HomeMy WebLinkAbout1944_07_12 Town Board Minutes REGULAR MEETING OF THE TOWN BOARD TOWN OF MAMARONECK, NEW YORK HELD JULY 12, 1944 In the Council Room of the Weaver Street Firehouse , Town of Mamaroneck, New York. The meeting was called to order by Supervisor Mandeville at 8:15 P.M. (Eastern War Time) . Present: Supervisor Mandeville Councilmen Embury, Stiner , Keeler Absent: Councilman Griffin The presence was also noted of Town Clerk Payne , Town Attorney Delius , Assessor Smith, Comptroller Orsino, and Welfare Officer DeVinne. The minutes of June 21, 1944, were approved as presented. The Supervisor requested the Town Clerk to read the communi- cations. A letter dated July 12, 1944, was received from Mr. Wm. H. Johnson, Village Manager, Village of Mamaroneck, with which he enclosed certified copies of resolutions adopted by the Village Board of Trustees on June 26 , 1944, as follows : "On motion of Trustee Withers , seconded by Trustee Kuhn: RESOLVED , that the bid received from the office of Edward Block in the sum of $900. for property known as Section 9, Block 11, Lot 20A-1 (Treupel Shaw Building) be and the same hereby is accepted, which acceptance , however, is conditioned upon ap- proval of said bid by the Town Board of the Town of Mamaroneck. Ayes: Withers, Dooley, Kuhn, Santoro Nayes: None On motion of Trustee Dooley , seconded by Trustee Withers: RESOLVED, that the bid from the office of Michael L. Walsh in the sum of $1 ,800.00 for the purchase of property known as Section 9 , Block 45, Plot (Schroeder property) be and the same hereby is accepted, conditioned, however, upon there being excepted from the plot an area of approximately 500 sq. ft. which is to be re- served to the Village for highway purposes , and further conditioned upon the approval of said bid by the Town of Mamaroneck. Ayes: Withers, Dooley, Kuhn, Santoro Nayes: None" An earlier letter dated June 28, 1944 and attached to the papers advised that the following bids received for the property known as the Seigle Estate , also known as Section 9 , Block 66, Lot 1, had been rejected: 114 Edward J. Payne - client , Morway Pickett - $5,250 Howard S. Meigha.n - for an interested party - 3 ,000 Barney Epstein, Inc. - for a client for all three parcels - 59000 The Supervisor called to the attention of the Board that these three parcels had all been advertised in one advertisement for which bids were received on June 23 , 1944 by the Village and acted upon by their Board on June 26 , 1944. Also that Councilmen Keeler and Stiner had been appointed at an earlier meeting to examine and discuss with the Village officials properties which are offered for sale. He said that he believed that there was some understanding to the effect that all three of these parcels should have been sold for the highest bids. How- ever, the Village officials had rejected the offer for the sale of one of the parcels. He added that since bids had been received by the Vil- lage another bid had been received for the Schroeder property which bid was in an amount equal to $500. in excess of the single bid received as a result of the advertisement. Full discussion was held on all three parcels during which Councilmen Feeler and Stiner reported on their examination of the pro- perties and talk with the Village officials. It was the opinion of the members of the Board that due to the misunderstanding on the Seigle property, and also that it appears that the market has improved, it might be well to readvertise all three parcels of land. It was on motion by Councilman Embury, seconded by Councilman Keeler , upon roll call , unanimously RESOLVED , that the recommendations of the Board of Trustees of the Village of Mamaroneck regard- ing the sale of the three properties mentioned and the prices set in the letters dated June 27 and June 28, 1944, from Village Manager Johnson be not approved at this time and that the Clerk so notify the Village manager and indicate to him that this Board wishes to recommend that all three properties be readvertised for sale. There was also received from the Village of Mamaroneck a certified copy of the following resolution adopted by the Village Board of Trustees on June 26 , 1944. The property referred to being owned by the Town of Mamaroneck and the approval of sale by the Town was given at the last regular meeting of the Town Board: On motion of Trustee Withers, seconded by Trustee Kuhn: RESOLVED, that the Village Board hereby approves of the offer of $900. made by Mrs. Artemise Casanave to the Town of Mamaroneck for the purchase of property known as Section 9, Block 89A, Lot 4 , on the Village map, and Parcel 169 , Block 942, on the Town map." The Town Clerk called to the attention of the Board that the list of polling places should be considered for approval. He pointed out that there was only one change from the last list , this being in the Ninth Election District where the store formerly used is now rented, and it became necessary to take space at 1989 Palmer Avenue. On motion by Councilman Keeler, seconded by Councilman Embury, it was , upon roll call , unanimously RESOLVED, that in accordance with the provisions of Section 66 of the Election Law, being Chapter 17 of the Consolidated Laws of the State of New York, as amended, the Town Board of the Town of Mamaroneck hereby designates the place in each election district in the Town at which the meeting for the registration of voters and elections and primaries shall be held in the year following. The Town Clerk called to the attention of the Board that the rate of pay for the election inspectors who were appointed at the last meeting should be approved. The Town Attorney recommended the following resolution which was on motion by Councilman Keeler , seconded by Councilman Stiner, upon roll call, unanimously - RESOLVED, that pursuant to Section 49 of the Election Law, the fees or compensation of inspectors of election in the various election districts of the Town of Mamaro- - neck for services to be rendered during the term of their office be fixed at the rate of pay provided for in the current Budget , namely, $8.00 per day in the incorporated sections and $10.00 per day in the unincorporated section, The Town Clerk informed the Board that Mr. Joseph Rigano had called at the office and had presented an affidavit verified by Edward J. Payne , dated July 11, 1944, stating that he was the holder of a tax lien in the sum of $5.72 on property known as Block 902, Parcel 298, which he had purchased at the Tax Lien Sale of the Town of Mamaroneck on ruay 26 , 1926 , and that he had lost the lien and the amount had been paid to him, and that he agrees to indemnify the Town of Mamaroneck against loss in case the lien was found. He also presented a satisfaction from Mr. Edward J. Payhe. On notion by Councilman Stiner , seconded by Councilman Embury, it was , upon roll call , unanimously RESOLVED, that upon the affidavit and satisfaction thus presented and duplicate lien issued which to- gether with the satisfaction and affidavit , will be sufficient to cancel the lien showing the same as having been paid. A petition was received from the Assessor requesting the ap- proval of a number of pages from the assessment naps showing corrections made by the Town Engineer as of June 1, 1944; such correction being due to the sale or transfer of lots or plots , filing of naps in the Depart- ment of Land Records in White Plains, and so forth. On motion by Councilman Stiner, seconded by Councilman Embury, it was unanimously RESOLVED, that the Board approved of the changes in the assessment maps of the Town of Mamaroneck as of June 1 , 1944, and the said maps are hereby corrected and rectified as of June 1, 1944, in the following places: Page: 606 , 6099 6162 705, 706, 709, 710, 719, 720 , 721, 724, 725, 728 , 815, 817, 818, 823 , 824, 825, 826 , 830 , 831, 832, 833 , 902, 906 , 915, 933, 936 , 942, 943 , 949, 952. The Town Clerk informed the Board that during the day of this meeting Mr. Carl Tortorella of Myrtle Boulevard, Town, stopped in to the Town Offices and advised that he had failed to renew his Plumbing License for the year 1944. He requested that the Town Board waive the thirty day period for renewal so that he could obtain the license. Following some discussion, it was on motion by Councilman Keeler , seconded by Councilman Stiner, upon roll call, unanimously RESOLVED, that the provision in the Plumbing Code re- quiring the renewal of license within thirty days fol- lowing the expiration of same be waived so as to permit the Town Clerk to issue the renewal of license to Mr. Carl Tortorella. 123 FURTHER, that the Town Clerk be and he hereby is authorized to renew sane upon the payment of the usual fee by Mr. Tortorella. The following reports for the month of June , 1944, were received and ordered filed: Report of the Receiver of Taxes and Assess- ments; Report of the Town Clerk; Report of the Building Inspector; Report of the Westchester County Dog Protective Association; Report of the Mamaroneck Health Center. The report of the Department of Public Welfare for the month of June , 1944, which showed as follows , was received and ordered filed: Year Case Load Individuals Total Exrenditures 1943 36 83 $ 19187.21 1944 30 64 1,391.04 The Supervisor informed the members of the Board that Council- man Griffin was dismissed from the New Rochelle Hospital and is now at home. He said that he thought Mr. Griffin would be able to attend the next Town Board meeting. He stated that it was in order to receive the reports of Committees. Councilman Embury informed the members of the Board that at a meeting of the Police Pension Fund, Town of Mamaroneck, held June 21, 1944, a resolution was adopted authorizing the treasurer to purchase 2.50% coupon war bonds , 5th Series, in the total sum of $3 ,000. He called to the attention of the councilmen that the new provisions in the law granting to councilmen the same powers as a notary public might cause an inconvenience to all concerned. He referred to the bulletin of the Associations of Towns and pointed out that the acknowledgment forms described were not in proper form. He also stated that he could see no way in which a county clerk' s certificatd could be given to certify the signatures. Councilmen Embury stated that he thought it well to offer the above information to the councilmen. Councilman Keeler stated that he thought that the provision was probably allowed as a matter of convenience for those who would file papers with the town boards throughout the State. Councilman Stiner reported that the Board of Review of Assess- ments had held its meetings in accordance with the law and that 299 appli- `cations for reduction of assessments had been filed, this being far below previous years. That eight sections out of nine had been reviewed ex- cluding the apartment properties and the business areas. These , he said, would be taken as a group to consider. To date there has been granted reductions totaling $39,000. He reported for the highway department by stating that they had cleaned the streets , the catch basins and some of the sewers. He informed the Board that the old dump has been closed and a sign placed stating that no dumping is allowed. He advised that a new location has become available. Councilman Keeler reported on some insurance matters and stated that there was nothing to report for the other departments. The Supervisor asked if there was any one present who wished to appear before the Board. Mr. Dominick Colantino of Prospect Avenue , fl4amaroneck, N.Y. , appeared before the Board to request a compromise of tax arrears dating back to 1930 , on property known as Block 821 , Parcel 388. The members of the Board examined the statement of taxes which had been prepared by the Tax Office. The Assessor was asked to describe the property and there was discussion following which it was on motion by Councilman Stiner , seconded by Councilman Embury, upon roll call, unanimously RESOLVED, that the Receiver of Taxes and Assessments be and he hereby is authorized to accept the sum of $250.00 in payment of the following described liens on property known as Block 821, Parcel 388: Year of Salle Amount- of Lien 1931 $ 27.45 1933 19.44 1934 26.55 1936 30.22 1937 35.66 1939 41.05 1940 34.24 1941 35.30 1942 35.73 1943 37.27 1944 410.47 FURTHER, that the current state, county and town tax in the amount of $16. 55, plus penalties , be paid. Also provided that both sums are paid within ten days. The Supervisor asked if there was any one else to appear before the Board. There being no one , he presented the following: Statement of Bank Balances as of 9 A.M. , July 12, 1944; Report of claims audited and paid by the Comptroller from June 21 to July 12, 1944; Resume of the financial position of the Town for the first six months of the year 1944. He also furnished the members of the Board with a statement of unpaid balances of State , County , Town, District taxes , special assessments and water arrears as of July 1, 1944, showing the amounts by the three sections of the Town - the unincorporated section, the Village of Larchmont , and the Village of Mamaroneck. Also by tax sections One to Nine. Copies of the above were distributed to the members of the Board. He informed the Board that the Joint Commission on Garbage Incineration had decided upon his suggestion that instead of the two engineers - one from the Town and one from the Village of Larchmont - being in supervision of the incineration plant at one time , that each engineer supervise the plant for six months. Ear. Richards of Larchmont to serve the first six months and Mr. Foote of the Town to serve the second six months. Under this plan he said that he believed that one person at a time would assume the responsibility of the operation of the plant and that this would work out very much better than the previous plan. The Supervisor stated that he had at hand correspondence from Mr. C.C. Merritt and Town Engineer Foote , concerning the proposed abandon- ment of "old Weaver Street" which adjoins the park area at the intersection of new Weaver Street and Palmer Avenue. He said that the Town Engineer reported that it is not used as a street or park area. After discussion, it was decided to proceed with the necessary steps to abandon this portion of cleaver Street and add it to the park area. The matter was referred to the Town Attorney for a report at the next meeting. The Supervisor informed the members of the Board that the Atlantic Municipal Corporation had offered to purchase certain tax liens from the Town of Mamaroneck at the face amount of the tax liens together with interest at six per cent from the date of sale. Following some discussion, it was on motion by Councilman Embury, seconded by Councilman Stiner , upon roll call , unanimously RESOLVED, that the Town of Mamaroneck sell and assign to Atlantic Municipal Corporation the fol- lowing described tax liens now owned by the Toxin of Mamaroneck at the amount set opposite the lien, which represents the amount of the lien, plus six per cent interest per annum from the date of sale: Year of Interest Amount Sale Block Parcel Total Lien at 615 Due 1944 902 224 $ 324.04 1.62 $ 325.66 1944 937 159 671.04 3.85 674.89 1943 907 191 287.71 18.70 306.41 The Supervisor stated that he had at hand the correspondence in connection with the strip of land adjoining the property of Mr. Lewis C. Smith, Jr, at number 39 Barnum Road, known as Block 210 , Parcel 784, on the assessment map of the Town of Mamaroneck. He recalled that the matter had been placed before the Town Board at the last meeting and that action had been deferred awaiting a report from the Assessor. He said that the report had been filed and that in a letter dated June 27, 1944, Pair. Lewis C. Smith, Jr, offered his check in the amount of $50.00 for the purchase of same. Following some discussion, it was on motion by Councilman Stiner, seconded by Councilman Keeler, upon roll call, unanimously - RESOLVED, that this Board convey to Louis C. Smith, Jr. certain property now owned by the Town which is bounded and described as follows: All that Lot , Plot , or Parcel of land lying being and situate in the Town of Idamaroneck, Westchester County, New York and known by and as the three (3 ' ) foot Reserved Strip along the easterly boundary of Lot No. 1, Block 425 on map entitled "Plan of Lots called Larchmont Gardens situate in the Town of Mamaroneck, County of Westchester and State of New York" , made by Long & Puller , Civil Engineers, and filed in the County Clerk' s office , Division of Land Records (formerly Register ' s Office) on September 11 , 1911 as map number 1949 , said Lot , Plot or Parcel being more particularly bounded and described as follows: BEGINNING; at a point in the northerly line of Edgewood Place (now called Barnum Road) where the same is intersected by the easterly line of Lot 1, Block 425 on above mentioned map, thence northwesterly along said easterly line of Lot No. 1, N 320-28'-34" 71 97. 58 feet; N 30-23-25" W 56.44 feet to the north- easterly corner of Lot No. 1 , thence northeasterly at right angles to the last course , across the "Reserve Strip" a distance of three (3 ') feet to a point in the westerly boundary of lands now or formerly of the Highridge Realty Corp. , (commonly called the Larchmont Sports Club) and thence in a southeasterly direction along said westerly boundary line S 300-23 '-25" E 56.42 feet; S 320-28' -34" E 97.34 feet to the northerly line of Edgewood Place (Barnum Road) thence in a southwesterly direction along the northerly line of Edgewood Place a distance across the Reserve Strip of 3.01 feet to the place or point of BEGINNING. FURTHER RESOLVED, that this resolution is subject to a permissive referendum as provided in Section 64, sub- section 2, of the Town Law, and that the Town Clerk is authorized and directed to give notice of the adoption of this resolution as provided in Section 90 of the Town Law. FURTHER RESOLVED, that , subject to a permissive referendum, such conveyance be made by quit claim deed and that the Town Attorney be authorized to prepare such a deed. TAKE FURTHER NOTICE , that the adoption of the said re- solution is subject to referendum upon a petition being filed with the Town Clerk, as provided in Section 91 of the Town Law. The Supervisor read a letter dated July 11 , 1944, received from John H. Baird, 1 Dundee Road, Town, in which Mr. Baird offered to purchase property adjoining his residence , known as Parcels 423 and 386 , Block 211, on the assessment map of the Town, for the total sum of $1,778.70. A check for this amount was attached. The Supervisor read the statement of costs , which included foreclosure of the property showing the Town' s total investment of $1 ,778.70. He called to the attention of the. Board that if the offer was accepted that the Town would receive full return on this property. Following some discussion, it was on motion by Councilman Stiner , seconded by Councilman Embury, upon roll call , unanimously RESOLVED , that the offer of John H. Board, in the sum of $1 ,778.70 , for the purchase of parcels known as 423 and 386 , Block 211, on the assessment map of the Town of Mamaroneck be approved and that the papers be referred to the Town Attorney for the preparation of the contract of sale and the transfer of title. The Supervisor presented correspondence between Mr. O.B. Lewis 35 Avon Road , Town, and the Town Attorney which included a final letter from Mr. Lewis dated July 11, 1944, offering his check in the amount of $1,437.60 for the purchase of property known as Parcel 565, Block 208 on the assessment map of the Town, which property adjoins the residence of Mr. Lewis. The Supervisor read the statement of costs to the Town which included the foreclosure and showed a total sum of $1,437.60. Again the Supervisor pointed out that this was also an offer giving full return to the Town. Following some discussion, it was on motion by Councilman Stiner , seconded by Councilman Embury , upon roll call , unanimously RESOLVED, that the offer of Mr. O.B. Lewis , in the sum of $1,437.60 , for the purchase of property known as Block 208 , Parcel 565, on the assessment map of the Town of Mamaroneck be approved, and that the papers be be referred to the Town Attorney for the preparation of the contract of sale and the transfer of title. A request was received from Mr. Henry P. Rubin of Dawes Place , Larchmont , for the settlement of certain tax arrears on property known as part of Parcel 442 , Block 609, on the assessment map of the Town. Action was deferred because there was no check attached. The Supervisor asked 'Welfare Officer DeVinne , who was present , if he had anything to place before the Board. Mx. DeVinne reported that the ceiling in the offices of the Welfare Department in the old Town Hill was breaking loose. He advised that more than ten years ago a panel ceiling board was applied on to the old ceiling and he believed that the nails had rusted away. That with the poor condition of the old ceiling it permitted plaster to break loose and fall. He said that it was a very dangerous condition. Following some discussion the Supervisor requested Councilman Stiner to examine the condition and make recommendations. The Town Attorney discussed with the members of the Board the possibility of settling the certiorari now pending on property of Theresa H. Semon, locatdd on Old white Plains Road. Following some discussion, Attorney Delius said that he would make a further report at the next meeting. At 11 o'clock the Board unanimously resolved to adjourn. Town Clerk
