SPECIAL MEETING OF THE TOWN BOARD
TOWN OF MAMONECK, NEW YORK
HELD FEBRUARY 10, 1913
At the Town Offices, 158 West Boston Post Road, Mamaroneck, N . Y.
The meeting was called to order by Supervisor Mandeville
at 10: 15 A. al. Eastern War Time .',
Present: Supervisor Mandeville
Councilmen Griffin, Keeler and Meighan
Absent: Councilman Bates
The presence was also noted of Town Clerk Payne, Town Attor-
ney Delius and Assessor Smith.
Supervisor Mandeville stated that Assesscr Smith would like
to secure permission from the Board to attend the Association of Totems
meeting on February 17 and February 18, 1943 .
Assessor Smith explained that he wished to attend the assessors '
school ovr.ich is part of the annual meeting of the Association and to
talk to the State Tax Commission'' regarding the equalization table for
franchise taxes. He said that the expenses of the trip would be about
$25 or $30.
On motion by Councilman Griffin, seconded by Councilman Meighan,
it was upon roll call unanimously
RESOLVED, that the Assessor be and he hereby is
authorized to go to Albany, hew York, on Febru-
ary 17 and February 18 on town business and that
he be allowed for expenses a sum not exceeding
$30.00 to be paid out of the item in the 1943
assessor 's budget for traveling expenses .
Supervisor Mandeville asked the Tovvn Clerk to read the com-
munications .
Before reading the communications the Town Clerk called to
the attention of the Board that at a previous meeting the Supervisor
was designated to represent the Town at the Annual Meeting of the Asso-
ciation of Towns and that while Supervisor Mandeville would be away on
a business trip, a certificate of appointment should be filed for a-
nother member of the Board.
Following discussion Councilman Keeler was designated as the
representative of the Torun. Board to attend the meeting and the Tov:m
Clerk was directed to notify the Association of Toms .
A letter dated February', 5, 1943, was received from A. Stirling
Smith, Chairman of the Board of Appeals for Zoning, informing the Town
Board that the tern of office of Orson A. Raynor as a member of the
Board of Appeals would expire on February 19, 1943 . He recommended
that Mr. Raynor be re-appointed. '',
On motion by Councilman' Keeler, seconded by Councilman Meighan,
it was upon roll call unanimously
RESOLVED, that Orson A. '' Ravnor be and he hereby
is re-appointed as a member of the Board of Appeals
for Zoning for a term of five years ending Febru-
ary 19, 1048 .
letter dated February', 9, 1943, was received from Henry R.
Dillon, Receiver of '.Taxes, informing the Board that subject to its
approval he wished to deputize 14r. Alexander Finson to receive tax
money, give proper receipt therefor in the tax receiver' s name, enter
same upon the records of the tax office and deposit the tax money in
the bank as required by law.
The Board discussed the necessity of bonding Mr. Finson for
his work and following the recommendation of the Town Attorney it was
agreed to authorize the issuance of a public official bond in the amount
of $10,000.
On motion by Councilman Griffin, seconded by Councilman Keeler,
it was upon roll call unanimously
RESOLVED, that the action of the Receiver of 'Taxes
in deputizing Mr . Aiexander Finson to receive tax
money, give proper receipt therefor in the tax
receiver' s name, enter same upon the records of the
tax office and deposit the tax money in the bank as
redui red by lawn, be and it hereby is approved; and
be it
FURTHER RESOLVED, that Finson be bonded for the
sum of $10,000 the expense of the bond to be a town
charge.
A letter dated February 8, 1943, was received from Mrs . Marion
tidesson, Chairman of the 'Town of Mamaroneck Recreation Council, request-
ing that supplies, an itemized list of which had already been submitte
to the Town Board, be purchased. out of the funds allocated to the Re-
creation Council and that the order be placed as soon as possible.
Following discussion the Town Clerk was directed to notify
Mrs . Anna L. Brewer, Treasurer of the Recreation Council, that funds
were available to be used at her discretion and when the claims for
the equipment were presented to the town, they would be approved for
payment.
A letter dated February 8. 1943, was received from Town En-
gineer and Superintendent of riighways Foote, reporting that the crews
had completed the following work ', for the week ending February 6, 1943 :
(a) Removed snow from business area, apartments and Murray Avenue
School; (b) Stock-piled sand and salt; (c) Drained Rockridge Road and
(d) Cleaned snow and ice from catcihbasins . The report was ordered
filed.
Supervisor Mandeville pointed out that each week Mr. Foote
had always supplied him with a report and that he had asked all heads
of departments in the Town Offices to supply similar weekly reports,
which wrould be filed. in his office, in order that the members of the
Board could inform themselves concerning the work of all departments .
He said that he hoped that the Board would approve of the plan and
find it helpful.
Councilman Griffin stated that he would like to see a record
kept of everything that happens in the office so that the members of
the Town Board would be in a position to know what is going on and
Councilman Keeler expressed his approval of the plan, provided the
members of the Board made a point of referring to it.
On motion by Councilman Keeler, seconded 'by Councilman
Griffin, the following resolution vvas upon roll call unanimously
adopted:
WHEREAS certain duties are now being performed by
Town Officers and employees, which are in addition
to and beyond the duties properly performed by them,
for which they receive compensation according to the
tax budget of the Town of Mamaroneck as adopted; and
WHEREAS their compensation on has, from time to time,
been supplemented or augmented from other budget
appropriations from departments to which such addi-
tional services were rendered; and
WHEREAS it is desired to rectify these situations as
of February 1st, 1943 and to approve in all cases, a
total fixed salary or compensation for such officers
and employees;

The letter of Ky . Foote with reference to the tin can collec-
tion was referred to Councilman 'Beeler to discuss with the Yar Council .
The Towo Clerk 'presented the annual report of the Supervisor
for the fiscal year ended. December 31, 1942, as submitted to the State
Comptroller.
On motion by Councilaan'' Grif fin, seconded by Councilman Keeler,

A summary of receipts and disbursepents of the Supervisor for

A letter dated February 3, 1943, was received from F. H. Bull,
Jr. , 'Treasurer, Lear -rationing Board 2560-9, enclosing a, statement of
receipts and disbursements in setting up the new Rationing Board head-
quarters and a check for $16 . 21, representing the 'Toi;;n' s proportionate
share of the unexpended surplus of 1910 funds appropriated for the Ration-
ing Board. The letter and statement were ordered. filed..
The report of the Town Clerk for the month of January, 1943
was received- and filed.

of January, 1943 was received and filed.
Councilman Griffin ;resented the report of Glick-Freedman,
the 'Town auditors, for the year elided December 313 1941.
On motion by Councilman Griffin, seconded by Councilman
meighan, it was unanimously
RESOLVED, that the annual report of Glick-Freedman,
the 'Town auditors, for the year ended December 31,
191,1, be and hereby= is received and filed.
The regular order of business was suspended at 11 A. M. in
order to open bids received for the 9,000 Genera_ Bonds of 103,
Series ?, of the Town of Mamaroneck.
On motion of Councilman Griffin, seconded by Councilman
'_feeler, the following preamble and resolution were presented:

received from the Supervisor:

THE COUNTY OF WESTCHESTER, NEW YORK.
RESOLVED BY THE THE BOARD OF THE TOWN OF MAMARONECK,
IN THE COUNTY OF WESTCHESTER, NEW YORK, AS FOLLOWS:
Section 1. The 9,000. General Bonds of 1943, Series I.
authorized by virtue of a resolution entitled: "Resolution
appropriating the sum of $9,000. to pay a portion of the
cost of public improvement work relief projects in the Town
and authorizing the issuance of $9,000. bonds of the Town
of Mamaroneck for said purpose", adopted February 3, 1943,

The Town of Mamaroneck, in the County of Westchester, a

ber, 19 , the sum of One thousand Dollars ($1,000.00) , and to
pay interest on such sum at the rate of per centum
( %) per annum, semi-annually on the first days of September
and March in each year from the date of this bond until it
matures upon presentation and surrender, as they severally mature,

of the Laws of 1933, the Town Law, constituting Chapter 62, and
the General Municipal Law, constituting Chapter 24 of the Consoli-
dated Laws, and by virtue of a resolution of the Town Board of the

The faith and credit of said Town of Mamaroneck are hereby
irrevocably pledged for the actual payment of the principal of
and interest on this bond according to its terms.

and things required by the Constitution and statutes of the

which this is one, together with all other indebtedness of said

On motion of Councilman Griffin, seconded by Councilman
Keeler, the foregoing resolution was adopted by the following vote:

The regular order of business was resumed at 11:20 A. M.
The Board thereupon instructed the Town Clerk to open the
bids received for . the $6,923.77 Certificate of Indebtedness represent-
ing the amount due the State Retirement Fund for the Town' s contribu-
tion, a statement for which was received too late to include in the
1943 budget:

On motion by Councilman Keeler, seconded by Councilman Griffin,
it was unanimously
RESOLVED, that the Town Board does hereby approve
of the sale of this note at .64% interest per
annum to The First National Bank of Mount Vernon.
Supervisor Mandeville asked for reports of committees .
Councilman Keeler read a letter from Comptroller Leo N. Orsino
calling attention to the fact that the Fire Department had over-expended
its 1942 budget by $171.86 according to the Comptroller' s records and
also by $195 .27 for other purchases made in the latter part of 1942,
claims for which had recently been audited and charged by him to the
1943 appropriation for that department. Mr. Keeler said that the Comp-
troller had recommended that the matter be taken up by the Town toard
d a resolution asked transferring the necessary amount from surplus
and a resolution passed transferring the necessary amount from surplus
in the 1942 budget to take care of the $171.86 over-expenditure.
Supervisor Mandeville pointed out that the Fire Department has
been working under strained conditions and stated that he thought
they should be complimented on the remarkable job they have been doing.
On motion by Councilman Keeler, seconded by Councilman
Griffin, it was upon roll call unanimously
RESOLVED, that in accordance with the procedure re-
commended by the Comptroller, the Supervisor and the
Comptroller are hereby authorized to transfer from
surplus funds remaining in the 1942 budget the amount
of $171.86 to take care of the 1942 over-expenditure
of the Fire Department.
Councilman Keeler reported that pursuant to a resolution of
the Town Board the bonds for Supervisor .McCulloch both for the General
Fund and the Highway Fund had been cancelled as of the date Supervisor
Mandeville came into office and new bonds had been issued covering
Supervisor Mandeville. He said that there would be a return premium
for the unexpired portion of the bonds covering Supervisor McCulloch
and there would be charges for that same period covering Supervisor
Mandeville, but that it would be arranged so that the credit would off-
set the charge.
Mr. Keeler stated that at the last meeting of the Board,
following a discussion on the question of carrying insurance on a
Ford pick-up truck loaned to the Town for use of the decontamination
squad, he had been requested to find out what the cost would be to add
this to the 'Town' s policy for limits of $50/100,000 for public liability
and property damage of $5,000. He reported that it would cost $12.66
per annum or $11.61 from February 1 to the end of the year. He said
that the matter had been reported to the Comptroller and that he pre-
sumed that the funds would be found to take care of the cost of the in-
surance.
On motion by Councilman Keeler, seconded by Councilman Griffin,
it was upon roll call, unanimously
RESOLVED, that the above described insurance
protection be provided or the Ford pick-up
truck loaned to the Town for use of the decon-
tamination squad of the civilian protection
services.
Councilman Meighan brought up the matter concerning the old
First National Bank building and stated that if there was some means
of salvaging and restoring the building to some useful function to the
Village and Town, it would be of reat benefit to both communities.
There was full discussion and the matter was referred to the
Town Attorney to try to work out an agreement in resolution form with
the Village of Mamaroneck.
Supervisor Mandeville explained to the Board that under the
New York State War Emergency Act the Supervisor of the Torun is Deputy
County Director of Civilian Protection or he can at his discretion ap-
point a deputy county director to act for him. He said that he was
very anxious to have a deupty appointed. He pointed out that the posi-
tion is one of great responsibility and that Chief of Police Yerick,
Fire Chief Burton, Chief Warden Jennings and Mr. DeVinne were familiar
with the requirements of the posiion. He asked the Board for sugges-
tions as to who should be appointed.
Following discussion Supervisor Mandeville stated that he
would appoint Chief of Police Paul A. Yerick as Deputy County Director
of Civilian Protection and the Board expressed approval of his action.
Supervisor Mandeville also explained that the vacancy left
on the War Council by the death of John V. Luce had not been filled
and recommended that Clair V. Johnson, Chairman of the Board of Police
Commissioners be appointed to fill the vacancy.
On motion by Councilman! Griffin, seconded by Councilman
Keeler, it was upon roll call unanimously
RESOLVED, that Clair V. Johnson, Chairman of the
Board of Police Commissioners, be and he hereby
is appointed a member of the Town of Mamaroneck
War Council to serve at the pleasure of the Town
Board.
Supervisor Mandeville reported that he had attended a meeting
of the Larchmont-Mamaroneck Joint Incinerator Commission on February 9,
1943, and that everything seemed to be in good condition. He stated
that it looked as though the proportionate share of the operating costs
would be about 48 per cent for the Town and 52 per cent for the Village
of Larchmont.
He also reported that he had attended the Board of Supervisors
meeting on February S, 1943, and while in White Plains had talked with
Mr. George S. Haight, General Superintendent of the County Park Com-
mission, about re-routing trucks on the proposed Pelham-Port Chester
Parkway around Mamaroneck. He said that he thought something might be
worked out.
Mr. Mandeville informed the Board that Town Engineer Foote had
reported to him that there is $950 unexpended in the 1942 sewer depart-
ment budget and had suggested that this sum be used to make a survey
of the houses in the Glen Road, Chatsworth Avenue, Murray Avenue and
Colonial Avenue area, where the drainage situation has been very* trouble-
some, to see what dwellings are emptying their storm water drains into
the sewer, which DIr. Foote feels had caused trouble. He stated that
bir. Foote would like to have Ir. Owen Cunningham assist hire in making the
investigation..
Councilman Keeler commented that the Town should do what it
could to see what is causing the backing up of these drains .
Following further discussion it was on motion by Councilman
Keeler, seconded by Councilman Griffin, unanimously
RESOLVED, that Town Engineer Foote be and he hereby
is authorized to proceed with a survey of the dwell-
ings in the Glen Road, Chatsworth Avenue, Murray
Avenue and Colonial Avenue area to check on illegal
house connections, with the understanding that the
expenses shall not exceed the funds available in the

FURTHER RESOLVED, that the Town Engineer be authorized
to employ Owen Cunningham to assist in taking notes
and data for the survey.
Supervisor Mandeville informed the Board that he was going
away for a short time and that during his absence he would like to
have Councilman Griffin take care of the office.
The Town Clerk inquired whether or not notices should be
sent for a meeting on February 17 and the Board agreed that no meet-
ing would be held on that date unless Councilman Griffin decided that
there was sufficient business for the Board to consider.
At 12:10 P. M. the Board unanimously resolved to adjourn.
