The meeting was called to order by Supervisor Llandeville at 8:15 P.M. (Eastern 'gar Time) . Present : Supervisor Mandeville Councilmen Griffin, Embury, Stiner , (Keeler Absent : None The presence was also noted of Town Clerk Payne , Town Attorney Delius , Assessor Smith, Comptroller Orsino, and Accountant Finson. The minutes of October 18, 1944 , were approved as presented. The Supervisor requested the Town Clerk to read the com- munications. A letter dated November 1 , 1944, was received from Assessor Smith, concerning tax arrears charged against property known as Block 113, Parcel 109 (former description Section 1 , Block 25, Lots 39 and 40) for the tax year 1882 , sale of 1883 , in the amount of $11.90. It was stated that the description on the assessment roll covering this tax was vague and indefinite and, therefore , the arrears were set up in error and should not have been charged against this property. Assessor Smith informed the members of the Board that he had made a search of the County records and found that this old tax, for the sum of $11.90 to have been cancelled. Following some discussion , it was on motion by Councilman Griffin, seconded by Councilman Stiner , upon roll call , unanimously RESOLVED , that the tax arrears in the sum of $11.90 against Block 113 , Parcel 109 (old number Section 1 , Block 25, Lots 39 and 40) for the tax of 1882 , sale of 1883 , be cancelled on the tax arrears records of the Town. An undated letter was received from the Westchester Lighting Company requesting the extension provided for in the agreement dated August 17, 1928 between the Town of Mamaroneck and the Westchester Light- ing Company , relating to the gas mains in Homer Avenue in the Town of Mamaroneck, the extension to run to and including the lath day of August , 1948. A copy of the agreement for signature was attached. On motion by Councilman Stiner , seconded by Councilman Embury , it was , upon roll call , unanimously RESOLVED, that the Supervisor be and he hereby is authorized to sign the modification agreement on behalf of the Town of Mamaroneck, extending the agreement with the Westchester Lighting Com- pany to and including the 17th day of August , 1948. The Town Clerk called to the attention of the Board that the hours of voting had been extended by the Legislature to 9 P.M. on Elec- tion Day. He pointed out that in 1940 the election inspectors and poll clerks were paid $2.00 extra for the additional time. 5 Councilman Embury said that he would have a further talk with Mr. Watkins and report at the next meeting. Councilman Stiner reported that he and Councilman Keeler , on a tour of inspection, visited the Town' s cemetery on Stanley Avenue , and it was found that the wall surrounding it was in bad shape and needed considerable repairs. He said that there was other work to be done , such as leveling off the top of the cemetery which would involve a con- siderable amount of money. He added that if some thought were given to this now that perhaps the work could commence a year from now. The Supervisor suggested that as long as the Town must main- tain the cemetery, he recommended that Town Superintendent Foote prepare sketches as to its improvement. It was decided that Councilmen Keeler and Stiner , and Mr. Foote , as a committee , formulate ideas as to the improvement of the cemetery with the possibility of acquiring the adjoining lot as ad- ditional space for future use. Councilman Keeler discussed the problem of the accumulation of leaves and debris left by gardeners at this time of the year along the curbs instead of carting it away. The Supervisor explained the different methods used in the last fear years to dispose of this material , and it was decided to call Mr. Keeler ' s comments to the attention of Mr. Foote. The Supervisor informed the members of the Board that he would be out of town for the next few weeks and recommended that Councilman Stiner take his place at the 'Mater Board meetings , and to act in place of the Supervisor at the Town Board meetings. On motion by Councilman Embury , seconded by Councilman Griffin, it was upon roll call , unanimously RESOLVED, that Munroe Stiner , a councilman of the Town of Mamaroneck, is hereby designated to represent the Town in the place of the Supervisor at meetings of the Board of Trustees of Westchester Joint water Works No. 11 to be held between the date of this meeting and December 1 , 1944; FURTHER, that he be the presiding officer at meetings of the Town Board of the Town of Mamaroneck to be held from the date of this meeting to December 1 , 1944. Ayes: Supervisor Mandeville Councilmen Embury , Griffin, F.eeler Not Voting: Councilman Stiner The Supervisor presented the following resolution, which was on motion by Councilman Keeler , seconded by Councilman Griffin, unanimously adopted: RESOLVED , that the Supervisor and the Comptroller be and they hereby are authorized to transfer funds in the 1944 Budget , as follows: Outside Villages Police Department: From: Police Sergeants - $1 ,928.40 57 To: Police Chief - $ 190.00 Police Lieutenant - 163.68 Police Patrolmen - 1, 574. 92 FURTHER RESOLVED, that the resolutions authorizing the transfer of funds to meet the five per cent war emergency bonus to the uniformed police force , at the meetings held on January 5, April 1 , and May 23 , 1944, be and they hereby are rescinded. Attorney Delius called to the attention of the Board that the County Transportation Co. Inc . has been operating a so-called al- ternate route through the Ridge section of the Town not authorized by the Public Service Commission, and since the Company must apply at once for amendment of its Certificate , the Town Board must give its consent to the proposed change for that part of the route within the Town boundaries , if it is to be continued. After consideration, the following resolution was on motion by Councilman rmbury , seconded by Councilman Griffin, unanimously adopted: WHEREAS , application has been made by County Trans- portation Company, Inc . , requesting consent for the operation of motor buses for the transportation of passengers and property carried by said passengers , for hire , in, upon, along , and across certain streets in the Town of Mamaroneck, under the provisions of Sections 66 and 67 of the Transportation Corporations Lave of the State. RESOLVED, that a public hearing on the request and application of County Transportation Company, Inc. be held on the 15th day of November , 1944, at 8:30 o' clock P.M. in the Council Room at the Weaver Street — Fire House , on Weaver Street in the Town of Mamaroneck, before the Town Board , and be it FURTHER RESOLVED, that the Town Clerk be and he hereby is authorized , empowered and directed to have published in the Mamaroneck Daily Times , the official newspaper of the Town of Mamaroneck,, a suitable notice to be prepared by the Town Attorney , of such public hearing , such publication to be made on or before the 4th day of November , 1944. The Town Attorney recommended the following resolution, which was on motion by Councilman Keeler , seconded by Councilman Embury , upon roll call , unanimously adopted: WHEREAS ,at the annual salecf tax liens held by the Supervisor on the 28th day of May , 1930 , Bonded Capital Corporation duly purchased a tax lien in the amount of $291.92, affecting property in the Town of Yamaroneck, then designated as Section 6 , Block 16E , Lots 2 and 3B (now known as Block 611 , Parcel 513) on the Assessment Map of the Town of Mamaroneck, and then assessed to Guy Vroman; and WHEREAS , the premises subject to said lien are now owned by Nilaud Holding Corporation, having its grin- cipal office at 176 Broadway , Burough of 11anhattan, of which Mr. William A. Daly is president , and has furnished the following: (1) Satisfaction certificate signed by Bonded Capital Corporation showing payment of the amount of the lien to it; 259 (2) Affidavit of Archer U. Rodney, president of Bonded Capital Corporation, verified October 23rd , 1944, stating that according to available records of the said corporation, the lien was paid and satisfied and the original lien is rot in its possession: (3) Affidavit of Guy Vroman, verified October 26th, 1944 , from which it appears that he obtained the original lien from Bonded Capital Corporation by the payment to them of the amount due thereunder and that he has made due and diligent effort to find said lien and has been unable to do so and further statinv that the lien has never been assigned or transfered: (4) Undertaking and indemnity agreement executed by William A. Daly, October 23rd , 1944, indemnifying and saving harmless the Town of Mamaroneck against all damages , costs , expenses , costs and claims which may hereafter arise by reason of the pro- duction of the original transfer of tax lien: NOW , THERFFORE. , BE IT RESOLVED , that , pursuant to Section 54 of the Westchester County Tax Act , the Supervisor hereby is authorized , and directed to deliver to Nilaud Holding Corporation and/or William A. Daly , as president thereof , a duplicate of Tax Lien No. 93 , sale of 1930 , in the amount of $291.92 , af- fecting premises known as Section 6 , Block 16E , Lots 2 and 3B (noes Blocs; 611 , Parcel 513) on the Tax Assessment Map of the Town of Mamaroneck, to the end that the same may be delivered to the Receiver of Taxes , together with the satisfaction thereof and the affidavits and the indemnity agreement or undertaking , herein above recited , for can- cellation. The Supervisor informed the members of the Board that b?anager Johnson had telephonedhim that day stating that the Village Board of Trustees had decided not to accept the deed to the Swift property lo- cated. on Spencer Place. At the last meeting of the Town Board , he pointed out that a resolution was passed by our Board approving of this action. On motion by Councilman Stiner , seconded by Councilman feeler , it was upon roll call , unanimously RESOLVED, that the resolution adopted at the meeting of October 18, 1944, approving of the action to obtain the deed to the Swift Estate in lieu of foreclosure , be and it hereby is rescinded. - At 11 P.M. the Board unanimously resolved to adjourn.
