REGULAR MEETING OF THE TOWN BOARD, TOWN OF MAMARONECK
NEW YORK, HELD SEPTEMBER 20 , 1944.
In the Council Room of the Weaver Street Firehouse , Town of
Mamaroneck, New York.
The meeting was called to order by Supervisor Mandeville
at 8:15 P.M. (Eastern War Time) .
Present : Supervisor Mandeville
Councilmen Griffin, Embury , Stiner , heeler
Absent: None
The presence was also noted of Town Clerk Payne , Attorney
Delius , Assessor Smith , Comptroller Orsinc , Town Engineer and Supt.
of Highways Foote , and Accountant Finson.
The minutes of September 6 , 1944, were approved with cor-
rections.
The Supervisor requested the Town Clerk to read the con-
munications.
The Town Clerk advised that two (2) proposals had been re-
ceived for the replastering of the Public Welfare Office ceiling.
They appeared as follows:

Gentlemen:
We hereby submit estimate covering replastering v,-ork
to be done at the Public Welfare Office , 189 Prospect
Avenue , Mamaroneck , N.Y. , as follows :
Remove all old plastering and wood lath from the ceil-
ing of the Auditorium and replace xith wire lath and
plaster.
Repair - plaster walls on north side of Auditorium
on both sides.
Remove all debris from building and leave same broom
clean.

The above work to be done for the sum of SIX HUNDRED
EIGHTY-SEVEN DOLLARS ($687.00) .

material to complete the plaster work as per specifi-
cations for the sum of EIGHT HUNDRED FIFTY and 00/100
DOLLARS ($850.00) .

The members of the Board discussed the work to be done ,
and it was on motion by Councilman Stiner , seconded. by Councilman
Embury , upon roll call , unanimously
RESOLVED, that the contract be awarded to the
lowest bidder , Joseph Rigano , Inc. , for $687.00;
FURTHER, that the Building Inspector be author-
ized to supervise the work.
A thank you card for the expression of sympathy for the
death of Pvt. George W. McElroy , Jr. , was received from the parents ,
Mr. and Mrs. George W. McElroy. The card was ordered filed.
A letter dated September 20 , 1944, was received from Mr .
Wm. H. Johnson, Village Manager of the Village of Mamaroneck, in which
he advised the members of the Town Board that the Village Board had ap-
proved by resolution the sale of property known as Section 9 , Block 45,
Plot , to Mr. George B. Voetsch , for the sum of $3850. A certified copy
of the resolution was attached.
It was on motion by Councilman heeler , seconded by Council-
man Stiner , upon roll call, unanimously resolved:
WHEREAS , the Village of Mamaroneck has hereto-
fore acquired by deed in lieu of foreclosure ,
property known as Section 9 , Block 45, Plot on
the tax assessment map of the Village of I"amaro-
neck; and
WHEREAS , the Town of Mamaroneck owns certain tax
liens upon the same property which is known upon
the tax assessment map of the Town of idamaroneck
as Block 916 , Parcel 21 , representing arrears of
taxes due it which were heretofore levied atainst
said property; and
WHEREAS , the Village of Mamaroneck, by resolution
duly adopted September 18 , 1944, accepted an offer
from Mr. George B. Voetsch, for the purchase of said
property , in the amount of $3 ,850 , which acceptance
however , is conditioned upon similar action being
taken by the Town Board of the Town of Lamaroneck;
and
WHEREAS , this Board considers it to the best interests
of the Town of Mamaroneck to approve such offer and to
authorize the sale to the end that the property may be
sold free and clear of all taxes and the proceeds bf
sale , if any divided;
NOW, THEREFORE , BE IT
RESOLVED, that the Town Board of the Town of Mamaroneck
agrees that the property known as Section 9 , Block 45,
Plot on the tax assessment map of the Village of Mama-
roneck, and known upon the tax assessment map of the
Town of Mamaroneck as Block 916 , Parcel 21 , be sold
for $3 ,850;
FURTHER RESOLVED, that the net proceeds of such sale
shall be divided between the Town of Mamaroneck and
the Village of Mamaroneck proportionately to the
amount due each as of the date of such sale.
The report of the Town Clerk for the month of August , 1944 ,
was received and ordered filed.
The Supervisor asked if there was anyone present who wished
to address the Board.
Messrs. Philip and Emil Zvirin of Boehm & Co. were present.
Mr . Philip Zvirin addressed the Board by stating, that unfortunately
and uninowingly the Town had become a party to a transaction which
was unfair to his office.
He referred to the sale of vacant land by the Town to the
adjoining owner , Mr. John H. Baird. He said that he and his brother
Emil had spent a lot of time on trying to bring about the sale . He
related their business transactions with Mr. Baird and exhibited a
map which he claimed he had shown to Mr. Baird.
Members of the Board inquired if Mr. Zvirin or his office
had registered the name of the purchaser with the Town or any of its
officials.
Mr. Zvirin claimed that he stated to the Supervisor that
his prospective purchaser was the adjoining owner. He said that he
did not register the name of Mr. Baird with the Town.
Mr . Emil Zvirin addressed the Board by stating that he had
had many deals with the city of New Rochelle and in no case did he
have to register the name of the prospective purchaser. He added
that he believed that the commission on this transaction was fully
earned.
The members of the Board deferred action until they had
an opportunity to examine the file on the sale of this property.
The Supervisor asked if there wras anyone else who wished
to aprear before the Board.
Mr. T. Roosevelt Allen, President of the Westchester Shore
Humane Society , Inc. , appeared to request that the Town entertain an
offer for the lease of an industrial plot owned by the Town on Harrison
Drive , Village of Larchmont , and known as Parcel 671, in Block 601
on the assessment of the Town. He asked for a term of five years
at a gross rental of $300. per year. Also , an option for the pur-
chase of the land for $1 ,000. subject to approval by public refer-
endum, and referred to extracts of the Town minutes of September 1,
1931; November 2 , 1931; November 6 , 1935; and December 4, 1935, in
which the very same property had been referred to for the use of
a shelter.
He pointed out that in November 2 , 1931 the supervisor and
counsel vrere instructed to prepare contracts for the conveyance of the
land to the Humane Society but that this tras never carried out because
of some unknown reason.
The members of the Board discussed the matter completely
with Mr . Allen, following which , it was on motion by Councilman Stiner ,
seconded by Councilman Griffin, upon roll call , unanimously
RESOLVED , that the proposal of Mr . Allen be approved
in principal and that the Town Attorney be and he
hereby is directed to prepare a lease for the term
of three years fully covering the items in detail
as discussed by the members of the Board. and Mr .
T. Roosevelt Allen.
The Supervisor suggested that while matters of Town-owned
property are being discussed that it might be well to consider the
offer of Mr. A.F. Beringer for the land opposite his property on
Glencoe Pass at the corner of Fenimore Road.
There was discussion during which the Supervisor pointed
out that it appears that when the engineer laid out Glencoe Pass it
was intended as an entrance to the back land which was later to be
developed. He said that he believed that the sale of the property
referred to by Mr . Beringer might injure the possibilities for the
development of the back land.
Councilman Keeler stated that he had been inclined to
approve of the disposal of the property on the theory that it was
of little use but that the price equity is not always the answer.
He said that after listening to the Supervisor he believed the pro-
perty should not be sold. He asked if this property was on the
exempt list and when informed by the Assessor that it was he said
that there was one thing which he had discovered recently and that
is that properties which are on the exempt list and sold by the Tor!
do not carry a tax charge against the purchaser until the next roll.
Councilman Griffin inquired if it was not possible to
allow for the use of only one of the two entrances to Glencoe Pass.
The Supervisor asked the Town Engineer to explain the
layout shown on the map of this property.
There was considerable discussion during which Councilman
Embury pointed out some important factors , and it was on motion by
Councilman Stiner , seconded by Councilman Embury , upon roll call ,
unanimously
RESOLVED , that the offer submitted by Mr. Beringer
for the purchase of property known as Block 312 ,
Parcel 45 on the assessment map of the Town of
Mamaroneck, bordered by Glencoe Pass and Fenimore
Road , be and it hereby is denied.
FURTHER RESOLVED, that the assessment roll for
the year 1943 , taxes of 1944, and the assessment
roll for the year 1944, taxes of 1945, which show
property now appearing on the rolls as follows :

Councilman Embury stated that there was nothing to report
for his departments.
Councilman Stiner reported that the Town Engineer had placed
a sign at the entrance to the bridge on the road to Premium Point warn-
ing the users that they were doing so at their own risk. He also ad-
vised that New Rochelle had placed a sign on their side of the bridge.
He informed the Board that the pump in the station near the
corner of Colonial Avenue and Murray Avenue had failed again and sug-
gested that an item of $250. be placed in the budget for a new motor.
He said that he would bring the matter up again at the time the budget
is to be prepared.
Councilman Keeler reported that the proposed budget for in-
surance for 1945 had been received from Mr. Sutton and that he had
checked the same and marked a few items which he would go over with
Mr. Finson. He recalled to the members of the Board that at the budget
meeting held last year there had been a suggestion that policies be
placed on a three-year basis where possible . He advised that this was
being done on a gradual plan and that some of the renewals would be
for this term.

The Supervisor stated that it was in order to receive the
reports of committees.
Councilman Griffin presented the following reports , which
were, received and ordered filed: Claims audited and paid by the
Comptroller from September 6 to September 20 , 1944; Statement of
Bank Balances as at 9 A.M. September 20 , 1944; Report of the Super-
visor for the month of August , 1944; Analysis of Estimated Revenues;
Analysis of Budget Appropriations and Expenditures; Summary of Re-
ceipts and Disbursements.
Councilman Griffin moved for the approval of the following
petitions received from the Assessor , and Councilman Embury seconded
the resolution, which was , upon roll call , unanimously adopted:
WHEREAS , the Assessor has presented petitions for
the correction of the assessment roll for certain
years , pursuant to the provisions of Section 33 of
Chapter 105 of the Laws of 1916 , as amended , known
as the Westchester County Tax Act; and
WHEREAS , after due consideration this Board finds
it desirable to grant said petitions for the cor-
rection of said assessment roll;
NOW, THEREFORE , BE IT

school tax of 1944, which shows property now appear-
ing on the roll as follows:

He reported for the Fire Department by advising the members
of the Board that a test was held at the extreme northern end of the
district on Old White Plains Road. He gave the results of the test
and explained that about 1500 feet of hose was required to reach
the site of the test from the hydrant. He said that the direct pres-
sure from the hydrant itself gave little or no stream. That with one
pumper near the hydrant and one at the site of the test , it was possible
to get up a strong pressure.
He explained that the Town Engineer has all the data and
that a further report would be made at a later meeting.
Councilman Feeler inquired if the Town had purchased the
two ambulances being used by the Red Cross and referred to an accident
which had happened a few days before this meeting at which an ambulance
would have been quite useful.
The Supervisor informed Councilman Keeler that the ambulances
were not bought out of Town funds but that he believed they were bought
from contributions from the public in general.
Councilman Keeler stated that he believed that if one of the
ambulances could be placed at the disposal of the Police Department ,
or that in case of necessity they have access to same , it would be
advantageous to the residents of the community.
He said that now that he had been informed he did know! i whom
to approach on the matter.
The Supervisor recommended that a resolution should be
adopted expressing appreciation to the several departments of the Town
for their splendid and courageous service during the hurricane which
occurred on September 14, 1944.
Councilman Griffin pointed out that it was not generally
known that the Supervisor was out during the whole time of the storm.
He recommended that a resolution be adopted which would commend all
of the departments , including the Supervisor.
He offered the following resolution, which was seconded by
Councilman Embury and approved by the vote of the Councilmen:
WHEREAS , on September 14, 1944, storm warnings were
given along the eastern seaboard that a hurricane
was moving up the Coast; and
WHEREAS , the Supervisor , the Town Police , the Fire-
men, the Public Works Department , and the Civilian
Defense Volunteers were alert and mobilized for any
eventuality; and
WHEREAS , the hurricane did strike and endanger our
citizens with fallen trees by the hundreds , live wires,
high water , fire , loss of light and communications; and
WHEREAS , the forces of the Town did meet the situation
and carry on throughout the entire night and the follow-
ing day in complete cooperation while in great risk of
their lives; and
WHEREAS , no fatalities occurred in the Town as a result
of the storm;
NOW, THEREFORE , BE IT
RESOLVED , that the Town Board , on behalf of the citizens
of the Town, publicly extend thanks for the marvelous
manner in which the safety of our people was protected;
FURTHER, that the record of this splendid work be
spread upon the minutes of this meeting and that a
copy of this resolution be published.
The Supervisor recommended the approval of the following,
which were on motion by Councilman Embury, seconded by Councilman Stiner ,
upon roll call , unanimously
RESOLVED, that the Receiver of Taxes and Assessments
be and he hereby is authorized , empowered and directed
to accept payment of the following taxes on property
known as Block 208, Parcel 103 , at the face amount
of the liens plus interest at the rate of six (6)
per cent from the date of sale :

cent from the date of sale:

On motion by Councilman Embury, seconded by Councilman Stiner ,
it was upon roll call , unanimously
RESOLVED, that the Receiver of Taxes and Assessments
be and he hereby is authorized , empowered and directed
to accept the face amount of the liens plus interest
at the rate of six (6) per cent from the date of sale ,
in payment of the following tax liens on Block 928 ,
Parcel 352 , to be assigned to the Atlantic Municipal
Corporation, New York, N.Y.

RESOLVED , that the Receiver of Taxes and Assessments
be and he hereby is authorized , empowered and directed
to accept the sum of $529. 18 in full payment of the
following tax liens , owned by the Town of Lamaroneck:

FURTHER RESOLVED, that the 1944 town tax in the amount
of 547. 58 , plus penalty of 53.33; and the 1944 school
tax of $47. 14 be paid in full.
The Supervisor announced that he had at hand an offer in
the amount of $1,000 from Edward J. Payne , real estate broker , on
behalf of his client , Mr. Jules M. Gorlitz , owner of property formerly
known as the Lansberg residence , for adjoining property owned by the
Town and known as Block 942 , parcel 710 and part of Parcel 659 , on
the assessment map of the Town.
The Supervisor advised that there was earlier correspondence
and that the complete file was at hand, and it was decided that the file
be handed to Councilmen Keeler and Stiner , committee on properties within
the Village of Mamaroneck, to take the question of the sale up with the
Village of Mamaroneck officials , and report back at the next meeting.
Following a discussion, it was decided that a special meeting
be held on Wednesday evening , September 27 , 1944 at 7:30 P.M to con-
Sider the report of the Town' s auditors , Glick-Freedman, for the year
1943.
At 10:15 P.M. the Board unanimously resolved to adjourn.
