ORGANIZATION MEETING OF THE TOWN BOARD
TOWN OF MAKRONECK, NEW YORK
HELD JANUARY 6, 1943
At the Town Offices, 156 West Boston Post Road, Plamaroneck, N. Y.
The meeting was called to order by Supervisor McCulloch at
8 P. 1. (Eastern War Time) .
Present: Supervisor McCulloch
Councilmen Griffin and Mandeville
absent: Councilman Bates
The presence was also noted of Town Clerk Payne, Town Attor-
ney Delius, Assessor Smith, Comptroller Orsino, and Superintendent of
Highmays and 'Town Engineer Foote .
The minutes of the meetings of December 10 and December 12,
1942, were approved as presented.
The members of the Board expressed their regret that Council-
man Bates could not be present at the organization meeting this year.
The Supervisor informed the members of the Board that Councilman Bates
was improving and everybody present wished for his early return to the
meetings .
The Supervisor requested. the 'Town Clerk to read the communi-
cations .
The Town Clerk presented the public official bonds received
at his office for the positions of 'loam comptroller and treasurer of
the Police Pension Fund., which bonds had been approved as to form by
the 'Town Attorney.
On motion by Councilman Mandeville, seconded by Councilman
Griffin, it was upon roll call, u
RESOLVED, that Globe Indemnity Company public
official bond No. A318976 in the amount of $1,000
made to the Town of Mamaroneck covering the position
of comptroller and naming Leo N . Orsino as principal
be and it hereby is owed and ordered filed accord-
ing to law.
On motion by Councilman MandeviIle, seconded by Councilman
Griffin, it was upon roll call unanimously
RESOLVED, that Globe Indemnity Company public
official bond. No . A318641 in the amount of 12, 500
made to the 'Trustees of Police Pension Fund of the
Town of Mamaroneck covering the position of
treasurer of the Police Pension Fund and naming
Rufus K. Allerton as principal, be and it hereby
is approved and ordered filed according to law.
The 'Town Clerk presented the following certificate of appoint-
ment of deputy town clerk:

Pursuant to Subdivision 10 of Section 30 of the
Town Law, State of New York, 1 hereby appoint Miss Alice E.
Wheelock as Deputy Town Clerk of the Town of Mamaroneck for

On motion by Councilman Griffin, seconded by Councilman
Mandeville, it was unanimously
RESOLVED, that the action of the Town Clerk be
and it hereby is approved and that the certificate -
be placed in the Town records .
The following letter was read:

Gentlemen:
The Republican Town Committee at a meeting
held December 21, 1942, endorsed Mr . Edward A. Ileeler
as their recommendation to the Town Board for the
appointment of councilman to fill the temporary vacancy
left by Councilman Munn Brewer who has entered the
Awned forces of the United States of America.
The Cormmittee deems it a pleasure to recoraiend
such a capable gentleman, who has a wide knowledge of
local matters .

The Town Clerk was asked if any other letters with recommen-
dations for the vacancy were received. He replied that none had been
received..
Councilman Griffin stated that he was very much in favor of
Mr. Keeler and offered the following resolution which was seconded by
Councilman Mandeville and upon roll call unanimously adopted:
WHEREAS, a vacancy now exists on this Board due
to the induction into military service of Munn Brewer,
a councilman duly elected for a term commencing
January 1., 1942 and terminating December 31, 1945,
which vacancy occurred on December 13, 1942; and
WHEREAS, pursuant to the provisions of Chapter 678
of the Laws of 1942, this Board desires to fill the
temporary vacancy which exists by reason of the in-
duction of Munn Brewer, as aforesaid, into the military
service of the United States;
NOW, THEREFORE, BE 1T
RESOLVED, that Edward A. Keeler is hereby appointed
councilman to fill the temporary vacancy now exist-
ing in the office of councilman, pursuant to the
provisions of said Chapter 678 of the Lai^as of 1942.
The foregoing resolution was adopted by the following vote:
AYES: Supervisor McCulloch
Councilmen Griffin and Mandeville
NOES: None
The Supervisor requested the Town Comptroller to locate
Mr . Keeler and escort him to the meeting .
The Town Attorney recommended the following resolution which
was on motion by Councilman Griffin, seconded by Councilman Mandeville,
RESOLVED, that the salary of all elected officials
of the Town of Mamaroneck, including Edward A.
Keeler, be fixed in accordance with the amount stated
in the annual estimate or budget for the year 1943,
all such salaries to be effective as of January ist,
1943, except that of Edward A. Keeler, which is to
be effective as of January 6th, 1943, the date of his
appointment.
When Mr. Keeler appeared the members of the Board welcomed
him and advised him that they mere pleased to have him join them as a
member of the Town. Board.
Councilman Keeler expressed his appreciation and stated that
he would do his best to serve even though temporarily. "You may be
sure, " he said "that I will do the best that I can to help you with
the problems and will do my share of the ruork."
The Supervisor stated that he was about to appoint the
committees for the year 1943 and asked Councilman Keeler if he would
accept the same appointments given Councilman Brewer last year.
The Supervisor explained the arrangement of the committees
of the Board and outlined some of the problems handled by each council-
man.
Councilman Keeler stated that he would be very much pleased
to accept the appointments referred to.
The Supervisor then announced the appointment of the follow-
ing committees for the year 1943 : -

Councilman Mandeville stated that he was very happy to inform
Councilman reeler that the Fire Department of the tov.n could be rated
as second to none. He said that the equipment was in perfect order and
that the men were doing a marvelous job and would do most anything for
- the 'Town. Board.
The Supervisor stated that the department had given a large
number of members to the armed forces and that this was causing a prob-
lem but that outside of this question the department was in fine shape .
The Supervisor explained that Councilman Brewer was also a
member of the Board of Trustees of the Police Pension Fund of the 'Poem
and asked Councilman Keeler if he would accept that appointment.
The Supervisor explained that there are three members of the
Board of Trustees, the Supervisor, the Chief of Police and one menioer
of the 'Town Board appointed annually.
Councilman Beeler stated that he would be pleased to accept.

RESOLVED, that Councilman :feeler be and he hereby
is appointed a member of the Board of Trustees
of the Police Pension Fund of the Town of Mamaro-
neck, Idew York, to serve during the year of 1943 .
The Supervisor requested the Town Clerk to continue with the
communications .
The following letter was read:

Gentlemen:
I herewith submit the following report for
your records.
On New Year ' s Eve between 11 P. M. and 4 A. Id.
a special continuous inspection was made by firemen
Gallagher, Harrington and Mellor of the following estab-
lishments: Loyal inn, Sagamore Inn, Post Lodge, Dom-
estic Club, Bonnie Briar Club, Winged Foot Club.
Conditions in the above places were found to be
very satisfactory. A few minor violations were imme-
diately corrected. The management of all these places
gave the inspectors full cooperation.

The 'Town Clerk was directed to write a letter to Chief Burton
stating that the 'Town Board commends the department for being alert to
conditions throughout the community and that this was the finest type
of protection to the citizens of the community.
The Supervisor stated that with reference to the Fire Depart-
ment the 'Town Comptroller was present with a claim from Ralph Rice for
the 1940 Buick sedan which was delivered to the department to be used
as a chief' s car. Comptroller Orsino explained that the item in the
1943 budget for the purchase of a chief' s car allowed the expenditure
of $650 and that the cost of the car was $675 . He requested that he
be permitted to pail the extra $25 .00 out of the equipment account of the
Fire Department budget.
it was on motion by Councilman Mandeville, seconded by Council-
man Griffin, upon roil call, unanimously
RESOLVED, that there be transferred from the
equipment fund of the Fire Department the sum of
425 .00 to the item for the replacement of the fire
chief's car in the same department.
A letter dated December 28, 1942, was received from Earl R.
Van Sickle, Chairman of the Executive Committee, Taxpayers of the Unin-
corporated Section, Town of Mamaroneck, New York, which referred to the
letter concerning the DeBartolo residence dated December 10, 1942, sent
out by the Town Board and signed by the Supervisor.
The letter from the committee read in part that no board
or employee of the tarn could rightfully use its or his discretion
in the enforcement of local ordinances so long as these have been passed
and are local laws and that this applied particularly to the zoning
ordinance. The letter went on to urge the tooin to remove an alleged
violation at the residence above mentioned.
Follol,ving a lengthy discussion during which the Supervisor
explained the .natter to Councilman Keeler it was decided to refer the
letter to Attorney, Delius for a report at the next meeting of the Board.
The following letter was read:
December 9, 1942
Mr . Bert C. McOulloch, Supervisor,
Town of Mamaroneck.
Dear Mr. McCulloch:
Herewith, a copy of a report of the Committee
on Flood Control, of the Larchmont Gardens Association.
As you probably k,now, this is almost entirely the work
of Pair. Richard Land, to whom full credit for this very
fine survey, and the useful recommendations should go.
Your careful attention to these recommendations
will be greatly appreciated.

Following some discussion the Town Clerk was requested to
prepare copies of the report for the members of the Board for study
and one copy for the Village of Mamaroneck.
-__ The Town Clerk was also reouested to Barite a letter thanking
the association for the report and to extend an invitation to Mr. Land
and his committee to attend the regular meeting of the Town Board to
be held on January 20, 1943, at which meeting the Van Etten report on
another portion of the water shed would be discussed.
The Supervisor referred to the letter received from the Village
of riamaroneck at the 'Town Board meeting held November 18, 192,2, and the
decision at that time that a joint conference be held sometime after
the first of the year to discuss problems of mutual interest. He asked
what mere the wishes of the members of the Board in this matter.
Following some discussion it was decided that the Supervisor
be authorized to arrange the conference for Uednesday evening,
January 13, 1943 •
The question of regular meeting dates for the year was raised
and it was on motion by Councilman Griffin, seconded by Councilman
Keeler, unanimously
RESOLVED, that the meetings of the Town Board be
held at 8 o' clock P. M. on the first and, third
Wednesdays of each month, unless such day be a
holiday and then on the next succeeding day.
It was decided that the meeting of January 20, 1943, be held
at the Iveaver Street Firehouse .
The following reports for the month of December, 1942 were
received and filed: (I) Report of the Receiver of Taxes and 2) Report
of the Liamnaroneck Health Center.
The annual report of the Building and Plumbing inspector
for the year 1942 was received and filed.
Councilman Griffin stated th at the only tiling to report for
the Park Department outside of the ordinary work at this time of the
vear vas that David Butler, Secretary of the Larchmont Gardens Associa-
tion, had. requested the keeping of the ice on the Larchmont Gardens
Lake in proper condition for skaters . He said that Commissioner David
Embury wrote a letter to Mr . Butler, stating that the departzaent was
doing everything that they could do to meet safety recuireraents and clear
the lake of snow so as to permit skating .
He presented the report for the Department of Public Welfare
for the month of December and stated that it was a pretty, good report.

Councilman Griffin presented three petitions received from
the Assessor for the correction of the assessment roll so as to cernit
the apportionment of taxes .
On motion by Councilman Griffin, seconded by Councilman
Keeler, the following resolution was upon roll call unanimously adopted:
WHEREAS, the Assessor has presented petitions for
the correction of the assessment roll for certain
years, pursuant to the provisions of Section 33 of
Chapter i05 of the Laws of 1916, as ascended, knolprn
as the Uestchester County 'Tax Act; and
WHEREAS, after due consideration this Board finds
it desirable to grant said petitions for the correc-
tion of said assessment roll;

Councilman Beeler stated. that, he wanted to advise the Board
that all the town property is protected with extended coverage against
war dariage and that as lead of the insurance committee he wanted to
advise the Board that there is now availabie extende coverage for money
and securities on the preraises , He Said that this was not available
until nog and that the he wanted to inform the Board. He added that if
monies were deposited regularly and there were no securities on hand lie
would not recommend this coverage .
After same discussion it was agreed that this insurance was
not necessary.
Councilman Randeville stated that there was very little to
retort for the Highway Department other than that the department did
good work during the recent storm and that sand had been spread in the
dangerous places . He said that there were some complaints about gar-
bage collection but thht because of weather conditions and. other things
it could not be helped. He said that George Osborne is acting as yard.
superintendent and making minor repairs to the equipment and that he was
doing a very good. job . He said that he nould have something to add to
this at the next meeting.
The Supervisor stated that he had received some very fine
compliments for the work of the Highway Department from residents on
the Aew Rochelle side near Wood Acres . He said that they had advised
him that on their way to the station they have hard going until they
reach the Mamaroneck town streets .
The Town Attorney advised the members of the Board that there
would be a conference of town attorneys of the Association of 'Towns in
Albany, on Monday, January 11, 1943) and that while there were to be
discussions on proposed legislation affecting towns, he thought it im-
portant for him to attend..
On motion by Councilman Mandeville, seconded by Councilman
Griffin, it was upon roll call unanimously
RESOLVED, that the 'rowan Attorney be and he hereby
is authorized to attend the meeting of the town
attorneys of the Association of Towns to be held
in Albany, New York, on Monday, January il, 1943,
and that the expenses of the trip be paid out of
the budget item in the Legal Department for such
expenses .
The Supervisor stated that he was very happy' to advise the
Board that the 'Town had received a three-point increase in the equaliza-
tion rate established by the county, also that the Tuwn had sold its
$225,000 tax note to The County 'Trust Company at .62% which, he said,
was a much better deal than the Town of Harrison was able to make .
The Supervisor recommended the following resolution which
was oil motion by Councilman Mandeville, seconded by Councilman Griffin,
upon roll call unanimously adopted:
RESOLVED that Jack Connors be re-appointed dog
warden as of January 1st, 1943 to serve at the
pleasure of the Town Board; and
FURTHER RESOLVED that his salary shall be at the
rate of $100 per month, such salary shall start
as of January 1st, 1943 and be in lieu of fees as
provided in Section 123 of the Agriculture and
Markets Law.
Councilman Mandeville advised the Board that he had received
a letter from Councilman Brewer. in which Mr . Brewer requested
Mr. Mandeville to convey his best regards to the members of the Board..
Councilman aandeville added. that Mr . Brewer is stationed at
Camp Croft, tooth Carolina.
_ The members of the Board requested Councilman Mandeville to
furnish them with Mr. Brewer' s full address.
At 9:40 P . M. the Board unanimously resolved to adjourn.
