REGULAR MEETING OF THE TOWN BOARD , TOWN OF MAMARONECK,
HELD SEPTEMBER 19 , 1945
In the Councilman Room of the weaver Street Fire House , Town
of Mamaroneck, New York.
The meeting was called to order by Supervisor Mandeville
at 8:15 P.M. (Eastern Peace Time) .
Present : Supervisor Mandeville
Councilmen Keeler , Stiner , Embury , Watson
The presence was also noted of Town Clerk Payne , Town
Attorney Delius , Comptroller. Orsino , Assessor Smith , and Accountant
Finson.
The Supervisor asked the Town Clerk to proceed with the
reading of the communications.
The Town Clerk informed the members of the Board that
the minutes of the meeting of September 5, 1945 were typed but not
checked. He said that they would be sent out in the mail within
the next few days.
A letter dated September 18 , 1945, was received. from
Chief of Police Paul A. Yerick, advising that temporary Patrolman
Louis Combree had handed in his resignation to take effect Sep-
tember 26 , 1945.
On motion duly made and seconded the resignation was
accepted.
A letter dated September 7, 1945, was received from The
Larchmont Visiting Nurse Association, Inc . , inviting the members
of the Town Board to the inspection of their offices , and to attend
the tea party to be given on Saturday , September 22 , from three to
five o ' clock P.M .
The Supervisor asked the members to make note of the
date and time if they wished to attend.
The Town Clerk was requested to advise the Association
that the letter had been presented to the Town Board.
A letter dated September 7 , 1945, was received from the
County Transportation Co. Inc . , with a statement attached , showing
a report of the receipts for the six-month period ending June 1945,
for the operation of their buses within the Town of Mamaroneck.
A letter dated September 6 , 1945, was received from
Village Clerk Margaret E. Lord , With a certified copy of a re-
solution attached , which snowed as follows:
"At a meeting of the Board of Trustees of the Village of
Larchmont , New York, held at the Municipal Building in
said Village on the 4th day of September , 1945. at 8 P.M.

the following resolution was duly moved, seconded and
unanimously carried:
RESOLVED , that the deed submitted by the Town of
Mamaroneck covering property known as Block 601 , Parcel
671 , which the Town is conveying to the Village of Larch-
mont in lieu of all open taxes and tax liens , is hereby
accepted; and
FURTHER RESOLVED , that the following Village taxes
due on said Parcel 671 in Block 601 are hereby authorized
to be cancelled as of this date:

The following reports for the month of August , 1945,
were received and ordered filed: Report of the Town Clerk; Re-
port of the Building Inspector ; Report of the Plumbing Inspector ;
Report of the Supervisor; Analysis of Estimated Revenues; Summary
of Receipts and Disbursements; Analysis of Budget Appropriations
and Expenditures ; List of Claims audited and paid by the Comptroller
from September 5 to September 19 , 1945.
The Town Clerk reported that the Public Official Bond
in the name of the Supervisor covering highway moneys had been re-
ceived. It was referred to Councilman Keeler , the head of the com-
mittee on Insurance.
The Town Clerk reported that he had received from the
Town Attorney ' s office , two proposed letters , which , if approved ,
were to be sent to the members of the Zoning Board of Appeals who
are inactive. The letters were handed to the Supervisor to read.
--- The Supervisor discussed the letters with the members
of the Board, and it was decided to lay the matter over until the
Town Attorney arrived.
The Supervisor asked if there was any one present who
wished to address the Board.
Mr. Barney Epstein, Real Estate Broker , stated that
he had two matters to discuss : one was in connection with the
offer by a client of his office for a vacant plot adjoining the
Property of Mr. Feterson located on Orienta Avenue. (Check in the
sum of $100. as evidence of good faith was attached to the bid) .
In discussing this matter , it was decided that inasmuch as the plot
in question was part of a larger parcel that the offer should be
rejected because the Board felt that the entire parcel should be
sold as one .
Mr. Epstein told the Board that if they were not receptive
to this bid that he had been authorized by his client to negotiate
for the entire parcel , for which he offered the sum of $4,000.
After discussion, the Board decided to advertise the
property , and on motion by Councilman Keeler , seconded by Council-
man Stiner , the following notice was authorized for publication in
the Daily Times , the official newspaper of the Town:
ADVERTISEMENT FOR BIDS
The Town Board of the Town of Mamaroneck will
accept bids for the purchase of a parcel of property
located in the Village and Town of Mamaroneck, acquired
in tax lien foreclosure proceedings.

Following is the description of the said parcel:
The plot or parcel of land consisting of Lots Nos. 29 ,
30 , 31 , 35 and 36 as shown on a map entitled "Map of Eagle
Hommocks , Town and Village of Ilemaroneck, Westchester County,
New York,j1 made by A.J. Foote Engineering Corporation,
July 10th , 1929 and filed in the office of the Clerk of
the County of Westchester , Division of Land Records ,
March 15th, 1930 as Map No. 3571 , and also known and de-
signated on the Tax Assessment Map of the Town of Mamaroneck
as Block 934, Parcel 29.
The property is offered subject to any state of facts
an inspection or accurate survey may show, covenants and
restrictions contained in former deeds of record , easement
rights of the Westchester Lighting Company and sewer ease-
ments granted to the Village of Mamaroneck under instrument
recorded in Liber 3032 of Conveyances , page 424 on May 7th ,
1930 in the office of the Clerk of the County of Westchester ,
Division of Land Records and terms of a certain agreement for
the erection of a dam or dyke recorded in Liber 2799 of Con-
veyances , page 410 , in the office of the Clerk of the County
of Westchester , Division of Land Records.
All bids must be accompanied by a certified check for
10% of the amount of the bid and in the event the bid is
rejected , such check will be returned to the unsuccessful
bidder.
All bids should be contained in an envelope addressed
to the Town Clerk of the Town of Mamaroneck and should be
plainly marked "Bid for Property. "
Bids must be received by the Town Clerk on or before
5 P.M. on October 3rd, 1945, at the Town Clerk' s office ,
-- 158 West Boston Post Road in the Village and Town of Mamaro-
neck and thereafter , from 7:45 P.Iai. until 8:15 P.N. on
October 3rd , 1945, at the Council Room in the Weaver Street
Fire House , in the Town of Mamaroneck.
The rights to reject any or all bids is reserved by
the Town Board.

The other matter , Mr. Epstein said , was in connection
with the advertisement which appeared in the Daily Times that bids
would be received for eight (8) parcels of land which comprises 53.61
acres. He said that this had come to his attention within the last
few days and that while he has a client who is interested in the
property he has had no time to complete the details necessary to
present a bid. He explained that the land must be studied by his
client ' s engineer and that many other things , such as type and price
of dwellings must be considered. He said that he is operating a
one'-man real estate office and that it has been impossible for him
to proceed quickly after learning of the offer to sell. He said
that he wa tnot appearing to cause any upset in the procedure of
the Board hat he felt that he should make it known to the members
of the Board that he has a client who is very much interested in
the property and that he would like to have whatever consideration
that is possible under the circumstances.
The Supervisor asked Mr. Alan Carnoy , who was present ,
what he thought of the request , since he was an interested bidder
for the same property.
Mr. Ca.rnoy did not make a definite reply but said that
he thought the Town Board should decide the matter.
Following further discussion. , it was decided to re-ad-
vertise the property , the bids for which were to be received until
8: 15 P.M. , October 3 , 1945, in the Council Room of the Weaver Street
Fire House.
Upon motion by Councilman Keeler , seconded by Councilman
Embury , the following notice was authorized for publication in the
Daily Times:
ADVERTISEMENT FOR BIDS
The Town Board of the Town of Mamaroneck will accept
bids for the purchase of eight (8) parcels of property
located in Larchmont Ridge and Fenimore Cooper Park in
the Unincorporated section of the Town and the Village
of Mamaroneck, acauired in tax lien foreclosure pro-
ceedings.
The parcels are generaly described in this notice
and a map showing their location is on file in the office
of the Town Clerk together with a more detailed description
which has referenda to filed maps and record title and
these may be examined between the hours of 9 A.M. and 5 P.1.4.
any day except Saturday at his office , 158 West Boston Post
Road , Village of Mamaroneck. Bids must be received by the
Town Clerk on or before 5 P.M. October '3, 1945, at the Town
Clerk' s office , 158 West Boston Post Road in the Village
and Town of Mamaroneck, and thereafter from 7:45 P.M.
until 8: 15 P.M. on October 3 , 1945, at the Council Room
in the Weaver Street Fire House , in the Town of 1amaroneck.
Following is the general description of the eight (8)
-- parcels:
PARCEL 1. A plot consisting of approximately 18.67
acres and lying generally along the southwesterly side of
Fenimore Road and which is described on the present tax
assessment map as Block 225, Parcel 846; Block 209 , Par-
cel 1; Block 203 , Parcel 173•
PARCEL 2. A plot consisting of 12.01 acres lying
generally southwest of Winged Foot Drive and between Ormand
Place and the proposed Cross-County Parkway and known on
the tax assessment map as Block 209 , Parcel 300; Block
Parcel 260; Block 209 , Parcel 47.
PARCEL 3. A plot consisting of 1.27 acres lying
generally on the southerly side of Fenimore Road and known
on the tax assessment map as Block 204, Parcel 180.
PARCEL 4. A plot consisting of 1. 55 acres lying on
the southerly side of Fenimore Road and known on the tax
assessment map. as Block 204, Parcel 156.
PARCEL 5. A plot consisting of approximately 7.23
acres lying northeasterly of Winged Foot Drive and north-
westerly of the proposed Cross-County Parkway and known on
the tax assessment map as Block 204 , Parcel 247.
PARCEL 6. A plot consisting of approximately 6. 76
acres bordering on the southerly side of Fenimore Road and
known on the tax assessment map as Block 206 , Parcel 97.

PARCEL 7. A plot consisting of approximately 5.74
acres bordering on the southerly side of Fenimore Road and
known on the tax assessment map as Block 206 , Parcel 208.
PARCEL 8. A plot consisting of approximately 1.60
acres lying on the southerly side of Fenimore Road and easterly
side of Grand Street and known on the tax assessment map as
Block 801 , Parcel 512. This parcel is in the Village of
Mamaroneck.
The property is offered subject to any state of facts
an inspection or accurate survey may show, covenants and re-
strictions of record , easements of record and rights of way
over streets , roads or avenues shown on filed maps and rights
to the natural flow; of the brood, where it flows through the
premises and premises adjoining.
Only bids made for the entire eight (8) pardels will be
considered.
All bids must be accompanied by a certified check for
10% of the amount of the bid and in the event the bid is re-
jected , such check will be returned to the unsuccessful bidder.
All bids should be contained in an envelope addressed
to the Town Clerk of the Town of Mamaroneck and should be
plainly marked , "Bid For Property. "
The right to reject any or all bids is reserved by the
Town Board.

The Supervisor suggested that the meeting proceed with
the reports of committees.
Councilman Watson presented three petitions received from
the Assessor for the correction of the assessment roll so as to per-
mit the apportionment of taxes.
On motion by Councilman Watson, seconded by Councilman
Embury, the following resolution was unanimously adopted:
WHEREAS , the Assessor has presented petitions for
the correction of the assessment roll for certain
years , pursuant to the provisions of Section 33 of
Chapter 105 of the Laws of 1916 , as amended , known
as the Westchester County Tax Act; and
WHEREAS , after due consideration this Board finds
it desirable to grant said petitions for the cor-
rection of said assessment roll;
NOW , THEREFORE , BE IT
RESOLVED , that the assessment roll of 1944, school
tax of 1945, and the assessment roll of 1945, taxes
of 1946 , which show the property now.* appearing on
the roll as follows:

Reporting on the Incinerator , Councilman Matson stated
that Consulting Engineer Taylor had suggested that the Plant be
shut down for two days in order to make a thorough examination.
He said that actually the Plant was shut down for three days and
the result was that considerable repairs were found necessary. He
said that many repairs were made and as a result of this an improve-
ment was seen in the operating procedure. He said that Mr . Foote
reported that after the severe storm on Monday and Tuesday , Sept. 17
and 18, fourteen and a fraction tons of garbage was burned in four
unit hours. He pointed out that the rated capacity is 22 tons per
unit hour , so that in view of the improvements made the operation
is a little above the rated capacity. He added that there is plenty
of work yet to be done.

Councilman Watson stated that his duties as head of the
committee on Recreation were not very clear to him. He said that
if there was no recreation program by the Town, there is a program
under the school system. He said that he has been looking for ideas
and would welcome suggestions. He said that he had one thought in
mind that may work out well. He proposed that the Town have a
catalogue printed calling attention to the residents of the facilities
available for recreation. He referred to the golf courses , Saxon
moods Park, the outdoor skating , etc.
The Supervisor accepted the proposal as a grand idea and
all of the members of the Board agreed.
It was decided that Councilman Vatson be authorized to
accumulate the information and submit a sample of the catalogue
for consideration of the Board as to the expenditure necessary.
Councilman Embury stated that he had nothing to report
for his committees.
Councilman Stiner reported that he had a Personnel matter,
He read the following letter:

Dear Mr. Smith:
Mrs. Frances Riley has been a patient of mine
for many years. She has been chronically ill for
some time and all efforts at treatment have given
little or no results because it has been necessary
for her tb keep on working instead of getting the
rest that is vitally important.
May I request that she be granted a leave of
two to three months so that she can regain her health.

Councilman Stiner stated that Mrs. Frances Riley is a very
good worker and has been doing a fine job , despite her illness . He
recommended a leave of absence for two months with pay. He said that
she has been doing her work and doing it wonderfully well. He said
that this will not involve a replacement as there is the necessary
help in the office at the present time.
Following discussion, it was on motion by Councilman Stiner ,
seconded by Councilman Embury , upon roll call , unanimously
RESOLVED , that the Town Board does hereby grant
Mrs. Frances Riley , a vacation period of five weeks
with an additional three weeks vacation time as
accumulated to her benefit , the full period not
to extend beyond December 1 , 1945.
Councilman Stiner read a letter handed to him by Mr. Foote ,
concerning a cave-in in a driveway off of West Drive which serves
three houses . The letter was referred to the Town Attorney for reply.
For the Board of Review, Councilman Stiner reported that
the 1946 tax assessment roll for the Town has been by $719 ,493.00 ,
which breakdown is as follows :

The Supervisor stated that he had at hand a check for
$220.63 received from Pars. Catherine Biondo, to settle tax arrears
on property known as Block 603 , Parcel 481 , which represents the
face amount of the tax liens.
Following discussion, it was on motion by Councilman
Stiner , seconded by Councilman Keeler , upon roll call , unanimously
RESOLVED, that the Receiver of Taxes and Assess-
ments be and he hereby is authorized, empowered
and directed to accept payment of the following
taxes on property known as Block 603 , Parcel 481 ,
at the face amount of the liens:

The Supervisor stated that he had at hand a check for
$241.91 received from 11r. George PT. Burton, Jr . , to settle certain
tax liens on property known as Block 123 , Parcel 271 , with interest
at six per cent from the date of sale.
Following discussion, it was on motion by Councilman Embury,
seconded by Councilman Stiner , upon roll call, unanimously
RESOLVED, that the Receiver of Taxes and Assess-
ments be and he hereby is authorized, empowered
and directed to accept payment from Mr. George N.
Burton, Jr. for the following taxes on property
known as Block 123 , Parcel 271 , on the tax assess-
ment map of the Town, at the face amount of the
liens plus interest at the rate of six, per cent
from the date of sale :

The Supervisor stated that he had at hand a check for
$1 ,200. offered by Mr. Frank Guadagnolo for the settlement of cer-
tain taxes on Block 126 , Parcel 11. The Supervisor said he would
not recommend this offer because it did not include the penalties
which amount to $166.95 additional.
On motion by Councilman Embury , seconded by Councilman
Watson, it was decided to reject the offer with further recommendation
that if Mr. Guadagnolo would submit a check for $1 ,366.95, it would
be reconsidered at the next meeting.
The Supervisor recommended the following , which was on
motion by Councilman Stiner , seconded by Councilman Keeler , upon
roll call , unanimously

FURTHER RESOLVED, that the Compensation Plan of the
Town of Mamaroneck for the above emp;ogees be increased

The Supervisor informed the members of the Board that
during this past summer the shade trees on the highways throughout
the Town have been trimmed and when the bill for same was finally
presented it was found to be more than expected. That the full
amount of the claim could not be paid from this year ' s budget and
an item should be' included- in next year ' s budget to take care of the
unpaid balance.
The Board decided in favor of this.
Councilman Keeler reported that at the last meeting the
Town Board discussed the question of insurance in connection with
the Guadagnolo property for which a 15-day binder was submitted to
him and which he approved. He presented the binder marked approved.
Councilman Keeler reported that he had at hand a number of
bills from the Fire Department totaling $1 ,002.99 , which he had
check. He recommended the approval of the bills as presented.
The members of the Town Board sitting as the Board of
Fire Commissioners considered the claims , and it was on motion by
Councilman Keeler, seconded by Councilman Stiner , upon roll call ,
unanimously
RESOLVED, that the following described claims be
and they hereby are approved , and that the Supervisor
and Comptroller be and they hereby are authorized to
pay same out of the budget for the Fire Department :

Councilman Keeler said that he had another invoice at hand
which had been presented to him later , which he had checked and re-
commended for approval.
Councilman Keeler offered the following , which was seconded
by Councilman Stiner , and upon roll call , unanimously
RESOLVED , that the following described claim be
and it hereby is approved, and that the Supervisor
and Comptroller be and they hereby are authorized
— to pay same out of the budget for the Fire Depart-
ment-

Councilman Keeler reported that he had examined the Super-
visor ' s bond which had been handed to him earlier in the meeting and
approved of same.
On motion by Councilman Keeler , seconded by Councilman
Stiner , it was , upon roll call , unanimously
RESOLVED, that the following bond , required by the
Highway Law, is hereby approved-
Bond , Owen A. Mandeville , as Supervisor of the Town
of Mamaroneck, conditioned for. the faithful disburse-
ment and safe keeping and accounting of highway funds
received by him as such Supervisor during the calendar
year 1945, pursuant to the provisions of Section 279
and Section 282 of the Highway Law, upon which the
National Surety Corporation is surety , in the penal
sum of $951.38.
The Supervisor referred to the proposed letters to the in-
active members of the Zoning Board of Appeals and discussed the con-
tents with Mr. Delius.
Following consideration by the members of the Board , it
was decided that the Town Attorney be authorized to mail same.
