and expenditures of the Town for the fiscal year commencing January 1, 1944 , which statement is knorn as the Annual Estimate : PRELIMARY BUDGET ESTIMATED DISBURSEMENTS GEI ERAL TOWN 1. On motion duly made and seconded , it was unanimously RESOLVED, that the Town Clerk give notice of said Public Hearing as required by Section 113 of the Town Law in "The Daily Times" , the official news- paper , published in the Town of Mamaroneck, in its issues of November 20 and November 27, 1943; and be it FUTHER RESOLVED, that the Comptroller have prepared seventy-five (75) copies of said Preliminary Budget for the use of the Public.
