MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF
THE TOWN OF MAMARONECK HELD ON JUNE 19, 2019, BEGINNING AT 5:00PM IN
CONFERENCE ROOM A AND CONTINUING AT 8:00 PM IN THE COURT ROOM OF THE
TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK

CALL TO ORDER - WORK SESSION

On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, the Work Session was
unanimously opened at 5:00PM.
Update – Town Police Department
Additionally Present: Police Chief, Paul Creazzo, Police Lieutenant, Jim Maher
Chief Creazzo began by updating the Town Board on the recent incidents at the Hommocks Middle School.
Chief Creazzo gave an update on his Department, the changes he has made since becoming Chief, the
recent retirements and new hires. The Department recently participated in active shooter training and the
Chief has been overseeing a departmental software upgrade.
Update – Community Solar Project
Mr. Altieri stated that he and Mr. Maker will be reviewing a final draft agreement and at that point he will
bring it to the Town Board. There was a recent Housing Authority meeting at which they discussed the
project, four Hommocks Apartment tenants were present. Sustainable Westchester will be overseeing and
helping to walk residents through the sign up process. They will provide assistance as well as on site
computers, and propose a sign up day at the Senior Center and or Hommocks Ice Rink. The priority will be
to offer this program fist to low and moderate income residents, then to the larger community.
Discussion - Draft Legislation Commuter Parking
The Town Board reviewed the latest draft of this legislation, noting that a there may be possible legislation
overlapping on the same streets. A more comprehensive comparison to the current vehicle and traffic code
should be done. The Town will be sending out a letter of explanation to all residents in the affected areas,
making specific note of the difficult state requirements for enacting residential parking districts, as well as a
streets ability to ‘opt out’ of the legislation if a majority of the residents’ on that street agree. The Town
Board discussed timing for a public hearing and for the roll out of a legislation of this significance.
The letter to the residents will go out as soon as the public hearing is set.
New Business
Supervisor Seligson informed the Board of a grant opportunity for Madison Avenue. She recently met with
Thomas Baird whose company Barton and Loguidice prepared a study of Fifth Avenue for the Town, to
discuss proposals for Madison Avenue. A feasibility study is due with the grant application. The grant is due

July 26, and the Town Board agreed on its submission.

Update – Community Development Block Grant
The Town Board reviewed the grant application in advance of tonight’s public hearing. They recapped that
the funding request for 2020 will be for the interior of the Senior Center, and the Harmon Drive Sidewalk,
and the 2021 request will be for exterior renovations to the Senior Center.
New Business
Mr. Altieri gave an update on the Comprehensive Plan, stating that the request for proposals was sent to
seven or eight firms, with a due date of June 27. The Town Board will discuss the proposals at the July
Town Board meeting.
Mr. Altieri gave an update on the installation of the Electric Vehicle Charging Stations, and distributed a
chart of a cost analysis. The Board discussed the overages in the bids received versus the original estimates.
The report of bids is on the regular agenda for this evening.
The Town Board made some changes to the budget calendar and added its approval to the regular agenda
for this evening.
Mr. Altieri updated the Board on the Waverly Avenue Bridge. The Town has previously approved funding in
the amount of $200,000 for reconstruction of the bridge. It appears that the Village of Mamaroneck has
applied for a grant from the County in the amount of 1million dollars. If they receive this funding the
Village of Mamaroneck will not require the Town’s funds. If this is the case the $200,000 will carry over into
the 2020 Town Budget.
On motion of Councilwoman Fiddelman, seconded by Councilman King, the Board unanimously agreed to
enter into an Executive Session to discuss current litigation, potential litigation and the settlement of a
retirement benefit within the Fire Department.

On motion of Councilwoman Katz, seconded by Councilman King, the Board unanimously agreed to resume
the Regular Meeting.
CALL TO ORDER - REGULAR MEETING
The Regular Meeting of the Town Board was called to order by Supervisor Seligson at
8:30 PM, she then pointed out the location of the exits.
Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this
evening, adding this is an open meeting that all residents are welcome to attend.
SUPERVISOR’S SUMMARY REPORT
We are all saddened by the incidents of threats involving students this past week. The Town, as
always, will continue to work with the School District to provide police support and protection as
appropriate. The Town of Mamaroneck Police Department (TMPD) is available at all times to
respond to potential danger and investigate potential criminal activity in the Town and the schools
within the Town. The Town Administrator and I have on-going communication with the TMPD and
are also available to respond to concerns. We are fortunate to have regular collaboration between
the police departments of the Town, Village of Larchmont and Village of Mamaroneck. There was
significant communication among and action by the MUFSD, TMPD, and Village of Mamaroneck
Police Department this past week in response to the threats. Thankfully, after investigations, none
of the threats were considered credible.

On a happier student note, we held a Mock Town Board meeting on June 6 with MHS ninth
graders. The students addressed several topics and did a wonderful job. In fact, Steve and I thought
we could be out of a job soon. They were well prepared by their teacher, Joe Liberti, and gave
thoughtful consideration to the issues they addressed.
The Town Fire District Referendum was held yesterday and we will formally accept the results
during this meeting. I attended a Westchester County sponsored Climate Change Conference on

June 6. The Village of Mamaroneck held a ribbon cutting to celebrate the renovation and
improvements to the spray garden at Harbor Island Park. It looks great and kids were having lots of
fun in the water. The County held a conference on the State sponsored Shared Services initiative.
The County reviewed their progress from the 2018 plan, outlined the timeline and asked for input
for the 2019 plan. I was invited to speak to the residents of the Carlshire Tenant Association at their
annual meeting. I always enjoy speaking with residents about the Town.

Friday, July 19 is Town of Mamaroneck, Village of Mamaroneck and Village of Larchmont day at
Playland . There are special offers and prizes for residents of our three municipalities.
I mentioned the Green Your Commute Challenge, sponsored by the NYS Dept. of Environmental

Conservation in which the Town is participating this summer. As of June 18, the Town of
Mamaroneck is second in the state!
Finally, thank you to our MHS senior interns Chelsea Finstead, Franco Marsella and Lily Shein for
the six weeks they spent working on Sustainability programs.

Councilwoman Katz noted that the Town received one written communication in favor and a number of
residents attended the Traffic Committee endorsing this legislation.
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the Public Hearing was
unanimously closed.
On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, the following Local law was
approved:
Local Law No. 7 – 2019
This local law shall be known as the “Prohibition on Parking within Thirty Feet of the
intersection of Maple Hill Drive and Murray Avenue” Law.
BE IT ENACTED by the Town Board of the Town of Mamaroneck
Section 1 – Purpose:
The purpose of this law is to improve visibility near the intersection of Maple Hill Drive and
Murray Avenue.
Section 2 – Prohibition of Parking on Maple Hill Drive within Thirty Feet of Murray Avenue:
Section 219-18 of the Code of the Town of Mamaroneck hereby is amended to add thereto the
following:
Name of Public Highway Direction of Travel Location
Maple Hill Drive Both For a distance of 30 feet from its intersection
with Murray Avenue
Section 3 – Sign(s) to be Erected and Painting to be Done:
An appropriate sign or signs shall be erected on and/or above, and/or striping shall be painted
on the surface of Maple Hill Drive indicating where parking is prohibited by this law.
Section 4 – Severability:
Should any provision of this Local Law be declared invalid or unconstitutional by any court of
competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any
other provisions of this Local Law, which may be implemented without the invalid or
unconstitutional provisions.
Section 5 – Effective Date:
This Local Law shall become effective upon filing with the Secretary of State.

was approved:
Local Law No. 8 – 2019
This local law shall be known as the “Prohibition on Parking within Three Feet of a Driveway
Entrance on the North Side of Palmer Avenue between Richbell Road and Blossom Terrace” Law.
BE IT ENACTED by the Town Board of the Town of Mamaroneck
Section 1 – Purpose:
The purpose of this law is to improve visibility for drivers of cars exiting from their driveways on
the north side of Palmer Avenue between Richbell Road and Blossom Terrace.
Section 2 – Prohibition of Parking within Three Feet of Certain Driveway Entrances:
Section 219-18 of the Code of the Town of Mamaroneck hereby is amended to letter the existing
section as subsection “A.” and to add a new subsection B. to read as follows:
B. No motor vehicle shall be parked in front of, or within three (3) feet of a public or private
driveway on the north side of Palmer Avenue between Richbell Road and Blossom Terrace.
Section 3 – Sign(s) to be Erected and Painting to be Done:
An appropriate sign or signs shall be erected on and/or above, and/or striping shall be painted
on the surface of Palmer Avenue indicating where parking is prohibited by this law.
Section 4 – Severability:

On motion of Councilwoman Elkind Eney, seconded by Councilman King, the following was approved,
WHEREAS, on June 19, 2019 the Town of Mamaroneck held a public hearing on a
proposed Community Development Block Grant Proposal, and
WHEREAS, the Town Board presented the application for 2020 funding to include
interior renovations to the Senior Center, and sidewalk improvements for Harmon
Drive, and for 2021 funding, exterior renovations to the Senior Center Parking Lot, and
WHEREAS, the Town of Mamaroneck received no opposition to these proposals or
funding applications.

NOW, THERFORE, BE IT
RESOLVED, that the Mamaroneck Town Board does hereby approve the submission of the
Community Development Block Grant (CDBG) Funding Applications as detailed below:
2020 Funding Year:
Interior Renovations - Senior Center, with funding from the CDBG in the amount of $168,200 and
funding from the Town of Mamaroneck in the amount of $86,800.
Sidewalk Improvements – Harmon Drive, with funding from the CDBG in the amount of
$202,800, and funding from the Town of Mamaroneck in the amount of $109,200.
2021 Funding Year:
Exterior Renovations – Senior Center Parking Lot, with funding from the CDBG in
the amount of $162,850, and funding from the Town of Mamaroneck in the amount
of 87,690.00.

by the Board of Fire Commissioners of said Fire District on the 1st day of May, 2019, be duly

2) After the polls had closed for said election, we immediately canvassed the ballots cast.
Inspection of such ballots disclosed the following results:
Total number of ballots cast: 39
Total number of votes in favor of proposition: 29
Total number of votes against proposition: 10
Total number of votes declared void: 0
3) Upon the completion of such canvass, the Chairman of the election publicly announced the
result thereof.
4) A true, correct and complete copy of the official voting ballots used at said special election is
attached hereto and made a part hereof.

5) On the 30 day of May, 2019 a meeting of the Inspectors of Election was held at the time and
place specified in the Resolution of the Board of Fire Commissioners adopted May 1, 2019. At said meeting a
register of all persons entitled to vote in the election was prepared containing the names of all persons residing
in said Fire District and qualified to vote in said election whose names were on the registration list certified and
supplied to said Fire District by the Westchester County Board of Elections as of a date twenty-three days before
the date of said election. All of the votes described above were of voters whose names appear on the register
prepared at such meeting.

4. Award Contract TA-19-05 Weaver Street Fire Station
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the following was
approved
WHEREAS, on April 11, 2019 the Town publically opened and read three (3) bids for Contract
TA-19-05 Weaver Street Fire Station, and
WHEREAS, the Town’s construction manager, Calgi Construction Company has conducted an
evaluation of the apparent successful bidder, and recommends Contract TA-19-05 be awarded
to Specialty Construction Systems, Inc. in the amount of 1,800,000.00.
NOW, THEREFORE, BE IT
RESOLVED, that the Mamaroneck Town Board does hereby award Contract TA-19-05 Weaver Street
Fire House to the lowest responsible bidder meeting all of the Town’s requirements, to Specialty
Construction Systems, Inc., in the total amount of $1,800,000.00, as detailed below:
Base Bid - $1,756,000.00
Alternative No 1: Resilient Floor Tile - $4,500.00
Alternative No 2: Fire Alarm System - $36,500.00
Alternative No 3: Etching of Glass at Opening - $3,000.00,
and
BE IT, FURTHER
RESOLVED, that the Town Administrator is hereby authorized to execute said contract on behalf of
the Town.

Commissioner Elkind Eney noted the upcoming Firemen’s Parade on July 2.
There being no further business to come before the Commission, on motion of Commissioner Elkind Eney,
seconded by Commissioner Katz, the Commission unanimously adjourned and the Town Board reconvened.
AFFAIRS OF THE TOWN
1. Authorization – Resolution/Grant Contract – NYS Department of Transportation
Authorization – Consultant Selection Waverly Avenue Bridge Replacement
On motion of Councilwoman Elkind Eney, seconded by Councilman King, the following was approved,
Authorizing the implementation and funding of the costs of 100% of the costs of a
transportation project, which may be eligible for federal-aid and/or state-aid, or reimbursement from Bridge
NY funds.
WHEREAS, a project for the Waverly Avenue over Sheldrake River Bridge Replacement in the Town of
Mamaroneck, Westchester County, P.I.N. 8762.19 (the Project") is eligible for funding under Title 23 U.S.
Code, as amended, that calls for the apportionment of the costs such program to be borne at the ratio of
95% Federal funds and 5% non-federal funds; and
WHEREAS, the Town of Mamaroneck will design, let and construct the Project: and
WHEREAS, the Town of Mamaroneck desires to advance the Project by making a commitment of 100% of the
costs of the work for the Project or portions thereof.
NOW, THEREFORE, the Mamaroneck Town Board duly convened does hereby
RESOLVED, that the Mamaroneck Town Board hereby approves the above-subject Project; and it is hereby
further
RESOLVED, that the Mamaroneck Town Board hereby authorizes the Town of Mamaroneck to pay 100% of
the cost of preliminary engineering and the right-of-way incidentals work for the Project or portions thereof,
with the understanding that qualified costs may be eligible for federal-aid, state-aid, or reimbursement from
Bridge NY funds; and it is further
RESOLVED, that the sum of $249,200.00 is hereby appropriated from the Town of Mamaroneck Capital
Project #2019-62 and made available to cover the cost of participation in the above phase(s) of the Project;
and it is further
RESOLVED, that the Mamaroneck Town Board hereby agrees that the Town of Mamaroneck shall be
responsible for all costs of the Project which exceed the amount of federal-aid, state-aid, or NY Bridge
funding awarded to the Town of Mamaroneck; and it is further
RESOLVED, that in the event the Project costs not covered by federal-aid, state-aid, or NY Bridge funding
exceed the amount appropriated above, the Town of Mamaroneck shall convene as soon as possible to
appropriate said excess amount immediately upon the notification by the Town Administrator thereof; and
it is further
RESOLVED, that Town of Mamaroneck hereby agrees that construction of the Project shall begin no later
than twenty-four (24) months after award and the construction phase of the Project shall be completed
within thirty (30) months; and it is further
RESOLVED, that the Administrator of the Town of Mamaroneck be and is hereby authorized to execute

on behalf of the Town of Mamaroneck all necessary agreements, certifications or reimbursement
requests for federal-aid and/or state-aid with the New York State Department of Transportation in
connection with the advancement or approval of the Project and providing for the administration of the
Project and the Town of Mamaroneck's funding of Project costs and permanent funding of the local share
of federal-aid and state-aid eligible Project costs and all Project costs within appropriations therefore
that are not so eligible; and it is further
RESOLVED, that a certified copy of this resolution be filed with the New York State Commissioner of
Transportation by attaching it to any necessary Agreement in connection with the Project; and it is
further
RESOLVED, this Resolution shall take effect immediately.

On motion of Councilwoman Katz, seconded by Councilwoman Fiddelman, the following was approved,
WHEREAS, specific procedures for the procurement of consultant services to be utilized for the
replacement of the Waverly Avenue Bridge are required in conjunction with the NYSDOT BRIDGE
NY grant award, and
WHEREAS, fifteen firms listed on the region 8 list of the prequalified firms from the New York State
County Highway Superintendent Association for NYSDOT were solicited for request for proposals,
and
WHEREAS, three (3) firms submitted proposals: Barton & Loguidice,, P.C., Tectonic Engineering and
Hudson Valley Engineering Associates, and
WHEREAS, based upon the assessment process and rubric of the Town’s Engineering Department,
the firm of Hudson Valley Engineering Associates is hereby recommended.
NOW, THEREFORE, BE IT
RESOLVED, that the Mamaroneck Town Board does hereby accept this recommendation and
approves the selection of Hudson Valley Engineering Associates for consulting services for the
Waverly Avenue Bridge Replacement Project.

WHEREAS, on June 5, 2019 the Mamaroneck Town Board awarded Contract TA-19-07 Highway
Garage Repairs to Specialty Construction Systems Inc., for a bid price of $45,000, and
WHEREAS, that bid price was incorrect and should have been correctly stated as $46,000.00, and

4. Authorization – Extension of Lease Agreement Southeast Consortium
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the following was

entered into a lease agreement in May of 1997, and
WHEREAS, the parties wish to amend the terms of that lease agreement.
