TOWN OF MAMARONECK, NEW YORK
HELD DECEMBER 30, 1936
At the Town Offices, 158 West Boston Post Road, Mamaroneck, N. Y.
8: 30 P. M.The meeting was called to order by Supervisor McCulloch at

The presence was also noted of Town Clerk Marvin and Town
Attorney Delius.
The Supervisor stated that the meeting was being held pur-
suant to the provisions of Paragraph 1 of Section 62 of the Town Law,
which requires that the Town Board of every town of the first class
shall meet on the 28th day of December or on a subsequent date before
December 31st of each year, and that the date of December 30th had
been set by the Town Board at its meeting on December 16, 1936.
He directed the Clerk to note with regret that Mr. Griffin
was absent from the meeting on account of illness.
The minutes of the meeting of December 2, 1936, were approved
as printed.
The Supervisor presented the Annual Report of Highway Monies
for the Year 1936 which was ordered filed and published as required
by law.
Mr. Brennan on behalf of Highway Superintendent Foote pre-
sented the Town Superintendent' s Estimate for Highway Purposes for
the Year 1937 showing the following amounts:

On motion by Mr. Brennan, seconded by Mr. Bates, it was
unanimously
RESOLVED, that the foregoing Town Superintendents
Estimate for Highway Purposes for the Year 1937
be and it hereby is approved; and be it
FURTHER RESOLVED, that the amount set opposite
each item is the amount which shall be raised
by tax for the specific purpose mentioned.
Supervisor McCulloch stated that the Board had met, pursuant
to call, for the purpose of considering the tax budget for the year
1937.
The Board thereupon proceeded to consider the protests and
objections made by those who addressed the Board at the hearing held
on December 28, 1936.
The various items contained in the tax budget were then
considered item by item, and after a thorough discussion had thereon,
Councilman Meginniss offered for adoption the following:
WHEREAS, this Board has heretofore made, compiled and
filed with the Town Clerk a proposed tax budget con-
taining the estimated probable revenues and estimated
expenditures for the several departments, offices and
other town and special districts purposes for the year
1937; and
WHEREAS, notice of the completion and filing of said tax
budget and calling a public hearing thereon has been
duly published on December 14, 17, 21, and 24, 1936, in
the manner required by law; and
WHEREAS, a public hearing upon said tax budget was duly
held by and before this Board on December 28, 1936; and
WHEREAS, this Board has duly considered the protests
and objections made against certain items contained
in said tax budget, and considered separately all
the items contained in said tax budget;

NOW, THEREFORE, it is
RESOLVED, that the final estimates, as completed
by the Town Board and filed in the office of the
Town Clerk, be and the same hereby are adopted as
the budget for the year 1937, pursuant to the
provisions of the Town Law and that said estimates,
as so adopted, be entered in detail in the minutes
of this Board as follows:

and it is
FURTHER RESOLVED, that the annual budget estimates
of the expenditures of the Town of Mamaroneck for
the fiscal year 1937 be adopted and confirmed and
that the Town Clerk be and he hereby is directed
to enter the same upon the minutes; and that the
sums of money hereinafter stated are hereby appro-
priated from the current revenues; as provided by
law, for the offices, departments, boards, commissions
and purposes hereinafter enumerated for expenditure
in the manner directed by law, to wit:

RESOLVED, that for the fiscal year 1937 the sums
hereinafter set forth and for the purposes listed
below, be levied, assessed and collected upon the
taxable properties of the Town of Mamaroneck and
properties in the Town of Mamaroneck outside of the
villages of Larchmont and Mamaroneck, the properties
of the several districts specified below including
Mamaroneck Valley Sewer District, and the several
parcels of taxable property, franchise assessments
and persons within the Town and within such special
districts, and that the various assessments for
sewer, sidewalk, street and other improvements listed
below and contained in the various assessment rolls
and books of the Town of Mamaroneck, the installment
assessments of which become payable in the year 1937,
be extended on the Tax Roll of the Town of Mamaroneck
against each of the several parcels affected by such
assessments, or parts thereof; to wit:

RESOLVED, that the Town Clerk be and hereby is
authorized and directed to deliver to the Supervisor
a copy of said tax budget and a transcript of the
minutes of this meeting, duly certified, and to
transmit to the Clerk of the Board of Supervisors
of Westchester County a duplicate copy of said tax
budget and transcript of the minutes of this meeting,
also certified, as provided by Section 116 of the
Town Law.
The resolutions were seconded by Councilman Bates.
A vote was taken upon the foregoing resolutions and
after the roll call the vote was announced as follows:

Noes: None
Motion declared carried.
Town Attorney Deli-as presented a petition dated December 30,
19363 from Assessor Smith requesting the correction of the assessment roll
for the year 1935, tax of 1936, so as to pernit the apportionment of
certain taxes. He recommended approval of the request.
On motion by Mr. Meginniss, seconded by Mr. Brennan, it
was unanimously
RESOLVED, WHEREAS, the Assessor has presented a
petition dated December 30, 1936, for the correction
of the assessment roll for the year 1935, tax of 1936,
pursuant to the provisions of Section 33 of Chapter
105 of the Laws of 1916, as amended, known as the
Westchester County Tax Act; and
WHEREAS, after due

Town Attorney Delius stated that because of an unexpected
delay in obtaining from the printer copies of certain proposed new
Town ordinances, it would be impossible to hold the public hearing
on these ordinances on January 12, 1937, as set forth by the Board
in resolution adopted at its meeting on November 18, 1936. He re-
commended that the hearing be held on January 26, 1937, and that public
notice of this hearing be published in The Daily Times and The Larchmont
Times on or before January 15, 1937.
On motion duly made and seconded it was unanimously
RESOLVED, that the resolution adopted by this
Board at its meeting on November 18, 1936, setting
the date of January 12, 1936, for a public hearing
on certain proposed new ordinances be and it hereby
is rescinded; and be it
FURTIiER RESOLVED, that this hearing be held on
January 26, 1937, at the Weaver Street Fire House
at 8 P. M. ; and be it
FURTHER RESOLVED, that due notice be given of
said hearing in The Daily Times and The Larchmont
Times on or before January 15, 1937.
The Supervisor said that it had come to his attention that
it might be possible for the Town to purchase materials and supplies
, for the use of the Highway Department at a saving in cost to the Town
if the purchase were made through the office of the County Engineer.
He referred the matter to Mr. Brennan, Town Engineer Foote and Comp-
troller Luceno for investigation and report to the Board.
A letter dated December 16, 1936, was received from Local
Union No. 543 of Mamaroneck, United Brotherhood of Carpenters and
Joiners, favoring the re-zoning of the Petigor property so as to per-
mit the erection of apartment houses. The letter was ordered filed.
A letter dated December 30, 1936, was received from Michael
Giacomo of 6 Fifth Avenue, Larchmont, requesting permission to pay
certain taxes without interest.
On motion by Mr. Meginniss, seconded by Mr. Bates, it was
upon roll call unanimously
RESOLVED that in view of the action taken by the
Town Board in other and similar cases, the Receiver
of Taxes and Assessments be and he hereby is authorized
to accept payment of taxes for the year 1908 and 1909,
sales of 1909 and 1910, the liens for which are owned
by the' Town on property known as Section 1, Block 67,
Lot 11, without interest provided payment be made within
thirty days.
The report of the County Health Department for the month
of November, 1936, was received and filed.
After discussion the Clerk was directed to write to Chairman
King of the Police Commission stating that the appearance and condition
of the police telephone booth on the Boston Post Road opposite Homnocks
Road was the occasion of some comment.
On motion by Mr. Brennan, seconded by Isar. Bates, it was
unanimously
RESOLVED, 7HEREAS, Justice of the Peace William A. Boyd
served this community for more than fifty years in a
large number of public capacities; and
WHEREAS, by his friendly manner, his devotion to his
duties and his public spirit he endeared himself to
everyone who came in contact with him;
NOW, THEREFORE, be it
RESOLVED, that this Board hereby express its deep
sorrow occasioned by his death on December 21, 1936,
and regret the loss to the Town of such a fine
citizen; and be it
FURTHER RESOLVED, that a copy of this resolution be
sent to the members of his family.
Mr. Brennan reported that in accordance with the action
taken by the Board at its meeting on December 16, 1936, he had
endeavored to contact Mr. Joseph Shapiro of Bonnie Briar Lane con-
cerning additional street lights in that neighborhood and had so far
been unable to get in touch with him.
Town Attorney Delius presented to the Board the text of
a proposed change in the zoning ordinance or regulations of the Town
of Mamaroneck providing for the establishment of a new Use District
to be known as «B-2" Residential District, designed to permit only
the erection of so-called garden type apartment houses and for the
establishment of the necessary area and height districts to conform
thereto.
On motion by Mr. Brennan, seconded by Mr. Bates, it was
unanimously
RESOLVED, that the proposed changes in the zoning
ordinance or regulations of the Town of Mamaroneck
providing for the establishment of a new Use District
to be known as `tB-2" Residential District, designed
to permit only the erection of so-called garden type
apartment houses and for the establishment of the
necessary area and height districts to conform
thereto, as submitted by the Town Attorney, be and
they hereby are approved; and be it
FURTHER RESOLVED, that a public hearing thereon
be held by and before this Board at its meeting
on January 20, 1937, at the Town Office at 8 P. M. ;
and be it
-- FURTHER RESOLVED, that due notice of said hearing be
given in The Daily Times not later than January 4,
1937, as required by law.
The Supervisor extended to each member of the Board his
best wishes for the coming year and each member of the Board in turn
extended to the Supervisor and every other member of the Board similar
best wishes.
At 9:05 P. H. the Board unanimously resolved to adjourn
out of respect to Judge Boyd.
