HomeMy WebLinkAbout1940_05_01 Town Board Minutes E REGULAR MEETING OF THE TOWN BOARD TOWN OF MAMARONECK, NEW YORK HELD PliAY 1, 1940 At the Town Offices, 158 (Pest Boston Post Road, Mamaroneck, N. Y. The meeting was called to order by Supervisor McCulloch at 8: 00 P. M. Present : Supervisor McCulloch Councilmen Bates, Griffin, Mandeville, Meginniss Absent: None The presence was also noted of Town Clerk Payne, Town Attor- ney Delius, Assessor Smith, Comptroller Luceno and Town Engineer Foote . The minutes of the meeting of April 17, 1940, were approved as presented. The Supervisor suggested that the meeting proceed with the reports of committees. Councilman Meginniss stated that he had nothing to report . Councilman Griffin presented a preliminary report for the Welfare Department for the month of April, 1940. He explained that it was too early to have a complete report for the meeting. He read the report which showed as follows: As of the 30th of March the department had 403 cases, 3 new applications and 19 re-opened or a total of 22 new cases and a sum total of 425. The department closed 65 cases so there was a total of 360 cases open at the end of the month. The department gave re- lief to 386 cases and the following was expended: P.W.O $13,959.57 Veteran 2,135.50 Total 516, 095. 07 making a decrease of $1, 533. 14 from March, 1940. In April, 1939 the department had a total expenditure of $11,887. 97. Therefore, there was an increase of $4,207.10. Mr. Griffin added that about twelve or fifteen had been laid. off W. F. A. projects in the Town and that he thought that they would go back on home relief. He stated that he had read in the local newspaper that the village of Larchmont was about to spend $2,500 for work on trees damaged during the sleet storm. He referred to the condition of the trees throughout the unincorporated area and suggested that something be done as soon as possible . He pointed out that $400 out of $500 allowed in the budget for the care of trees had already been expended for emergency work and that it had been estimated that an additional $1,500 would be the minimum amount necessary to com- plete the work. The members of the Board., the Town Attorney and the Super- intendent of Highways discussed the matter at length. Following the discussion on motion by Councilman Mandeville , seconded by Councilman Bates, upon roll call, it was unanimously RESOLVED that the expenditure of the sum of $1,500 for extraordinary repairs of highways which have become unsafe for public use and travel because of the damage to trees along the highways caused by the ice or sleet storm of March 4, 1940, as recommended E by the Superintendent of Highways, is hereby approved and the Superintendent of Highways is directed to proceed to cause such damage to be repaired pursuant to Section 269 of the Highway Law. FURTHER RESOLVED that the Town Clerk prepare a statement showing the probable cost of making such repairs which statement should be presented to and signed in duplicate by the majority of the members of this Board, one duplicate to be filed with the Town Clerk and one delivered to the Supervisor, copy of which is to be transmitted to the Department of Public Works of the State of New York. Councilman Griffin presented a petition dated May 1, 1940 received from the Assessor for the correction of the assessment roll so as to permit the apportionment of taxes . On motion by Councilman Griffin, seconded by Councilman Mandeville , the following resolution was unanimously adopted: WHEREAS, the Assessor has presented a petition dated May 1, 1940, for the correction of the assessment roll for the year 1939, taxes of 1940, pursuant to the provisions of Section 33 of Chap- ter 105 of the Laws of 1916, as amended, known as the Westchester County Tax Act; and WHEREAS, after due consideration this Board finds it desirable to grant said petition for the correction of said assessment roll; NOW, THEREFORE, BE IT RESOLVED, that the assessment roll for the year 1939, taxes of 1940, which shows property now appearing on the roll as follows: Section Block Lot 8 58 7,8, 9 Owner Land Imp. Councilman Mandeville presented certain highway claims for approval. J. Foote 5 .58 The Supervisor asked if there was any one present who wished to address the Board. Mr. "Wallace Cardwell, circulation manager of "The Daily Times" newspaper appeared to request permission for the use of the courtroom at 11 Edgewood Avenue ,Town, for the purpose of holding meetings with the newsboys of the unincorporated area on Monday evenings from seven to eight o' clock. On motion by Councilman Mandeville, seconded by Councilman Griffin, it was unanimously RESOLVED, that representatives of "The Daily Times" newspaper be granted permission to use the courtroom at 11 Edgewood Avenue, Town, on Monday evenings from seven to eight o' clock for the purpose of hold- ing meetings with newsboys of the unincorporated area. On motion by Councilman Bates, seconded by Councilman Griffin, it was unanimously RESOLVED that Kent Builders, Inc. be permitted to compromise the taxes oh Lots 34B and 35, Block 6, Section 1, in the Town of Mamaroneck by paying the face amount of all taxes without penalties and interest, and in addition the current taxes (1939) both state , county and town and school with current penalties, provided such payment be made within thirty ( 30) days of the date of this resolution; and FURTHER RESOLVED, that this compromise is made upon the assurance of the owners that they will improve the property by building thereon; and FURTHER RESOLVED, that the Town Attorney notify Kent Builders, Inc . of the Board' s disposition of this matter. On motion by Councilman Griffin, seconded by Councilman Bates, it was unanimously RESOLVED, that the Receiver of Taxes and Assess- ments be and he hereby is authorized, empowered and directed to accept payment of the following taxes on Section 6, Block 12, Lot 25, the liens for which are held by the Town, in the face amount of the liens plus interest computed at 6 per cent per annum, provided payment is made within thirty days Amount of Tax Year Sale Year Lien 1931 1932 7.29 1932 1933 7. 91 1933 1934 7.21 1934 1935 11.75 1935 1936 7. 78 1936 1937 8.38 1937 1938 8.89 1938 1939 9. 69 On motion by Councilman Griffin, seconded by Councilman Bates, it was upon roll call unanimously RESOLVED, that in accordance with the provisions of Section 34 of the Westchester County Tax Act a notice of the sale of tax liens, which sale shall be held on May 22, 1940, be and it hereby is ordered published once in each week for three weeks consecutively commencing on Wednesday, May 1, 1940, in "The Daily Times", the official newspaper published in the Town of Mamaroneck; and be it FURTHER RESOLVED, that the matter of attending to the publication of this notice of sale be and it hereby is referred to the Receiver of Taxes and Assessments; and be it FURTHER RESOLVED, that said notice shall have appended thereto a particular and detailed state- - ment of the property, the tax lien on which is to be sold, giving the section, block and lot numbers together with the name of the owner thereof as set -- forth in the records of the Receiver of Taxes and Assessments. Town Attorney Delius submitted the application and release signed by George L. Bourne for the discontinuance of a certain portion of Weaver Street, State Highway No. 19, no longer needed for highway purposes, together with a blueprint and rive copies each of consent of the Town Board and order of the Town Superintendent of Highways discontinuing same , which papers he and Superintendent of Highways Foote had approved. The members of the Board and the Town Clerk signed the consent . The Superintendent of Highways signed the order. The Board directed the Town Attorney to return the papers to Douglas L. Barrett, Right-of-Way Engineer, Department of Public Works, County of 'Westchester. On motion by Councilman T Iandeviile, seconded by Councilman Griffin, upon roll call (the Supervisor not voting) it was unanimous- ly RESOLVED, that the Supervisor be and he hereby is authorized to sign the following W. P. A. project — proposals: Birch Lane , Village of Larchmont Total estimated cost X14,785. 00 Total estimated Federal contribution 8,730.00 Total estimated sponsor' s contribution 69055.00 Approximate cost to Town 39700.00 Parking Plaza on 'Woodland Avenue Village of Larchmont Total estimated cost 7, 638.00 Total estimated. Federal contribution 3,416 .00 Total estimated sponsor' s contribution 4,222. 00 Approximate cost to Town 3,350.00 FURTHER RESOLVED, that the above mentioned projects be submitted to the federal government for approval. Councilman Meginniss stated that he thought that there should be some kind of statement prepared so that the Board could tell at a glance what the Town was committed to on W. P . A. projects. Following some discussion, the members of the Board directed Comptroller Luceno to prepare such a statement and present an up- to-date copy from time to time when ''W. P. A. projects are offered for approval. The Supervisor informed the Board that he had received a letter from Superintendent of Highways A. J. Foote with plans show- ing work contemplated by the Yew York, Few Haven & Hartford Railroad Company. He said that Pdr. Foote had recommended that the Board authorize him to approve the plan. Following discussion with Mr. Foote, it was on motion by Councilman Bates , seconded by Councilman Griffin, upon roll call, unanimously RESOLVED that Superintendent of Highways A. J. Foote be and he hereby is authorized to approve the plan entitled "N.Y.N.H. & H.R.R. - New Haven Division Proposed Alterations at Bridge No. 7. 21 Weaver .St. , Mamaroneck, N . Y. , Office of Chief Engineer - New Haven, Conn. , March, 1940" provided the work is done at n4 cost to the Town of Mamaroneck or the Westchester Joint VVater Works, No. 1. Assessor Smith stated that Anne Chulew, owner of Section 9, Block 40, Lot 29 ( old) , Block 14, Parcel 65 (neow) , had offered to settle certiorari proceedings on the basis of a reduction in assess- ment from $24,500 to $20, 000. Following some discussion, on motion duly made and seconded, it was denied. The Town Attorney stated that he recommended the settlement of the certiorari proceeding instituted by Graecen Cottages, Inc. , to review the assessment upon a parcel of property in the Village of Mamaroneck known as Section 91 Block 931 Lot 19 on the basis of a reduction in the assessment from $11, 000 to $10, 000. Upon motion made by Councilman Bates, and seconded by Councilman Griffin, the following resolution was adopted; WHEREAS, heretofore and on or about the 2nd day of October, 1939, a writ of certiorari was obtained by Graecen Cottages, Inc. owner of Section 9, Block 931 Lot 191 to review the assessment upon the premises owned by it; and- - WHEREAS, a return to such writ was duly filed by the Assessor and Board of Review on or about the 15th day of November, 1939, and no further proceed- - ings have been taken; and WHEREAS' the Town Attorney and Assessor recommend to this Board that the proceedings be settled and discontinued upon the reduction of the assessment I rom $11,000. to $10, 000; NOW, THEREFORE, BE IT RESOLVED, that the assessment for the year 1939 upon property known as Section 9, Block 93, Lot 19, assessed for $11,000 be reduced to $10, 000 provided the certiorari proceeding now pending in the name of Graecen Cottages, Inc. be discontinued without costs. FURTHER RESOLVED, that the Town Attorney is hereby authorized and directed to sign the necessary stipulation to obtain an order of the Supreme Court providing for such reduction and refund of any excess taxes paid. A letter dated April 20, 1940, was received from The Larch- mont Gardens Association, signed by George D. Burchell, secretary, favoring the acquisition by the Town of the Weaver Street Chapel Property, providing that the improvement of the park, if any, be financed by public subscription and donation. The letter was ordered filed with other correspondence pertaining to the so-called `spark lot". The Town Clerk reported that he had received a letter from U. M. Flick, Supervisor of Public Records, Division of Archives and History of the State Education Department, in which the importance of safe-guarding public records was stressed, and Sections 1193 and S' 0 1199-a, Article 46 of the Education Law, requiring that certain records shall be kept in fire-proof rooms, vaults, safes or other fire-resisting receptacles were pointed out . The Town Clerk called to the attention of the Board the fact that the space available for such storage is limited and re- commended that a room in the rear of the basement at 15B West Boston Post Road be fire-proofed for this purpose . After inquiring if the records were now protected, the members of the Board directed the Town Clerk to make estimates for the work necessary to fire-proof the room mentioned. The report of the Building Inspector for the month of April was received and filed. The report of the County of Westchester Department of Health for the month of March was received and filed. Following the suggestion of the Supervisor, the members of the Board decided that during the months of June, July, August and September one Town Board meeting be held on the third 'Wednesday at the usual time.
