HomeMy WebLinkAbout1943_08_04 Town Board Minutes nx REGULAR MEETING OF THE TOWN BOARD TOWN OF MAMARONECK, NEW YORK HELD AUGUST 49 1943 In the Council Room of the vleaver Street Firehouse , Town of Mamaroneck, New York. The meeting was called to order by Supervisor Mandeville at 8 p.m. (Eastern War Time) . Present: Supervisor Mandeville Councilmen Stiner , Brower and Griffin Absent: Councilman Keeler The presence was also noted of Town Clerk Payne , Town At- torney Delius , Assessor Smith, Town Engineer and Superintendent of Highways Foote. The minutes of the meeting of July 21, 1943 were approved as presented. The Supervisor requested the Town Clerk to read the com- munications. The Town Clerk reported that the agreement between the Town of Mamaroneck and the Westchester County Dog Protective Assoc- iation, Inc . had been approved by the Commissioner of Agriculture and Markets of New York State , and that a copy had been received for the files of the Town. The Town Clerk reported that the Police Chief had left pre- pared copies of a resolution authorizing the opening of a Ration Bank Account for gasoline for the Police Department. Town Attorney Delius advised that he had prepared the re- solution and that the new system of OPA requires that bank accounts with no money involved be opened to take care of distribution of gasoline supplies. He added that no doubt all the other departments of the Town would be required to do likewise. On motion by Councilman Stiner, seconded by Councilman Griffin, on roll call, it was unanimously RESOLVED, that a ration bank account , or accounts, as defined in General Ration Order Pdo. 3 , be opened and maintained in the name of the Town of Mamaroneck with The Bank of Westchester , or one of its branches , which bank shall act as an agency of and under the direction and supervision of the Office of Price Administration and shall be responsible only to the Office of Price Administration; that any one of the following police officers of the Town, i.e. , Paul A. Yerick, Chief of Police and Paul Euiler, Lieutenant, is hereby authorized, on behalf of the Town and in its name: To sign ration checks , as defined in said Order; to indorse ration checks or other ration evidences , owned, or held by this Corporation, for deposit in said account; and FURTHER RESOLVED, that the Town Clerk shall certify to said Bank and the Office of Price Administration the names of such officers and employees at present , and shall from time to time hereafter, as changes in the personnel are made , immediately certify such changes to the Bank and the Office of Price Admin- istration; and ti FURTHER RESOLVED, that The Bank of Westchester be and it hereby is authorized to receive and honor all ration checks signed in accordance with the foregoing resolution, and such certification by the Town Clerk; and FURTHER RESOLVED, that the foregoing resolutions shall remain in full force and effect until written notice of their amendment or rescission shall have been received by said Bank; and FURTHER RESOLVED, that the foregoing authorization and resolutions shall apply to any and all ration bank accounts which the Police Department of the Town of Yamaroneck now is or may at any future time be required or authorized by the Office of Price Administration to open or maintain, without further authorization from this Board; and FURTHER RESOLVED, that the Town Clerk be and he is hereby authorized and directed to certify to said The Bank of Westchester and to the Office of Price Administration the foregoing resolutions. The following reports for the month of July, 1943 , were re- ceived and filed: (1) Report of the Receiver of Taxes and Assessments; (2) Report of the Building Inspector; (3) Report of the Plumbing In- spector; (4) Report of the Mamaroneck Health Center. The Supervisor suggested that the meeting proceed with reports of Committees. Councilman Stiner reported that the guard rails along Old White Plains Road were being painted and that certain road repairs were being made. He added that the new road roller was working very well. He also reported that the retaining walls along the Sheldrake River were nearing completion. He informed the Board that conditions at the incinerator were improving and that the management of Larchmont Acres had been doing pretty well in their effort to cooperate. The Supervisor informed the Board that the Commission for Joint Garbage incineration had placed Village Engineer Richards of the Village of Larchmont and Town Engineer Foote in charge of the incinerator and that in the future the members of the Town Board would notice better efficiency at the plant. Councilman Griffin stated that he had viewed the report handed in by Engineer Foote and that the average temperature in the chambers was not at any time as high as recommended for the plant. He said that it did seem as though the plant could be run with better efficiency. The Supervisor stated that in the past Air. Foote could not go into the plant and dictate , but that in the future he will be able to direct and that he is to continue to report back to Councilman Stiner. Councilman Stiner reported that the Board of Review for assessments had completed, with the exception of apartment houses, all nine (9) sections of the Assessment Roll. He added that he believed that all of the work would be completed before the next meeting of the Town Board. Councilman Griffin stated that there was nothing to report for the Park Department as the meeting of the Commissioners would not be held until the middle of the month. He presented and read the report for the Department of ; Wel- fare for the month of July, 1943 , which showed as follows: TOTAL GRASSLANDS CASE LOAD INDIV. EXPENDITURES HOSPITAL CASES AMOUNT 1943 —27 51 $ .76 z3 52,030`.00 1942 122 425 4,777.78 25 3 ,110.00 Councilman Griffin commented on the great reduction in the cost of Public Welfare Relief, and stated that everything proved sat- isfactory with the new Cash Payment Relief plan and that it also ef- fected savings at the Town Offices in the Comptroller ' s Department. Outside 'Villages 100.00 Total $27 ,120. 3 He also .presented and read the statement of Bank Balances as of 9 a.m. , August 4, 1943; which showed a grand total, of all funds on hand of $268,818.75• The statement of claims audited and paid by the Comptroller --- for the period July 20 , 1943 to August 4, 1943 was presented by Council- man Griffin. He informed the Town Board that Mrs. Lorna L. Marts had asked for a leave of absence because her husband had left for the Armed Services , and that there would be a temporary change of residence. Following some discussion it was on motion by Councilman Griffin, seconded by Councilman Stiner , upon roll call RESOLVED, that Mrs. Lorna L. Harts , Social Case Worker in the Public Welfare Department in the Town of Mamaroneck, New York, be and she hereby is granted a leave of absence for the duration of the war period. Councilman Brewer reported on Recreation with the suggestion that if and when the people decide by means of the referendum at the next election upon having a recreational system, it might be well to ask the Board of Education for the facilities in the school buildings on the school grounds and the staff to carry out the plan. He said that he had conferred with Mr. T. James Ahern, Superintendent of Schools, and that it . looked favorable. He continued that he did not wish to speak for the School Board, but that he believed that they would go along on the plan. He advised that their next meeting would be held in September. He pointed out that the Board of Education was running a very extensive program with the $3 , 500 placed in their budget for the purpose for a limited period. He also pointed out that the Town would be obliged to hire a Supervisor and physical directors on part time while the school system could have Mr. Ahern act as the general supervisor and work it in with his duties. Also, that the present staff of school directors doing this work could continue on a plan. 633 He added that with all they could do the work a lot cheaper than the Town, and that it would put to use fully all the facilities of the Town. He referred to the WPA Project for Recreation and stated nothing could be gained from that experience as part was paid for by the Federal Government and part by the Town. He said that Recreation never really had been put on a good plan in the Town. The members of the Board commented that they thought that it was an excellent idea. Councilman Brewer stated that in order to bring his report up to date he wished to advise that he was arranging a meeting with Mr. Philip Moynahan, Chairman of the School Board and the mayors of - both Villages to talk the matter over so that when the plan is pre- sented to the people they will know something about the plan. The members of the Town Board decided to await the recom- mendations resulting from the conference. Councilman Brewer offered and recommended the following re- solution which was seconded by Councilman Stiner , and upon roll call, unanimously RESOLVED, that the claim of Anthony Piacenti or Vito Piacenti, for emergency hospitalization and medical care of Anthony Piacenti, in the sum of $220.25, as submitted to the Welfare Officer , be approved and that payment be made accordingly. Mr. Peter C. Doern, Jr. Inc. , Real Estate Broker, appeared before the Board and stated that a client of his office wished to make application to the Town Board for the apportionment of certain property on 'taxes shown on the Town records in Block 926. Following some discussion, Mr. Doern was requested to file a sketch of the proposed division of the property with the Assessor , and the Assessor was requested to report back to the Town Board. The Supervisor informed the Board that he had received a copy of the following resolution which was adopted by the Village Board of Trustees of the Village of Larchmont , at a meeting held August 2, 1943: WHEREAS , the parcel of land designated on the Tax Map of the Village of Larchmont as Parcel 1 in Block 615 passed into the ownership of the Town of Mamaroneck on or about 6ctober 16, 1942 by virtue of foreclosure of tax liens; and WHEREAS , said parcel was assessed erroneously and illegally on the Assessment Roll of 1942 of the Village of Larchmont for the tax of 1943 because said parcel is exempt from taxation for the tax year of 1943: NOW THEREFORE , BE IT RESOLVED, that the assessment and the tax- thereon for Parcel 1 , in Block 615, on the Tax Map of the Village of Larchmont hereby is cancelled pursuant to the authority of Subdivision 4 in Section 109a of the Village Law, and the Treasurer is directed and authorized to mark the Assessment Roll accordingly. The Supervisor informed the Board that there had been some correspondence with Mr. Charles Gersbach, 12 Mohegan Road, Larchmont, N.Y. , concerning town-owned property adjoining Mr. Gersbach's property, and presented the following letter: 0 12 Mohegan Road Larchmont , N.Y. August 3, 1943 Supervisor Town of Mamaroneck 158 west Boston Post Road Mamaroneck, N.Y. Dear Sir: I beg to confirm my letter of August 2nd _ and send you enclosed check for $1 ,000. This is the amount of my offer for Parcel 339, Plot 208, corner of Oxford and Mohegan Roads. It is my understanding that this amount will include all taxes due as of date of sale. Thanking you for your kind attention in this matter, I beg to remain, GG mmd Encl. Very truly yours, /s/ Charles Gersbach The check for $1,000 accompanied the letter. Following some discussion, it was on motion by Councilman Griffin, seconded by Councilman Brewer , upon roll call, unanimously RESOLVED, that the offer of Charles Gersbach to purchase from the Town of Mamaroneck, pre- mises now owned by it and acquired in tax lien foreclosure proceeding, which is known as Block 208, Parcel 239 (old number Section 2, Block 8A, Lot 39 for $1,000 be accepted; and FURTHER RESOLVED, that the Town Attorney is authorized and directed to prepare the necessary deed of conveyance and the Supervisor and Town Clerk are authorized to execute and deliver such deed to Charles Gersbach, upon receipt of the sum of $1,000 with the understanding, however , that the Town of Mamaroneck is to pay the School Tax which becomes a. lien upon the property on Sep- tember 1, 1943 , and that said conveyance be made free and clear of all taxes up to and including September 1 , 1943. The Supervisor reported that the highways are in good con- dition and that everything else seems to be in good order. Town Clerk Payne informed the Board that since Miss Sally Barrett had left the temporary position in the Town Offices , he had been trying to locate another person to carry on this work. He re- ported that on July 26, 1943 , bliss Conris S. Mondello had applied for the position and was accepted, subject to the approval of the Town Board. He stated that the matter had first been taken up with Councilman Stiner , Chairman on Personnel. Following some discussion, it was on motion by Councilman Stiner , seconded by Councilman Griffin , upon roll call , unanimously RESOLVED, subject to the approval of the Personnel Officer of the County of Westchester , Miss Connie S. Mondello. be and she hereby is appointed to the tem- porary position in the Town Offices as doing general clerical work at a salary at the rate of $18 per week. Said appointment to terminate not later than December 31, 1943. At 9:30 p.m. the Board adjourned. Town Clerk
