TOWN OF MAMARONECK, NEW YORK
HELD JULY 7, 1943
In the Council Room of the Weaver Street Firehouse , Town of
Mamaroneck, New York.
The meeting was called to order by Supervisor Mandeville
at 8 P.M. Eastern War Time.
Present: Supervisor Mandeville
Councilmen Griffin, Peeler , Stiner and Brewer
Absent: None
The presence was also noted of Town Clerk Payne , Town
Attorney Delius , Assessor Smith,', Comptroller Orsino, and Town Engineer
and Superintendent of Highways Foote.
The minutes of the meeting of June 16, 1943 were approved
with corrections.
The Supervisor asked the Town Clerk to proceed with the
reading of the communications.
A letter dated June 22, 1943 , was received from William H.
Johnson, Village Manager , of the Village of Mamaroneck, New York,
in which Mr. Johnson expressed appreciation on behalf of the of-
ficials of the Village of Mamaroneck, and its residents , for the
cooperation of the officials and the Fire Department of the Town
of Mamaroneck, for the assistance given during the large fire which
occurred in the industrial section of Mamaroneck, on Sunday, June 20,
1943. The letter was ordered received and filed.
A letter dated June 17,, 1943 , with a certified copy of
resolution adopted by the Village Board of the Village of Mamaroneck,
on June 14, 1943, was received from Treasurer-Clerk F.H. Bull , Jr. ,
cancelling the 1943 village tax in the surd of $78.48, on property
known as Section 8, Block 75, Lot 1. The letter and the copy of
the resolution were ordered referred to the Comptroller' s Department
for the correction of the records.
A copy of a letter was read dated June 2 , 1943 , signed by
the Supervisor and addressed to the Village of Larchmont concerning
the cancellation of the 1943 Village of Larchmont Tax on property known
as Block 615, Parcel 19 Assessment Map of the Town of Mamaroneck and
owned by the Town of Mamaroneck.
The Supervisor stated that the request was made and that
he was given some assurance this tax would be cancelled, although no
word had been received to date. He said he would again write a letter
to the Board of Trustees of the Village of Larchmont.
A letter dated June 28, 1943 was received from Paul A. Yerick,
Chief of the Town of Mamaroneck Police Department in which he advised
the Board that temporary Patrolman Robert Ingham was to be inducted in-
to the armed forces of the United States oh July 2 , 1943 Also, at a
meeting of the Board of Police Commissioners held June 26 , 1943 , the
following three temporary patrolmen were appointed for the duration
of the war to fill the vacancies of permanent members of the Department
now in service. The appointments to take place as of July 11 1943:
Aloysius T. Tighe, Edward Westfall, and Fred L. Bernabie. The Chief
also advised that Patrolman Michael G. Ryan who had been a member of
the Department for the past sixteen years had passed away in sudden
death, on June 27, 1943.
The Supervisor advised that he had declared an emergency
when he attended the Inspection held Saturday , June 5, 1943.

RESOLVED, that the appointment by the Police
Commission, pursuant to Chapter 47 of the Laws
of 1943 , amending the New York State War Emer-
gency Act by the addition of a new section,
Section 34b, "Temporary Patrolmen and Firemen" ,
is hereby approved and that salaries are appro-
priated for said temporary patrolmen from the
Budget heretofore adopted for the Police Depart-
ment , as follows:

A letter dated June 25, 1943 was received from Mr. Henry E.
Mendes , Chairman of the Town of Mamaroneck War Council , in which he
praised Mr. Frank J. Pickett of 162 West Brookside Drive, Larchmont,
for his untiring efforts in teaching first aid throughout the un-
incorporated area since the inauguration of civilian protection
activities. Fie further stated that in accordance with the policy
of the Town of Mamaroneck War Council to recognize meritorious service
of citizens in connection with civilian protection, he deemed it a
pleasure to nominate , in behalf of the Council , Mr. Pickett for
membership thereon.
The Supervisor and the members of the Board being familiar
with Mr. Pickett ' s work expressed their appreciation for his very
fine cooperation.
On motion by Councilman Keeler , seconded by Councilman
Griffin, it was unanimously
RESOLVED, that Mr. Frank J. Pickett , 162 west
Brookside Drive , Larchmont , N.Y. , be and he
hereby is appointed al member of the Town of
Mamaroneck War Council, and that Mr. Henry E.
Mendes , Chairman of the Town of Mamaroneck War
Council be so advised.
The following reports for the month of June, 1943 , were
read and ordered received and filed: 1) Report of the Receiver of
Taxes and Assessments; (2) Report of the Plumbing Inspector; (3)
Report of the Building Inspector; and (4) Report of the Dog Warden.
The Supervisor asked if there was anyone in the room who
wished to address the Board.
The Supervisor stated that he wished to take the privilege
of going over some matters and communications before the reports of
Committees were received. He presented a letter dated July 1 , 1943
received from A.W. Barnhart , of the A.W. Barnhart Co. , in which Mr.
Barnhart offered to settle certain tax arrears on property known as
Block 824, Parcel 76 , on the Town Assessment Map at a reduced amount.
A check of 81725.00 accompanied the letter.
Following a lengthy discussion, it was on motion by
Councilman Griffin, seconded by Councilman Stiner, uron roll call
unanimously
RESOLVED, that this Board accept the sum of
$1760.72 in payment of taxes and/or tax liens
now due and/or owned by the Town of Mamaroneck,
upon the property known and described on the
tax assessment map of the Town of Mamaroneck
as Block 824, Parcel '76 (old numbers, Section 80
Block 112, Lots 15,16919 ,20921 and 22) which
said taxes or tax liens are as follows:

The Supervisor read a' letter received from T. Roosevelt
Allen, submitting an offer on behalf of Joseph Scarano , 616 Fifth
Avenue , Town of Mamaroneck, in the sum of $300.00 for vacant land
owned by the Town and adjoining Mr. Scarano ' s property. A check
in the amount mentioned accompanied the letter.
During the discussion which followed some of the members
of the Board decided that they would like to have the opportunity
to view the property before a decision was made. Town Assessor
Smith was asked to furnish the members of the Board with a tracing
of the plot. The matter was laid over for the following meeting.
The Supervisor called to the attention of the Board the
serious condition which exists along the side of the Sheldrake River
bed, that West galley Stream Road and infest Brookside Drive are being
undermined by the flow of water'. He informed the Board that he and
Town Engineer Foote had examined the area affected and decided that
something should be done.
Councilman Stiner said that he had inspected the location
and the condition.
The Supervisor informed the Board that there are two sec-
tions where walls are needed, and that the Town Engineer had estimated
the cost at $900.00, for walls to correct the condition.
After further discussion it was agreed that something should
be done immediately. Councilman Brewer recommended that before any-
thing was done , an engineer ' s sketch, or some survey, be made of the
existing condition, for the Town' s records.
The Supervisor suggested that some large sized photographs
be taken and placed in the records of the Town. Town Engineer Foote
was directed to secure them.
On motion by Councilman Stiner , seconded by Councilman
Keeler , upon roll call unanimously
RESOLVED, that the Town Engineer is hereby
authorized to construct a retaining wall along
the west bank of the Sheldrake River , for the
purpose of protecting', and maintaining the road-
ways known as West Brookside Drive and Wiest Val-
ley Stream Road, as indicated on the sketch sub-
mitted by him, at a cost not to exceed $900.00.
FURTHER RESOLVED, that there is hereby appro-
priated from the item in the 1943 Budget , en-
titled, "Engineering Expenses for Flood Control
Survey, $2,000 ," the sum of $900.00 for this
purpose.
The Supervisor stated that it would facilitate matters if,
in pursuance to Section 86 of the Social Welfare Law, the Welfare
Officer of the Town could be authorized, without a co-signor , to
sign checks drawn on the Public Assistance Fund , on deposit in
the County Trust Company, Mamaroneck Branch.
There was some discussion as to the amount of funds on
deposit and also as to the amount of the Public Officials ' bond for
the position of Public Welfare Officer , and it was pointed out that
both were in the amount of $1,000.
Councilman Griffin recommended and offered the following
resolution which was seconded by Councilman Keeler:
RESOLVED, that pursuant to subdivision 1A,
Section 86 of the Social Welfare Law of the
State of New York, as added by Chapter 518 of the Laws
of 1943 , the Supervisor is hereby authorized to
pay over to the Town Welfare Officer , an amount
sufficient for use as' a revolving fund, not ex-
ceeding , however , the greatest amount of home
relief expenditures in any two months during
the year 1942 and that the Public Welfare Of-
ficer is hereby authorized to withdraw said
funds by checks for home relief purposes in
accordance with the plan established by re-
solution of this Board adopted May 19 , 1943.
FURTHER RESOLVED`, that the bond heretofore
filed by the Public Welfare Officer of the
Town shall be considered sufficient security
for the payment and withdrawal of said funds.
The Supervisor informed the Board that the portable bus
shelter had been placed near the intersection of Bonnie Briar Lane
and Weaver Street, for the use of residents in that section, and
advised that it was a structure' which could be readily picked up
and moved from one location to 'another , if necessary. He stated that
the objection entered by one of the residents in the neighborhood was
not as strong as in the past , and that he had talked with the residents
and if later there was any real objection, it would be easy enough to
move the shelter to a different location. He added that the residents
in favor of the shelter had contributed the materials for its con-
struction.
A request was made by Manager Johnson of the Village of
Mamaroneck regarding the old Legion property located on Fenimore Road
in the Village of Mamaroneck.
On motion by Councilman Keeler , seconded by Councilman
Stiner , the following resolution was upon roll call unanimously
adopted:
WHEREAS , the Town of Mamaroneck heretofore
obtained title to certain property formerly
described on the assessment map of the Town
of Mamaroneck as Section 9 , Block 40 , Lots
5, 6B, 7, 8, 9 , and 12 to 17 inclusive , new
numbers , Block 914, Parcel 1 , and which is
located on the northwest corner of Boston
Post Road and Fenimore Road , with a frontage
of 307 feet on Boston Post Road and a depth
of 289 i feet on Fenimore Road, by deed from
Helene Mr. wullschleger, in lieu of all State ,
County, Town and School taxes unpaid and ac-
crued up to December 31 , 1942; and
WHEREAS , such conveyance was made subject to
certain unpaid taxes and/or assessments due and
payable to the Village of 11amaroneck which now
amount to approximately $4,688.02; and
WHEREAS , there is upon the property a house or
dwelling not now used and which should be con-
demned and demolished in the interest of the
health and safety of the community; and
WHEREAS , this Board desires to convey this
property to the Village of Mamaroneck in lieu
of unpaid Village taxes or assessments and upon
condition that the Village demolish the build-
ing upon the premises,
NOW, THEREFORE, BE IT
RESOLVED, that this Board hereby authorizes
the Supervisor to execute and deliver a deed
in lieu of taxes to the Village of Mamaroneck
for the aforesaid property subject to any taxes
now due for State , County and Town taxes which
have accrued since January 1, 1943 , upon con-
dition that the Village cancel all taxes and/
or assessments due and payable to it , upon
said premises and further that they demolish
the building upon the premises within 90 days
from the date of said deed.
The Supervisor announced that it was in order to proceed
with the reports of Committees. '
As Chairman of the Board. of Review, Councilman Stiner re-
ported there were 404 complaints filed with the Board of Review this
year. He said that he was pleased to inform that this was the lowest
number of protests received since he has been on the Board. He re-
called that there were 963 filed two years ago. He stated that Sec-
tions 1 and 2 had been completed and that it would require approx-
imately a month to complete the balance.
On drainage matters , he reported that a new drain had been
installed across Rockridge Road, and that drains on Villa Road and
Forest Avenue had been checked and cleaned.
On sanitation, he stated that the use of a location at
Lester Place off Madison Street as a dump had been started, and re-
ported that he had inspected the Incinerator.
He reported on miscellaneous matters stating that the grass
had been mowed at the rear of the Firehouse; that the weeds were cut
along the main thoroughfares; that street signs were repaired and
straightened, and that the sidewalks at Revere , Emerson and Kenmare
Roads were repaired; that a new curb had been installed at Copley
Road and Kenmare Road, and several other items were mentioned.

Councilman Beeler presented and read a letter dated
July 7, 1943 received from the Fire Department in which it was ad-
vised that Mr. Harold 0. Thomsen had successfully qualified as an
emergency driver , and recommended his appointment.
It was on motion by Councilman Keeler , seconded by
Councilman Griffin, unanimously
RESOLVED, that Mr. Harold 0. Thomsen
be and hereby is appointed emergency
driver of the Fire Department of the Town
of Mamaroneck, to serve without pay at the
pleasure of the Town Board and the Fire De-
partment.
Councilman Keeler informed the Board that he was continuing
his study of the insurance question concerning Town owned properties
and that at the present time all that he could report was progress ,
since it is a large task.
On defense matters he reported that the air raid warning
test given on June 29 , 1943 occurred as follows: 1: 55 A.M. , yellow
signal; 2:24 A.M. , blue signal; 2:42 A.M. , red signal; 2:52 A.IT. ,
blue signal; 2: 59 A.M. white signal.
He also stated that ', from reports all stations were manned
in very good order and that no incidents were reported.
The Supervisor commended the local Organization for its
very fine work. He stated that within ten minutes notice of the alarm,
all posts were fully manned. He recommended that the Town Clerk be
directed to write a letter to the officers of the Mar Council ex-
pressing the appreciation of the Town Board for the very fine work
being done in this Community. ',
A motion duly made by Councilman Keeler , seconded by
Councilman Griffin, the Town Clerk was directed to write such a letter.
RESOLVED, that Mr. Harold 0. Thomsen
be and hereby is appointed emergency
driver of the Fire Department of the Town
of Mamaroneck, to serve without pay at the
pleasure of the Town Board and the Fire De-
partment. follows:

Councilman Keeler called to the attention of the Board
that there had been some discussion at the Village Board meeting
of Larchmont concerning out of town busses which are operating in
and to Playland, while such service could not be had for the re-
sidents of our towns and villages within the County.
There was some discussion as to the operations of the
W.P.A. outside the local community , and the Supervisor informed the
Board that he would be very glad to take up the matter concerning the
County Park with the County officials. He said that Ile would report
back at the next meeting.
Councilman Stiner stated that there was one other thing
which he wished to discuss with the members of the Board , and that
was that Mr. Moody had requested an inspection and the correction of
the sewer condition along Althea Lane. Town Engineer Foote displayed
a map shoeing the section.
Following discussion, the question was referred to Town
Attorney Delius and. the Town Engineer for a report at the next meeting.
Mr. T. Roosevelt Allen appeared at the meeting and dis-
cussed with the members of the Board the advantage of signing a con-
tract with the Westchester County Dog Protective Association, Inc. ,
to carry out the requirements of the Agriculture and Markets Law
of the State.
He suggested that the services of the dog garden be dis-
continued as of July 15, 1943 and that the new contract be effective
as of the same date. He added that the same person acting as dog
warden would be employed to carry out part of the work called for
under the agreement.
Following some discussion, it was on motion by Councilman
Griffin, seconded by Councilman Stiner , upon roll call , unanimously
RESOLVED , that the services of John J. Conner ,
as dog warden of the Town of Mamaroneck, be
discontinued as of July 15, 1943.
FURTHER, that the position of dog warden be
discontinued.
Following further discussion, it was on motion by Council-
man Griffin, seconded by Councilman Stiner
RESOLVED , that the Supervisor be and he
hereby is authorized to sign the follow-
ing agreement which shall be subject to
the approval of the Commissioner of Agri-
culture and Tvlarkets of the State of New York.
THIS AGREEMENT, made and entered into this 15th day of July ,
1943 , by and between the TOWN OF MAMARONECK, a municipal corporation
in the County of 'Testchester and State of New York, party of the first
part , and WESTCHESTER COUNTY PROTECTIVE ASSOCIATION. INC., a cor-
poration created and existing under the Membership Corporations Lava
of the State of New York, having its principal office at 40 Depot Plaza
in the City of White Plains , New York, party of the second part
WITNESSETH: the party of the second part in consideration of the
payment to it by the party of the first part , of the sum of money agreed
to be paid , in the manner and at the times hereinafter particularly
described, hereby covenants and agrees for itself and its successors
that
1. It will undertake , through its duly appointed agents , the
seizure and impounding of all dogs found unlicensed or untagged and
running at large in the Town of Lamaroneck in violation of the pro-
visions of Article 7 of the Agriculture and Larkets Lava, constituting
Chapter 69 of the Consolidated Laws , as amended , and that it gill also
provide for the maintenance of a shelter or pound for unlicensed or
untagged dogs or for lost , strayed or homeless dogs and for the de-
struction or other disposition of seized dogs not redeemed , as pro-
vided by law.

2. This agreement shall commence on July 15th , 1943 and
shall continue to July 15th, 1944.

3. In consideration of the faithft:.l and complete performance
by the party of the second part of the terms of this agreement , the
party of the first part , pursuant to the provisions of Article 7
of the Agriculture and Markets Law, as amended , hereb17 agrees to

until July 15th , 1944 , provided , however , that the total compen-
sation to be paid by the party of the first part to the party of
the second part shall not exceed the amount payable to the party
of the first part under the provisions of Article 7 of the Agri-
culture and 11arkets Law during the year for which this contract
is made.

The Supervisor asked if there was anyone present who wished
to appear before the Board. There being no one , the Board continued
with the order of business.
On motion bvv Councilman Griffin, seconded by Councilman
Stiner , the following resolution was upon roll call , unanimously adopted
VIHEREAS , because of resignations from positions
in the Tovan Offices , and more particularly in
the Supervisor ' s and Comptroller' s Department ,
duties formerly performed by employees who have
resigned their positions , are now being performed
by others , thus causing an increase in the taork
which they are called upon to perform
NOhT, THEREFORE , BE IT
RESOLVED, that the salaries of the following
employees of the Town, as of July 1 , 1943 , be
fixed as follows and that the amount of the
increase of such salaries as indicated for the
balance of the year 1943 , be appropriated from
other unexpended salaries allowed in the Budget
for 1943 , which are payable from General Town
taxes or levy:

Follovaing further discussion on requirements for help at
the Town Offices , it was reported by Town Clerk Payne that Miss
Sally Barrett had been, subject to the approval of the Town Board ,
employed as a relief telephone operator and typist for the vacation
period.
On motion by Councilman Stiner , seconded by Councilman
Griffin, unanimously
RESOLVED, that Sally Barrett is employed as
temporary relief telephone operator , for a
period not to exceed six weeks , to commence
as of June 28, 1943 , at a Weekly salary of
$16. 5o.
On motion by Councilman Breer , seconded by Councilman
Peeler , it was unanimously
RESOLVED, that this Board approve payment
of claim of $96.00 , to the A.B. Owens De-
tective Agency , submitted by the Police
Department , and appropriates for the pay-
ment of such claim the said sum from the
amount appropriated in the Budget of the
Department of Police , under Miscellaneous ,
$600.00,
At 10:45 p.m. , the Board unanimously resolved to adjonrn.
