HomeMy WebLinkAbout1942_07_01 Town Board Minutes REGULAR MEETING OF THE TOWN BOARD TOWN OF MAMARONECK, NEW YORK HELD JULY 1, 1942 In the Council Room of the Weaver Street Firehouse, Town of Mamaroneck, New York. The meeting was called to order by Supervisor McCulloch at S P . M. (Eastern War Time) . Present: Supervisor McCulloch Councilmen Griffin, Mandeville and Brewer Absent: Councilman Bates The presence was also noted of Town Clerk Payne, Town Attorney Delius, Assessor Smith, Public Welfare Officer DeVinne and Superintendent of Highways and Town Engineer Foote. The minutes of the meetings of May 20, June 3 and June 12, 1942, were approved with corrections . The Supervisor suggested that the meeting proceed with reports of committees. Councilman Griffin stated that it was too early to expect the June report of the Welfare Department. He gave the following figures as a preliminary report and stated that the full report would be presented at the next meeting: Case Load - 128; Total Relief Expended - $5,285.79 . He said that the total expended for the six months of 1942 was about $3,000 under the budget estimate for the same period. He pointed out that the expenditures for the first six months of last year were about $18,000 over the budget estimate for that period. He added that he thought that there would be less W. P. A. work, as the newspapers reported that federal appropriations for this purpose had been cut down. On motion by Councilman Griffin, seconded by Councilman Mandeville, the following resolution was unanimously adopted: WHEREAS, the Assessor has presented a petition dated July 1, 1942, for the correction of the assessment roll for certain years, pursuant to the provisions of Section 33 of Chapter 105 of the Laws of 1916, as amended, known as the Westchester County Tax Act; and WHEREAS, after due consideration this Board finds it desirable to grant said petitions for the correction of said assessment roll; NOW, THEREFORE, BE IT RESOLVED, that the assessment rolls for the years 1941 and 1942, taxes of 1942 and 1943, which show property now appearing on the rolls as follows: Section Block Lot Owner Land Imp. Total 4 41A pt. 17 Estate of Wm. T. Wood $ 550 550 (412-175) 4 41A pt. 17 Felix W. Smith & Wife 550 550 (412-179) M Councilman Griffin stated that at an earlier meeting the Town Board accepted Mr. C. Stewart Comeaux' s letter of resignation and adopted a resolution which, he said, he thought was very nice, thinking Mr. Comeaux for his many years of service to the Town. The other two members of the Board of Park Commissioners, he reported, were recommending the appointment of Mr. John A. Wang to fill the unexpired term left by Mr. Comeaux' s resignation. He said that he thought that Mr. Wang was an outstanding citizen and exceptionally fine fellow, for this appointment. He recommended and offered the following resolution which was seconded by Councilman Mandeville: WHEREAS, Mr. John A. Kiang has been recommended by the Board of Park Commissioners to fill the vacancy left by the resignation of Mr. C. Stewart Comeaux; NOW , THEREFORE, BE IT RESOLVED, that Mr. John A. Wang be and he hereby is appointed a member of the Board of Park Commissioners of the Town of Mamaroneck, New York, to serve the term expiring December 31, 1942. Councilman Brevaer reported that three sirens had been installed but not hooked up to the electricity. He said that a private contract had been given for the vwiring and that the electrician would go ahead with the work the following day. He added that tests similar to the other tests would be made . Councilman Mandeville reported that a thorough job of clean- ing the catch basins had been done by the Highway Department; also that some sidewalk repair work had been done . He informed the Board that Mr. Emil Zvirin had completed a contract for the sale of a dwelling facing Sackett Circle and the Federal Housing Administration was asking for a letter from the Town to the effect that all services of the Town are extended to the property. Following some discussion and upon advice of counsel that it was all right to give such a letter, it was on motion duly made and seconded unanimously RESOLVED, that the Supervisor be and he hereby is authorized to smite a letter to the Federal Housing Administration stating that all services of the Town are extended to the residents of Sackett Circle of the Town of Mamaroneck, New York. Welfare Officer DeVinne reported that a new State law had been adopted, effective July 1, 1942, authorizing small work relief projects . He advised that under the law local authorities could provide home relief in the form of wages for work relief on projects administered by local units of government. He said that there had been drastic cuts in federal funds for the forks Progress Administra- tion and that workers who have been unable to get employment in modern industry because of age or disability will have to go back to home relief. He said that with the new law it will be possible for the workers to give some return to the community; also that the State would refund forty per cent of the expenditures for the projects . Following some discussion it was on motion of Councilman Mandeville, seconded by Councilman Brewer, unanimously RESOLVED, that Supervisor McCulloch, Welfare Officer DeVinne and. Town Engineer Foote be and they hereby are appointed a committee to study the new law and report back at the next meeting. The Supervisor asked the Town Clerk to read the communi- cations. to sell said motes at public sale or arivate sale at not less than par and to fix the interest rate thereof at not exceeding six per centum, and to deliver same to the purchaser upon receipt of the purchase price, plus accrued interest from the date of the Notes to the date of delivery. Section 3 . Any instrument issued pursuant to this resolution shall be a general obligation of the Town of Miamaroneck, and the faith and credit of the Town are hereby pledged for the punctual payment of the principal of and interest on said obligations, and unless otherwise paid or payment provided for, a tax sufficient to provide for the payment thereof shall be levied and collected. Section This resolution shall take effect imme- diately. The Town Attorney reported that a hearing by the State Tax Cot nission on the appeal of the Town on the 1941 tax equalization table of the County would be held July 22, 1942, in the County Office Building at White Plains . He said that an attempt might be mde to have the State 'Tax Commission throw out the Town's appeal on the grounds that it is technically faulty. The claim is that it was not filed in time . He read off the dates and requirements of the lave and stated that he was satisfied as to the validity of the appeal . The Town Attorney stated that he recormended settlement of the certiorari proceedings instituted by W. Roy Idlanny, to review assessments for four years, i.e. the assessments of 1935, 1939, 1940 and 1941 (taxes of 1939, 1940, 1941 and 1942 respectively) upon -pro- perty in the Town of Mamaroneck which is owned by Mr. Manny, on the basis of reductions in the assessments which he believed were agree- able to the relator. Councilman Mandeville introduced the following resolution which was seconded by Councilman Griffin: WHEREAS, heretofore writs of certiorari were obtained by W . Roy idanny and described upon the assessment map and assessment roll of the Tom of Mamaroneck as Section 7 9 Block 79, Lots 4C, 5B, 5C,6B,6C,6D,7,8 , SB,9,11A,13A,13B,12,14,15 and Section 7, Block 71, Lot 3 (new numbers Block 728, Parcel 102 and Block 728, Parcel 276) be reduced as follows' For the year 1938 (tax 1939) from $56,000 to $39,000 For the year 1939 (tax 1940) from $50,000 to $38,000 For the year 1940 (tax 1941) from $69, 500 to $62,000 and from $50,000 to $38,000 For the year 1941 (tax 1942) from ; 65,000 to $62,000 and from $50,000 to 08,000 provided that all proceedings for the years 1938, 1939, 1940 and 1941 (tax of 1939, 1940, 1941 and 1942 respec- tively) be discontinued without costs to the Town of Mamaroneck, except that the Town of Mamaroneck pay to the referee, in the 1938 (tax of 1939) proceeding, the reasonable fees or allowance, if any, for his services to date in these proceedings . FURTHER RESOLVED that the 'Town Attorney is hereby authorized and directed to sign the necessary stipulation to obtain orders of the Supreme Court providing for such reductions, the refund of any excess taxes paid and the payment of the referee' s fee, if any. The 'Town Attorney recommended the following resolution which was on motion by Councilman Brewer, seconded by Councilman Griffin, upon roll call, unanimously adopted: WHEREAS, this Board heretofore and on the 18th day of Karch, 1942, appointed certain persons auxiliary volunteer firemen to serve in the Fire Department of the Town of Mamaroneck, for the period of the present emergency; and WHEREAS, the Legislature of the State has enacted Chapter 455 of the Laws of 1942 which was amended by Chapter 544 of the Laws of 1942, is known as the "New York State War Emergency Act" and which as so amended, became a law with the approval of the Governor, April 27th, 1942, and became effective on May lst, 1942; and WHEREAS, Section 34 of said Act contains provisions for the appointment of "Temporary Volunteer Firemen" RESOLVED that the resolution of March 18th, 1942, is hereby modified so as to provide for the appointment of the persons therein designated "Auxiliary Firemen" as Temporary Firemen" pursuant to Section 34 of the New York State tar Emergency Act; and it is further RESOLVED that nothing herein contained shall be construed to affect the rights and privileges of said persons as Volunteer Firemen by virtue of their prior appointment by this Board on March 18th, 1942. The following monthly reports for the month of June were received and ordered filed: (1) Report of the receiver of Taxes and (2) Report of the Plumbing inspector . At 9: 55 P . M. the Board
