MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF
THE TOWN OF MAMARONECK HELD ON SEPTEMBER 18, 2019, BEGINNING AT 5:00PM
IN CONFERENCE ROOM A AND CONTINUING AT 8:00 PM IN THE COURT ROOM OF THE
TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK

CALL TO ORDER - WORK SESSION

On motion of Councilman King, seconded by Councilwoman Katz, the Work Session was unanimously
opened at 5:00PM.
Proposed 2020 Town Budget Format
Additionally Present: Tracy Yogman Town Comptroller
The Town Board reviewed the new format for the 2020 Budget presented by Tracy Yogman and Steve
Altieri. In their memo they note that “the introduction provides information about the Town, its
organization, officials, mission and budget guide. Following the introduction is a budget overview that
provides a summary, outlines the fund structure of the Town and includes a narrative with highlights of the
budget. The new format focuses on a departmental view of the Town and presents the major expense
categories for each department so that the Board can focus on the bigger picture when considering budget
adjustments. Supplemental schedules follow the department budgets and includes additional Town
financial information including policies. A consolidated salary summary schedule is provided in this section
as well.”
The Town Board was very pleased with the new format.
Discussion – Proposed Operating Permits
Additionally present: Rich Polcari Building Inspector
Mr. Polcari presented the proposed legislation. This legislation will bring the Town more current with
respect to New York State guidelines, and modernize the requirements for certain types of uses and for
places of public assembly. The Town Board would like to add the setting of a public hearing on this
proposed law to this evening’s agenda.
Discussion – Comprehensive Plan
The Town Board reviewed their thoughts on the proposals received. The Town Board would like to move
forward and engage AKRF for the Town’s Comprehensive Plan, and will set a date for an initial meeting.

2020 Census
Supervisor Seligson stated that the Census officials have been engaging the Town and Villages in an effort
to have the communities’ form a joint committee with community stakeholders. Supervisor Seligson will
keep the Town Board apprised as things develop.
Food Waste Reduction Grant
The Town Board had previously asked for clarification of the expenses associated with the DEC Grant
awarded to the Town for food waste reduction and education. Mr. Altieri’s memo dated September 12,
clearly details the program, its financing and expenses. The next steps would be to approve the agreements
between the Town and the Greenburgh Nature Center, and between the Town and Adam Kaye. These two
agreements are on the regular agenda for this evening.
Commuter Parking Law
The Town Board reviewed a map with highlighted streets where residents were the most vocally in favor of
limiting commuter parking. The Town Board would like Mr. Maker to draft new legislation with restrictions
on North Chatsworth Avenue to Echo Lane, Rockingstone Avenue to Seton Road, Mountain Avenue to the
New Rochelle border, Maple Hill Drive and Overlook Terrace. The Town will issue a mailing to the effected
streets as soon as the legislation is drafted.
Update - Community Solar
Mr. Altieri stated that the Town continues to have an issue with the termination payment. Mr. Altieri has
asked Sunlight General to review this clause and come back to the Town with an alternative. Mr. Altieri and
Mr. Maker are comfortable with the remainder of the agreement. Additionally, Croton-on-Hudson
installed solar on their public works building and Mr. Altieri will reach out to their manager and see how
that agreement was drafted.
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the Board unanimously
agreed to enter into an Executive Session to discuss appointments to Boards and Commissions.
EXECUTIVE SESSION
Appointments to Boards and Commissions
On motion of Councilwoman Katz, seconded by Councilman King, the Board unanimously agreed to resume
the Regular Meeting.
CALL TO ORDER - REGULAR MEETING
The Regular Meeting of the Town Board was called to order by Supervisor Seligson at
8:00 PM, she then pointed out the location of the exits.
Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this
evening, adding this is an open meeting that all residents are welcome to attend.
PRESENTATION - Remembrance of Enslaved Person in Mamaroneck
Presenters: Judy Silberstein and John Pritts, Co-Presidents of the Mamaroneck Historical Society, Joanne
Shaw Mamaroneck Library Trustee, Sharon Mosley Latimer of LMCTV and the Human Rights Committee,
Ned Benton documenter of the NYS Slave Registry, and Lynn Crowley Larchmont Historical Society Director
and Town of Mamaroneck Historian
The presenters have become aware of our community’s foundational ties to the institution of slavery. They
hope to bring awareness to our community and pursue appropriate ways to memorialize the contribution
of enslaved persons to the development of our Town. Each presenter spoke about the various enslaved

persons, who they were and their particular contributions to our community. The organization is seeking
community input on how best to remember these individuals. Once they receive feedback from the
community, they will come back to the Town with ideas and recommendations.
SUPERVISOR’S SUMMARY REPORT
Good voting news for the Town… the County has confirmed that the Town Center will be an early
voting site! All elections are now run by the County, and the Town was pleased to offer the Town

Center as an early voting site. Early voting will begin October 26. The dates and times for early
voting will be on the Town’s website and the County’s website.
Tracy Yogman, the Town’s new comptroller, along with Steve Altieri, created a new budget
presentation format that we reviewed in our work session earlier. I think residents will find it
more user friendly with lots of explanatory narrative.
There have been lots of community activities the past few weeks and I’m happy I had the chance
to participate in or attend many of them. We held our annual September 11th commemorative
event at Girl Scout Rock in Memorial Park last Wednesday. There was a great turn out with many
members from the three municipal police, fire and ambulance departments as well as Girl Scouts,
Boy Scouts, veterans, elected officials and regular people. I thought it was one of our nicest
events. The annual Town of Mamaroneck vs. Village of Mamaroneck softball game took place
last Friday night and we crushed them – I mean we beat the Village 11 to 4, and the trophy will
live in Town Center for the year. We held a Volunteer Board Appreciation BBQ this past Monday
night to thank all the volunteers who work on the Town boards and commissions. We have 13
volunteer boards such as the Planning and Zoning Boards that help run the Town. We appreciate
their time and dedication throughout the year and enjoyed celebrating them on Monday night.
There was a Summit meeting where Assemblyman Steve Otis and State Senator Shelley Mayer
spoke. It was very fun watching the movie North by Northwest in Memorial Park last Friday
night. That was our last movie in the park for the season.

Supervisor Seligson asked if anyone in the audience would like to address the Board, and there was not.
BOARD OF FIRE COMMISSIONERS
The Meeting was called to order by Commissioner Seligson, and then on motion of Commissioner Elkind
Eney, seconded by Commissioner King, the Board of Fire Commissioners was unanimously declared open.

2. Other Fire Department Business
Commissioner Elkind Eney reported that there was a recent fire in Rye at which the Town Fire Department
provided FAST team support. FAST teams provide assistance to the fire fighters’ during a fire. Additionally,
it was reported that our new Fire Ladder received the award "Best Appearance" at the recent Town/Village
of Harrison Fireman's Parade.
There being no further business to come before the Commission, on motion of Commissioner Elkind Eney,
seconded by Commissioner Fiddelman, the Commission unanimously adjourned and the Town Board
reconvened.
AFFAIRS OF THE TOWN
1. Authorization – Agreement – Greenburgh Nature Center – Food Waste Reduction Grant
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, it was
RESOLVED, that the Mamaroneck Town Board does hereby approve the agreement between
the Town of Mamaroneck and the Greenburgh Nature Center, to provide services for the
implementation of the Municipal Food Scraps Reduction, Food Donation and Food Scraps
Recycling Program (Grant) from New York State, and
BE IT, FURTHER
RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf
of the Town.

the Town of Mamaroneck and Adam Kaye, to provide services for the implementation of the

from New York State, and

4. Declaration of Surplus Computer Equipment
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the following was approved,
WHEREAS, pursuant to NYS Information Security Breach Act of 2005, NYS General Business
Law section 899aa, NYS Cyber Security Policy P03-002 and PCI Compliance Assessment
Questionnaire D Attestation of Compliance for Merchants, the Town of Mamaroneck is
required to designate an Information Security Officer to be responsible for the security of all
electronic information, and
WHEREAS, the Town of Mamaroneck Town Board has determined that these items, which
are listed on the attached schedule (Attachment A), should be disposed of accordingly, either
by sale or by payment by the Town of Mamaroneck for disposal or by other means of
disposal available to the Town.
NOW, THEREFORE, BE IT
RESOLVED, that the Mamaroneck Town Board does hereby authorize the disposal of its
outdated computers through the Town’s sanitation services for disposal into the Westchester
County’s E-Waste Recycling Program, and

BE IT, FURTHER
RESOLVED, that all physical hard drives will be removed and disposed of as per NYS Cyber
Security Policy P03-002 and the Town of Mamaroneck Security Policy to protect the Town’s
information assets.

5. Authorization – Agreement Westchester County – Senior Nutrition Center/Meals on Wheels
On motion of Councilwoman Katz, seconded by Councilwoman Fiddelman, it was unanimously
RESOLVED, that the Mamaroneck Town Board does hereby approve the renewals of the
operating permits for the Senior Nutrition Center and Meals on Wheels Program with the
Westchester County Department of Health, and
BE IT, FURTHER
RESOLVED, that the Town Administrator is hereby authorized to execute said agreements on
behalf of the Town.
6. Authorization – Westchester Joint Water Works – Capital Project A-1360
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the following was
approved
WHEREAS, the Town has been advised that a water main break occurred on South Ridge Road
and requires immediate attention, and
WHEREAS, because the water main is comprised of transite which is an asbestos cement, the
Westchester County Health Department requires replacement of most of the pipe length.
NOW THEREFORE, BE IT
RESOLVED, that the Mamaroneck Town Board does hereby approve Westchester Joint Water
Works Capital Project A-1360 – Town Capital Project Account H8340.0400.2019.12 for the
replacement of 500ft of Transite Pipe on South Ridge Road, and
BE IT, FURTHER
RESOLVED, that the Mamaroneck Town Board does hereby authorize the transfer of funds in
the amount of $350,000.00, as detailed by the Town Comptroller in the following schedule:

8. Set Public Hearing – “Rules for Obtaining an Operating Permit” Law
On motion Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, it was unanimously
RESOLVED, that the Mamaroneck Town Board does hereby set the date for a Public
Hearing on the “Rules for Obtaining an Operating Permit” Law, for October 2, 2019 at
8:00PM at the Town Center, 740 West Boston Post Road, and
BE IT FURTHER,
RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said
hearing in a newspaper appointed as an official newspaper, and that said Notice, be
posted.
9. Appointments to Boards and Commissions
Housing Authority
On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, it was unanimously
RESOLVED, that Diana Lovett be appointed as Member E of the Housing Authority, and
BE IT FURTHER
RESOLVED, that the foregoing appointment shall be effective immediately upon the appointees
taking and subscribing the oath mandated by section 25 of the New York Town Law and shall expire
on December 31, 2022.
Zoning Board of Appeals
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, it was unanimously
RESOLVED, that Seth Bronheim be appointed as Alternate Member A of the Town of Mamaroneck
Zoning Board of Appeals, and
BE IT FURTHER

RESOLVED, that the foregoing appointments shall be effective immediately upon the appointees
taking and subscribing the oath mandated by section 25 of the New York Town Law and shall expire
on December 31, 2020, and

RESOLVED, that John Cuddy be appointed as Alternate Member 1 of the Town of Mamaroneck
