HomeMy WebLinkAbout1943_10_20 Town Board Minutes REGULAR MEETING OF THE TOWN BOARD TOWN OF MAMARONECK, NEW YORK. HELD OCTOBER 20, 1943 In the Council Room of the Weaver Street Firehouse , Town of Mamaroneck, New York. The meeting was called to order by Supervisor Mandeville at 8 p.m. (Eastern War Time) . Present: Supervisor Mandeville Councilmen Griffin, Brewer , Stiner and Keeler Absent : None The presence was also noted of Town Clerk Payne, Attorney Delius , Assessor Smith , Comptroller Orsino and Town Engineer and Superintendent of Highways Foote. The members of the Board welcomed Councilman Keeler , who had been ill for some time. The Supervisor suggested that the meeting proceed with the reports of committees. Councilman Stiner presented a report dated September 27, 1943 received from the Town Engineer giving the result of the survey of so-called illegal house sewer connections. The report stated that 560 houses were inspected and a list of the houses was given. Councilman Stiner suggested that a project be prepared for consideration along with other post war projects. There was general discussion about post war planning during which Supervisor Mandeville recalled that a list of proposed projects had been filed with the New York State Post Mar Planning Commission. Councilman Stiner stated that he would obtain for the next meeting of the Board the latest information from the State on Post War Planning. Councilman Brewer stated that there was nothing to report for his Departments. Councilman Griffin read the detailed financial statement for the month of September , received from the Supervisor. He reported that he had attended the regular meeting of the Park Commissioners held the previous evening and that there was nothing to report other than that the usual work was being carried on. He presented the following: Report of the Comptroller of claims audited and paid from October 7 to October 20, 1943; a statement of Bank Balances as of 9 a.m. , October 20, 1943. He stated that there was nothing to report for the Department of welfare as the regular report had been handed in at the last meeting of the Town Board. Councilman Griffin presented three petitions received from the Assessor for the correction of the assessment roll so as to permit the apportionment of taxes. On motion by Councilman Griffin, seconded by Councilman Stiner , the following resolution was , upon roll call, unanimously adopted: WHEREAS , the Assessor has presented petitions for the correction of the assessment roll for certain years , pursuant to the provisions of Section 33 of Chapter 105 of the Laws of 1916 , as amended, known as the Westchester County Tax Act; and WHEREAS , after due consideration this Board finds it desirable to grant said petitions for the correction of said assessment roll; NOW, THEREFORE , BE IT RESOLVED , that the assessment roll for the year 1942 , taxes of 1943 and the assessment roll of 1943 , taxes of 1944, which shows property now appearing on the roll as follows: Section Block Lot Name Land Only 1 37B 127 to (119-164) 132 Empire Trust Company $49500 be corrected as follows , in accordance with the provisions of subdivision 5 of Section 33. Embury 327 Block 119-19 Councilman Keeler reported that a full statement had been prepared for budget purposes showing the estimated costs of insurance for 1944, and that all departments had been notified as to the amounts necessary to provide adequate coverage for the coming year. He presented a typewritten report of estimated insurance costs for public liability insurance on vacant land now owned by the Town following foreclosure proceedings , or deeded to the Town in lieu of foreclosure , which matter had been referred to him at an earlier meet- ing. The members of the Board complimented Councilman Keeler for this work, as the report required a considerable amount of time and study of the details. He stated that there was one other matter which had come to his attention within the last month and that was that the Village of Iffama.roneck had borrowed a part of the assessment records to bring their records up to date , and that while very good care was taken during transportation and the time ,which the Village had possession of the records , it had occurred to him that there should be duplicate copies made of the assessment cards in case of fire damage. He recalled that some six or seven years ago he had recommended to the former Supervisor that something should be done to properly in- sure these cards. He stated it was estimated that the property record cards are in the value of approximately 40 or 50 thousand dollars and that they are almost irreplaceable under present conditions . He recommended that some consideration be given to having photostatic copies made of the cards as was done by the Village to complete their records the cost of which would only involve the original cost instead of considering insurance which would require an expenditure for premiums annually. Following some discussion it was decided to consider the matter along with other budget items , at the meetings to be held for this purpose . The Supervisor requested the Town Clerk to read the communications . A letter dated October 8 , 1943 was received from Chief of Police , Paul A. Yerick, advising the Town Board that the Police De- partment favored the granting of permission to the Mamaroneck Auxiliary Fclice Pistol & Rifle Club , the use of property at the corner of Fenimore and Grand Street as a range for small arms practice , provided, of course , that proper insurance protection is given, and , further that the Town of Mamaroneck Police Department is entitled to practice at the convenience of all concerned. It was agreed that when the insurance coverage is provided , further action would be taken. A letter dated October 6, 1943 was received from Richard I. Land commending the Town Board, Town Engineer Foote and the staff of workmen for the work done along the bank of the Sheldrake River. He stated that it affected the desired protection to the roadway and trees . He suggested that other improvements be made and enclosed a sketch showing a proposed addition to one of the bridges. Attached to the letter was a copy of his letter to James C. Harding , County Public Works Commissioner , commending the Town and also offering to the County suggestions referred to above. The papers were referred to Town Engineer Foote and the Town Clerk was requested to thank Mr. Land for his interest and co- operation. The Town Clerk stated that he wished to report that as directed, he had placed a public notice in the newspaper to the effect - that bids would be received by the Town Board for the s. le of one (1) 1934 Ford 4-Door Sedan, and one (1) 1934 Ford Station Wagon. Further , that letters had been mailed to the automobile dealers in the com- munity advising them of the notice and that no bids had been re- ceived. The members of the Board decided to hold the matter in abeyance until a decision is made at a later meeting for the dis- posal of the automobiles. The Town Clerk reported that pursuant to Section 82 of the Town Law an Election Notice would soon have to appear in the news- paper and that it would be necessary to change two of the polling places previously designated, because of certain conditions . Following some discussion, it was on motion by Councilman Griffin, seconded. by Councilman Stiner , upon roll call , unanimously RESOLVED, that the following: notice be published in the "Daily Times" , the official newspaper of the Town, in the issue of October 23 , 1943 , and that -the polling places listed be the official polling places for the General Election to be held on November 2 , 1943 : ELECTION NOTICE TO THE ELECTORS OF THE TO IN OF MAMARONECK.: NOTICE IS HEREBY GIVEN, pursuant to Section. 82 of the Town Law that at the General Election to be held in this state on the Tuesday next succeeding the first Monday in November (November 2) the following proposition will be submitted to the voters for their approval or disapproval. PROPOSITION NO. 1 Shall the Town of Mamaroneck establish a recreation system and annually levy and appropriate for the maintenance of such system not less than $10 ,000? The several Boards of Inspectors of Election heretofore duly appointed will meet on said November 2 , 1943 between the hours of 6 A.M.. and 7 P.M. at the following polling places heretofore designated. Payne Published by Order of the Town Clerk Town Board, Town of Mamaroneck The following reports were ordered received and filed: (1) Report of the Town Clerk for the montli of September 1943 ; (2) Summary of Receipts and Disbursements , from January 1 to September 30 , 1943; (3) Analysis of Budget Appropriations and Expenditures from January 1 to September 30, 1943; (4) Analysis of Estimated Revenues from January 1 to September 30, 1943; (5) Report of the Westchester County Dog Pro- tective Association for the month ending October 15, 1943- The Supervisor asked if there was anyone who wished to address the Board. There being no one , he asked the Town Attorney what matters he had to place before the Board. M The Town Attorney presented a letter dated October 5, 1943 received from Fdward H. Tatun, Esq. , requesting settlement of certiorari proceeding brought to review the assessment of property of the More Gage Corporation, known as Block 603 , Parcel 97. The members of the Board discussed the matter with Attorney Delius and it was decided to deny Mr. Tatum' s request for settlement. The Town Attorney reported on the recent decision in favor of the Bonnie Briar Holding Corporation, in their proceeding brought to review the assessments on their property. On motion by Councilman Keeler , seconded by Councilman Griffin, the Town Attorney was authorized to appeal the case. The Supervisor informed the Board that he had received a request from the Superintendent of Highway that certain transfers be made within the Highway Fund. Following, some discussion, it was on motion by Councilman Stiner , seconded by Councilman Griffin RESOLVFD, that the following transfers be made within the Highway Fund: FROM: Item 2 (Bridge Fund) - $150.00 Item 4 (Miscellaneous Funds) - $950.00 TO: Item 3, Machinery Fund $1,100.00 The Supervisor presented a letter dated October 14, 1943 received from Victor H. Stempf, Secretary of the Board of Police Com- missioners , advising that Sergeant Leonard H. Wilson had requested retirement due to physical disability. Further that Police Surgeon William G. LeFurgy verified the facts . Photostatic copies of the let- ters addressed to the Board of Police Commissioners from Sergeant Wilson and from Dr. LeFurgy were attached. Mr. Stempf stated that the Board of Police Commissioners regret the loss of Sergeant Wilson' s services , following his long and satisfactory service and that it is recommended that his present sick leave be extended to December 31 , 1943 and that his retirement commence following that day. The members of the Town Board expressed regret upon hearing of the necessity of Sergeant Wilson' s retirement, following his faithful service to the Town and referred the matter to Councilman Brewer and the Trustees of the Police Pension Fund, for further adtion. At 10:15 p.m. the Board adjourned Town Clerk
