REGULAR MEETING OF THE TOWN BOARD
TOWN OF MAMARONECK, NEW YORK
HELD JULY 21 , 1943
In the Council Room of the Weaver Street Firehouse , Town of
Mamaroneck, New York.
The meeting was called to order by Supervisor Mandeville
at 8 P.M.. (Eastern Velar Time) .
Present : Supervisor Mandeville
Councilmen Stiner, Brewer and Griffin
Absent: Councilman Keeler
The presence was also noted of Town Clerk Payne , Town
Attorney Delius , Comptroller Orsino, Assessor Smith, and Town Engineer
and Superintendent of Highways Foote.
The minutes of the meetings of June 24 and July 7, 1943 ,
were approved as presented.
The Supervisor asked the members of the Board if it would be
agreeable to change the routine of business to permit the Town Attorney
to present his matters of business first so that he could leave at 9 o '
clock because of illness in his family.
Attorney Delius called to the attention of the Board that it
was drawing near to the time to submit to the Board of Elections the
proposed form of submission on the question of establishing a Recreation
Commission in the Town which is to be voted upon at the general election
held on November 2 , 1943.
He presented the form of resolution which embodied the pro-
position as it would be submitted on the voting machines. There was
some discussion on the question as to the amount of the funds to be
set up for the operation of the system, if approved. Mr. Delius pointed
out that the resolution was prepared leaving space for the amount of
the funds in blank pending the decision of the Board.
Following further discussion, the matter was referred to
Councilman Brewer , Chairman on recreation matters , with a suggestion
that he request the persons in charge of local recreation, to submit
the budget estimate. .
The Town Attorney referred to a question concerning tax
records , and Councilman Griffin called to the attention of the Board
that certain recommendations made by the Town' s auditors in their last
report should be carried out.
Councilman Griffin offered the following resolution which
was seconded by Councilman Stiner , and it was upon roll call unanimously
RESOLVED, that the recommendations with
respect to reconciliation of the record of
unpaid taxes and assessments , made by Messrs.
Glick-Freedman, Certified Public Accountants
and Auditors , as contained in their audit of
the books and accounts of the Town of Mamaro-
neck, which is dated May 14, 1942 , be approved.
FURTHER RESOLVED, that in pursuance of such re-
commendations , the records in the office of the
Supervisor of the Town', be reconciled with records
kept in the office of the Receiver of Taxes , with
regard to unpaid taxes', and assessments.
The Town Attorney explained that in past years the
Huguenot Trust Company had been designated as a depository of Town
funds and that now it is desired to again include the Huguenot Trust
Company in the list of depositories for the Town.
On motion by Councilman Griffin, seconded by Councilman
Stiner , it was upon roll call unanimously
RESOLVED, that the Huguenot Trust Company of
New Rochelle , N.Y. , be and it hereby is de-
signated as a depository of the Town of
Mamaroneck and/or the Supervisor of the
Town of Mamaroneck, provided that the amount
on deposit in said Huguenot Trust Company
shall not atany time, be in excess of the
amount insured by the Federal Deposit In-
surance Corporation.
FURTHER RESOLVED, that all checks for the
withdrawal of such funds as are on deposit
in the Huguenot Trust Company , shall be signed
by the Supervisor and counter-signed by the
Comptroller of the Town of Mamaroneck.
On motion by Councilman Brewer , seconded by Councilman
Stiner , it was upon roll call unanimously
RESOLVED, that the amounts of withholding
taxes held by the Town of Mamaroneck, in
accordance with the Current Tax Payment Act
of 1943 , shall be deposited with the Bank of
Westchester , in return for deposit certificates
as required by the terms of the above Act.
Attorney Delius requested the Board to transfer the un-
expended amount remaining in the Certiorari and Foreclosure Account
in the 1942 Budget , to the 1943 Budget Account.
On motion by Councilman Griffin, seconded by Councilman
Brewer , it was upon roll call unanimously
RESOLVED, that the unexpended amount remaining
from the appropriation in the 1942 Budget for
tax lien foreclosure' costs and certiorari costs ,
i. e. , the sum of $642. 50, be transferred and
added to the appropriation for certiorari costs
as contained in the Budget for the year 1943.
Attorney Delius presented a letter received from Mr.
William E. Thrasher , General Superintendent of the Westchester Joint
'eater Works No. 1, regarding an incorrect item in the certification
of water arrears for the year 1942 , and recommended the correction.
On motion by Councilman Brewer , seconded by Councilman
Griffin, it was unanimously
RESOLVED, that the amount levied by resolution
of the Board, December 15, 1942 , for unpaid
water charges against Block 106 , Parcel 490 ,
in the sum of $1.66 ,', be cancelled since it
appears that the same was in error and should
have been charged against Block 106, Parcel 516.
Attorney Delius handed to Councilman Griffin a memorandum
concerning laws effecting the use of Park areas , which information
was requested by the Park Department.
Councilman Griffin stated that he would go over the matter
with the Park: Commission at their next meeting.
Supervisor Yandeville informed the Board that some of
the Councilmen had reported that they had inspected the property
adjoining the residence of Yr. Joseph Scarano at 616 5th Avenue.
Also, that following negotiations he had received through Yr. T.
Roosevelt Allen a check in the amount of $400 which represented
an increase of $100 over the amount first offered by hr. Scarano
for the purchase of the property.
Following some discussion, it was on motion by Councilman
Griffin, seconded by Councilman Stiner, unanimously resolved
WHEREAS , an offer has been received from
Joseph Scarano , 616 5th Avenue , Town of
Mamaroneck to purchase a parcel of property
heretofore acquired by the Town in proceed-
ings of foreclosure of tax liens , and which
is a part of Block 132 , Parcel 1 , formerly
known as Section ,1, Block 51, Lots 7 , 10 ,
11 , 19 , 18, 17 , 18, and a part of Lot 16 ,
adjoining the northerly portion of Lot 17,
for the sum of $400; ', and
WHEREAS , the amount offered appears to this
Board to be the fair and reasonable value
thereof, for the purpose of sale ,
NOW, THEREFORE , BE IT
RESOLVED, that the Supervisor is hereby
authorized to execute and deliver a deed to
the said Joseph Scarano, upon receipt of the
sum of $400;
FURTHER RESOLVED, that the Town Engineer is
- -_ hereby directed to prepare a metes and bounds
description of the property so to be sold , and
the Town Attorney is authorized and directed
— to prepare the necessary deed for the conveyance
of said property to Joseph Scarano.
Councilman Brewer recommended that a policy be set up for
the handling of all such sales in the future whereby a public notice
will be given for bidders , and if an offer is first placed with the
Town before the property has been advertised for sale , that such
public notice carry a statement that the property is being offered
subject to the offer on file in the Town Offices.
Following some discussion the Town Clerk was requested
to receive offers for the purchase of Town-owned property and that
he give notice as referred to by Councilman Brewer.
The Supervisor informed the Board that early in June he
attended a conference held with the Supervisor of the Town of
Harrison, the Village Yanager of Mamaroneck, the Mayor of Larchmont ,
and Yr. John Baum, Chairman of the local Ration Board, and that
many matters were discussed. Of these , the most important being the
need of additional space to house the personnel of the Ration Board.
It was decided to utilize the space on the first floor of the former
First National Bank building , but he advised that since then, every
consideration was given to this arrangement and it was proven that
it would be less expensive to secure additional space in the building
where the Ration Board is now located.
He reported that the cost of additional equipment and
additional rent would result in an added amount of $390.00 , over and
above the present budget.
The cost to the Town, based on previous pro rata arrange-
ments , would result in a charge of $85. 80. He recommended the pay-
ment of the Town' s share to the Ration Board.
Councilman Brewer ,stated that he understood that it was
more or less an emergency measure , and that while he is in favor
of providing the citizens of the community with the proper facilities ,
he did not feel that the Town had the right legally to make these
contributions.
The Supervisor pointed out that the same question had
been raised at different times and no opinion had been handed down
covering the subject. Also , that in order for the communities to
provide the facilities , it has been necessary for them to appropriate
such funds and added that these funds are used to horse and equip
volunteer workers , and not to pay salaries for Federal employees.
Councilman Bremer suggested that if the communities were
to get together , it might be possible to get the Federal Government
to assume these expenses , as these local offices were nothing more
than a branch of the Federal Government.
Attorney Delius reported that he has been waiting months
to receive an opinion on the matter from the Attorney General and
that nothing had been received to date.
Councilman Stiner suggested that the Town' s contribution
be made but that a protest be filed with the proper authorities.
Councilman Brewer agreed.
Supervisor Mandeville stated that he was not sure as to
whether the protest should be made by the Town, or by the Chairman
of the local Ration Board. He explained that Mr. Baum, the Chairman,
had been endeavoring to get the Government to pay all of the expenses ,
and stated that he would be willing to write the letter for the Town,
but would not do so until he had had a talk with Mr. Baum.
On motion. by Councilman Stiner , seconded by Councilman
Griffin, it was upon roll call unanimously
RESOLVED, that the Comptroller be and he
hereby is authorized to audit the claim pre-
sented by the War Pride and Rationing Board,
2560-9 , in the amount of $85. 80 , and the
Supervisor is hereby authorized to pay same
out of the budget for War Council activities
for the year 19433 and
FURTHER, that it is understood that the above
amount represents the share of the Town of
Mamaroneck based on the pro rata arrangement
used previously for the payment of such ex-
penses of the local Ration Board. , the expenses
being assumed by the Town of Harrison, Village
of Mamaroneck, Village of Larchmort , and Town
of Mamaroneck.
Mr. Victor J. Hopkins, Chairman of the Democratic party
of the Town appeared at the meeting and the Supervisor asked him if
he had any matters to place before the Board.
hr. Hopkins stated that he had brought in a certified copy
of the list of election inspectors being submitted by the Democratic
party. He said that he wished to file same with the Town Clerk.
Town Clerk Payne advised the Board that he had also received
a certified copy of the list of election inspectors recommended by
the Republican party, signed by Chairman Burton C. Meighan.
The Supervisor stated that it was in order to make the
appointments and submitted the lists to the members of the Board for
consideration.

The Town Clerk presented the following list of polling
places for the year 1943 which were discussed by the members of the
Board.
The Town Clerk advised that Mr. Meighan, Chairman of the
Republican party had approved of the list.
Mr. Hopkins was asked if the Democratic party approved
of the list of polling places presented. He stated that the list
did meet with the approval of his Party.
On motion by Councilman Griffin, seconded by Councilman
Stiner , it was upon roll call unanimously
RESOLVED, that in accordance with the provisions
of Section 66 of the Election Law, being Chapter 17
of the Consolidated Laws of the State of New York,
as amended, the Town Board of the Town of Mamaroneck
hereby designates the place in each election district
in the Town at which the meeting for the registration
of voters and elections and primaries shall be held in
the year following the ensuing first day of October :

The Supervisor suggested that the meeting proceed with the
reading of communications.
A letter dated July 12 , 1943 was received from Mr. Henry E.
Mendes, Chairman of the Town of Mamaroneck Tar Council , in which he
thanked the members of the Board for their letter covering the accom-
plishments of the War Council. The letter was ordered received and
filed.
A letter dated July 20, 1943 was received from P:layor B.J.
Santoro of the Village of Mamaroneck in which he referred to a con-
versation with the Supervisor concerning a proposed joint meeting
of the Town and Village Boards to cover certain items of mutual in-
terest. He suggested that a meeting be held during the week of July 26.
Following discussion, it was decided that the meeting be
arranged for Tuesday evening, July 27, at 8:30 , in the Council Room
of the Weaver Street Firehouse. The Town Clerk was requested to
advise Mayor Santoro of the wishes of the Town Board.
A letter dated July 9 , 1943 was received from Harvey Tao.
Manss , President of the Bonnie Briar Civic Association, thanking
the members of the Board on behalf of the residents of the Bonnie
Briar Section for the added comfort and convenience of having a
bus shelter at the entrance on Bonnie Briar Lane near Weaver Street.
The letter was ordered received and filed.
A letter dated July 12, 1943 was received from Yrs.
Kenneth Proctor Phelps , requesting permission to keep chickens on
her premises at 21 Howell Avenue, Town. The application was dis-
cussed and there was a question about the ordinances , also, as to
whether or not the deed restrictions of Howell Park prohibited the
keeping of chickens. The letter was referred to the Town Attorney
for reply.
A letter dated July 19 , 1943 was received from Leo N. Orsino,
Comptroller of the Town in which he requested authorization to make
the following transfers within the 1943 Budget:

On motion by Councilman Griffin, seconded by Councilman
Brewer , it was upon roll call unanimously
RESOLVED, that the Comptroller be and he
hereby is authorized to transfer from the
item of Office Expenses of the Department of
Town Engineer in the 1943 Budget , the sum of
$150.00 to the item of Engineering Expenses
in the same Department and within the same Budget.
The Town Clerk presented a copy of a letter dated July 14, 1943 ,
addressed to Mr. Evans ward , Director of the Westchester County Park
Commission and signed by Supervisor Mandeville.
The letter referred to grievances and complaints of citizens
of the communities who are unable to get transportation facilities
to and from Playland , while out of County vehicles are permitted by
the WPA to operate. The copy of the letter was ordered placed in
the Town' s files.
The report of the Town Clerk for the month of June , 1943
and the report of the Mamaroneck Health Center were received and ordered
filed.
Councilman Griffin reported that the Park Department was
very much satisfied with the work done on the Honor Roll and referred
to the expenditures provided for by the Town.
Councilman Griffin advised that he had attended a meeting
of the Park Department the night before and the question arose as to
the money the Park Department had spent out of their budget for the
new addition to the Honor Roll. Comptroller Orsino reported that the
sum of 845.90 was charged direct to the payroll of the Park Department
and Mr. Griffin stated that the Park Department would like to have
their budget credited for that amount.
Comptroller Orsino suggested that Mr. rung, Chairman of
the Park Commission submit a claim for $45.90 against the donor Roll
which in turn will be credited back to the pay roll account of the
Park Department.
Councilman Griffin stated that the secretary to the Board
of Park Commissioners had been requested to send a letter to Mr.
Otto Eggers , who designed the Honor Roll, thanking him for his
assistance and said that he felt that the Town Board should also
write a letter to Mr. Eggers thanking him for his great personal
interest for his valuable time spent in designing this beautiful
structure , and the fine spirit in which he contributed his services
to the Community without cost. The Town Clerk was requested to write
a letter to Mr. Eggers expressing the feelings of the Board.
Councilman Griffin presented the following reports which
were ordered filed: (1) Summary of Receipts and Disbursements from
January 1 to June 30 , 1943; (2) Analysis of Budget Approrpriations
and Expenditures from January 1 to June 30 , 1943; (3) Analysis of
Estimated Revenues from January 1 to June 30 , 1943; (4) Claims
audited and paid by the Comptroller from July 7 to July 21 , 1943.
He read a statement of the bank balances as of 9 o 'clock,
July 21, 1943 , showing a total balance of $253 ,376.23 in all funds.
Councilman Griffin presented the following petitions re-
ceived from the Assessor for the correction of the assessment roll
so as to permit the apportionment of taxes.
On motion by Councilman Griffin, seconded by Councilman
Brewer , the following resolution was upon roll call unanimously
adopted:
WHEREAS , the Assessor has presented petitions
for the correction of the assessment roll for
certain years , pursuant to the provisions of
Section 33 of Chapter 105 of the Laws of 1916,
_- as amended , known as the "'Westchester County
Tax Act; and
WHEREAS , after due consideration this Board finds
it desirable to grant said petitions for the cor-
rection of said assessment roll;
NOW, THEREFORE , BE IT
RESOLVED, that the assessment roll for the year
1942 , taxes of 1943 , and the assessment roll of
1943 , taxes of 1944, which shows property now
appearing on the roll as follows:

The Supervisor inquired if there were any committee reports.
Councilman Stiner reported that the Board of Review had
completed reviewing assessments for the first six sections and that
at the present time they were working on Section 7.
`On drainage , he reported that work had been started on the
construction of the rataining wall along Sheldrake River and that some
of the work had been completed. He added that the men had been re-
tarded somewhat in their work because of the heavy storm which occurred
during the morning of the day of this meeting , but that no damage was
done to that part of the wall which had already been erected.
He also reported that he and Town Engineer Foote had discussed
with Mr. Cummings , resident manager of Larchmont Acres , the question
about full incineration of the garbage at the Larchmont Acres. He
stated that for a while the incineration of the garbage was not being
incinerated properly. He informed the Board that a warning had been
given to Mr. Cummings that they would have to do a good job of it or
else another plan would be put into effect.
Councilman Stiner advised that the difficulty is that re-
sidue of half burned garbage coming from Larchmont Acres cannot be
incinerated properly at the Joint Incinerator plant and that the amount
of oil used in an effort to incinerate this material would run into
a considerable cost.
Councilman Brewer presented to the Board an inventory and
estimate of value of equipment which was purchased by the Town for the
WPA project for Recreation, which inventory and estimate had been sent
to him by Mr. Ahern and prepared by Earl A. Fisher.
Councilman Brewer pointed out that the operations of the
WPA have ceased and that now that the school system is carrying on the
Recreation Program that Mr. Ahern has offered to purchase some of the
equipment for use in their program.
He stated that there were certain items which they did not
have use for and presented a sheet showing the items which would be
taken by the school system.
Following some discussion, it was on motion by Councilman
Brewer , seconded by Councilman Griffin, upon roll call unanimously
RESOLVED, that the following described equipment
be and it hereby is approved for sale by the Town
of Mamaroneck, to the Union Free School District
No. 1 of the Town of Mamaroneck, for the amounts
set forth. The check to be made payable to the
Supervisor of the Town and deposited with the
Town funds.

Councilman Brewer recommended that the balance of the
equipment be held over until such time as a decision could be made
either by the school officials or by the Town following the referendum
for recreation purposes which will be placed before the voters at
the fall election.
The Supervisor informed the Board that he had visited
Councilman Keeler at the New Rochelle Hospital during the day, and
that he found Mr. Keeler was resting very comfortably. He stated that
it was expected. that Mr. Keeler would improve with careful treatment ,
and a lot of time and patience. The members expressed their best
wishes for Mr. Keeler.
Supervisor Mandeville stated that in the absence of Council-
man Keeler he wished to refer to the letter and report made by Mr.
Keeler on the question of the exchange of road rollers. He stated
that it was Mr. Keeler ' s recommendation that the exchange be made.
The Supervisor stated that he had inspected the road roller
which was offered in exchange for the Town's road roller and that he
recommended approval of the deal. He asked Town Engineer Foote to
be sure that the roller was delivered in good condition.
On motion by Councilman Brewer , seconded by Councilman
Griffir, the following resolution was upon roll call unanimously
adopted:
WHEREAS , the Town Superintendent of Highways
has recommended that the Town purchase a six-
ton Buffalo Springfield tandem roller , Serial
number 15114, and has secured from Hodge and
Hammond, Inc. , an offer to furnish such a rol-
ler at a price of $3 ,103 , and in connection with
such purchase they have agreed to buy from the
Town or the Town Superintendent of Highways , a
10-ton 3 wheel Austin-Western roller , Serial
number 78704, which is owned by the Town,for
the sum of $3 ,103;
NOW, THEREFORE , BE IT
RESOLVED, that the purchase and sale of the
above mentioned rollers , by the Town Super-
intendent of Highways , for the sum of $3 ,103
is hereby approved as required by Chapter 142
of the Highway Law, subject to approval by the
Commissioner of Public Works of Westchester
County.
For Councilman Keeler , the Supervisor presented a statement
of the balances in the Fire Department Budget.
The Supervisor stated that at the last meeting the question
concerning the installation of a sewer line along Althea Lane was re-
ferred to the Town Attorney and the Town Engineer and that Attorney
Delius had mailed a copy of his report to the members of the Board.
He referred to the report and asked what the Board 's wishes
were in the matter.
Following some discussion, it was on motion by Councilman
Brewer , seconded by Councilman Stiner , upon roll call unanimously
RESOLVED, that the Town Attorney obtain the proper
easement for laying the sewer along Althea Lane.
Said easement to be approved by Town Engineer
Foote so that it will be proper for the con-
struction of the sewer.
The Supervisor advised that the Town Clerk had reported
that Miss Sally Barrett had decided to leave the temporary position
with the Town, on July 12 , 1943•
Councilman Griffin raised the question as to the needs of
the Town for gasoline supply to carry out the work of the several
departments , such as highway , garbage , police and fire departments.
The Supervisor stated that he thought that the Town could
get along all right because certain savings had been effected by
adjustments in the equipment and the minimum use of same. He asked
Town Engineer Foote to bring in a report at the next meeting showing
the amount of gasoline saved by the efforts of the departments , as
compared to last year.
The Supervisor asked if there was anyone present who wished
to appear before the Board.
Assessor Smith stated that he wished to report that he
had received certified copies from the Department of Taxation and
Finance , of the set-up in the final special franchise valuation by
the Department mentioned, and submitted a copy for the inspection
of the members of the Board.
The Supervisor again asked if there was anyone who wished
to appear before the Board.
The Board unanimously resoly to adjourn at 9:55 P.M.
