TOWN OF MAMARONECK, NEW YORK
HELD OCTOBER 16, 1942
In the Council Room of the Weaver Street Firehouse, Town of Mamaroneck, New York.
The meeting was called to order by Supervisor McCulloch
8 P. 1d. (Eastern War Time) .
Present: Supervisor McCulloch
Councilmen Griffin, Bates, Mandeville and Brewer,
Absent: None
The presence was also noted of Town Clerk Payne, Town Attorney
Delius, Town Engineer and Superintendent of Highways Foote.
The Supervisor announced that the meeting was called to discuss
the subject of flood control and any other business placed before the
Board.
The Supervisor reviewed all that had been done over a period
of years and the Board proceeded with a general discussion on the flood
control problem affecting the unincorporated area.
Town Engineer Foote reported that as directed by the Town
Board he had tried but was without success in obtaining the co-operation
of Mamaroneck Village Engineer Vroman in a joint survey of the entire
Sheldrake River bed and its water shed. He stated that he then proceeded
with his own study of conditions along the stream. He presented maps,
pictures and other data for the information of the Board. He recommended
that a consulting engineer be employed to collaborate with him in a survey
of the upper part of the water shed around and near the Larchmont Village
reservoir.
Councilman Brewer asked Mr. Foote who he would recommend.
Mr. Foote suggested that', L. E. Van Etten would be a very good
man to employ as he had had long years of experience in the section re-
ferred to.
Councilman Griffin stated that one of the things he wanted to
know was the exact answer to the question as to whether or not the
Larchmont Village reservoir overflow had increased the flow of water
down the stream.
Following further discussion it was on motion by Councilman
Brewer, seconded by Councilman Mandeville, upon roll call, unanimously
RESOLVED, that the Town Board does hereby authorize
the employment of Mr. L. E. Van Etten, Consulting
Engineer, to seek information and supply exact data
as to whether or not the Village of Larchmont has
through its operations increased the flow of water
into the Sheldrake River;
FURTHER RESOLVED, that the report be rendered within
a reasonable length of time and that the fee for same
shall not exceed $250.00.
Councilman Brewer recorded the following which was on
motion by Councilman Brewer, seconded by Councilman Mandeville, unani-
mously
RESOLVED, that the resolution adopted September 16,
1942, authorizing the Supervisor and the Town Attorney
to appeal to the Board Engineers of Rivers and
Harbors from the recommendations made by the United
States Army District Engineer of New York be rescinded
because same was based on incorrect information.
The Supervisor recommended that the Board should do everything
possible to get the federal government to furnish a final survey on the
local flood control problem. He said that he had already contacted
Ralph A. Gamble and requested him to bring the matter to the attention
of the House Committee on Rivers and Harbors.
He raised the question about another problem - the drainage
of the Maple Hill area - and recorded that Town Engineer Foote fur-
nish the Board with a report of same. He said that an answer on this
situation had been promised to Mr. David E. Lynn and George F. Clow,
and other petitioners .
The Board directed Mr. Foote to prepare to such a report.
The Supervisor asked if there was any other business to be
placed before the Board.
Councilman Mandeviile recommended the following which was on
motion by Councilman Mandeville, seconded by Councilman Griffin, unani-
mously
RESOLVED, that the week of November 2 to November 7
inclusive be and it here is designated as "Clean-
Up Week" .
On motion by Councilman Griffin, seconded by Councilman
Mandeville, it was unanimously
RESOLVED that the following offer heretofore
received by the Town Board for the purchase of
certain property acquired by the Town as a result
of tax lien foreclosure proceedings and now owned
by the Town, be accepted
Offer made by Harold S. Woodward to purchase Block 211,
Parcel 508 for the sum of $559 .39 subject to School
tax due September 1st, 1942.
FURTHER RESOLVED that the Town Attorney is hereby
authorized to prepare the necessary contract to sell,
providing for a deposit of 10% of the purchase money
at the time of signing the contract, and providing
further that a bargain a sale deed shall be given by
the Town of Mamaroneck, subject to covenants and re-
strictions of record, any state of facts an accurate
survey may show, and the zoning restrictions and that
Emil Zvirin is recognize as the broker and entitled
to a commission of $55.94 payable when, as and if
title closes .
FURTHER RESOLVED, that the Supervisor is authorized to
execute and deliver a deed to Harold S. Woodward whose
offer to purchase is accepted, which deed shall conform
to the provisions of this resolution.
The Town Attorney informed the Board that Mrs . Mildred Sanford,
realtor, had notified him by letter that her client, Mr. Pomerance, had
withdrawn his offer to purchase the lot on Mohegan Road known as Block 208,
Parcel 525 .
Copies of the following had been mailed by the Comptroller to
all members of the Board and the report was brought up for discussion:

Dear Supervisor McCulloch
In closing the books on 'October 1, I find that there is
an unexpended balance of $298.08 available for the Fenimore
Road Project.
You will recall that on August 5, 1942, the Town Board
passed a resolution authorizing the Supervisor and
Comptroller to transfer from unexpended projects of the
WPA to the Fenimore Road Project, the sum of $1,000.
Ninety per cent of the funds used since the adoption of
this resolution were expended for salaries and wages of our
inspector and chauffeur. The only other material purchased
for this Project was the '',gasoline for the compressors and
trucks and the contingent liability insurance premium.
Inasmuch as there will be due on October 15 the sum of $125
for payroll, there will remain the sum of approximately $175
for gasoline and insurance. Our gasoline has been costing
us approximately $90 per month. After this gasoline is de-
ducted from the $175 remaining, there will be left only $85
available for the payment of salaries. You can readily see
from these figures that here will not be funds on hand to
meet the payroll of Mr. Dimando and Mr. Osborne on Octo-
ber 31. Therefore, unless funds are provided by the Town
Board between the date of this letter and October 31, I
shall be unable to approve the WPA payroll of October 31.

Following some discussion an unanimous decision was made that
there be no further appropriation for W. P. A. projects.
The Supervisor recommended that the Engineer' s Department
prepare a complete and final report on the W. P. A. program sponsored
by the Town of Mamaroneck. He suggested that the report include such
items as the direct benefits derived by the Town through having the
improvements, a comparison of costs if the work was done under contract
and the number of men removed from the public welfare rolls through
such work relief projects . He recommended that Mr. James Dimando be
transferred to the Engineer' s Department for one month to complete the
report.
Following some discussion it was on motion by Councilman Bates,
seconded by Councilman Griffin, unaimously
RESOLVED, that the recommendation of the Supervisor
be approved and that James F. Dimando be transferred
to the Engineer' s Department of the Town for one month
to complete the report referred to.
There being no other business the Board adjourned at
10:10 P. M.
