REGULAR MEETING OF THE TOWN BOARD, TOWN OF MAMARONECK,
HELD OCTOBER 17, 1945
In the Council Room of the Weaver Street Fire House , Town of
Mamaroneck, New York.
The meeting was called to order by Supervisor Mandeville
at 8:15 P.M. (Eastern Standard Time) .
Present : Supervisor Mandeville
Councilmen Keeler, Stiner , Embury , Watson
The presence was also noted of Town Clerk Payne , Town
Attorney Delius and Accountant Finson.
The Town Clerk reported that the minutes of October 3 , 1945
were not ready for distribution.
The Supervisor requested the Town Clerk to read the communi-
cations.
A letter was received from Walter T. Brinkerhoff of 340
Weaver Street , advising that an Advertisement appeared in the Real
Estate section of last Sunday ' s New York TIMES referring to 395 Weaver
Street as a two-family dwelling. He entered a protest against this
use in Residential A district.
The Supervisor informed the members of the Board that a
similar complaint had been received from Mr. Richard M. Page and that
a reply had been sent to Mr . Page which explained that the use was
non-conforming , as it had been a two-family house before the zoning
was put into effect.
The Supervisor said that he would send a similar letter to
Mr. Brinckerhoff.
The following reports for the month of September , 1945,
were received and ordered filed Report of the Town Clerk; Report
of the Mamaroneck Health Nurses.
The Supervisor suggested that with the permission of the
members of the Board , he would like to deviate from the usual order
of business to make his reports.
He said that he had at hand a certified check from i'r,
Neal R. Andrews , payable to the Town, in the sum of ($20 ,463.38 for
the tax arrears on the properties in the Edgewater Point Section,
which tax arrears were approved for settlement at the last meeting
of the Board. The check was ordered to be turned over to Accountant
Finson for proper distribution.
The Supervisor advised that a certified check in the amount
of $7 ,000 had been received from Mr. Richard Mood. He. pointed out
that $6 ,882.04 is the face amount of all the tax liens on the pro-
perty owned by the Rockcliffe Estates.
Following discussion, it was on motion by Councilman Stiner ,
seconded by Councilman Watson , upon roll call , unanimously
RESOLVED, that the Receiver of Taxes and Assess-
ments be and he hereby is authorized , empowered
and directed to accept the sum of $6 ,882 .04 and
to sell by assignment to Ida H. Wood , 4208 Chesa-
peake St . N.W. Washington, D.C. , the face amount

of the tax liens , without interest from the date of
sale , owned by the Town of Mamaroneck on the follow-
ing described properties:

The Supervisor stated that he had at hand a check for
x,2 ,488.24 from Nick Garito, representing the face amount of the tar,
liens on property known as Block 402 , Parcel 53. He said that the
propert- is approximately 22 acres and is assessed by the Town for
$9 ,000, (Land $8,000 Supervisor also inforned
the members of the Board that this was formerly the Burton property
and that about a month ago , when he had called Yx. Burton in on another
tax matter , reference was made to this property but no action was taken.
Following discussion, it was on motion by Councilman Embury ,
seconded by Councilman Watson, upon roll call , unanimously
RESOLVED , that the Receiver of Taxes and Assess-
ments be and he hereby- is authorized , empowered
and directed to sell by assignment to Vick Garito ,
the following tar, liens on property known on the
tax assessment map of the Towm as Brock 402 ,
Parcel 53 , at the face amount of the tax liens:

The SuiDervisor stated that he had at hand a check for
$1 ,200. from Mrs. Anna R. Tower offering to buy Town-owned property
known as Block 208, Parcel 406.
Conforming with previous action on such offers of this
kind , it was on motion bit Councilman Keeler , seconded by Councilman
Stiner , upon roll call , unanimously
RESOLVED, that the following notice be published
in the Daily Times , the official neluspaper of the
Town:
ADVERTISEMENT FOR BIDS
The Town Board of the Town of Mamaroneck will
accept bids for the purchase of a parcel of property
located on Larchmont Ridge , which was acquired by the
Town in tax lien foreclosure proceedings and which is
described as follows:
Lot No. 38 on map of Larchmont Ridge , property of
Fenimore Cooper Estates , Inc . , Town of Yamaroneck,
Westchester County , New York, portion of Section
No. 4, dated January 12 , 1929 and filed in the
County Clerk' s office , Westchester County as
Map Vol. 68, page 67 which lot is also known on
the Tax Assessment Map of the Town of Mamaroneck
for the year 1938 as Section 2 , Block: 8A, Lot 38
and on the present Assessment Map as Block- 208,
Parcel 406.
The property is to be sold subject to:
Any state of facts an accurate survey or in-
spection of the premises will show;
Covenants , restrictions , easements of record and
rights of way over streets , roads , or avenues
show on filed. maps;
Rights to the natural flow of the brook, if any ,
,which may flow through the premises.
All bids must be received by the Town Clerk on Nov-
ember 13th, 1945, at the Town Clerk' s office , 158 West
Boston Post Road., in the Village and Town of Mamaroneck
from 9 A.M. to 5 P.M. and from 7:45 P.M. to 8:15 P.M
at the Council Room in the Weaver Street Fire House ,
in the Town of Mamaroneck.
All bids must be accompanied by a. certified check
for 10% of the amount bid and in the event the bid is
rejected, such check will be returned to the unsuccess-
ful bidder.
All bids should be contained in a sealed envelope
addressed to the Town Clerk, Town of Mamaroneck and should
be plainly marked "Bid for Property" .
The right to reject any or all bids is reserved by
the Town Board.

The Supervisor presented the following letter :
TOWN OF MAMARONECK WAR COUNCIL

Larchmont , N.Y.
October 15, 1945
Hon. Owen A. Mandeville
Supervisor , Town of Mamaroneck,
158 West Boston Post Road
Mamaroneck, New York.
Dear Mr. Mandeville :
Now that the wars are over , and all con-unities
throughout the nation are getting back gradually to
peacetime pursuits , there does not seem to be any ne-
cessity for continuing in eistence the Town of Liamaro-
neck War Council . All divisions or subsidiary organi-
zations either have been disbanded or are dormant , and
no occasion for holding a formal meeting of the Council
has presented itself in over a year. Therefore , as
Chairman of the Council , I take the liberty of suggesting
that the Town Board give consideration to taking such
action as may be required by the Statutes , and compatible
therewith , to dissolve the Council at an early date .

The Supervisor recalled the many services rendered the
community by the War Council and stated that the activities of the
- Council did bolster the morale of the people and helped to cause a
sense of security. He recomrended that letters be sent to Mr. Ilendes
and the members of his staff in appreciation for their valuable ser-
vices.
Following further discussion, it was on motion by Councilman
Keeler , seconded by Councilman Stiner , unanimously
RESOLVED, that the Town of Mamaroneck War Council
be dissolved and that proper notice be given to the
government authorities.
FURTHER THAT , the Town Clerk be directed to give
notice to all the branches of the local War Council
and to thank each member of the same on behalf of
the Town Board and the citizens of the community.
The Supervisor presented the following letter :

— Dear Owen:
As you know, I am not at present a property
owner in the town of Mamaroneck, and therefore not quali-
fied to continue as a member of the Zoning Board.
Please submit my resignation to the Town Board ,
and oblige.

The members of the Board recalled the many years of service
that Mr. Smith had given to the Town, as a member of the Zoning Board
of Appeals , and it was with regret that the resignation was accepted.
The Town Clerk was requested to send a letter of appreciation
on behalf of the members of the Board and the citizens of the community ,
for the fifteen years of service given by Mr. Smith , in this connection.
The Supervisor handed to each member of the Board a copy of
the 1946 budget , for their study and comments . He said that a meet-
ing should be held , according to law, between the tenth and fifteenth
of November to adopt the preliminary budget.
After discussion, it was decided to hold the next regular
meeting of the Town Board , on November 13 : at 7:30 P.M. in the Council
Room of the Fire House.
The Supervisor read a letter dated October 5, 1945, received
from James C. Harding , Commissioner of Public Works , County of West-
chester , attaching copy of a. resolution adopted by the Board of
Supervisors at their meeting on October 1st , concerning snow removal
on State Highways. A copy of the agreement for this purpose was also
attached.
It was on motion by Councilman Stiner , seconded by Council-
man Keeler , upon roll call , unanimously
RESOLVED , that Town Superintendent of Highways
A.J. Foote, be and he hereby is authorized to
sign the agreement for the removal of snow on
State Highways within the township of the Town
of Mamaroneck.
The Supervisor informed the members of the Board that pro-
vision was made for the salary of Michael Hannan, temporary fire
truck driver , up to November 1 , 1945. He asked the members of the
- Board their wishes in continuing Mr. Hannan for the balance of the
year. He pointed out that the 1946 Fire Department budget estimate
provides for an additional man. He suggested that it might be well
to have Yr. Hannan serve out the remainder of this year , with funds
being transferred to cover this expenditure.
It was on motion by Councilman Embury , seconded by Council-
man Stiner , upon roll call , unanimously
RESOLVED, that temporary fire truck driver ,
Michael Hannan, be and he hereby is appointed
to fill out the months of November and December ,
1945, in the said position.
FURTHER, that the Supervisor and the Comptroller
be and they hereby are authorized to transfer funds
within the Fire Department budget for the expenditure
necessary to pay the salary for this position for the
term above mentioned.
The Supervisor called to the attention of the members of
the Board the need for the appointment of two men in the Department
of Sanitation.
Following some discussion., it was on motion by Councilman
Stiner , seconded by Councilman Embury , upon roll call , unanimously
RESOLVED, that the following be appointed to the
position of sanitation man, to serve at the pleasure
of the Town Board , for a salary at the rate of $160.
per month:

The Supervisor suggested that the meeting proceed with
the reports of committees .
Councilman Watson reported that he had no apportionment
requests from the Assessor.
On Incineration, he reported that as a result of the
work that has been going on at the Plant , and with the services of
Consulting Engineer Taylor , there has now been drafted a set of in-
structions for the operation and maintenance of the Plant. He added
that as far as he knew, this was the first time that instructions
had been prepared.. The set of rules and regulations are to be
submitted to the Incinerator Commission for approval.
The matter of the allocation of the pumping costs of the
Westchester Joint Water Works No. 1 was brought up by Councilman
Watson who said that he had made an investigation of the prorosed
distribution and had gone over the matter with Mr. Thrasher , General
Superintendent of the Water Works . He said that he would make a re-
port at a later meeting.
Councilman Embury reported that a meeting of the Park De-
partment was held last evening and that Mr. Julian Cargill , who has
taken over the duties of the Honor Roll Committee , commented very
well upon the beautiful shape Mr. Brown had left the records. Be
said that there is room for 40 names on the Honor Roll and that in
this connection the Park Department is now working on details to
take care of future needs.
Councilman Stiner reported that since the last meeting
he has been around with Town Engineer Foote on various inspections.
He said that collection service in connection with garbage is in-
proving very rapidly.
Councilman Kepler stated that he had at hand a number of
bills from the Fire Department totaling $892.01 , which he had checked
and recommended their approval.
The members of the Town Board sitting as the Board of Fire
Commissioners considered the claims , and it was on motion by Council-
man Keeler , seconded by Councilman Embury , upon roll call , unanimously
RESOLVED, that the following described claims be and
they hereby are approved , and that the Supervisor and
Comptroller be and they hereby are authorized to pay
sane out of the budget for the Fire Department,

The Town Attorney reported that he had negotiated the
terns of a contract for the sale of eight ( 8) parcels of property
for which a bid was received from Westchester Land & Homes Company ,
at the last meeting and presented to the Board a scheme for incor-
porating certain release clauses from the mortgage for 60% of the
purchase price , which was approved by the Board..
On motion by Councilman Embury , seconded by Councilman
Watson, it eras , upon roll call , unanimously
RESOLVED, that the contract as negotiated by the
Town Attorney is hereby approved and the Supervisor
authorized to sign the same , and that the Town At-
torney proceed to take all steps necessary to close
title in accordance with the terms of the contract ,
the same to be upon the following terms:
$30,000 for all eight parcels: 40%,or $12 ,000
in cash of which $3 ,000 had been received as de-
posit . Balance of $18 ,000 on a first purchase
money mortgage payable for three years with in-
terest at 6%, and with the following release
clauses:
Parcel 1 - $800. per acre , or any fraction thereof,
except such part of this parcel as is included in
Lots 144, 144A, 159 , 160 , 162 , 163 , 164 on Register ' s
Office Map No. 3762 , for which $1 ,000 an acre , or
any fraction thereof shall be paid for release.
Parcel 2 - $800. per acre , or any fraction thereof,
Parcel 3 & 4 - $1 ,000 per acre , or any fraction thereof.
Parcel 5 - $800. per acre , or any fraction thereof.
Parcel 6 and 8 - ° 500, per acre , or any fraction thereof.
— Parcel 7 - $600. per acre , or any fraction thereof.
The Town Attorney recommended the following:
WHEREAS , heretofore a writ of certiori was obtained
by JOHNFTHEL REALTY CORPORATION, owner of property
described on the assessment map and assessment roll
of the Town of Mamaroneck as Block 315, Parcel 1;
Block 320 , Parcel 1; Block 325, Parcel 21 , Block 804,
Parcel 605; Block 326 , Parcel 1; Block 346 , Par-
cel 1 ; Block 802 , Parcel 500; Block, 803 , Parcel 159:
and Block 304, Pa cel 1 , to review the assessments for
the year 1945 (tax of 1946) ; and
WHEREAS , it is recommended to this Board that the pro-
ceedings be settled and discontinued upon the reduction
of the assessment ,
NOW , THEREFORE , BE IT
RESOLVED , that the assessment for the year 1945 (tax
of 1946) upon property owned by Johnethel Realty Cor-
poration, be reduced as follows:

provided the certiorari proceeding , now pending in
the name of Johnethel Realty Corporation, for the
year 1945 (taxes of 1946 be discontinued without
costs against the Town of Mamaroneck.
FURTHER RFSOLVED, that the Town Attorney is hereby
authorized and directed to sign the necessary sti-
pulation to obtain an order of the Supreme Court
providing for such reduction.
The foregoing resolution eras , upon roll call , adopted by
the following vote:
