HomeMy WebLinkAbout1945_03_28 Town Board Minutes REGULAR MEETING OF THE TOWN BOARD, TOWN OF MAMARONECK HELD MARCH 28, 1945 In the Council Room of the Weaver Street Fire House , Town of Mamaroneck, New York.. The meeting was called to order by Supervisor Mandeville at 8: 15 P.M. (Eastern War Time) . Present- Supervisor Mandeville Councilmen Embury , Stiner , Feeler Absent : None The presence was also noted of Town Clerk Payne , Town Attorney Delius , Assessor Smith, Comptroller Orsino , Accountant Pinson, and Public Welfare Officer DeVinne. The minutes of the meeting of March 7, 1945, were approved as presented. The Supervisor requested the Town Clerk to read the communi- cations. A card acknowledging the expression of sympathy by the Town Board was received from Mrs. Edward C. Criffin. A letter dated March 13 , 1945, was received from Treasurer- Clerk F.H. Bull , Jr. of the Village of Mamaroneck with which he enclosed a certified copy of a resolution which was adopted by the Board of trustees of the Village of Mamaroneck expressing deep regret to the Town Board for its loss by death of Councilman Edward C. Griffin The communication and resolution were ordered placed in the Town's records The Town Clerk presented an application recceived from Mrs. M. Walller for the operation of the Post Lodge for dancing. He stated that the Building Inspector Fire Department and Police Department had approved the application It was on motion by Councilman Embury seconded by councilman Stiner upon roll call unanimosly RESOLVED that the Town Clerk be and he hereby is authorized to issue the dance hall license for the Post Lodge to Mrs. Millie Waller A letter dated March 10, 1945 was received from Mr. Edward Ely Hoxie in which he expressed his opinion of the members of the Board of Appeals for zoning The letter was ordered recceived and filed The Town Clerk stated that at the meeting held February 21 the Town Board considered the cancellation of the 1875 school tax or tax lease affecting Block 908 Parcel 404. he said that the Town Board by resolution had favored the cancellation and had referred the matter to the Town Attorney and that since then the Town Attorney had given his opinion that the Town board has no authority to effect this cancellation The members of the Board discussed the matter with the Town Attorney who was present and it was on motion by Councilman Keeler seconded by Councilman Stiner upon roll call unanimously 443 RESOLVED, that the action of the Town Board with reference to Block 908 , Parcel 404 , at the meeting held February 21 , 1945, be and it hereby is res- cinded , and that the applicant be notified that the Town Board does not have the authority to cancel the tax lease referred. to. The report of the Town Clerk for the month of February 1945 was ordered received and filed. The Supervisor asked if there was any one present who wished to appear before the Board. Public Welfare Officer DeVinne appeared and recommended to the Board the amendment of resolution heretofore adopted on May 19 , 1943 , providing for cash payments in Rome Relief cases. These amendments , he stated , are to be approved by the Department of Social Welfare of the State of New York. Acting upon his suggestion, Councilman Embury moved and Councilman Stiner seconded the following resolution: RESOLVED, that the resolution heretofore adopted on Yay 19 , 1943 , providing for cash payment in Bone Relief cases , is hereby amended to read as follows : On Page I of the Amendments Eliminate sentence beginning: "All authorizations such as new and reopened cases , etc . " and substitute Khere an emergent or none-recurring need exists be- tween the date of opening or re-opening of the case -- and the period covered by the check for the first re- gular grant , case worker shall prepare two separate authorizations on Form PA-16 , one for a ' once only' cash grant to provide for the specific items of ° emer- gent or non-recurring need ' , and the second authorization for the amount of the regular 'recurring ' cash grant. Emergency needs will be provided by voucher only in extreme cases. '' Section F . Page 15 changed to read. E . Provision for Grants issu®G betty en Pay R211 Periods . In the event of a new or reopened case accepted for assistance between payroll dates two authorizations should be prepared. The first authorization should cover actual need of the client as of the date of acceptance to cover the period from the date of acceptance to the next regular payroll date and the second , to cover the regular semi-monthly grant based upon the established budget de- ficit to be granted on a recurring basis effective with the next regular payroll date. DItr . Richard Fish of 10 Oxford Road , Town, appeared and re- ferred to his letter of March 26 , 1945, in which he submitted an offer of $500 for the vacant land adjoining his residence and known as Block 208 , Parcel 189 on the assessment clap of the Town. During the discussion which followed , the Supervisor reminded Mr . Fisk that the Torn Board can not consider any compromise on the assessment of the land and that the Assessor has determined the same on the bases that all other assessments are considered in the neighbor- 4 hood. He said that he believed that the Town Board wants this understood so that the purchaser would not come in within a snort time asking for a reduction in assessment using the price as an argument. Following further discussion, it was on motion by Councilman Keeler , seconded by Councilman Stiner , upon roll call , unanimously - RESOLVED, that the sale of Block 208 , Parcel 189 , be and it hereby is authorized for the sum of $500. and that the Town Attorney be and he hereby is di- rected to prepare the papers for the conveyance of the property- to Mrs. Janice A. Fisk. The Supervisor suggested that the meeting proceed with the reports of committees. Councilman Embury reported that he had studied the samples for an engrossed resolution for the members of the Griffin family and that he recommended the one prepared by Aries & Rollinson, which is similar to the one which vas prepared for the Bates family. He si1g- gested that it be done on sheepskin. It was on motion by Councilman Embury , seconded bey Councilman Stiner , unanimously RESOLVED , that the Town Clerk be and he hereby* is authorized to place on order the preparation of the memorial to former Councilman Edward C. Griffin. Councilman Embury stated that in connection with the Parr- Department the Park Commission had asked Mr. Otto Eggers to consider the plan of enlarging the Honor. Roll and that it was agreed that some- thing will have to be done pretty soon. He stated that Mr. Eggers had prepared a sketch and that he has in mind a permanent plan which may not have to be done completely immediately. That his elan is to bring another panel around, facing the north the same as the one facing the south . Mr . Embury presented the sketch and all agreed that it is a very fine plan, Mr. Embury informed the members of the Board that Mr . Eggers has been in torch with Mr. Foote on the matter and that Mr. 'Wang has also been in touch with Mr. Foote regarding estimates on the cost of the work to be done at this tire. Following further discussion, it was on motion by Councilman Stiner , seconded by Councilman Keeler , upon roll call , unanimously RESOLVED, that under the supervision of Councilman Embury , the Park Department be authorized to proceed with that part of the work which is necessary at this time to the Honor, Roll "memorial in keeping frith the plan prepared by Pas . Otto Eggers. Councilman Embury reported that from time to time there have been a number of requests for a playground for children in the unin- corporated area of the Town, and that a suggestion has been made that the playground at Hurray Avenue School be used. He pointed out that in the use of any property there would be need for supervision; also , that i would entail liability. He mentioned that Flint Park is avail- able for children in the Larchrnont Village area and that there is none in the. unincorporated section. He stated that the question has been in the minds of the people for a long time and suggested that it might be well l to keep it in mind for a Postwar Project. He reported that ➢r . Aitchison, the Park Foreman, had dis- cussed with him the proposal that the parr groundsmen be paid on re- gular salary instead of on a per diem basis. It was pointed out that if the men are included in Civil Service their net salaries will be less after all deductions are made. The question was referred to the Town Attorney as to .whether or not it is possible to put these men on a regular salary. He reported that the New fork, New Haven do Hartford Railroad Company had been very fine in their cooperation in dressing up the area along their right-of-way between the station and Chatsworth Avenue. Councilman Stiner reported. that Town Engineer Foote had been ill and that this day was the first time that he had been up since the doctor ordered him to bed. He said that he was doing quite well but that he had to be careful and needed a good long rest. He informed the members of the Board that Trir . Rate was in charge and that every- body connected with the Public Works Department was doing their very best to keep the work going. Councilman Stiner presented two petitions received from the Assessor for the correction of the assessment roll. TvYartin E. King. He said that Assessor Smith accom- panied them to the property, and that following discussion and careful consideration he and Councilman Keeler decided upon recommending the following: WHEREAS , heretofore a writ of certiorari was ob- tained by PAUL H. HEDRICK, owner of property de- scribed on the assessment main and assessment roll of the Town of Mamaroneck as Block 212 , Parcel 326 , for the year 1944 (tax of 1945) , and WHEREAS , the Assessor and Board of Review of the Town of Mamaroneck duly filed a return to said writ , and no further proceedings have been had and WHEREAS , the Town Attorney and Assessor recommend to this Board that the rroceedings be settled and dis- continued upon the reduction of the assessment from $26 ,000 to $22,500 NOW, THEREFORE , BE IT RESOLVED, that the assessment for the year 1944 (tax of 1945) upon property owned by PAUL H. HEDRICK, and described upon the assessment map and assessment roll of the Town of Mamaroneck as Block 212 , Parcel 326 , be reduced as follows: FROTVT Block_ Parcel Land Improvement Total 212 326 $11,000 $15,000 $26 ,000 TO 212 326 $10,000 $12,500 $22 ,500 provided the certiorari proceeding, now pending in - the name of Paul H. FURTHER RESOLVED, that the Towh Attorney is hereby authorized and directed to sign the necessary sti- pulation to obtain an order of the Supreme Court providing for such reduction and the refund of excess taxes paid, if any. The foregoing resolution was on motion by Councilman Stiner , seconded by Councilman Reeler , upon roll call , unanimously adopted. Councilman Stiner reported on a sewer condition on Fenimore Road where the Town main line from the Tinged Foot section joins up with the sewer main line near Grand. Street. He stated that the volume of water coming down was too great for the Village line to take it and that Village Manager Johnson had ordered the valves shut off in the Vil- lage line to spill the water in the Town line over into the Sheldrake River. He stated that there are on file some agreements between the Village and the Town and that while they call for certain obligations on the part of each , there is no question that the situation is of mutual interest. He said that it was possible that there are some openings in the Town line. The Supervisor agreed that the problem is a mutual one and that it is possible that the plugs in the spurs which were provided for connections have rotted out. He stated that in some cases the contractors inserted wooden plugs at the end of these spurs and that it might be possible in the construction of this line. The matter was laid over for consideration when the Town Engineer is able to go into the matter with the Town Board. Councilman Keeler presented the following statements: State- ment of Bank Balances as of March 28 , 1945; List of claims audited and paid by the Comptroller from February 21 to T.iarch 28, 1945; Supervisor' s statement for the month of February 1945; Analysis of Estimated Re- venues; Analysis of Budget Appropriations and Expenditures; Summary of Receipts and Disbursements. He presented claims amounting to a total of $1 ,066. 59 of the Fire Department which he recommended approved. Joint l"ater Works #`1 726.66 453 Councilman Keeler informed the members of the Board that there was a communication at hand from the Fire Department to the effect that Mr. "Tommy" Manville had graciously donated to the Town of Mamaroneck Fire Department a new 1942 Ford chassis. He stated that a bill stamped paid from H.T. Flinn Motors Co. was attached to the letter , and that he understood that Flinn hotors are entitled to sell two of these trucks this year and that this one was given at a slight reduction because it was for the Town of 1,,%maroneck. He said that the truck would be useful for small fires especially brush --- fires. He advised that it would cost $1,350. to equip the chassis but that the greater amount of the cost of the fire truck is in the chassis. He said that he had asked the Comptroller to give him a list of the balances due the Fire Department in their budget for 1945 and that he went over same with the Fire Chief and that he bilieved that the De- partment could afford to equip the chassis. He said that on the basis that the truck could be used for small emergency cases , that he would recommend that the gift be accepted. Supervisor Mandeville asked if a priority had been obtained for the truck. There was further discussion by all the members of the Board after which it was decided to lay the questions over , concerning the acceptance of the gift and the equipping of same , until the next meet- ing. Councilman Keeler recalled that at the last meeting the matter concerning the purchase of a 70B Kreiselman Rescuscitator , at a cost of $300. had been referred to him and that he was ready to re- commend that the purchase be made. --- Following some discussion, it was on motion by Councilman Keeler , seconded by Councilman Stiner , unanimously RESOLVED, that the Fire Department of the Town be and it hereby is authorized to purchase one (1) #70B Kreiselman Rescuscitator from the 'Ohio Chemical & I1fg. Co. with the necessary equipment not to exceed $300. the same to be paid out of the budget for the Fire Department for the year 1945. Councilman Keeler reported that the Howell Park Association is in the process of erecting attractive signs at street intersections in the Park which will replace Town signs which are obsolete . He said that the cost will be approximately $400. despite the fact that members of the Association are doing some of the work. He said that the Association would like to have an allowance at least up to the cost of replacing the regular Town signs which amount to about 820. each. The Supervisor stated that this certainly would be a very good investment . He said that it was good to feel that a group of people think this much of their community to contribute their time and money towards beautifying their own neighborhood. He said that the signs are quite attractive. It was on motion by Councilman Embury, seconded by Councilman Stiner , upon roll call , unanimously RESOLVED, that the Superintendent of f_ighways be and he hereby is authorized to reimburse the Howell Park Association to the extent of $160. which re- presents the normal cost to replace eight street signs at intersections of the streets in Howell Park. 455 Councilman reeler advised that there has been some recent legislation allowirig,-extra expenses for snow removal because of the severe winter. Some were of the opinion that this is being provided for emergency work which was done off the highways in up-State rail- road centers. The Town Attorney was requested to look into the matter. The Supervisor announced that an offer of $250. was re- ceived from Nicola Librandi , 93 Myrtle Boulevard, Town , tp purchase - by assignment certain tax liens held by the Town. H. Johnson, Village D.2anager , with a certified copy of a resolution approved by the Village Board of Trustees for the sale of vacant land known as Section 8, Block 85, Lots 24B, 25, 26 and 27 on the assessment map of the Village of hama.roneck, for the sum of $1 ,800. the property being known and designated as Block 830 , Parcel 292 on the assessment map of the Town. ITr. Johnson said in his letter that the purchaser, Tamco Yanufacturing Company intends to erect an industrial structure on the property. Following some discussion, the following was on motion by Councilman Stiner , seconded by Councilman Keeler , upon roll- call , unanimously adopted: 17HEREAS , the Village of Iamaroneck has heretofore acquired by deed in lieu of foreclosure , property known as Section 8, Block 85, Lots 24B, 25,26 and 27, on the tax assessment map of the Village of Mamaroneck; and - L'rTHEREAS , the Town of Mamaroneck owns certain tax liens upon the same property which is known upon the tax assessment map of the Town of Mamaroneck as Block 830 , Parcel 292, representing arrears of taxes due it which were heretofore levied against said property; and WHEREAS , the Village of Yamaroneck, by resolution duly adopted March 12, 1945, accepted an offer from Tamco Manufacturing Company, 250 °,'rest 54th Street , New York, I'..Y. , for the purchase of the property in the amount of $1 ,800 , which acceptance , however , is conditioned upon similar action being taken by the Town Board of the Town of Mamaroneck; and '7HEFEAS , this Board considers it to the best in- terests of the Town of Mamaroneck to approve such offer and to authorize the sale to the end that the property may be sold free and clear of all taxes , and the proceeds of sale , if any, divided , IIO"T, THERF'-FORE , BE IT RESOLVED, that the Town Board of the Town of Mamaro- neck agrees that property known as Section 8, Block - - 85, Lots 24B, 25, 26 and 27 on the tax assessment map of the Village of Mamaroneck, and known upon the tax assessment map of the Town of Mamaroneck as Bloc1= 830 , Parcel 292 , be sold for $1 ,800. 461 by the Town Clerk, and shall have the seal of the Town affixed thereto. The Supervisor is hereby authorized and directed to sell said Certificate at private sale at not less than par , without advertisement or public bidding , and to deliver the same to the purchaser upon receipt of the purchase price , plus accrued interest from the date of the Certificate to the date of delivery. - Section 4. The faith and credit of the Town of Mamaroneck are hereby pledged for the punctual payment of the principal of and interest on said Certificate of Indebtedness and , unless othervTise paid. , or payment pro- vided for , taxes shall be levied on all the taxable pro- perty in said Toren in an amount sufficient to pay said principal and interest . On motion of Mr. Keeler , seconded by Mr . Embury , the foregoing resolution was adopted by the following vote : AYES : Supervisor IRand.eville Councilmen Embury , Stiner , Keeler NOES : None The Supervisor informed the members of the Board that tax lien certificates in the amount of o'15,000 were paid leaving a balar_ce of $120 ,000. He pointed out that the savings in interest by paying these certificates now instead of July 19 1945, amounts to 1,2;25.94. He added that there is available in the 1945 budget X120 ,000 to meet the above balance. The Town Attorney stated that he had at hand a letter from Mr . Rutledge E. Rate , Building and Plumbing Inspector , concerning an alleged violation at '9 Leafy Lane , Town. The letter was ordered. re- ceived and filed. The Town Attorney reported that checks in the amount of $1 ,00j.16 had been received from Larchmont Estates , Inc . with an re- quest for a further extension of time , and a stipulation asking that the foreclosure sale be adjourned.. After discussion, as to the advisability of accepting the check and the application of same , it was on motion by Councilman Stiner , seconded by Councilman Keeler , upon roll call , unanimously RESOLVED , that the Town Attorney be and he hereby is authorized to enter into the following stipulation with the Larchmont Estates , Inc. SUPREME COURT OF THE STATE OF JET7,1 YORK COUNTY OF 7UTCHESTER T07N OF MUTA.RONECY, Plaintiff, -against- STIPL?LP,TIOP? _ LA RCHMONT ESTATES , INC . , T1117 PEOPLE OF THE STATE OF NEVT YORK, the VILLAGE OF MAMFRONECK and MAURICE GOLDMAN, Defendants. IT IS HEREBY STIPULATED AND AGREED AS FOLLO1S! 5 FURTHER RESOLVED , that the net proceeds of such sale shall be divided between the Town of Mamaroneck and the Village of Mamaroneck proportionately to the amount due each as of the date of such sale. The Supervisor recommended the following resolution , which was on motion by Councilman Keeler , seconded by Councilman Embury, upon roll call , unanimously adopted: RESOLUTION AUTHORIZING THE ISSUANCE OF CE"TIFICATE -- OF INDEBTEDNESS IN ANTICIPATION OF UNCOLLECTED TAXES LEVIED FOR SCHOOL PURPOSES. RESOLVED BY THE TOTIN BOARD OF THE T01 71I OF IL?IL^.RONECK_, IN THE COUNTY OF TESTCHESTER, NEW YORK, as follows: Section 1. In anticipation of the receipt of taxes levied for school purposes and unpaid in Union Free School District No. 1 of the Town of Mamaroneck for the fiscal year beginning July 1 , 1944, and ending June 30 , 1945, the sum of not more than X55,000.00 shall be borrowed on the credit of the Town, pursuant to Chapter 105 of the Lairs of 1916 of the State of New York, as amended , and a Certi- ficate , or Certificates , of Indebtedness of the Town in said amount shall be issued to evidence said loan. Section 2. It is hereby determined and declared: (a) The total amount of taxes levied in said school district for school purposes for said fiscal year , is 8910 ,389.23. (b) The total amount of said taxes outstanding and uncol- lected is $58 ,647. 84. (c) The total amount heretofore borrowed and outstanding - in anticipation of the collection of said taxes , is none. Section 3.
