HomeMy WebLinkAbout1945_05_02 Town Board Minutes REGULAR MEETING OF THE TOWN BOARD, TOWN OF MAMARONECK HELD T1tiY 2 , 1945 In the Council Room of the Weaver Street Fire House , Town of Mamaroneck, New York. The meeting was called to order by Supervisor tandeville at 8:15 P.M (Eastern 'War Time) . Presents Supervisor Mandeville Councilmen Embury, Stiner , Keeler The presence was slso noted of Town Clerk Payne , Tocun Attorney Delius , Assessor Smith , Comptroller Orsino, and accountant Finson. The minutes of the meeting of April 18 , 1945, were approved as presented. The Supervisor requested the Town Clerk to read the communi- cations . Twro reports dated April 30 , 1945, were received from the County Transportation Company , Inc. covering two (2) six-month periods ending June 30 , 1944 and December 31 , 1944 showing the total gross receipts for each period. The report was ordered received and filed. The following reports for the month of April , 1945, were also ordered received and filed- Report of the Building Inspector: Report of the Plumbing Inspector, The Supervisor suggested that the meeting proceed with the reports of committees. - Councilman Keeler informed the members of the Board that the Fire Department had asked him to extend an invitation to all to attend the Memorial Day exercises which would be held on the Department grounds on May 30 , at 9.30 A.M. He advised that the representatives of the Town Department and the Larchmont Village Department were meeting to make arrangements for the parade and. that there was some question about using some pieces of apparatus. He said that this may come before the Town Board at the next regular meeting® He said that he had a copy of a letter from the Police Department vrhich he believed all had received , in connection with the safety campaign, or Nation-wide Brake Emphasis Program. All the members of the Board stated that they did receive this letter. Councilman Stiner reported that he and Councilman Keeler had made a study of the request presented by Mr. Richards , Executive Engineer , of the Village of Larchmont , on behalf of the Village Board at the last meeting of the Town Board. He said that the assessment Roll is being prepared now and that in order to have these parcels removed from the Roll , the Village must file a letter vrith the Assessor to the effect that they own the parcels and intend to use them for park areas. With, reference to the tax, arrears , Councilman Stiner stated that these arrears had been incurred during private oerunership and that the best he and Mr. Keeler could recommend would be that the Town wavie the interest and penalties but not the costs for advertising the liens for sale. It was on motion by Councilman Stiner , seconded by Councilman Keeler , upon roil call , unanimously RESOLVED, that the Receiver of Taxes and Assessments be and he hereby is authorized, empowered and directed to accept the sum of $319,49 , representing the face amount of the taxes and the advertising costs included in the liens on Block 701 , Parcel 275, and to cancel the following tax liens upon the records of the Town. The Supervisor asked Mr. T Roosevelt Allen, who was present , if he wished to address the Board, Mr Allen stated that at the last meeting of the Board he ras asked to come back and report as to hour the matter was going in connection with the Shelter Fund for the Westchester County Dog Pro- tective Association, He said that he had made a proposition to the Village of Namaroreck which has been under discussion and that on this very night the city of Rye is considering a letter which was sent to the City Council, He said that they will probably make the appropriation and that he would known the following morning. He said that the Village of Larchmont will meet on May 7 , and they, too, rill receive a letter asking for their share. He said that he had talked, to two of the officials and that they informed him that they believed that the money will be found in their Budget . He pointed out that the next Town Board meeting will cone after the option of the Society expires on May 11 , and that the pur- chase of the property for the Shelter depends upon raising the $1 ,500 in the interim of ten days. _° He said that if the various communities do their share the Society can make out all right. He added that if the members of the Board wished to know how the citizens in the Town feel about this matter he had with 'him a number of petitions to present . He read one of the petitions. The Supervisor asked if the members of the Board and Mr. Allen would give him an opportunity to talk with the two mayors of the two Tillages within Mamaroneck, that he believed that he mould have an answer in a very short time. He said that he did have a talk with Manager Johnson of the Village of 1amaroneck and that it is believed in all fairness to all of the communities that the payments should come simultaneously or not at all. Councilman Feeler asked Mr. Allen if he was right in assuming that if the Societe did not get this Shelter that their work would come to an end. Nr. Allen replied that it would put the Society on somewhat of a. month-to-month basis . That they are trying to become permanent so that they world have some assurance of providing their services for a long time to come . That the reason why they want the property is that at their present location they have no definite assurance of continuing under the present arrangement. The Supervisor again asked if he might have the opportunity to talk to the two mayors to see what their Boards are going to do about it. He told Mr. Allen that he would have an answer for him on the following Saturday morning. The members of the Board had agreed earlier in the discussion on the procedure suggested by the Supervisor„ The Supervisor informed the members of the Board that he had received an offer from the Rollins family for the settlement of tax arrears on their property known as Block 307, Parcel 73. He presented a check in the amount of $1 ,331.65 which was intended to include the current taxes. After some discussion , it was on motion by Councilman Stiner , seconded by Councilman Embury , upon roll call , unanimously RESOLVED, that the Receiver of Taxes and Assessments be and he hereby is authorized , empowered and directed to accept the sum of $878.03 on property known. as Bloc! 301 , Parcel 73, in payment of the following tax liens plus interest at the rate of A from the date of sale : Sale Year Tax Year Amount of Lien interest at Total 1941 1940 25.67 6.16 S 31 . 83 1942 1941 245.11 44.11 289. 22 1943 1942 255.48 30.66 286.14 1944 1943 255. 51 15.33 270.84 0878,03 The Supervisor informed the members of the Board that he had an offer from Meffert & Co. Inc. to purchase by assignment cer- tain tax liens on Bloch 721 , Parcel 180 and Block 609 , Parcel 494, with interest reduced to six per cent. Following some discussion, it was on motion. by Councilman Peeler , seconded by Councilman Stiner , upon roll call RESOLVED , that the Receiver of Taxes and assessments be and he hereby is authorized , emporered and directed to sell by assignment the following tax liens on pro- perty known as Block 721 , Parcel 130 , and Block 609 , Parcel 494, for the sum of .$;1 ,101. 50, which includes interest at the rate of six per cent from the date of sale , the assignment to be to meffert & Co. None Not Voting- Supervisor Mandeville The Supervisor informed the members of the Board that he had received an offer of $2 ,000 for the sale of tax liens by assignment on the property known as Block 416 , Parcel 36, He said that this offer - was to include the current taxes and that the interest the Town is as follows- Total Tax Liens 1940-1944 Inc! . - $3 ,999. 85 Interest 1,321.80 $5,321.65 1954 Town Tax 4® I 3 .7J Following some discussion, it was decided. that Councilman Stiner and Councilman Feeler , as a committee , inspect the property and offer a recommendation at the next meeting, The Supervisor presented a letter dated May 1 , 1945, re- ceived from Tiro John F. O 'Connell , in which he offered the sum of $600. for the Town-owned property known as Block 208 , Parcel 525, adjoining the O'Connell residence at 25 Mohegan Road. Following some discussion, it was decided that the sum of $700. would be accepted , and it was on notion by Councilman Stiner , seconded by Councilman Feeler , upon roll call , unanimously RESOLVED, that the Supervisor be and he hereby is authorized to negotiate for the sale of Block 208, Parcel 525, for the sum of $700. FURTHER , that if he is successful , he is authorized to sign contract and convey title by deed to M John F. O 'Connell. The papers to be prepared by the Town Attorney. The Supervisor reported that at the last meeting he had been authorized to complete negotiations far the sale of Block 208, Parcel 420 , to Mr . William Fernschild , for the sum of $500. He said that this had been done and that Mr. Fernschild had consented to pay the $500. in cash® It was on motion by Councilman Stiner, seconded by Council- man Keeler , upon roll call, unanimously RESOLVED, that the Town Attorney be and he hereby is requested to prepare the necessary papers for the conveyance of title of Block 208 , Parcel 420 . for the sun of $500. to Mrs. Harriet P. Fernschild. FURTHER, that the Supervisor be and he hereby is authorized to sign such papers on behalf of the Town. The Supervisor brought up the matter of abolishing the ramshackle buildings 'located on Myrtle Boulevard and Known on the assessment map as Block 133 , Parcel 890 and 901 , which properties were recently foreclosed by the Town. He explained that these build- ings have no usable value and in fact only shells remain and. are dangerous if allolrred to remain in their present condition. The Board voiced approval of removing these buildings and authorized the Supervisor to proceed with arrangements to demolish the buildings. The Supervisor reported that Tor. Rate , the Building Inspector , had received an application, for alterations to the barns on property recently acquired by Mr. Barge M. Seymour from the Johnethel Corporation. Be explained to the Board that the matter arras discretionary. That the Building Inspector has been informed by the Town Attorney that the issuance, of the permit was discretionary with him and that Mr. Rate had asked him for his opinion and he advised him that he could issue -- the permit together with a notice that these barns could not be used commercially under the existing zoning, The Supervisor stated that he had the pleasure of informing the members of the Board that the Town Committee recommended the appoint- ment of Mr . Edward F. ^latson to fill the vacancy caused bcy the death of former Councilman E.C. Griffin. Councilman Embury said that he mould be very glad to have the privilege to move, the acceptance of this recommendation, Which gas seconded by Councilman Stiner and approved by unanimous vote. Councilman Embury offered the following , which was seconded by Councilmen Stiner and Keeler , and upon roll call , unanimously adonteds WHEREAS , there exists a vacancy in the office of councilman in the Town of Mamaroneck and WHEREAS , a recommendation has been accepted to fill this vacancy; NOW, THEREFORE , BF IT RESOLVED that Iffre Edward F. Watson be and he hereby is appointed to fill the office of council- man of the Town of Mamaroneck for the term ending December 31 , 1945. This appointment to tale effect immediately upon the filing of the oath of office by Mr. Watson. ea K eJ The Supervisor made the following statement : "I think Mr. Watson will be a great asset to the Board. He has a great deal of engineering experience and while in office in Larchmont did a splendid job. I thine the Town Conmittee is to be comrendedon the recommendation. With your permission, I will notify Mr. 'Matson to attend the next meeting. " The Town Attorney discussed with the members of the Board the certiorari proceedings now pending on the Larchmont Apartments , Inc .
