BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Nancy Seligson Councilwoman Abby Katz Councilwoman Jaine Elkind Eney Councilwoman Sabrina Fiddelman Councilman Jeffery L. Altieri, Town Administrator Connie Green O’Donnell, Deputy Town Administrator William Maker, Jr., Town Attorney Allison May, Assistant to the Town Clerk CALL TO ORDER - WORK SESSION Additionally Present: Lindsay Luft Administrative Assistant and representatives from Mamaroneck High School’s AP Civics Class On motion of Councilwoman Katz, seconded by Councilman King, the Work Session was unanimously opened at 5:00PM. st Review – 1 Quarter Financial Report Additionally Present: Tracy Yogman Town Comptroller The Town Board reviewed the First Quarter Fiscal Year 2019 Budget Report prepared by the Town Comptroller. Supervisor Seligson thanked Ms. Yogman for her presentation format, adding it contained more detail of the three large funds as well as an overview of fund balances. Supervisor Seligson stated st that this report is only for the 1 quarter, but finances look very good. Ms. Yogman reported that she is analyzing on-line payments with e-checks for paying taxes. With this option all fees are paid by the taxpayer, and are significantly lower than credit card payments. Discussion – Overview of Housing Trends – Westchester County Additionally Present: Norma Drummond C commissioner of the Westchester County Department of Planning and Bill Brady Chief Planner at Westchester County Department of Planning Ms. Drummond distributed a Powerpoint presentation for her discussion. After Ms. Drummond’s presentation the discussion continued and Ms. Drummond stated that Westchester County has prepared a ‘snap shot’ report of each municipality and their demographics, noting that the report will be issued by the County Executive sometime in June. Ms. Drummond noted that publicly funded (affordable) senior housing needs an approval waiver from the New York State Human Rights Commission, and municipal code should address ‘beds’ and not just ‘units’, an important distinction that should be in the code. Westchester County is working on the Census 2020 LUCA program and has established a Complete Count Committee, and recommends that local municipalities create the same committees. Mr. Brady offered his services to the Town with respect to the Town’s work on a Comprehensive Plan. Mr. Brady noted that the New York State Department of Transportation (NYSDOT) is becoming more open minded/interested in corridor planning. Supervisor Seligson discussed the denial of the Town’s grant application to the NYS DOT for a round-a-bout at Myrtle Blvd and Madison Avenue. Mr. Brady stated that representatives from NYSDOT will be coming to the County Planning Board for discussions, and he will mention this project to them, as well as the Town’s current application for a left turn signal at Weaver Street and Palmer Avenue. In closing Mr. Brady and Ms. Drummond noted that Westchester County is interested in discussing with local municipalities the affordable gap in housing across the County. 1 May 21, 2019 Review – 2019 Capital Project Schedule/CDBG/EFC Green Infrastructure Grant The Town Board reviewed a memo from Mr. Altieri dated May 17, 2019, outlining project proposals for a CDBG Grant application. The two areas of interest are the Fifth Avenue streetscape and renovations to the Town Senior Center. The Town Board discussed these two proposals noting that the grant application is th due June 28 and the Town should not let this funding opportunity pass by. In order to proceed the Town is th required to hold a public hearing, an estimated date could be June 19. Reorganization of Town Engineer’s Office The Town Administrator is proposing the addition of a full time junior civil engineer to the Town Engineer’s Office. As the role of the Town Engineer has become much broader, the Administrator sees the need for such a position. The Town Board reviewed a memo dated May 16, from the Town Administrator detailing this recommendation. Reusable Bag Law The Town Board received a letter from the Sustainability Collaborative urging the Town Board to move forward with the Reusable Bag Legislation, even if the State law is unclear. The Town hopes that the County will hold to the $0.05 charge per bag. Supervisor Seligson gave an update on the donated reusable bags, adding that the organization Mother Earth will be funding production of 1,000 bags. The bags are currently in production at Ink it Up. Another 1,000 bags will be donated by another company. The Town Board discussed the pros and cons of passing legislation now, prior to the State law going into effect in March of 2020. The Town Board would like to review the State law again in detail with the goal of drafting Town legislation closely mimicking the State. The Town would like to have a draft ready to set a public hearing at the June 4 meeting. Update - Share the Road The Town Board reviewed a memo from Mr. Altieri dated May 17, discussing the Sustainability Collaborative’s initiative in “developing a more inviting environment for residents to use bicycles.” The Sustainability Collaborative has discussed focusing on adding shared lane markings, known as ‘sharrows’ to certain streets within the Town. This will be added to the Traffic Committee agenda for May 20 for their comments on the proposal. Consensus that education and coordinated outreach is needed. Review – 2018 Financial Audit Additionally present: Alan Kassay of O’Connor Davies The Town Board reviewed communications from O’Connor Davies: 1) outlining required communications and control deficiencies found in the audit 2) response from the Town Comptroller and Town Administrator to identified items 3) the statement of cash receipts, disbursements, and cash balances for the Town Court 4) the audit regarding our compliance with respect to financial assistance provided by the New York State Department of Transportation 5) the complete volume of the financial statements and supplementary information for the fiscal year ending 2018. Mr. Kassay discussed the documentation before them. The Town will hold a public presentation this evening on the 2018 Financial Audit presented by Mr. Kassay. New Business Councilwoman Elkind Eney updated the Town Board on the Hommocks Ice Rink project, noting that revised drawings have been received from Dan Tierney. Mr. Tierney's revised drawings are being reviewed by all parties. The Recreation Commission has passed a resolution approving the project in concept. CALL TO ORDER - REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:00 PM, she then pointed out the location of the exits. Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this evening, adding this is an open meeting that all residents are welcome to attend. 2 May 21, 2019 PRESENTATION – 2018 Audit and Financial Statements Alan Kassay of O’Connor Davies gave a Powerpoint presentation titled Town of Mamaroneck, New York Report to the Town Board December 31, 2018. SUPERVISOR’S SUMMARY REPORT th On Tuesday, June 18 there will be a special Fire District election held from 3:00 pm to 9:00 pm. The election will be held at the Weaver Street firehouse for all residents of the unincorporated part of the Town of Mamaroneck. The election is for the borrowing of funds for the additional funding needed for the firehouse apparatus floor reconstruction and restoration of the lower level of the firehouse. Fire Districts in NYS must hold mandatory referendums if funds are to be borrowed for a project. The additional funding for the reconstruction of the firehouse floor is $236,000. The cost of the lower level restoration is $2,289,000. The proposed bond is for $2,475,000 as the Town is proposing to use $50,000 from a previous capital project to fund a th portion of this. Please remember to vote on Tuesday, June 18 between 3:00 pm and 9:00 pm. That reminds me that today is also the school district budget and board member election. If you haven’t voted yet, the polls are open until 9:00 pm. We had a successful Compost Giveaway at the Maxwell Recycling Center. We gave away 20 yards of compost material to residents of the unincorporated part of the Town and Village of Larchmont. We reviewed the first quarter financials with Town Comptroller, Tracy Yogman, this evening during our work session and the Town remains in strong financial position. I had the pleasure to participate in the MHS Talks program where different professionals speak about their professions and careers to MHS juniors. The STEM Alliance and Mamaroneck School District put on the expansive program. I also was happy to speak at the LGCA Annual meeting last night. I always appreciate the opportunity to talk to residents about the Town government and programs. The Town held its first movie in Memorial Park last Friday and we had a great turnout. It was a beautiful evening to watch Disney’s original 101 Dalmatians until the credits when it started to sprinkle rain. st Finally, please know and remember that the Town’s leaf blower ban law goes into effect June 1. st That means that no one is allowed to use a gasoline powered leaf blower from June 1 until th September 30. Please notify your landscapers. The Town police will be enforcing this law. CITIZEN’S COMMENTS Supervisor Seligson asked if anyone in the audience would like to address the Board, and there was not. Supervisor Seligson added that the Public Hearing originally scheduled for tonight has been cancelled, due to a mistake in publication by the Journal News. The hearing has been republished for the next meeting to th be held June 5. BOARD OF FIRE COMMISSIONERS The Meeting was called to order by Commissioner Seligson, and then on motion of Commissioner Elkind Eney, seconded by Commissioner Fiddelman, the Board of Fire Commissioners was unanimously declared open. Fire Department Business Commissioner Elkind Eney mentioned that the new fire ladder truck has been delivered and is now in Brewster where they are installing equipment and putting graphics on the truck. It will be ready in 3 to 4 weeks. Commissioner King asked if the new truck would be unveiled at the Fireman’s Carnival, but Commissioner Elkind Eney could not confirm that. There being no further business to come before the Commission, on motion of Commissioner Fiddelman, seconded by Commissioner King, the Commission unanimously adjourned and the Town Board reconvened. AFFAIRS OF THE TOWN 1. Authorization – Renewal of Shared Services Agreement – City of New Rochelle On motion of Councilwoman Fiddelman, seconded by Councilman King, it was RESOLVED, that the Mamaroneck Town Board does hereby approve the renewal of the inter- municipal agreement with the City of New Rochelle for leaf collection and snow removal services as amended this evening, and 4 May 21, 2019 BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town. Authorization – Grant in Aid Contract – NYSERDA On motion of Councilwoman Elkind Eney, seconded by Councilman King, the following was approved, WHEREAS, the Town previously applied for a grant from NYSERDA to implement a building energy efficiency project, and WHEREAS, the total cost of the project is $81,200, with a grant from NYSERDA in the amount of $50,000, and the Town share to be $31,200. NOW THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby approve the contract between the Town of Mamaroneck and NYSERDA for a grant in the amount of $50,000, for the replacement of air conditioning units at the Town Center, and BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town. Authorization – Transfer of Funds – Dedication Bench On motion of Councilman King, seconded by Councilwoman Elkind Eney, the following was approved, WHEREAS, the Town has accepted a donation for the purchase and installation of a memorial bench from Ms. Heather Waters. Reset Public Hearing – Water District Bonds At the April 24 Town Board Meeting, a resolution was adopted to set a public hearing for consideration of a water district bond issue. Unfortunately, the Journal News failed to properly publish the public hearing notice. Therefore, the public hearing will need to be reset for June 5, 2019. In the Matter ORDER of CALLING The Increase and Improvement of Facilities of PUBLIC the Consolidated Water District in the Town of HEARING Mamaroneck, Westchester County, New York WHEREAS, pursuant to proceedings heretofore had and taken by the Town Board of the Town of Mamaroneck, Westchester County, New York, pursuant to the provisions of Section 202-b of the Town Law, it has been determined to be in the public interest to provide for a certain increase and improvement of the facilities of the Consolidated Water District in the Town of Mamaroneck, Westchester County, New York, at a maximum estimated cost of $2,513,500, consisting of the construction of a new Kenilworth Water Storage Tank, reconstruction of the Rye Lake Ultra Violet facility and water infrastructure improvements related to the planned paving projects of the Town of Mamaroneck, including incidental improvements and expenses in connection therewith; and WHEREAS, a map, plan and report including an estimate of cost has heretofore been prepared in connection therewith and is on file in the office of the Town Clerk of such Town; and WHEREAS, said capital projects, as proposed, have been determined to be Type II Actions pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act, as such, will not have any significant adverse impact on the environment; and WHEREAS, in order to undertake the improvements to the aforesaid facilities as described therein, it will be necessary to expend the sum of $2,863,500, an increase of $350,000 over that previously authorized and an addendum to said map, plan and report has been prepared in connection therewith; and WHEREAS, it is now desired to call a public hearing on the question of authorizing such increase and improvement of facilities of said Consolidated Water District at the revised maximum estimated cost; NOW, THEREFORE, IT IS HEREBY ORDERED, by the Town Board of the Town of Mamaroneck, Westchester County, New York, as follows: Section 1. A public hearing will be held at the Town Hall, 740 West Boston Post Road, in th Mamaroneck, New York, in said Town, on the 5 day of June, 2019, at 8:00 o’clock P.M., Prevailing Time, on the question of increasing and improving the facilities of the Consolidated Water District in the manner described in the preambles hereof, and to hear all persons interested in the subject thereof, concerning the same, and to take such action thereon as is required or authorized by law. Section 2. The Town Clerk is hereby authorized and directed to cause a copy of the Notice of Public Hearing hereinafter provided to be published once in the official newspaper designated for this purpose, and also to cause a copy thereof to be posted on the sign board of the Town, such publication and posting to be made not less than ten, nor more than twenty, days before the date designated for the hearing. Section 3. The notice of public hearing shall be in substantially the form attached hereto as Exhibit A and hereby made a part hereof. Section 4. This Order shall take effect immediately. Salary Authorization – Police Department On motion of Councilman King, seconded by Councilwoman Fiddelman, it was RESOLVED, that the Mamaroneck Town Board does hereby appoint Karen Orchanian, who currently works part-time in the Police Department, as a full-time Office Assistant in the Police Department, at an annual salary of $56,000.00, effective May 22, 2019. Salary Authorization and Job Classification Change – Recreation Department On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, it was RESOLVED, that the Mamaroneck Town Board does hereby approve the appointment of Michelle Ballantyne to the position of Recreation Assistant, at an annual salary of $52,657.00, effective, no later than June 21, 2019.
