TOWN BOARD, TOWN OF MAMARONECK, NEW YORK
Held November 18, 1942
In the Council Room of the Weaver Street Firehouse, Town of
Mamaroneck, Nev; York.
The meeting was called to order by Supervisor McCulloch at
8 P. M. (Eastern War Time) .
Present: Supervisor McCulloch
Councilmen Brewer, Griffin, Mandeville
Absent: Councilman Bates
The presence was also noted of Town Clerk Payne, Town Attor-
ney Delius, Assessor Smith, Comptroller Luceno, and Town Engineer and
Superintendent of Highways Foote.'
The minutes of the meeting of October 16 and October 21,
1942 were approved as presented.
The Supervisor suggested that the regular order of business
be suspended to hear those present
Mr. Silas S. Clark, attorney for the relator, appeared before
the Board and requested consideration of an offer to compromise the
assessments for two years, i.e. the assessments of 1940 and 1941
(taxes of 1941 and 1942 respectively) upon property in the Town of Ma-
maroneck owned by PAL-MAM REALTY CORP. and known on the assessment map
of the Town of (!Mamaroneck as Block 907, Parcel 140 (old numbers Sec-
tion 9, Block 15, Lot 16) .
- There was some discussion with Mr. Clark who agreed to imme-
diately pay the taxes if the assessments were reduced to a total of
$27, 500 for both years . The Town Attorney and Assessor both recom-
mended that the settlement be made.
Councilman Mandeville introduced the following resolution
which was seconded by Councilman Griffin:
WHEREAS, heretofore writs of certiorari were obtained
by PAL-MAM REALTY CORP. 'owner of property described
on the assessment map and assessment roll of the Town
of Mamaroneck as Block 907, Parcel 140 (old numbers
Section 9, Block 18, Lot 16) ; and
WHEREAS, the Assessor and Board of Review of the Tovin
of Mamaroneck duly filed returns to said writs, and
no further proceedings have been taken; and
WHEREAS, the 'Town Attorney and Assessor recommend to
this Board that the proceedings be settled and dis-
continued upon the reduction in the assessments as

NOW, THEREFORE, BE IT
RESOLVED that the assessments for the years 1940 and
1941 (taxes of 1941 and 1942, respectively) upon pro-
perty owned by Pal-Mam Realty Corp. and described
upon the assessment map and assessment roll of the
Torun of Mamaroneck as Block 907, Parcel 140 (old num-
bers Section 9, Block 18 Lot 16) be reduced as follows:
For the year 1940 (tai: of 1941)

For the year 1941 '(tax of 1942)
From 033, 500 to X627, 500'
provided that all procedings for the years 1940 and
1941 be discontinued without costs to the Town of
Mamaroneck.
FURTHER RESOLVED that the Lowe Attorney is hereby
authorized and directed to sign the necessary stipu-
lation to obtain orders of the Supreme Court provid-
ing for such reductions,', and refund of excess taxes
paid, if any.
The vote on the resolution was as follows :

NOT VOTING: Councilman Brewer
Before action was taken by the Board Councilman Brewer ex-
plained that he felt that he was disqualified and could not vote on
the matter by reason of the fact that he had a client in the imme-
diate neighborhood of this property.
The Supervisor asked if there was any one else who wished
to appear before the Board.
There being no one he suggested that the meeting proceed
with the regular order of business .
Councilman :Mandeville reported that the streets, gutters and
sidewalks throughout' the town were in verb good. condition. He added
that the equipment of the Highway Department was being cleaned and
painted.
Councilman Griffin reported that the honor roll structure
was nearing completion and that the Park Commission was preparing
plans for the dedication ceremonies which would be held on a Sunday
afternoon. He said that Mr. David. A. Embury, Chairman of the Board
of Park Commissioners, would be master of ceremonies and that members
of the clergy, officers and members of local organizations, and the
officials of the village of Larchmont and the town of Mamaroneck would
be invited to take part.

Councilman Griffin presented two petitions received from the
Assessor for the correction of the assessment roll so as to permit the
apportionment of taxes .

WHEREAS, the Assessor has presented petitions for
the correction of the assessment roll for 1942,
taxes of 1943, pursuant to the provisions of Sec-
tion 33 of Chapter 105 of the Laws of 1916, as
amended , known as the Westchester County Tax Act;
and
WHEREAS, after due consideration this Board finds it
desirable to grant said petitions for the correction
of said. assessment roll;

Councilman Brewer stated that there was nothing to report
for his departments only that the Town Clerk had handed to him a few
minutes before the meeting a letter from the town' s insurance broker
referring to the compensation insurance. He said that there was a
question about the extension of coverage to include elected and a.p-
pointed officials and that he would go over the matter with the broker
before making a recommendation.
The Supervisor requestethe Town Clerk to read the communi-
cations.
A letter dated November 12, 1942, was received from Fire
Chief George Burton stating that Mr. Charles Weller had been elected
a member of the Fire Department. He recommended that the action be
approved.
On motion by Councilman Mandeville, seconded by Councilman
Griffin, it was unanimously
RESOLVED, that the action of the Fire Department
of the Town of Mamaroneck in appointing Dr. Charles
Teller as a member of department be and it
hereby is approved.

A letter dated November 5, 1942, was received from Fire Chief
George Burton stating that he and Town Engineer Foote had completed a
survey of fire hydrant locations in the tovai fire district and that they
recommended the elimination of seven (7) fire hydrants .
It was on motion by Councilman Mandeville, seconded by
Councilman Griffin, upon roll call, unanimously
RESOLVED, that the Westchester Joint Water Works
No. 1 be requested to discontinue as of November 30,
1942, the following fire hydrants:
Hydrant No. 221 on Eton Road
Hydrant No. 84 on Nohegan Road
Hydrant No. 169 on Fenimore Road
Hydrant No. 142 on Fenimore Road
Hydrant No . 143 on Fenimore Road
Hydrant No. 170 on Fenimore Road

A letter dated November 10, 1942 was received from Peter C.
Doern, Inc . asking if the town intended to renew its lease for the
town offices at 155 West Boston Post Road, Mamaroneck, New York, for
the year 1943 •
Following some discussion it was decided that it might be
well to have inserted in the new lease a clause permitting the Town
Board to discontinue the lease following sixty days ' notice. The
matter was referred to the Town Attorney.
A letter dated November 10, 1942, was received from
Clair V. Johnson, Chairman of the Board of Police Commissioners, in
which he advised that the commissioners recommended a leave of ab-
sence for Officer Christopher Lovely.
On motion by Councilman Griffin, seconded by Councilman
Brewer, it was unanimously
RESOLVED, that leave of absence is hereby extended
to Officer Christopher Lovely of the Weaver Street
Police Department of the Town of Mamaroneck, pur-
suant to Section 246 of the Military Lave, while he
is engaged in the performance of military duties .

Re: John Moll' s Greenhouse v.
Township of Mamaroneck
Gentlemen:
We have been retained by Mr. John Doll of
Weaver Street, Larchmort, to represent his claim for
damages caused to his Greenhouse on December 19th,
1941, by blasting done by the Township of Mamaroneck
on the street adjoining his Greenhouse.
Mr. Moll advises us that he had had numerous
conferences with your office and with Mr. Foote but
no concrete action was taken by your office, although
he had been promised on several occasions that action
would be taken. Mr. Moll submitted to you an esti-
mate of the damages, on January 27th, 1942.
We shall greatly appreciate your advising us
as to the present status of this matter, so that we
may accordingly inform our client.

Following some discussion the letter was referred to the
Town Attorney. i
A letter dated October 25, 1942, was received from Miss
Erma Bernheimer, in which she stated that the basement of her house
at No. 37 Myrtle Boulevard was over-run with water during the floods
and as a result of this she had to receive treatments at the New
Rochelle Hospital . She enclosed the hospital bill for $3 .00 and
asked that th.e Town pay same . The letter was referred. to the Totivn
Attorney.
A letter dated October 29, 1942, was received from
William J. Yarmy, town constable, in which he advised that lie had
entered the United States Navy and would. serve for the duration of
the war. He requested a leave of absence.
On motion by Councilman Griffin, seconded by Councilman
Brewer, upon roll call, it was unannimously
RESOLVED, that town constable, William J.
Yarmy, be and he hereby is granted a leave
of absence while he is engaged in the per-
formance of duty in the armed forces of the
United States of America.

A letter dated October 30, 1942, was received from Max Hirsch,
of 170 Myrtle Boulevard, town, in which he made application to fill the
vacancy left by Mr. Yarmy,
It was announced that Mr . Leonard J. Grosso of 156 West Post
Road, Mamaroneck, also had applied for the position.
Following some discussion it was on motion by Councilman
Griffin, seconded by Councilman Brewer, upon roll call, unanimously
RESOLVED, that Mr. Leonard J. Grosso be and he
hereby is appointed constable of the town of
Mamaroneck, New York, to serve writhout pay at the
pleasure of the Board; and be it
FURTHER RESOLVED, that he civalifyr by filing the
necessary bond which shall be approved by the
Town Attorney, also that he file the statutory oath
of office .
A letter dated November 11, 1942, was received from Washington
Camp No. 53, Patriotic Order, Sons of America, signed by David G.
Cuyter, President, inviting the Town Board to attend. a patriotic vic-
tort' rally to be held on the first anniversary of Pearl Harbor Day,
December 7, 1942, at the Junior High School
The Supervisor asked the members of the Board to take note
and the 'Town Clerk was directed to send copies of the letter to the
members of the Board and also to thank the organization for the in-
vitation.
A letter dated October 27, 1942, was received from Charles
and Ei na Karl, in which they asked permission to pay certain old tax
arrears at a reduced amount.
Following some discuss it was on motion by Councilman
Griffin, seconded by Councilman Mandeville,
RESOLVED, that the Receiver of Taxes and Assess-
ments be and he hereby authorized, empowered
and directed to accept payment of the following
taxes on Block 221, Parcel 78, the liens for which
are held by the Town, at the face amount of the
lien, provided payment made within thirty days:

A letter dated November 10, 1942, was received from the State
of New York Commission of Correction, klbany, New York, in which they
advised that the report of the inspection of the town lock-up dated
October 15, 1942, was approved. ' The report was ordered received and.

The following petition was received from the Assessor:

TOWN OF MAMARONECK
TO THE HONORABLE TOWN BOARD OF THE TOWN OF MAHARONECK:
I, the undersigned, Assessor of the Town of
Mamaroneck, do hereby respectfully petition, pursuant
to Section 33 of Chapter 105 of the Laws of 1916 as
amended, for the correction of the Assessment Roll of
the Town of Mamaroneck, for 1941-1942, as follows:
FIRST: Property known as Block 315, Parcel 1,
owned by Johnethel Realty Company, has been erroneously
included in Sewer Distrct No . 1 of the Town of Mamaro-
neck, upon the Assessment Roll of the Town of Mamaroneck
for. the year 1941, tax of 1942 . The boundaries of said
district indicate that the property is not actually in-
eluded in the Sewer District;
SECOND: The Assessment Roll for 1941 (tax of
1942) should, therefore, be corrected in this respect,
pursuant to the provisions of Paragraph "fourth" of
Section 33 of the Westchester County Tax Act. (Chapter
105 of the Laws of 1916 as amended) .
WHEREFORE, your petitioner requests the Town
Board to correct the Assessment Roll accordingly.

Town of Mamaroneck and the Westchester County Park Commission for the
use of Parcel 45 and part of Parcel 1B, Sheet 9, Pelham-Port Chester
Parkway by the Towan of Mamaroneck Park Commission for nursery purposes

The Assessor presented petition dated and verified Novem-
ber 4th, 1942, pursuant to Section 33 of the Westchester County Tax

1942-1943, certain station installations and apparatus, as well as
private branch exchanges owned by the New York Telephone Company in-
stalled on property privately owned and not belonging to the New York
Telephone Company. The petition states in detail the number of such

Councilman Brewer recommended that in view of the fact that
the Town was being sued because of alleged damage from flood waters
no expression be given at this time and that the petition be tabled.
On motion duly made and seconded it was so ordered.
The Supervisor informed the members of the Board that copies
of the survey of flood conditions made by Mr. L. E. Van Etten, con-
sulting engineer, would be delivered to them within a week.
The Supervisor reported to the members of the Board that he
had received a letter from hr. F. Finsthwait, a new owner at 11 Emer-
son Place, and that the owner complained about the condition of the
DeBartolo property at the corner of Murray Avenue and Emerson Place .
The Supervisor asked if all members of the Board had read
the proposed letter to be mailed to the residents in that vicinity.
Councilman Brewer offered a suggestion and then the members
of the Board authorized the Supervisor to mail copies of the letter
to all of the residents who signed the petition and those who sent
separate letters complaining about the DeBartolo property.
The Supervisor presented the statement of machinery and
tools owned by the Town for highway purposes as submitted by the
Superintendent of Highways pursuant to the highway lays .
He informed the Board that Dr. Charles Weller and Charles
D. DeVinne were accepted by the Town of Mamaroneck War Council as
members and recommended the appointments .

The Supervisor presented a letter dated November 12, 1942)
received from Village Manager Johnson of the Village of Mamaroneck,
stating that the Village Board thought that it would be a good idea
to get together to discuss problems of mutual interest.
The members of the Town Board expressed their pleasure in
agreeing to this plan and authorized the Supervisor to complete
arrangements for a conference to be held some time early in January,
1943 .
The Supervisor suggested that if there was no further busi-
ness, the Board proceed with the preparation of the Annual Estimate
for the year 1943, which study had been started at the special meet-
ing held. on November 12, 1942.
Following a lengthy discussion the Board prepared the
following itemized statement in writing of the estimated revenues
and expenditures of the Town for the fiscal year commencing
January 1, 1943, which statement is known as the Annual Estimate:

On motion duly made and seconded it was
RESOLVED, that the foregoing Annual Estimate or Tax
Budget of the Town of Mamaroneck as prepared by this
Board for the year 1943 be and it hereby is approved;
and be it
FURTHER RESOLVED, that said original estimate or
budget be filed in the office of the Town Clerk
where it will be available for inspection by any
interested persons at all reasonable hours; and be it
FURTHER RESOLVED, that the Public Hearing thereon as
required by Section 113 of the Tom Law be held by and
before this Town Board on Thursday, December 10, 1942,
at 5:15 P. M. in the auditorium of the Senior High
School on Palmer Avenue, Mamaroneck.
The vote on the foregoing resolution resulted

On motion duly made and seconded it was unanimously
RESOLVED, that the Town Clerk give notice of said
Public Hearing as required by Section 113 of the
Town Law in "The Daily Times", the official news
paper, published in the Town of Mamaroneck, in its
issues of November 30 and December 7, 1912; and be
it
FURTHER RESOLVED, that the Comptroller have prepared
one hundred and twenty'-five (125) copies of said
Annual Estimate or Tax Budget for the use of the
public.
With reference to the discussion concerning the budget
and particularly in regard to the possibility of refunding $60,000
of General Toe, bonds, the Town Attorney stated that it would be
necessary to obtain the approval and consent of the Comptroller of
the State as provided in Section 8 of the General Municipal Lave.
He suggested that this consent should be obtained before the statu-
tort' notice of the public hearin on the budget is published and
because of the fact that this notice should be published not later
than November 30th, 1942, he recommended that the Supervisor and he
go to Albany at once and present the matter to the State Comptroller
for approval. Reference was mad to the forms of petition furnished
by the State Comptroller' s offic for such refunding and upon. motion
made by Councilman Brewer, seconded by Councilman Griffin, the follow
ing resolution was adopted:

RESOLUTION AUTHORIZING APPLICATION TO THE STATE
COMPTROLLER FOR. APPROVAL OF THE REFUNDING OF A
PORTION OF ITS BONDED DEBT
The Town Board of the Tone of Mamaroneck hereby
resolves as follows:
Section 1. The Supervisor of the Town of Pdamaro-
neck is hereby authorized and directed on behalf of
the Town to cause a petition in substantially the form
annexed 'hereto to be presented to the State Comptroller
requesting the approval of the refunding of a portion
of its bonded debt contracted before January 1, 1939,
pursuant to Article VII of the Constitution and Sec-
tion S of the General Municipai Law.
Section 2. This resolution shall take effect
immediately.
The foregoing resolution was upon roll call adopted by
the following vote:
AYES: Supervisor McCulloch
Councilmen Brewer and Griffin
NOES: None
NOT VOTING: Councilman Mandeville
Councilman Mandeville called to the attention of the Board
that a notice had been given in the Association of Towns bulletin in
connection with the filing of claims against the State for the differ-
ence-between the full amount of state aid payable to the towns under
Section 279 of the Highway Law and the amount actually received by the
towns . He stated that in the notice it was mentioned that George R.
Fearon was representing many of the towns throughout the State. He
also called: to the attention of the Board that Mr. Fearon had repre-
sented the Town of Mamaroneck in filing the claim for 1941 and that
although nothing had been collected, it might be well to have him file
a claim for the year 1942• He stated that he had been advised by the
Superintendent of Highways that bile the retainer fee would. remain
the same as last year, namely, $10.00, Mr. Fearon is now asking 25 per
cent of the amount recovered for 1942 as against 5 per cent for 1941.
Following some discuss it was on motion by Councilman
Mandeville, seconded by Councilman Griffin on roll call, the Super-
visor not voting,
RESOLVED, that the Supervisor be and he hereby
is authorized and directed to execute on behalf
of this town the claim and such other papers,
instruments and proceedings as may be necessary
for the preparation, filing and prosecution of
the claim for the difference between the full
amount of State aid payable to the Town. of Mam-
aroneck pursuant to Section 279 of the Highway
Law and the amount actually received by the Town
of Mamaroneck; and be it
FURTHER RESOLVED, that the forms for such filing
be obtained from the office of Costello, Cooney
and Fearon of Syracuse, New York, and that said
- firm be employed to prosecute this claim.
At 12:00 midnight the Board unanimously resolved to
adjourn.
