TOWN OF MAMARONECK, NEW YORK
HELD JUNE 17, 1942
In the Council Room of the 'Weaver Street Firehouse, Town of
Mamaroneck, New York.
The meeting was called to order by Supervisor McCulloch at
S P. M. (Eastern War Time) .
Present: Supervisor McCulloch
Councilmen Brewer and Mandeville
Absent: Councilmen Bates and Griffin
The presence was also noted of Town Clerk Payne, Town Attorney
Delius and Town Engineer and Superintendent of Highways Foote.
The Supervisor recommended that the minutes of previous meet-
ings be held over until the full board was present.
He said that Councilman Griffin was getting along quite well
and that Councilman Bates had informed him that he could not attend
this meeting.
He suggested that the meeting proceed with the reports of
committees .
Councilman Mandeville stated that there was nothing to
report for his departments .
Councilman Brewer stated that he would like to see a little
more speed in getting the air raid alarm sirens hooked up .
Town Engineer Foote stated that he was ready to have the
sirens installed as soon as locations were decided upon. He said that
-- there were seven (7) in all and that he would like to have the opinions
of Police Chief Yerick, Fire Chief Burton and Chief Air Raid Warden
Jennings.
Councilman Brewer stated that he thought that Mr. Mendes
would like to be present. He urged that the sirens be installed as
soon as possible.
He presented the following copy of a report received from
Engineer Foote:

Air Raid Sirens - 2nd Test
Dear Sir:
The following is a report on the 2nd siren test,
made Saturday morning, June 13th. On this test, we
arranged to have the siren raised about 20 feet above
the ground surface.
The test locations and the times of the tests are
as follows:
Location No. 1 Weaver Street Fire House 10:10 A. M.
Location No. 2 Glen Eagles Drive, Rouken Glen 10:40 A. M.
Location No. 3 Oxford Road near Mohegan Dr. 11:10 A. M.
I suggest that we have another test on Saturday morning and arrange
to have as many air raid wardens as possible to observe and give their
opinion as to locations.
I also suggest that the Supervisor arrange with the fire Department to have
the two fire sirens sounded at the same time on Saturday morning.
It would be desirable to have the Chiefs of the Police and the Fire Department
present to give their opinions of the locations before they are finally settled
A map is attached showing the locations of the locations of the sirens and also
the positions of the observers for each test red for No.1 blue for No. 2 and green
for No. 3

Councilman Brewer stated that the use of the fire alarm sirens
for fires would cause confusion, as the sound was similar to the air
raid alarm.
The Supervisor stated that he thought that sirens would have
to be abandoned for use as fire alarms.
A letter was received from Chief Burton and Town Engineer
Foote recommending that seven (7) hydrants be removed from sections
within the unincorporated area.
Councilman Brewer asked that the letter be tabled until more
information was received and the locations inspected.
Councilman Brewer and Attorney Delius reported that they had
prepared for the approval of the Town Board a letter addressed to
1lilliam B. Folger, Personnel Officer of the County, with suggestions
for changes in the proposed civil service classification list of posi-
tions in the Town. The letter was read and following a lengthy dis-
cussion it was on motion by Councilman Brewer, seconded by Councilman
Mandeville, upon roll call, approved and the Town Attorney was directed
to mail same to Mr. Folger.
Commissioner Clair V. Johnson presented a list of persons
who had taken and successfully completed the auxiliary police course
and recommended that they be appointed.

RESOLVED, that the following named persons are
hereby designated and appointed as members of the
auxiliary police of the Town of Mamaroneck with
powers of peace officers as provided in Section 104
of the New York State War Emergency Act:

Councilman Mandeville introduced the following resolution:
RESOLUTION AUTHORIZING THE ISSUANCE OF $200,000.
TAX LIEN CERTIFICATES OF INDEBTEDNESS OF THE TOWN OF
MAMARONECK, ITV THE COUNTY OF WESTCHESTER, NEW YORK.
RESOLVED BY THE TOWN BOARD OF THE TOWN OF MAMARONECK
IN THE COUNTY OF WESTCHESTER, NEW YORK,. as follows:
Section 1. For the purposes authorized by law, the
Supervisor is hereby authorized to borrow an amount not
exceeding $200,000. and to issue Certificates of Indebted-
ness of the Town therefor against transfers of tax liens
owned by the Town not otherwise pledged, pursuant to the
Westchester County Tax Law, constituting Chapter 105 of
the Laws of 1916, as amended. Each of said Certificates
of Indebtedness shall be designated "Tax Lien Certificate
of Indebtedness" .
Section 2. It is hereby determined and declared:
(a) The total amount of transfers of tax liens owned
by the Town, covering tax liens included in tax sales
held prior to May, 1942, not yet redeemed, is. . . . . .$500,188.10
(b) The total amount of transfers of tax liens bid
in or purchased by the Supervisor on behalf of the
Town at the last tax sale, held in May, 1942, not yet
redeemed, is . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .4120,645.49
(c) The total amount of Tax Lien Certificates
of Indebtedness heretofore issued and outstanding
against said transfers of tax liens, or any portion
thereof, is . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .$110,000.00
(d) The total amount of said transfers of tax
liens otherwise pledged in any manner, is . . . . . . . . . . -0-
(e) The total amount of Certificates of In-
debtedness heretofore issued and outstanding in
anticipation of the collection of taxes for the
non-payment of which properties were included in

(f) All of the Certificates of Indebtedness
referred to in section (e) hereof will be paid
from taxes collected since the issuance of said
obligations and from the proceeds of the Tax Lien
Certificates of Indebtedness authorized herein.
Section 3 . The following matters in connection
with said Certificates of Indebtedness are hereby
determined:
Date: July 1, 1942
Maturity: July 1, 1943
Numbers and
Denominations:
Interest rate: %per annum, payable at maturity.
Form: Substantially as determined by resolution
adopted January 4, 1939, except that said
Certificates shall recite that they are issued
pursuant to Chapter 105 of the Laws of 1916,
as amended, for money borrowed against transfer
of tax liens owned by the Town.
The Supervisor is hereby authorized to determine all
matters in connection therewith not determined by this or
subsequent resolution and his signature upon said Certi-
ficates shall be conclusive as to such determinations.
Said Certificates of Indebtedness shall be signed by the
Supervisor and countersigned by the Town Clerk and shall
have the corporate seal affixed thereto. The Supervisor
is hereby authorized and directed to sell said certificates
at private sale at not less than par, without advertise-
ment or public bidding, and to deliver the same to the
purchaser upon receipt of the purchase price, plus accrued
interest from the date of the Certificates to the date of
delivery.
Section 4. Any instrument issued pursuant to this
resolution shall be a general obligation of the Town and
the faith and credit of the Torn are hereby pledged for the
punctual payment of the principal of and interest on said
obligations, and unless otherwise paid or payment provided
for, an amount sufficient for such payment shall be inserted
in the annual estimate and a tax sufficient to provide for
the payment thereof shall be levied upon all the taxable
property in the Town.
On motion of Councilman ; Mandeville, seconded by Councilman
Brewer, the foregoing resolution was adopted by the following vote:

Attorney Delius reported that he had requested the Village
of Mamaroneck to submit to the Town Board statements of receipts and
disbursements and outstanding taxes with all proposals for the sale
of properties owned by the Village within the Tov,n of Mamaroneck. He
added that he had ordered a title search on the property known as
Pleasant Hour Grill at 439 Mamaroneck Avenue, Village of Mamaroneck.
Mr. Ralph Gironda appeared at the meeting and Attorney Delius
advised the Board that he had received a certified copy of the resolu-
tion in which the Village of Mamaroneck accepted Mr. Gironda's offer
of $1,750 for the property known as 662 to 668 Old White Plains Road,
Village of Mamaroneck. He added that the resolution was adopted on
February 24., 1942, which date was previous to the latest Town tax date.
Following some discussion it was decided that the matter be
referred to the Supervisor and Attorney Delius and that following the
next meeting they would advise Mr. Gironda of the action of the Board.
Upon the question of the letter from A. J. Foote, Town Engineer
and Superintendent of Highways, regarding vacations for employees in
the Highway Department, Sewer Department, Sewer District No. 1, and
Garbage Department (Garbage District No. 1) which was referred to the
Town Attorney at the last meeting, the Town Attorney reported that if
a resolution were adopted pursuant to Section 92 of the General Piuni-
cipal Law, vacations could be granted to employees paid on a per diem
or hourly basis, within the limits provided in that section.
Upon motion made by Councilman; Mandeville, seconded by
Councilman Brewer, the following resolution was adopted:
RESOLVED, that this Board hereby grants vacations
to all employees compensated on a per diem or
hourly basis, not to exceed one week in each year
in which they have been employed for not less than
1,222 hours, with full pay.
FURTHER RESOLVED, that for the purpose of granting
_ such vacations in the year 1942, the number of hours
which entitle such employees to such vacation shall
be computed as of June lst, 1941 and annually there-
---- after from June lst; and
FURTHER RESOLVED, that vacations shall be granted to
said employees by the Town Superintendent of Highways
and Engineer, at such times as he may consider suitable;
but only between the first day of June and the first
day of October in any year.
The foregoing resolution was adopted by unanimous vote of
the Board.
Attorney Delius reported that Receiver of Taxes Dillon had
referred to him a letter dated May 26, 1942, received from Mr. Norman
M. Kramer, asking for relief under the Soldiers ' and Sailors ' Civil
Relief Act of 1940. He said that the letter claimed that Milton J.
Kramer, a joint owner of Nos . 98 to 100 Post Road, Larchmont, was
serving in the armed forces and that it would be necessary to defer
payment of taxes because of this and business reasons . Mr. Delius
advised the Board that the records in the assessor' s office and the
county clerk' s office failed to show the transfer of the property from
Yetta Kramer to Jacob A. , Norman M. and Milton J. Kramer. He said that
there had been a considerable amount of correspondence on the matter
and that now an affidavit had been received from Norman M. Kramer,
stating that the property has been owned by the parties mentioned since
and prior to October 17, 1940.
Following some discussion it was on motion by Councilman
Miandeville, seconded by Councilman Brewer, upon roll call, unanimously
RESOLVED that upon advice of counsel, the applica-
tion of Parr. Norman M. Kramer be and it hereby is
denied.
Attorney Delius reported that Mr. Daniel Kusell had requested
that the matter concerning Taylor Place be held over until his return
to Larchmont in the fall. It was agreed that this be done and fr. Delius
was asked to advise Mr. Kusell.
The Supervisor presented the following financial statements
for the period from January 1 to Ma 31, 1942: (1) Analysis of Budget
Appropriations and Expenditures; (2) Summary of Receipts and Disburse-
ments; and (3) Analysis of Estimated Revenues . The statements were
ordered filed.
The Supervisor informed the Board treat he had received a
letter dated June 17, 1942, from Village Manager Win. H. Johnson with
an application made by J. Roy Kriner, a member of the Science Depart-
ment of Mamaroneck Senior High School, Mamaroneck, New York, to the
- War Department Civilian Protection School at Amherst College, for a
course in methods of combattin g chemical warfare. He explained that
Mr. Kriner had been teaching civilian defense groups in the Larchmont
area in methods of combatting war gases and that Mr. Johnson had stated
that the Village of Mamaroneck was quite willing to pay a just share of
Mr. Kriner' s expenses for the course if the other two units would do
likewise. He said that the total expenses would not exceed $50.00.
The Supervisor asked the members of the Board what their
wishes were in the matter.
Following some discussion no action was taken by the Board.
The Town Clerk' s report for the month of May was received
and ordered filed.
At 9:30 P. M. the Board unanimouslby resolved to adjourn.
