TOWN OF MAMARONECK, NERI YORK
HELD JUNE 21, 1944
In the Council Room of the Weaver Street Firehouse , Town of
Mamaroneck, New York.
The meeting was called to order by Supervisor Mandeville at
8:15 P.M. (Eastern War Time) .
Present: Supervisor Mandeville
Councilmen Embury, Keeler , Stiner
Absent: Councilman Griffin
The presence was also noted of Town Clerk Payne , Attorney
Delius , Assessor Smith and Comptroller Orsino.
The minutes of the meeting of June 7, 1944, were approved
as presented.
The Supervisor informed the members of the Board that he had
visited Councilman Griffin at the New Rochelle hospital where he is
convalescing following an operation and that Mr. Griffin is doing very
nicely, also that he had telephonedthe hospital during the day of this
meeting and again was informed the Mr. Griffin is getting along quite
well.
The members of the Board expressed their wishes for his early
recovery.
The Supervisor requested the Town Clerk to read the com-
munications.
A petition was received from the Assessor requesting the
approval of a number of pages from the assessment maps showing cor-
rections made by the Town Engineer as of June 1, 1944, such corrections
being due to the sale of or transfer of lots or plots , filing of maps
in the Department of Land Records in White Plains , and so forth.
On motion by Councilman Embury, seconded by Councilman Stiner ,
it was unanimously
RESOLVED, that the Board approves of the changes
in the assessment maps of the Town of Mamaroneck
as of the first of June , 1944, and the said maps
are hereby corrected and rectified as of June 1,
1944, in the following places:
Page : 101, 102, 103 , 107, 112 , 118, 119, 120 ,
121, 122, 123 , 124, 125, 132 , 208, 215,
329 , 340 , 401 , 403 , 410 , 412 , 414 , 417,
509 , 726.
A letter dated June 13 , 1944, was received from Receiver of
Taxes Dillon, stating that the Atlantic Municipal Corporation has of-
fered to purchase by assignment certain tax liens held by the Town
on Block 106 , Parcel 376. Also another letter stating the same for
Block 906 , .Parcel 1.
Following some discussion, it was on motion by Councilman
Keeler , seconded by Councilman Embury, upon roll call , unanimously
RESOLVED, that the Receiver of Taxes and Assessments
be and he hereby is authorized, empowered and directed
to accept the sum of $973.71, in payment of the follow-
ing tax lien on Block 106 , Parcel 376 , to be assigned
to the Atlantic Municipal Corporation, New York, N.Y. :

FURTHER RESOLVED, that the Receiver of Taxes and
Assessments be and he hereby is authorized, empowered
and directed to accept the sum of 51110.98 in payment
of the following tax lien on Block 906 , Parcel 1, to
be assigned to the Atlantic Yunicipa.l Corporation,
New York, N.Y.

A letter dated June 20 , 1944, was received from &"orris Stern
Agency, Real Estate , in which Mr. Stern stated that a client of his
office , Mr. Samuel Paonessa , was interested in purchasing an adjoining
lbt to his place of residence , in which there are tax arrears dating
back to 1938. That the Town waive the penalties and interest on these
taxes so that the transaction could be completed and thereby place the
property in good standing on the Town' s records. A statement showing
these tax arrears and a sketch of the property had been furnished by
the tax office.
There was some discussion during which the members of the
Board indicated their approval of the settlement of the taxes , but
did not take formal action pending receipt of a check to cover same.
A letter dated June 21, 1944, was received from Louis C.
Smith, Jr. , 39 Barnum Road , Town, in which he inquired about a re-
served strip of land which borders his property on the easterly side ,
which is about three feet wide. He stated that if the Town was in a
position to sell this strip, and was willing to do so, that his offer
for the purchase of same would be in the amount of $45.00.
There was some discussion as to ownership and the value of
same , following which the matter was referred to Assessor Smith for
a report at the next meeting.
The Town Clerk called to the attention of the Board that
the next meeting of the Board of Plumbing Examiners would be held on
June 30, 1944, and that through the death of Dr. LeFurgy there was a
vacancy, and that the Code required that one members of the Board should
be a physician.
After some discussion the members of the Board decided to
defer action on the appointment until the next meeting of the Town Board.
A claim in the amount of $568.40 was received from The Daily
Times , Mamaroneck-Larchmont Publishing Co. Inc. , in which the charges
were made for the publication of notice of the sale of tax liens which
was held on May 24, 1944. The notices appeared on May 3,10 , and 17, 1944.
Following some discussion, it was on motion by Councilman
Keeler, seconded by Councilman Embury, upon roll call, unanimously
RESOLVED, that the Comptroller be and he hereby
is authorized to audit the claim of The Daily Times
for the services rendered, and that the Supervisor
be authorized to appropriate from 1943 surplus funds
the amount to pay same.

The Town Clerk presented a claim dated June 15, 1944, re-
ceived from Alexander Finson, Town Accountant , for expenses for a trip
to Albany to confer with the Deputy Comptroller of the State; also to
file plans with the Post war Planning Commission.
The Supervisor informed the members of the Board that he
directed Pair. Finson to make the trip.
It was on motion by Councilman Stiner, seconded by Councilman
Keeler , upon roll call, unanimously
RESOLVED, that the claim dated June 15, 1944, filed
by Alexander Finson, Town Accountant, be and it hereby
is approved, and that the payment of same be made from
the item in the 1944 Budget for such purpose.
The Town Clerk reported that pursuant to the provisions of
the Election Law,the chairman of each major political party had filed
their lists of recommendations for the appointment of election in-
spectors. The lists were examined by the members of the Board and
passed on to the Supervisor for his action.
The Supervisor filed the following certificate:

The Town Clerk called to the attention of the members of the
Board that during the last presidential election two (2) machines were
rented from the Automatic Voting Machine Corporatioh, because of the
increase in registration, lie stated that he had discussed the matter
with the Supervisor and that it was believed that one (1) additional
machine would be necessary for the coming presidential election.
Following some discussion, it was on motion by Councilman
Reeler, seconded by Councilman Stiner , upon roll call , unanimously
RESOLVED, that the Town Clerk be and he hereby
is authorized to order the rental of one (1)
voting machine from the Automatic Voting Machine
Corporation, at the rental price of 8125.00, plus
transportation. The charge to be made against the
Budget for Election purposes.
The Town Clerk presented an application for dance hall license
received from the Loyal Inn Corporation, which had been on file in the
Town Clerk' s office since the first of the year and held in abeyance
until the approval of the New York State Department of Labor had issued
its certificate of compliance of the State Standard Building Code.
The Town Clerk informed the Board that all the requirements
of the State had now been met , and explained that because of war con-
conditions there was delay in getting panic bolts for the exit doors.
It was on motion by Councilman Stiner, seconded by Councilman
- Embury, upon roll call , unanimously
RESOLVED, that the Town Clerk be and he hereby
is authorized to issue the dance hall license
to the Loyal Inn Corporation, for the term end-
ing December 31, 1944.
The report of the Welfare Department for the month of May,
1944, which showed as follows , was received and filed.

The report of the Town Clerk for the month of May, 1944, was
received and ordered filed.
The Supervisor stated that it was in order to continue the
consideration of the application of the Scarsdale Bus Company to operate
buses from Palmer Avenue in the unincorporated section on which a public
hearing was held at the last meeting of the Town Board.
The Town Clerk informed the Board that there was a letter dated
June 20, 1944, received from the County Transportation Company, Inc. , by
E.R. Brumley , General Attorney , in which the Company filed its objections
to the granting of the consent to the Scarsdale Bus Company.
Mr. Thomas R. Fisher, representing the Scarsdale Bus Company,
was asked by the Supervisor if he had anything to say.

Mr. Fisher said that he had made his appearance to explain
the proposed schedule and the fare zones , and to furnish any other
information required by the Board. He explained the proposed fares
and answered the questions put by the members of the Board.
Following discussion, it was on motion by Councilman Embury ,
seconded by Councilman Stiner , upon roll call, unanimously resolved:
- WHEREAS , upon application of Thomas R. Fisher , Jr. and
Garrison R. Corwin, doing business as Scarsdale Bus Com-
pany, this Board heretofore and on the 12th day of June ,
-- 1942 and on the 19th of May, 1943 , granted a permit or
consent , pursuant to Sections 66 and 67 of the Transpor-
tation Corporations Law, to operate buses along 4Ueaver
Street to Myrtle Boulevard, along Myrtle Boulevard to
Chatsworth Avenue and along Chatsworth Avenue to the Vil-
lage of Larchmont and also along Palmer Avenue between the
Village of Larchmont and the City of New Rochelle , this being
part of a proposed through route between the City of White
Plains and the City of New Rochelle ; and
WHEREAS , the Public Service Commission has , to date
authorized the operation of the bus route only along
that part of the route from the boundary line of the
Village of Larchmont to the boundar , line of the Town
of Scarsdale and has , so far , refused to grant permission
to operate along Palmer Avenue ; and
WHEREAS , the permit or consent last granted on Yay 19th,
1943 , expired by limitation contained therein, requiring
operation to commence within 120 days from the date thereof:
and
WHEREAS , Scarsdale Bus Company on the 24th day of May, 1944,
filed a new application for operation over Palmer Avenue as
a part of a through line from New Rochelle to White Plains ,
and due notice of a public hearing to be held on the 21st
of June , 1944, was given as required by statute; and
[uEREAS , Thomas R. Fisher , Jr. appeared in support of said
application and no one appeared in opposition thereto other
than County Transportation Co. who also wrote a letter to the
Board, signed by its General Counsel , which letter was re-
ceived and filed
LOW, THEREFORE , BE IT
RESOLVED, that the Town Board of the To-wn of Mamaroneck,
pursuant to the provisions of Sections 66 and 67 of the
Transportation Corporations Law, hereby grants consent to
Scarsdale Bus Company , subject to the provisions , conditions ,
requirements and limitations as set forth in resolution of
the Board granting permit or consent to said Scarsdale Bus
Company which was adopted on June 12th 1942 , except , however ,
the conditions and limitations as to fare zones and rates
and schedule for operation of buses as set forth in Para-
graphs "Thirteen" and "Fourteen" of said resolution, along
and across the following named streets , avenues , highways
or portions thereof in the Town of Mamaroneck, to writ:
BEGINNING on Palmer Avenue at the boundary line of
the City of New Rochelle and the Town of Mamaroneck,
easterly on Palmer Avenue to the westerly boundary line
of the Village of Larchmont and the Town of Mamaroneck.
Returning via the same route. Being part of a through
route from Tbite Plains to New Rochelle via Larchmont.
Provided, however , that the fare zones and rates
shall be as follows:

provided , however , that from any point in the Town
of Mamaroneck, including the Village of Larchmont ,'
to any other point in the Town of Mamaroneck, the
fare shall be 10 cents.
Provided, further , that the operation of buses
shall be as follows :
On weekdays
Hourly between the hours of 6 A.M. and 7 A.Y.
Half-hourly from 7 A.M. to 9 P.M.
Hourly from 9 P.M. to 12 M.
On Sundaes and legal holidays.
Hourly from 8 A.M. to 12 E1.
FURTHER RESOLVED, that unless operation of buses
contemplated by this consent , i.e. over Palmer
Avenue between the Town of Mamaroneck and the
New Rochelle City line , is commenced on or be-
fore 120 days from the date of this resolution
pursuant to certificate of convenience and ne-
cessity issued by the Public Service Commission
this consent shall lapse and become null and void.
Councilman Embury stated that there was nothing to report
for the Park Department, but that there were some plans in connection
with the Honor Roll which were being studied and that a full report
would be made at a later meeting.
He read some letters received from Thomas Aitchison, Jr. , former
park superintendent , now serving with the armed forces.
On personnel, Councilman Stiner reported that some of the
employees had started their vacations and others were in the process
of doing so, without interruption to the routine of work.
He reported for the Board of Review by stating that it seemed
to be the lightest year for protests for quite some time and that he
would be in a position to give the number of protests filed at the next
meeting. He pointed out that last year there were 409 protests.
He stated that for Councilman Griffin, and in his absence , he
wished to present the following petitions received from the Assessor for
the adjustment of the assessment records.
On motion by Councilman Embury , seconded by Councilman Keeler ,
the following resolution was , upon roll call, unanimously adopted:
WHEREAS , the Assessor has presented petitions for

Chapter 105 of the Laws of 1916 , as amended, known

Councilman Stiner stated that at the last meeting he and
Councilman Keeler had been appointed to a committee to examine certain
properties for which offers had been received by both the Village and
the Town. He said that he had the papers at hand on one parcel and
Mr. Keeler had the papers on the other parcel.
He reported that they had met with the officials of the
Village of Mamaroneck and that during their discussion it was agreed
that an attempt should be made to obtain more money for the parcel. He
said that the broker had been notified and that the purchaser , Mrs.
Artemise Casanave , had submitted a final offer of $900.00 for the lot.
On motion by Councilman Stiner , seconded by Councilman Keeler,
it was , upon roll call, unanimously
RESOLVED, that the offer to purchase property known
as Block 942, Parcel 169 on the tax assessment map
of the Town of Mamaroneck and also known as Lot No. 4
on the map of Eagle hommocks filed in the office of
the Clerk of the County of Westchester as map No. 3571,
for $900.00 be accepted.
FURTHER RESOLVED, that the Town Attorney is hereby
instructed to prepare a contract with Charles L.
Casanave and Artemise Casanave , his wife , for the
purchase of the property, subject to survey, ex-
ceptions , covenants, restrictions and easements
contained in the title.
FURTHER RESOLVED, that this resolution shall become effective only
upon the adoption of a similar resolution by the Board of Trustees of the
Village of Mamaroneck
FURTHER RESOLVED, that the Board recognizes Mr.Edward J. Payne
broker who brought who brought about this sale
Councilman Stiner read a letter dated June 9, 1944 received from Charles
D. DeVinne Public Welfare Officer of the Town in which Mr. DeVinne recom-
mended the temporary appointment of Mrs. Eleanor Lyon Stevens as steno-
grapher junior grade for half time duties at the rate of one-half the annual
salary of $1144. Civil Service forms for the purpose were attached
Councilman Stiner recommended and moved the following resolution which
was seconded by Councilman Keeler and upon roll call unanimously
RESOLVED, that Mrs. Eleanor Lyon Stevens be and she hereby is appointed
as a temporary employee to fill the position as a stenographer junior grade at
the rate of one-half of the annual salary of $1144. Such appointment to be subject
to the approval of the Personnel Office of the County of Westchester and to be
effectuve as of June 9, 1944
FURTHER, that the Supervisor be and he hereby is authorized to sign the
certificate forms furnished by the Civil Service Commision
Councilman Keeler informed the members of the Board that with reference to
offers recieved for the sale of Town and Village owned properties that the
officials representing both in a conference held recently had agreed upon a
plan whereby the properties may be examined immiediately following the
receipt of an offer so that both parties would be in a position to report to their
Boards without the necessity of deferring action until an examination had been
made.
He reported that he and Councilman Stiner had examined the parcel of land
known as Block 823 Parcel 9 on the assessment map of the Town of Mama-
roneck in which an offer had been received by the Village of Mamaroneck from
the Westchester Wholesale Warehouse, Inc. and that a conference had been with
the Village officials regarding same. He informed the Board that it was decided to
reject the offer.
The Supervisor stated that in the absence of Councilman Griffin he wished
to present the official reports.
He presented the statement of bank balances as of 9 A.M. June 21, 1944. Also
the report of the Comptroller for claims audited and paid from June 7, 1944
to June 21, 1944
The Supervisor presented a check for $225.59 from Mamaroneck Post No. 90
of the American Legion and a letter from William E. Thrasher the Commander
offering this check in payment of all tax liens upon property owned by the Post
known as Block 910 Parcel 452 on the tax assessment map all of which liens
were acquired by the Town at annual tax sales.
On motion by Councilman Embury seconded by Councilman Keeler it was upon
roll call unanimously
RESOLVED that the sum $225.59 is hereby received in payment of the following
tax liens owned by the Town of Mamaroneck on Block 910 Parcel 452

The Town Attorney presented the following resolution which was on motion
by Coucilman Stiner seconded by Councilman Keeler upon roll call Unanimosuly

1942 and 1943 (taxes of 1943 and 1944) and
WHEREAS the assessor and Board of Review of the Town of Mamaroneck
duly filed returns to said writs and
WHEREAS Joseph J. Harding Esq was heretofore appointed to hear the
testimony and report his findings and conclusions to the court and an organization
meeting was held n June 16th, 1944 and no further proceedings have been had
and
WHEREAS the Town Attorney and Assessor recommend to this Board that
the proceedings be settled and discontinued upon the reduction of the assessment
as follows:
