TOWN OF MAMAROFECK, NEW YORK
HELD DECEMBER 29, 1944
In the Council Room of the Weaver Street Firehouse , Town of
Mamaroneck, New York.
The meeting was called to order by Supervisor Mandeville
at 8:15 P.M. (Eastern War Time) .
Present: Supervisor Mandeville
Councilmen Griffin, Embury, Stiner
Absent : Councilman Keeler
The presence was also noted of Town Clerk Payne , Town
Attorney Delius , Town Engineer and Superintendent of Highways Foote ,
Comptroller Orsino , and Accountant Finson.
The minutes of the meeting of December 1 , 1944, were approved
as presented.
The Supervisor stated that there were some papers before
him which might be considered at this time . He presented the pro-
posed agreement between the Town of Mamaroneck and the Westchester
County Dog Protective Association, Inc. to act as agents for the
seizure and impounding of all dogs found unlicensed or untagged or
running at large , in violation of the provisions of the Agriculture
and Markets Lars of the State.
Following some discussion , it was on motion by Councilman
Embury , seconded by Councilman Stiner , unanimously
RESOLVED, that the Supervisor be and he hereby is
authorized to sign the agreement between the Town
of Mamaroneck and the Westchester County Dog Pro-
tective Association, Inc. , which contract is sub-
ject to final approval by the New York State De-
partment of Agriculture and Markets.
The Supervisor presented the proposed agreement between
the Town of Mamaroneck, Village of Larchmont , and the Larchmont Public
Library, which provides for an adjustment as allowed in the Town' s
budget for the year 1945.
Following some discussion, it was on motion by Councilman
Embury, seconded by Councilman Griffin, upon roll call , unanimously
RESOLVED, that the Supervisor be and he hereby is
authorized to sign the agreement between the Town
of Mamaroneck, Village of Larchmont , and the Larch-
mont Public Library, which agreement amends the
original agreement dated Sept. 15, 1930 , with
modifications on Feb. 2, 1937 and Feb. 5, 1941.
The Supervisor reported that some time ago the matter con-
cerning the strip of property in front of 103 Murray Avenue and owned
by Mrs. Katherine Kennedy was referred to him to try to effect a
— settlement on an encroachment by the Town for sidewalk purposes. He
informed the Board that he had negotiated with Mrs. Kennedy and had
finally obtained a signed option for the purchase of the strip , for
the sum of $225.00.
Following discussion, the matter was referred to the Town
Attorney to obtain the necessary search and prepare papers for tran-
sfer of the strip to the Town.
The Supervisor recommended the following resolution, which
was on motion by Councilman Embury, seconded by Councilman Stiner ,
upon roll call , unanimously adopted:
WHEREAS , on October 16, 1944 , the Town Board of the
Torn of Lamaroneck passed a resolution accepting the
offer of Gunn Brothers Oil Company , Inc. to purchase
the property designated on the assessment roll of the
Town of Mamaroneck as Block 901 , Parcel 126 , for the
sum of $7,500 , upon the following terms:
40% of which is to be in cash , and 60% of which
is to be represented by a Purchase Money mortgage ,
which mortgage shall run for a term of five (5)
years bearing interest at the rate of five rer
cent ( 5% ) per annum and is to be amortized at the
rate of four per cent (4%) per annum. Both interest
and amortization shall be payable in quarterly in-
stalments and the principal sum remaining shall
become due and payable at the termination of five
years from the date of the signing of said mort-
gage;
WHEREAS , on October 17, 1944, the Village Board of the
Village of Hamaroneck , by resolution duly approved said
offer of sale; and
WHEREAS , on the 27th day of December , 1944, title was
conveyed to said Gunn Brothers Oil Company, Inc. , and
Salvatore Amico; and
WHEREAS , the receipts and disbursements in connection
with said property are as follows:

showing the net receipts to be apportioned between
the Town and Village of Mamaroneck to be $4,122.78,
and
WHEREAS , the amount of unpaid taxes and percentage
due the Village and Town are as follows:

NOW, THEREFORE , BE IT
RESOLVED, that in accordance with the percentages
above set forth that there be paid to the Village
of Mamaroneck 75.99% of the net receipts of $4,122.78,
less the sum of $1 ,918.49 which is already in their
possession, or the net sum of $1 ,214.41.
FURTHER RESOLVED, that the Supervisor be and he
hereby is authorized to distribute the interest
and amortization payments on the above mentioned
Purchase Money mortgage when received, to the Town
and to the Village in the same ratio as indicated
in the above distribution statement.
FURTHER RESOLVED, that these disbursements be made
from the receipts of the aforementioned transaction.
FURTHER RESOLVED, that the commission due Barney
Epstein, Inc. , broker , who brought about the sale ,
in the amount of $375.00, be approved. Said payment
to be made from the proceeds of the sale of this pro-
perty.
On motion by Councilman Embury , seconded by Councilman
Stiner , it was , upon roll call , unanimously
RESOLVED, that the sum of $4,134.00 be accepted by
the Town of Mamaroneck as representing its share of
the purchase price of the premises known as Section 9 ,
Block 11 , Lot 20Al and Section 9 , Block 11 , Lots 20A2-
21B-20B-21A on the Village of Mamaroneck assessment
roll and known as Block 901 , Parcels 87 and 92 on the
Town of Mamaroneck assessment roll , and that said sum
be applied first to the payment of 1944 state , town,
county and school taxes unpaid and that the balance
of $3 ,472.33 be applied to the payment of the following
tax liens outstanding on Block 901 , Parcel 87 and 92 ,
which tax liens are hereby cancelled.

On motion by Councilman Stiner , seconded by Councilman
Embury, the following resolution was , upon roll call , unanimously
adopted:
RESOLUTION AUTHORIZING THE ISSUANCE OF CERTIFICATES
OF INDEBTEDNESS IN AMOUNT NOT EXCEEDING $160,000. OF THE
TOWN OF MAMARONECK, IN THE COUNTY OF WESTCHESTER, FEW
YORK, IN ANTICIPATION OF THE RECEIPT OF TAXES LEVIED
FOR TOWN PURPOSES.
RESOLVED BY THE TOWN BOARD OF THE TOWN OF MAMARONECK,
IN THE COUNTY OF WESTCHESTER, NEW YORK, as follows:
Section 1. To provide a fund to be expended for
any of the purposes for which funds are appropriated
in the annual estimate of the Town for the fiscal year
— beginning January 1 , 1945, the Supervisor is hereby
authorized to borrow a sum not exceeding $160 ,000.
at one time , or from time to time as the money may be
needed , on the credit of the Town, in anticipation of
the receipt of taxes for said fiscal year applicable
to such purposes. The Supervisor shall issue a certi-
ficate , or certificates , of indebtedness in the name
of the Town in the principal amount of such loan or
loans pursuant to section 117 of the Town Law , con-
stituting Chapter 62 of the Consolidated Laws of the
State of New York, as amended.
Section 2. It is hereby determined and declared:
(a) The total amount of taxes to be levied
in said Town for Town purposes for said fiscal year,
as provided in the annual budget adopted the ist day
of December , 1944, is $650 ,328. 23 (exclusive of Judicial ,
Military', County and Mamaroneck Valley Sewer Levies) .
(b) The total amount of said taxes outstanding
and uncollected , is $650.328.23•
(c) The total amount heretofore borrowed and
-- outstanding in anticipation of the collection of said
-- taxes , is none.
Section 3. The following matters in connection
with said Certificates of Indebtedness are hereby de-
termined:
Date : January 15, 1945
Maturity: May 1 , 1945
Denomination: To be determined by the Supervisor
Interest Rate : To be determined by the Supervisor , but
not exceeding five per centum (50) per
annum.
Numbers: To be determined by the Supervisor
Form: Substantially in accordance with resolution
adopted January 4, 1939.
Said Certificates of Indebtedness shall be signed by the
Supervisor , contersigned by the Town Clerk and shall have
the Town seal affixed thereto. The Supervisor is hereby
authorized and directed to determine all matters in. con-
nection therewith not determined by this or subsequent
resolution, and to sell said Certificates of Indebtedness
at private sale at not less than par , without advertisement
or public bidding , and to deliver the same to the purchaser
upon receipt of the purchase price , plus accrued interest
from the date of the Certificates of Indebtedness to the
date of delivery.
Section 4. The faith and credit of the Town of
Mamaroneck are hereby pledged for the punctual payment
of the principal of and interest on said Certificates of
Indebtedness and, unless otherwise paid, or payment provided
for , taxes shall be levied on all the taxable property in
said Town in an amount sufficient to pay said principal and
interest.
On motion of Mr. Stiner, seconded by Mr . Embury , the
foregoing resolution was adopted by the following vote :

The Supervisor announced that the sum of $15,000 had been
paid on tax lien certificates which becomes due on July 1 , 1945, effect-
ing a. savings in interest costs of $46. 51. He added that the balance
of tax lien certificates now owing are $135,000 as against $188 ,000
on December 31 , 1944.
The Supervisor presented a letter from Mr. William Brill ,
attorney of the office of Messrs. Meighan & Necarsulmer , attorneys for
Mr . Thomas Vidile , with an offer for the settlement of certain tax
arrears on Block 815, Parcel 350.
Following some discussion, it was on motion by Councilman
Embury , seconded by Councilman Stiner , upon roll call , unanimously
RESOLVED, that the Receiver of Taxes and Assessments
be and he hereby is authorized , empowered and directed
to accept the sum of $519. 55 in payment of the follow-
ing taxes and/or tax liens now due and/or owned by the
Town of Mamaroneck, upon the rroperty known and desig-
nated on the tax assessment map of the Town of iamaroneck
as Block 815, Parcel 350:
Tax Liens for the sales of 1935 to 1941 inclusive , years
of levy 1934 to 1940 inclusive , for the face amount of
the taxes waiving penalties and interest in the amount
of $283.49.

Tax Liens for the sales of 1942-1944 inclusive ,
years of levy 1941 to 1943 inclusive , for the
face amount of the liens plus 12% interest in
the amount of $184.67, plus the current 1944
Town tax with penalties in the amount of 826.17 and
the 1944 school tax plus penalties in the amount
of $25.22.
The Supervisor presented a letter from Mr. Reuben R. Sirlin
attorney , representing Mr. Abe Chulew, offering to purchase liens on
Block 901 , Parcel 350 , at a reduced amount.
Following some discussion, it was on motion by Councilman
Stiner , seconded by Councilman Embury , upon roll call , unanimously
RESOLVED, that the Receiver of Taxes and Assess-
ments be and he hereby is authorized , empowered
and directed to sell by assignment the following
tax liens held by the Town at the face amount of
the liens plus interest computed at six per cent
per annum, to Mr. Abe Chulew, 222 Tlest post Road,
hramaroneck, N.Y.

The Supervisor presented a letter received from Mamaroneck
Federal Savings & Loan Association , in which they referred to an old
tax lien for the year 1935 which had been discovered open on Block 825,
Parcel 291. They requested permission to pay the lien at a reduced
amount.
Following some discussion, it was on motion by Councilman
Embury , seconded by Councilman Stiner , upon roll call , unanimously
RESOL7ED, that the Receiver of Taxes and Assessments
be and he hereby is authorized, em-nowered and directed
to accept the face amount of the liens plus interest
at the rate of six per cent from the date of sale , in
payment of the following tax lien, on Block 825, Par-
cel 291 , provided payment is made within thirty days:

The Town Clerk reported that all of the insurance policies
for the year 1945 had been received from the Town's insurance broker
and that a representative of Councilman Keeler ' s office had checked the
policies and that everything conforms with the requirements set up in
the insurance estimate by Councilman Keeler for the year 1945.
A letter dated December 29 , 1944, was received from Comptroller
Orsino in which he requested authorization to make certain transfers
within the 1944 Budget.

Public Welfare Officer DeVinne reported that he had re-
ceived four bids for redecorating the interior of the Welfare Offices ,
of which the lowest bid was $210.00 by Samuel McAndless . He recommended
that this bid be accepted and the contract awarded to Mr. McAndless.
Following some discussion, it was on motion by Councilman
Embury , seconded by Councilman Stiner , upon roll. call , unanimously
RESOLVED, that the contract for redecorating the
offices of the Department of Public Welfare in
the old Town Hall , be awarded to Samuel McAndless
and that the work be placed under the supervision
of Mr. Rutledge H. Rate , Building Inspector of the
Town of Mamaroneck.
Public Welfare Officer Dellinne requested that a transfer of
funds be made within the 1944 Budget for his Department to cover the
cost of the painting authorized in the foregoing resolution.
It was on motion by Councilman Griffin, seconded by Councilman
Embury, upon, roll call , unanimously
RESOLVED , that the Supervisor and the Comptroller
be and they hereby, are authorized to make the fol-
lowing transfer within the 1944 Budget

Public Welfare Officer DeVinne called to the attention of
the Board that he had experienced difficulty in collecting funds for
a burial which had been authorized by his Department. fie informed the
Board that after authorization had been given , it was discovered that
the deceased was credited with a bank account in an Elmsford Bank.
He said that he had approached the officials of the bank and they had
refused payment. Also that he had taken it up with the Public Admin-
istrator of the County and that to date approval had not been given.
In the meantime , the funeral director was holding the Town responsible
as authorization had been given for the burial.
Following some discussion, it was on motion by Councilman
Embury, seconded by Councilman Stiner , upon roll call , unanimously
RESOLVED, that Public Welfare OfficerDeVinne
be and he hereby is authorized to pay Silleck &
Meech Funeral Home the sum of $76.74, and obtain,
at the same time , an assignment of their claim
against the estate of the deceased which assign-
ment shall be turned over to the Town Attorney
for collection.
The Town Attorney made his report in reference to the cer-
tiorari proceedings brought by the Chelsea Fireproof Storage Ware-
houses , Inc . , which matter was discussed with the Board.
Regarding Larchmont Manor Park Society certiorari , the
Town Attorney reported that the Appellate Division had affirmed
without opinion the decision of Hon. J. Addison Young , Official Re-
feree.

After some discussion, he was instructed to move for
permission to appeal to the Court of Appeals.
The Totem Attorney presented the following resolution:
WHEREAS , heretofore a writ of certiorari was obtained
by Winged Foot Holding Corporation, owner of property
- , described on the assessment map and assessment roll of
the Town of Mamaroneck as Block 347, Parcel 1 , for the
year 1944 (taxes of 1945) ; and
WHEREAS , the Assessor and Board of Review of the Town
of Mamaroneck, duly filed a return to said writ and
no further proceedings have been had; and
WHEREAS , the Town Attorney and Assessor recommend to
this Board that the proceedings be settled and dis-
continued upon the reduction of the assessment from
$750 ,000 to $700 ,000,
NOW, THEREFORE , BE IT
RESOLVED, that the assessment for the year 1944 (tax
of 1945) upon property owned by Winged Foot Holding
Corporation and described upon the assessment map and
assessment roll of the Town of Mamaroneck as Block 347 ,
Parcel 1 , be reduced as follows:

provided the certiorari proceeding, now pending in
the name of "Dinged Foot Holding Corporation, for the

against the Town of Mamaroneck.
FURTHER RESOLVED, that the Town Attorney is hereby
authorized and directed to sign the necessary sti-
pulation to obtain an order of the Supreme Court
providing for such reduction.
On motion by Councilman Embury, seconded by Councilman
Stiner , the foregoing resolution was adopted by the following vote :

The Town Attorney reported that he had completed some pro-
posed amendments to the Building Code and offered same to the council-
men for study. The papers were referred to Councilman Stiner.

moneys for the year 1944.

man Stiner , upon roll call, unanimously

On motion by Councilman Embury , seconded by Councilman
Stiner , it was unanimously
RESOLVED, that the foregoing town Highlvay Super-
intendent ' s estimate for Highway purposes for
the year 1945 be and it hereby is approved.
Councilman Embury moved the adoption of a resolution to
approve the salaries for all Town officials and employees and to ap-
point officers and employees for the year 1945. This motion being
duly seconded by Councilman Stiner , it iwas duly adopted as follows:
RESOLVED:
Section 1. That the salaries of all elected and
appointed officers of the Town of Llamaroneck for
the year 1945 are to be the salaries stated and
appropriated in the annual Budget or Estimate for
the year 1945 and all such salaries are to be paid
as of January 1st , 1945;
Section 2. That a bond be required for the faith-
ful performance of the duties of each of the follow-
ing officers in the amounts stated, with sufficient
sureties to be approved by this Board and the form

Section 4. That the employment of the last named
persons to the aforesaid positions , is in accordance
with the classifications made by the County Personnel
Officer , under the provisions of the Civil Service Lary
of the State and any vacancies which notw exist or which
nay , from time to time , occur in said positions , are to
be filled at salaries set in accordance with the provi-
sions of the salary scale adopted by the Town Board and
in conformity with the Civil Service Rules and amendments
thereto, for towns , villages and special districts in
Westchester County, New York.
Section 5. That a bond be required for the faithful

Section 6. That the following persons are hereby
appointed to positions classified as exempt under
the Civil Service Law such appointment to be made
as of January 1st , 1945 and to continue at the plea-
sure of the Town Board , at the annual salary or rate
of compensation hereinafter stated , which is to be
paid from the amounts appropriated in the annual Bud-
get or Estimate for the year 1945, or so much thereof
as shall be sufficient to pay the annual salary or
compensation as hereby fixed:
Section 7. That a bond be required for the faithful

approved by this Board and the form to be approved

Section 8. That there is hereby appropriated from
the amount levied in the annual Budget or Estimate
for 1945 for Department of Police , Patrolmen, the
sum of $6 ,750 to be paid as salary or compensation
to the following named temporary patrolmen now serving
as such by virtue of an appointment pursuant to the
provisions of Chapter 47 of the Laws of 1943 , as long
as the period of their appointment shall continue :

Section 9. That the salaries of all officers, elected
and appointed , and of all employees , be paid semi-
monthly on the 1st and 15th days of each month.

for the Department of Highways , Item 1, the sum of 81 ,500
and from the Seaver Department , Supervising foreman (P.T. )
the sum of $1 ,200 as the annual salary and compensation
of Michael A. Yerola , Assistant Superintendent of Public
Works for services as foreman in the Department of High-
Ways and Sewer.

On motion by Councilman Griffin, seconded by Councilman Embury,
it was unanimously
RESOLVED, that in accordance with a request received
from Henry R. Dillon, Receiver of Taxes , this Board
hereby approves of his appointment of Leo TT. Orsino,
Senior Account Clerk, as Deputy Receiver of Taxes , and
his designation of Alexander Finson, Accountant , as a
person authorized to receive tax money, give prorer re-
ceipt therefor in his name , enter such payments upon the
records and deposit tax money in the bank.
The Town Clerk reported that pursuant to Subdivision 10 of
Section 30 of the Town Law of the State of New York, he had appointed
Miss Wilhelmina Schroeder as Deputy Town Clerk for the term of office
ending December 31 , 1945.
On motion by Councilman Griffin, seconded by Councilman Stiner ,
it was , upon roll call , unanimously
RESOLVED, that the appointment by the Town Clerk
of Miss Wilhelmina Schroeder as Deputy, Town Clerk
in accordance with his certificate dated December 29 ,
1944 , and this day presented to the Board , is hereby
approved.
On motion by Councilman Griffin, seconded by Councilman
Stirrer , upon roll call , it was unanimously
RESOLVED, that the regular meetings of this Board
be held on the first and third Wednesdays of each
month at 8:15 o'clock P.M. in the Council Room of
the Weaver Street Firehouse.
The Supervisor asked the members of the Board if they were
satisfied with the arrangements of committees for the rest year , and
if so, he wished to appoint the same committees for the year 1945.

On motion by Councilman Embury , seconded by Councilman Stiner ,

RESOLVED, that Mrs. Elizabeth Lawton be and she
hereby is reappointed as a member of the Board of
Park Commissioners of Park District No. 1 of the
Town of Mamaroneck, New York, to serve for the
term expiring December 31 , 1947.
On motion by Councilman Stiner , seconded by Councilman Embury ,
it was , upon roll call , unanimously
RESOLVED, that Mr . C. DeWitt Rogers be and he
hereby is reappointed as a member of the Board
of Appeals for Zoning , to serve for the term end-
ing February 19 , 1950.
On motion by Councilman Griffin, seconded by Councilman
Embury, the following was adopted , Councilman Stiner not voting:
RESOLVED, that in accordance with Article 2 ,
Section 12 of the Plumbing Code of the Town of
Mamaroneck, that the following be appointed to

Mamaroneck shall continue as now constituted
with Mr. Henry E. Mendes as Chairman.
The Supervisor stated that it would be in order to appoint
the auditors to examine the Town' s records for the year 1944.
It was on motion by Councilman Griffin, seconded by Council-
man Stiner , upon roll call, unanimously
RESOLVED, that the firm of Glick-Freedman , Certi-
fied Public Accountants of New Rochelle , New York,
be appointed to audit the records of the Town for
the year 1944.
FURTHER , that the compensation for this service be
in the amount of $1200.00.
On motion. by Councilman Stiner , seconded by Councilman Embury ,
it was, upon roll call , unanimously
RESOLVED, that in accordance with the provisions of

Chapter 5 of the Laws of 1935, which amends sub-
division 1 of Section 102 of the Town Law, the Town
Board of the Town of Mamaroneck hereby determines
to allow and pay the following Town Officers and em-
ployees in an amount not to exceed six cents per mile
for the use of their own automobiles for each mil
actually and necessarily travelled by them in the per-
formance of the duties of their several offices or
position:

On motion by Councilman Griffin, seconded by Councilman Stiner ,
it was unanimously
RESOLVED, that the following banks and trust companies
in which the funds of the Town of Mamaroneck and its
various districts and departments are now deposited
shall continue to be the depositories of such funds
for the year 1945 upon the same terms and conditions
as now obtained , including security deposits now in
effect:

On motion by Councilman Embury, seconded by Councilman Stiner ,
it was unanimously
RESOLVED , that "The Daily Times" of Mamaroneck be
designated as the official newspaper of the town of
Mamaroneck for the purpose of publishing notices.
The Town Clerk presented the lease for one year covering the
rental of the premises at 158 West Boston Post Road used for the Town
Offices. He reported that it was in the amount set aside in the Budget
for the rental and that it provided for painting the walls , ceilings
and woodwork of the first floor.
It was on motion by Councilman Stiner , seconded by Councilman,
Embuury, upon roll call , unanimously
RESOLVED, that the Supervisor be and he hereby is
authorized to sign the lease for the rental of the
premises used as the Town Offices , at 158 'lest
Boston Post Road , Village of Mamaroneck, which
rental agreement is provided for in the 1945 Budget.
