MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF
THE TOWN OF MAMARONECK HELD ON AUGUST 21, 2019, BEGINNING AT 5:00PM IN
CONFERENCE ROOM A AND CONTINUING AT 8:00 PM IN THE COURT ROOM OF THE
TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK

CALL TO ORDER - WORK SESSION

On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, the Work Session was
unanimously opened at 5:00PM.
Second Quarter Financial Report
Additionally Present: Tracy Yogman Town Comptroller
The Town Board reviewed the memo from Ms. Yogman and Mr. Altieri, titled Fiscal Year 2019 Second
Quarter Budget Report, dated August 7, 2019. Ms. Yogman noted that projections demonstrate a better
quarter than the previous quarter. Ms. Yogman pointed out a few noted changes in line items from last
quarter.
Review of Proposed Operating and Capital Budget Amendments
Additionally Present: Tracy Yogman Town Comptroller
As a result of the quarterly review of the budget, the Town Comptroller is recommending a number of
budget amendments that reflect spending through the first half of 2019 as well as anticipated spending
through the end of the year. These amendments will be formally adopted during the regular meeting this
evening.
Supervisor Seligson noted the recent call with Moody’s, adding that the Town anticipates its rating shortly.
Review of Written Comments – Commuter Parking Law
In preparation for this evening’s Public Hearing, the Town Board reviewed the comments received from the
public, most of which were not in favor of the law. It was stated that the law requires signs be installed no
further apart than 200 feet. The total cost of signage is approximately $22,500, with the law as written.
ADDED ITEM
Bag Waste Reduction Law
It was noted that the draft law still states $0.10 per bag, and should be changed to $0.05. It was also noted
that NY State law may allow for stricter municipal laws to remain in effect. The Town received a letter from
the Food Industry Alliance of New York State, Inc., and among other comments, there is a request to hold

over the public hearing until the next Town Board Meeting, in hope that the Town Board would consider
some of the changes being advocated by the Food Alliance. The Town Board reviewed the comments of the
Food Industry Alliance, specifically to hold off on the passing of this law, until after Labor Day when the
DEC is expected to comment on the NY State law. The Food Industry Alliance is also asking that the law not
be effective until January 31, 2020. The Town Board discussed holding over the public hearing until
September 4.
Follow Up- Sanitation Services Report
The Town Board reviewed the report dated April 27, 2019, and discussed, among other items, once a week
pick up and curb side only pick up. Mr. Altieri is suggesting a hold off on moving forward with curb side
food waste pick up as the process for this is still very much undetermined. The Town Board is inclined to
maintain current commercial pick up. The Town Board also feels strongly that any changes in personnel
should be done through attrition. A public meeting should and will be scheduled, so residents have a
chance to discuss the options and make their opinions known.
Discussion – Comprehensive Plan

Update – Planning for 2020 US Open
Discussion – Proposed Temporary Fence Law
Mr. Altieri noted that the Planning Board would like to know what the emergency plan is, and asked if the
plan is for lights to be on 24 hours. The Police deployment is still being worked on. State Police will be
deployed outside the Town. Mr. Altieri recently met with the USGA and Winged Foot Golf Club noting that
they have agreed to a green initiative, as well as donating any unused food. They are actively seeking
volunteers to manage waste stations. Currently the plan is for parking to be at Westchester Community
College, Orchard Beach and Purchase College, with shuttles from each. VIP parking for Uber and Lyft is
suggested to be at Harbor Island. There is also a push to minimize cars on the property, in this effort a
shuttle is being provided to members of the Club.
Mr. Altieri reported that the Club will be fenced in entirely, similar to 2006. With security challenges not
present in 2006, the proposed fencing exceeds heights in the Town Code. At this time it is recommended to
consider a temporary fence law. This law would be for properties of 50 acres of more, essentially the golf
courses. A law of this type would cover not only this event, but other instances where a temporary fence
might be necessary. It was noted that the USGA and Winged Foot Golf Club came before the Planning
Board to discuss the plans for this event. Mr. Maker and Mr. Altieri will work on a draft Temporary Fence
Law as well as one addressing the prohibition of drones.
Update – LMCTV – Van Operation/Third Floor Renovation
The memo from Mr. Altieri dated August 12, 2019, discusses the plan for LMCTV to purchase a production
van. The Village of Mamaroneck will purchase the van through NYS Contract and the Town would allow its
fueling through the Town’s yard, were the dispensing system is automated and the record keeping is more
efficient. With respect to the Office/Operating space at the Town Center, LMCTV is proceeding with the
design of the renovation. Due to these renovations the relocating of the existing tenants will need to take
place, and Mr. Altieri has requested that the architects also submit a proposal to the Town for these
alterations. The architect’s proposal is on the regular agenda for this evening.
ADDED ITEM
Mr. Altieri noted the difference in the funding percentage for the CDBG application. The Town Board asked
whether the sidewalk on Harmon was still a priority with the lesser funding, and Mr. Altieri replied, yes.
On motion of Councilwoman Fiddelman, seconded by Councilman King, the Board unanimously agreed to
enter into an Executive Session to discuss appointments to Boards and Commissions.

EXECUTIVE SESSION
Appointments to Boards and Commissions.
On motion of Councilwoman Fiddelman, seconded by Councilwoman Elkind Eney, the Board unanimously
agreed to resume the Regular Meeting.
New Business
Supervisor Seligson further explained the consulting agreement for the ‘Reducing Wasted Food Grant
Program’, noting that this is an attempt to reduce wasted food. The Town Board asked for more specific
deliverables from the consultant. The Town Board would like to move forward with the initial consultant,
but would like a better breakdown of expenses between the Village of Larchmont and the Mamaroneck
School District.
Supervisor Seligson stated that the Town has offered the Town Center as a site for early voting and awaits
confirmation from the Board of Elections.
CALL TO ORDER - REGULAR MEETING
The Regular Meeting of the Town Board was called to order by Supervisor Seligson at
8:15 PM, she then pointed out the location of the exits.
Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this
evening, adding this is an open meeting that all residents are welcome to attend.
SUPERVISOR’S SUMMARY REPORT – Supervisor Seligson deferred her comments in light of the large crowd
in attendance for the public hearing.
CITIZEN’S COMMENTS
Supervisor Seligson asked if anyone in the audience as here to address the Board with comments other
than the public hearings, and there was not.
PUBLIC HEARING – “Parking Prohibited on Certain Sides of Certain Streets at Certain Times” law.

LEGAL NOTICE IS HEREBY GIVEN that pursuant to Section 130 of the Town Law of the State of New
York, a Public Hearing will be held on August 21, 2019 at 8:00 PM or as soon thereafter as is possible
at the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider: “Parking
Prohibited on Certain Sides of Certain Streets at Certain Times” law.
Purpose
The Town Board finds that the proliferation of parked cars in the section of Town that lies within
one-half mile of the Larchmont Metro-North Train Station has caused congestion on the streets
and hazardous conditions for pedestrians and motorists alike. To establish control and restore
safe conditions to this area of Town, the Town Board enacts this local law that amends the current
law to prohibit parking for one hour of each weekday on each side of each street in this area.

On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the Public Hearing was
unanimously opened.
Supervisor Seligson gave a detailed history and developments of commuter parking in the community, as
well as recent situations which have moved the issue of commuter parking to the forefront, and
precipitated the drafting of this law.
Supervisor Seligson noted for the record that the Town received 73 written correspondence from
residents, a majority of which were not in favor of this law.

Supervisor Seligson noted that the Town Board will review all that has been said this evening, including
all written correspondence. The Town Board does not intend to vote on this law this evening, but rather

will hold the public hearing over until September 4, so residents’ who may be away can voice their
opinions.
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the Public Hearing was
unanimously adjourned until September 4, 2019.

Purpose
The State of New York amended article 27 of the Environmental Conservation Law by adding a new Title
28 (Bag Waste Reduction) which will become effective on March 1, 2020. The purpose of this local law
is to incorporate the new state law into the laws of the Town of Mamaroneck.
The Town Board determines that a shift to reusable bags in most retail transactions will benefit the
overall health, safety and welfare of the Town and the environment. The Town Board also finds that a
fee for using non-reusable bags is essential if there is to be a transition to reusable bags because such a
fee will encourage consumers to use reusable bags rather than bags for which a fee is charged.
Furthermore, the Town Board agrees with the Supreme Court of the State of Colorado which in Colo.
Union of Taxpayers Found. v City of Aspen, 418 P.3d 506 (Colo. 2018) held that the imposition of a fee for
using single-use bags is not a tax; but a fee designed to promote health, safety and welfare.

On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the Public Hearing was
unanimously opened.
Supervisor Seligson gave a detailed history of how this law and public hearing came to be, specifically
noting that this has been something the Town Board has worked on before but came up against strong
legal opposition from the food industry.
The following residents addressed the Town Board:

Jay Peltz, General Counsel to the Food Industry Alliance of NY State, spoke and distributed a written
statement, detailing some changes to the law that he is proposing.
Mitch Green, 6 Meadow Place, and Chair of the Sustainability Collaborative, in favor
Svetlana Wasserman, in favor
Mr. Maker suggests adjourning the public hearing until September 4, so the Town
has the opportunity to make a few small changes to the law as written, specifically
the cost of the bag at point of sale.
On motion of Councilwoman Fiddelman, seconded by Councilwoman Elkind Eney, the Public Hearing was
unanimously adjourned until September 4, 2019.

The Meeting was called to order by Commissioner Seligson, and then on motion of Commissioner Elkind
Eney, seconded by Commissioner King, the Board of Fire Commissioners was unanimously declared open.

The construction management proposal submitted by Calgi Construction (Option II) to provide
construction management services for the Weaver Street Firehouse project at a cost of
$86,400.00.

1. Authorization – Consulting Agreement – Reducing Wasted Food Grant Program
On motion of Councilwoman Elkind Eney, seconded by Councilman King, it was
RESOLVED, that the Mamaroneck Town Board does hereby approve the consulting agreement
between the Town of Mamaroneck and Tamar Hurwitz Fleming and Drew Fleming, to help the
Town facilitate the New York State DEC Grant to conduct Municipal Food Scraps Reduction,
Food Donation and Food Scraps Recycling Programs, and

Hearing on the Public Housing Agency Administrative Plan for October 2, 2019 at
8:00PM at the Town Center, 740 West Boston Post Road, and

hearing in a newspaper appointed as an official newspaper, and that said Notice, be

6. Authorization – Architectural Services – Third Floor Town Center
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, it was
RESOLVED, that the Mamaroneck Town Board does hereby approve the proposal submitted by
Hage and Ruocco Architects submitted on August 7, 2019 for design services on the third floor of
the Town Center, to be coordinated with the design of the proposed LMCTV space, and
BE IT, FURTHER
RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf
of the Town.

7. Resolution Laserfiche
On motion of Councilwoman Elkind Eney, seconded by Councilman King, the following was approved,
RESOLUTION TO DESIGNATE LASERFICHE DOCUMENTS OF TOWN BUDGETS
TO BE THE OFFICAL TOWN RECORD
WHEREAS, the Town of Mamaroneck purchased Laserfiche in 2009 with a substantial upgrade in
the Laserfiche software in 2013, and
WHEREAS, the Town Board has designated Laserfiche as the Town’s official Electronic Document
Management System to retain the Town’s digital records; and
WHEREAS, the Town has adopted and adheres to the Records Retention and Disposition Schedule
MU-1, prepared and issued by the State Archives and Records Administration (SARA), State
Education Department, pursuant to Section 57.25 of the Arts and Cultural Affairs Law, and Part 185,
Title 8 of the Official Compilation of Codes, Rules and Regulations of the State of New York, and
WHEREAS, the Town’s Laserfiche Repository has been structurally developed to adhere to the New
York State Record Retention and Disposition Schedule MU-1; and
WHEREAS, Town of Mamaroneck is committed to ensuring the future migration of their digital
records; and
WHEREAS, the security of the records and backup procedures are implemented and managed by
the Information Security Officer as described in the Town’s Cyber Security Policy and as defined in
the Official Compilation of Codes, Rules and Regulations of the State of New York, and
WHEREAS, the Town’s Records Management Officer/Town Clerk and IT Director have ensured that
based on the Official Compilation of Codes, Rules and Regulations of the State of New York, have
and will continue to adhere and abide by the following:

(a) A local government shall ensure that records retention requirements are incorporated
into any plan and process for design, redesign, or substantial enhancement of an
information system that stores electronic records
(b) A local government shall ensure that electronic records are not rendered unusable
because of changing technology before their retention and preservation requirements are
met. In the case of archival electronic records, a local government, in consultation with the
State Archives, must determine that the records will remain usable and accessible by
ensuring that the records are retained in currently available file formats and by creating
adequate documentation of the records and their systems as defined in subdivision (c) of
this section.
(c) A local government shall develop and maintain up-to-date documentation about all
permanent or archival electronic records sufficient to:
(1) specify all technical characteristics necessary for reading and processing the
records;
(2) identify all defined inputs and outputs for the system;
(3) define the content of the files and records;
(4) determine restrictions on access and use;
(5) understand the purpose and function of the systems;
(6) describe update cycles and /or conditions and rules for adding information to
the system, changing information in the system, or deleting information; and
(7) ensure the ongoing retention of the records by the local government,
And
WHEREAS, the Records Management Officer/Town Clerk’s Office has scanned the Tentative,
Preliminary, and Adopted Budgets for the Town of Mamaroneck into Laserfiche; and
WHEREAS, the Tentative, Preliminary, and Adopted Budgets scanned into Laserfiche follow all the
State Requirements for preservation of electronic records, and
WHEREAS, based on the Records Retention and Disposition Schedule MU-1, the electronic images
of the Tentative and Preliminary Budgets indexed as 1. \[51\], will be maintained for ten (10) years
and the Adopted Budget indexed as 2. \[54\], will be maintained permanently, and
WHEREAS, the Town finds the duplication of maintaining paper copies of these digital images to be
redundant, and
WHEREAS, copies of these Tentative, Preliminary, and Adopted Budgets found in other formats,
including paper, shall be deemed obsolete convenience copies, and will be disposed of through the
Records Management Office.
NOW THEREFORE BE IT
RESOLVED, the Mamaroneck Town Board does hereby declare of the Tentative, Preliminary, and
Adopted Budgets scanned images maintained in Laserfiche to be the official record of the Town of
Mamaroneck, and
BE IT FURTHER
RESOLVED, that the paper copies of the Tentative, Preliminary, and Adopted Budgets for the Town
of Mamaroneck can be destroyed by the Records Management Officer in accordance with the
Official Compilation of Codes, Rules and Regulations of the State of New York.

RESOLVED, that the Mamaroneck Town Board does hereby approve the annual
salary increase for Angela Paterno to $53,429.33, effective January 1, 2019.

9. Salary Increase – Town Police Department
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, it was
RESOLVED, that the Mamaroneck Town Board does hereby appoint Anthony DiTomasso, to
the position of Probationary Police Officer, at an annual salary of $58,262.00, effective August
26, 2019

10. School Tax Warrant
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, it was
RESOLVED, that the Mamaroneck Town Supervisor is hereby authorized to execute the
School Property Tax Warrants for the collection of the Mamaroneck School District Taxes
and a portion of the Scarsdale School District Taxes and that the Receiver of Taxes is
directed to proceed with the tax collection process.
