HomeMy WebLinkAbout1945_06_06 Town Board Minutes 2d REGULAR REETING OF THE TOWN BOARD, TOWN OF MAMARONECK, HELD JUNE 6, 1945 In the Council Room of the Weaver Street Fire House , Town of Mamaroneck, New York. The meeting was called to order by Supervisor Mandeville at 8:15 P.M. (Eastern War Time) . Present: Supervisor Mandeville Councilmen Keeler, Stiner, Embury, 'Watson The presence was also noted of Town Clerk Payne , Town Attorney Delius, Assessor Smith, Comptroller Orsino, and Accountant Finson. The Supervisor asked if there was any one present who wished to address the Board. Mr. Nani , of Nani's Restaurant , appeared and requested permission to have dancing one night at his restaurant on the Boston Post Road. He said that a relative was being married and the wedding party would be held at his place. The Supervisor informed Par. Nani that the enforcement of the regulations of the ordinances of the Town is in the hands of the Police Department and that his request should be filed at the Police Headquarters. Mr. Emil Zvirin of Boehm & Co. , Realtors, appeared and stated that his client , Mr. Frank Turco, wished to offer $3 ,500 for - the purchase of Block 133 , Parcels 890 and 901. He said that $2,000 of the amount would be in cash and the balance to be paid over a period of two years in two instalments. There was some discussion during which members of the Board stated that they had viewed the property. The Town Clerk called to the attention of the Board that following the last meeting Mr. Frank Guadagnolo had inquired about the offer which he had filed and that he was told that the obligations to the Town on this property is around $8,000 and that the Town ex- pected to get a price somewhere near this amount. The Town Clerk said that he believed that Mr. Guadagnolo would submit another offer if he thought that the sale would be considered for a price near to the figure offered by Mr. Zvirin's client. Following further discussion it was decided to advertise the property for sale so that bids may be received at the next meet- ing on June 20 , 1945. The Town Attorney was requested to prepare the advertisement. Mr. Henry M. Leigh, of 67 Myrtle Boulevard, appeared and said that he is interested in purchasing the vacant lot adjoining his property at the rear and running to Laurel Avenue , it being known as Block 124, Parcel 398. There being no details at hand, the Supervisor suggested that Mr. Leigh present a bid at the next meeting. The Supervisor suggested that the meeting proceed with the regular order of business. The minutes of the meeting of May 16, 1945, were approved as presented. f The Town Clerk presented a cony of the advertisement which appeared in the Daily Times on June 1 , 1945 listing the highway equip- ment which was being offered for sale. He informed the Board that there were four sealed bids at hand. .The Supervisor directed the Town Clerk to open the bids which showed as follows: Name Fordson Tractor 1936 Chevrolet 1934 Ford ............. .Dump Truck Sedan H.T. Flinn Motor Co. $300. for the three Units Adam Papuga 176.00 - - Donohue Garage 185.00 260.00 77.50 Devlin Lumber & Supply Co. 255.00 310.00 110.00 Following some discussion, it was on motion by Councilman Stiner , seconded by Councilman Keeler, upon roll call , unanimously RESOLVED, that the Superintendent of Highways be and he hereby is authorized to sell to Devlin Lumber and Supply Co. the highway equip- ment described belowc One Fordson Tractor-Snow Plow & Grass Cutter - $255.00 One 1936 Chevrolet Dump Truck 310.00 One 1934 Ford Sedan 110.00 A letter dated June 4, 1945, was received from the Town of Mamaroneck Police Department signed by Chief Yerick, stating that a special order had been received on May 14, 1945 from the office of Civilian Protection in white Plains giving permission to dismiss Air Raid Protective Services as of May 15, 1945. The Chief advised that in accordance with this order he has dismissed all the air raid pro- tective services and that all telephones have been removed from the Control Room and that the Control Room has been dismantled. He ex- plained other details which had been taken care of. The members of the Board expressed their appreciation for all of the services received through the Civilian Protection Organization and the Town Clerk was requested to acknowledge the letter from the Police Chief. A letter dated June 5, 1945, was received from the Town of Mamaroneck Police Department signed by Chief Yerick in which he stated that during the past winter water entered the fuel oil tank at Police Headquarters on numerous occasions. The leaks were due to the age of the tank and that bids had been received for the installation of a new tank. The letter was handed by the Town Clerk to Councilman Embury, head of the committee on Police matters. Councilman Embury read the bids which showed as follows: UO.-Gallon Tank 1000-Gallon .Tank Chatsworth oil & Heating Co. $280.00 $305.00 Mitchel Oil Corporation 180.00 226.00 Following some discussion, it was on motion by Councilman Embury, seconded by Councilman Stiner, upon roll call , unanimously RESOLVED, that Police Chief Yerick of the Town of Mamaroneck Police Department be and he hereby bs is authorized to award the contract for the installation of a 1 900-gallon fuel tank to the lowest bidder , Mitchel Oil Corporation, for the sum of $226.00. Work to be done as specified in the bid and payment to be made out of the Police Department budget for the year 1945. A letter dated May 18, 1945, was received from Mamaroneck Lodge No. 1457, B.P.O. Elks , signed by B.J. Santoro, Chairman, Flag Day Committee, inviting members of the Town Board to participate in the Flag Day services on June 14, 1945 at 6:30 P.M. The Supervisor asked the members of the Board to take note of the date and hour of the services. A petition dated May 18, 1945, was received from the Yonkers Bus , Inc. , 128 Saw Mill River Road , Yonkers, N.Y. for permission to operate bus service during the summer season on west Post Road and East Post Road , in the Town of Mamaroneck on a route between the City of New Rochelle and Playland. The petition stated that the service is to be maintained for the purpose of receiving and dis- charging passengers only at Playland and in the City of New Rochelle and that no passengers will be received or discharged within the Town of Mamaroneck. Following discussion the members of the Board decided to hold a public hearing on the matter at the next Town Board meeting, and it was upon motion by Councilman Stiner, seconded by Councilman Embury, upon roll call , unanimously RESOLVED, that the following notice be published in accordance with the law, in the Daily Times, the official newspaper of the Town: NOTICE OF PUBLIC HEARING TAKE. NOTICE that a public hearing will be held by the Town Board of the Town of Mamaroneck on the 20th day of June , 1945, at 8:15 o' clock in the evening of that day, in the Council Room of the weaver Street Fire House , weaver Street, Town of Mamaroneck, New York, for the purpose of considering the ap- plication of YONKERS BITS , INC. , for the consent of the Town of Mamaroneck under the provisions of Sections 66 and 67 of the Transportation Corporations Law of the State of New York for the operation of motor buses or omnibuses for the transportaion of passengers, and property carried by said passengers, for hire , in, upon, along and across certain streets , avenues and highways in the Town of Mamaroneck as follows: BEGINNING at the westerly boundary line of the Town of Mamaroneck and the easterly boundary line of the City of New Rochelle on the highway known as the Boston Post Road, thence easterly on said Boston Post Road approximately 1,300 feet to the westerly boundary line of the Village of Larchmont (at or about Deane Place) . And returning over the same streets ,avenues and highways to the point or place of beginning. BEGINNING at the easterly boundary line of the Village of Larchmont on the highway known as the Boston Post Road, at or near Nassau Road, thence easterly approximately 2,690 feet along the said Boston Post Road to the westerly boundary line of the Village of Mamaroneck. G., R TAKE FURTHER NOTICE that the purpose of said public hearing is to consider the granting of such consent for the use of the above described portions of streets or highways in the Town of Mamaroneck to YONKERS BUS , INC. , and that at said public hearing all persons interested will be given an opportunity to be heard, this notice being given pursuant to Section 64, Paragraph 79 of Chapter 62 of the Consolidated Laws, known as the Town Law, and Section 66 and 67 of Chap- ter 63 of the Consolidated Laws, known as the Transportation Corporations Law of the State of New York. PAYNE, Town Clerk The following reports for the month of May, 1945, were re- ceived and ordered filed: Report of the Receiver of Taxes and Assess- ments; Report of the Building Inspector; Report of the Plumbing In- spector; Report of the Mamaroneck Health Center. The Supervisor suggested that the meeting proceed with the reports of committees. Councilman Watson reported that he had spent some time in the Town Offices since the last meeting and endeavored to get a little acquainted with the various Departments. Councilman Embury stated that at the last meeting of the Park Department it was reported that there now appears 1,314 names on the Honor Roll - 742 from the unincorporated section, and 572 from the Village , with 31 Gold Stars and that there is room for 122 names. He said that the Park Department is very anxious to economize and that Mr. Brown , who is in charge of the Honor Roll , suggested that by re- arranging the names making a solid block instead of leaving spaces after each letter for additions, that it is possible that the present structure will take care of all of the additional names by placing the added ones at the end of the list. He pointed out that at the present rate of the draft there is enough space for at least two years. He said that the expenditures for the Park Department were slightly less than for the same four months' period last year. Referring to the plans submitted in accordance with the sketches made by Mr. Otto Eggers, Architect, for a permanent post war memorial, Councilman Embury explained that the Park Department feels it does not want to do the new work at the present time. He stated that the questioh left for consideration by the Town Board is whether or not it will want to do something on this matter in the near future. The Supervisor suggested that it might be well for Council- man Embury to make a recommendation at the next Board meeting as the Town Board is willing to carry out the wishes of the Park Department. -- He explained that plans are already under way to take care of the expenditures. That the amount could be included in the Budget for two years. The Supervisor reported that he had at hand an offer of $500. from Mr. Harry T. Flinn for the purchase of property known as Block 111 , Parcel 89, on which the Town has an easement. He said that in his opinion the offer was too low. In view of the fact that we are going to offer for sale , through advertising in the local paper, that in his opinion we should advertise this parcel along with another parcel on which he received an offer. The Supervisor stated that he had received an offer from Mrs. Thomas Doyle in the amount of $200 to purchase the lot adjoin- ing 69 Myrtle Boulevard together with the lot next to it in the east. He suggested that inasmuch as Mr. Leigh had appeared earlier in the meeting and was interested in one of these lots which is in the rear of his property that this should be included in the adver- tisement. It was agreed by the members of the Board that this be done. The Supervisor reported that on March 28 , 1945, the Town Board authorized the acceptance of the face amount of the taxes on property known as Block 126 , Parcel 427, from Mr. Euclide Brondoli. He said that he had at hand a check for $121.03 to pay additional tax arrears on the same property. On motion by Councilman Stiner , seconded by Councilman Keeler, it was , upon roll call, unanimously RESOLVED, that the Receiver of Taxes and Assessments be and he hereby is authorized, empowered and directed to accept payment of taxes for the following years on the following described property, the liens for which are held by the Town in the face amount of the taxes: Block 126. On motion by Councilman Stiner, seconded by Councilman Keeler, it was , upon roll call , unanimously RESOLVED, that the Receiver of Taxes and Assessments be and he hereby is authorized, empowered and directed to accept the sum of $255.12, in payment of the follow- ing tax liens on Block 829, Parcel 18, from Pars. Also, a certified copy of the resolution adopted by the Village accepting the offer of E. Leslie Goodwin, in the amount of $10,000, subject to the approval of the Town Board. Following discussion, it was on motion by Councilman Keeler , seconded by Councilman Stiner:, upon roll call , unanimously resolved WHEREAS , the Village of Mamaroneck has heretofore acquired by deed in lieu of foreclosure , property known as Section 9, Block 77, Lots 10 to 16 in- clusive , on the Tax Assessment Map of the Village of Mamaroneck; and WHEREAS, the Town of Mamaroneck owns certain tax liens upon the same property which is known upon the tax assessment map of the Town of Mamaroneck as Block 929, Parcel 51 , representing arrears of taxes due it which were heretofore levied against said property; and WHEREAS , the Village of Mamaroneck by resolution duly adopted May 28, 1945, accepted an offer from E. Leslie Goodwin, for the purchase of the property in the amount of $10,000, which acceptance , however, is conditioned upon similar action being taken by the Town Board of the Town of Mamaroneck; and WHEREAS , this Board considers it to the best in- terest of the Town of Mamaroneck to approve such offer and to authorize the sale to the end that the property may be sold free and clear of all taxes and the proceeds of sale , if any divided, NOW, THEREFORE , BE IT RESOLVED, that the Town Board of the Town of Mamaroneck agrees that property known as Section 9, Block 77, Lots 10 to 16 inclusive , on the tax assess- ment map of the Village of Mamaroneck, and known upon the tax assessment map of the Town of Mamaroneck as Block 929, Parcel 51 , be sold for $10,000. FURTHER RESOLVED, that the net proceeds of such sale shall be divided between the Town of Mamaroneck and the Village of Mamaroneck proportionately to the amount due each as of the date of such sale. The Supervisor stated that in accordance with the approval given by letter by each member of the Council', on the sale of the tax liens on Block 962 , Parcel 47, he wished to recommend a formal resolution. It was on motion by Councilman Embury, seconded by Councilman Stiner , upon roll call, unanimously RESOLVED, that the Receiver of Taxes and Assessments be and he hereby is authorized, empowered and directed to accept the sum of $1 ,933.32 , in payment of the following tax liens on Block 962, Parcel 47, from Donald Fa Tripp: Sale Year Tax Year Total Tax Lien 1942 1941 $ 270.38 1943 1942 613.78 1944 1943 513.69 1945 1944 IaL4Z $1 ,933.32 The Supervisor requested authorization to write off certain amounts which the Town has on deposit in the closed First National Bank in Mamaroneck. On motion by Councilman Stirrer , seconded by Councilman Watson, it was , upon roll call , unanimously resolved: WHEREAS , a balance of $8,993.90 heretofore de- posited in the First National Bank in Mamaroneck, remains as a credit upon the books of the Town of Mamaroneck, although the said First National Bank in Mamaroneck has been fully liquidated by the Comptroller of the Currency, and no further dividends are payable , NOW, THEREFORE , BE IT RESOLVED, that the Supervisor is hereby authorized to charge off from his accounts , the balance of $8,993.90 deposited in the First National Bank in Mamaroneck. FURTHER RESOLVED, that this resolution is adopted subject to approval of the State Department of Audit and Control , as provided in Chapter 275 of the Laws of 1945. The Supervisor recommended the following resolution, which was on motion by Councilman Stiner, seconded by Councilman Embury, upon roll call, unanimously adopted: RESOLUTION AUTHORIZING THE ISSUANCE OF NOT MORE THAN $104,000. TAX LIEN CERTIFICATES OF INDEBTEDNESS OF THE TOWN OF MAMARONECK, IN THE COUNTY OF WESTCHESTER, NEW YORK. RESOLVED BY THE TOWN BOARD OF THE TOWN OF MAMARONECK, IN THE COUNTY OF WFSTCHESTER, NEW YORK, as follows: Section 1. For the purposes authorized by law, the Supervisor is hereby authorized to borrow an amount not exceeding $104,000. and to issue Certificates of indebtedness of the Town therefor against transfers of tax liens owned by the Town not otherwise pledged, pursuant to the Westchester County Tax Law, consituting Chapter 105 of the Laws of 1916 , as amended. Each of said Certificates of Indebtedness shall be designated "Tax Lien Certificate of Indebtedness." Section 2. The following matters in connection with said Certi- ficates of Indebtedness are hereby determined: Date: July 2, 1945 Maturity: July 1 , 1946 Numbers and Denominations: To be determined by the Supervisor Interest rate: To be determined by the Supervisor Form: Substantially as determined by resolution adopted January 4, 1939, except that said Certificates shall recite that they are issued pursuant to Chapter 105 of the Laws of 1916, as amended, for money borrowed against transfer of tax liens owned by the Town. The Supervisor is hereby authorized to determine all matters in connection therewith not determined by this or subsequent resolution and his signature upon said Certificates shall be conclusive as to — such determinations. Said Certificates of Indebtedness shall be signed by the Supervisor and countersigned by the Town Clerk and shall have the corporate seal affixed thereto. The Supervisor is hereby authorized and directed to sell said certificates at private sale at not less than par, without advertisement or public bidding, and to deliver the same to the purchaser upon receipt of the purchase price , plus accrued interest from the date of the Certificates to the date of delivery. Section 4. Any instrument issued pursuant to this resolution shall be a general obligation of the Town and the faith and credit of the Town are hereby pledged for the punctual payment of the prin- cipal of and interest on said obligations , and unless otherwise paid or payment provided for , an amount sufficient for such payment shall be inserted in the annual estimate and a tax sufficient to provide for the payment thereof shall be levied upon all the taxable property in the Town. On motion of Councilman Stiner , seconded by Councilman Embury, the foregoing resolution was adopted by the following vote: AYES: Supervisor Mandeville Councilmen Keeler , Stiner , Embury, Watson NOES: None The Supervisor recommended the following resolution, which was on motion by Councilman Embury, seconded by Councilman Keeler , upon roll call , unanimously adopted: 543 WHEREAS , Chapter 473 of the Laws of 1945, provides for the payment by the State to certain municipalities of State aid for extraordinary expenses incurred for the control of snow on public ways during the period beginning November 15, 1944 and ending April 15, 19450 and WHEREAS, said Chapter 473 of the Laws of 1945 authorizes any municipality named in such chapter to transmit to the Superintendent of Public Works of the State of New York a statement signed and verified by the duly auth- orized representative of such municipality claiming such payment , NOW THEREFORE , BE IT RESOLVED, that Owen A. Mandeville as Supervisor of the Town of Mamaroneck is hereby authorized and di- rected to prepare or to have prepared, upon the form prescribed by the Superintendent of Public Works of the State of New York, a statement to be signed and verified by him claiming such payment, which statement shall include only expenditures for snow control on public ways within the boundaries of Westchester during the periods mentioned in subdivisions (1) and (2) of Section 2 of such chapter for the following items exclusively: (1) labor costs exclusive of the salaries or wages of persons regularly employed for municipal purposes , but payments for overtime work on snow control by such regularly employed persons may be included; (2) rental of hired equipment other than new equipment rented from manufacturers or dealers; (3) motor fuel and lubricating oils and greases; (4) cost of erecting and dismantling snow-fences; and (5) sand and — chloride. AYES: Supervisor Mandeville Councilmen Keeler , Stiner, Embury, Watson NOES: None The resolution was declared duly carried and the Town Clerk was directed to prepare certified copies thereof for transmission to Mr. Charles H. Sells , Superintendent of Public Works of the State of New York. The Supervisor suggested that in connection with the 1944 Glick-Freedman Autid, it would be well to consider same following the receipt of the audit report of the State Department of Municipal affairs , which audit has been made since the Glick-Freedman audit was completed. It was agreed that this be done. The Supervisor asked if the members of the Board had any questions concerning the copies at hand of the list of claims audited and paid by the Comptroller during the period May 16 to June 6, 1945. Also, the statement of the Bank Balances as of June 6, 1945. There __. were no questions. Councilman Stiner stated that he had nothing new to report for his Departments. He presented petitions received from the Assessor for the correction of the assessment roll so as to permit the apportionment of taxes. 4 On motion by Councilman Stiner , seconded by Councilman Keeler , the following was , upon roll call , unanimously adopted: WHEREAS , the Assessor has presented petitions for the correction of the assessment roll for certain years , pursuant to the provisions of Section 33 of Chapter 105 of the Laws of 1916 , as amended , known as the Westchester County Tax Act; and WHEREAS , after due consideration this Board finds it desirable to grant said petitions for the correction of said assessment roll; NOW, THEREFORE , BE IT RESOLVED, that the assessment roll for the year 1944, school tax of 1945, and the assessment roll of 1945, taxes of 1946 , which show property now appearing on the rolls as follows: Section Block Lot Name Land IMp. He said that he had checked the various claims and found them to be correct , which he recommended be approved. White Plains 9200 Manvel Whitestone Chairman May 25, 1945 Mr. Henry E. .Tendes, Chairman Town of Mamaroneck War Council 24 Glen Eagles Drive Larchmont , Few York Dear Mr. Mendes: To clarify the position of the Westchester County War Council , and to dispel any further rumors causing confusion in continuation of War Council activities , we wish to state that the Westchester County War Council will continue to serve the needs of the County under the War Emergency Act of New York State. Although certain duties of the Office of Civilian Protection have been terminated by directives issued by Guthrie Shaw, Deputy Director of Civilian Protection , on May 15, these in no way affect the civilian services rendered by the Westchester County War Council. We , urge , therefore , every Local War Council to continue its functions and duties in problems growing out of present war needs. Furthermore , we urge every War Council worker to stick to his job until the hour to close down officially has come. 549 The need for organized community effort is just as great evert though victory in Europe has been accom- plished. Half the job remains to be done , and the war against Japan must be met on the hoarse front with equal patriotic assistance from each and every War Council in Westchester County. The Town Attorney presented an easement agreement signed by henry T. Vaccaro, who died November 17 , 1944, and that in spite of diligent effort to locate the same , Anna U. Vaccaro, the widow and administratrix, had been unable to find the tax lien.
