SPECIAL PaICETING OF TIM TOWN BOARD, TOWN OF MAMARONECK
HELD SEPTEMBER 10, 1947
In the Council Room of the weaver Street Fire House, Town of
Mamaroneck, New York.
The meeting was called to order by Supervisor Mandeville at
8:15 P.M. ( Eastern Standard Time) .
Presents Supervisor Mandeville
Councilman Stiner, Mills, Watson
Absents Councilman Embury
The presence was also noted of Town Clerk Gronberg, Town
Attorney Delius and Accountant Finson.
The Supervisor asked if there was any one in the room who
wished to Address the Board.
Mr . Plan L. Carnoy, Builder, appeared to petition the Town
to install utilities, roads, sidewalks and curbs to the extension of
Lafayette Road, where he proposes to build twelve GI horses that will
sell at $17,000. or $17, 500. He also stated that he planned to build
four homes on Madison Avenue. He pointedout that in building these
twelve houses the yearly tax revenue would be approximately $5, 600 per
year.
The Supervisor informed Mr. Carnoy that Mr . Foote had prepared
an estimate of the cost of these improvements and that Councilman Watson
,would review his plans and Mr. Foo#E� s estimate and report back to the
Town Board.
The minutes of August 13, 1947, were approved as presented.
A letter dated August 17, 19479 was received from the Secretary
of the weaver Street Fire Council:, expressing thanks to the Supervisor
and Town Board for resurfacing of the parking area in the rear of
the fire House . The letter was ordered placed on file.
A letter date45 Septemher3, 1947, was received from Clair V.
Johnson, Chairman of the Board of police Commissioners recomr.ending that
Police Chief Yerick attend the International Police Chiefs ' Convention
to be held in Duluth, Minnesota, September 21 to 25 inclusive.
On motion by Supervisor Mandeville, seconded by Councilman
Stiner, it was, upon roll call, unanimously
RESOLVED, that Police Chief Paul A. Yerick be and
he hereby is authorized to attend the International
Police Chiefs ' Convention to be 'meld in Duluth,
Minnesota,September 21 to 25 inclusive ;
FURTHER RESOLVED, that the Comptroller is hereby
authorized to audit the claim for the expenses of
the trip in an amount not to exceed $175. , said
amount to be paid out of the Police Department
budget.

The Town Clerk requested authorization to publish the Regis-
tration Notice as prescribed by law, and on motion by Councilman Stiner,
seconded by Councilman Mills, it was, unanimously
RESOLVED, that in accordance with Section 75 of the
Election Law a notice be published in the Daily Times,
on September 26 and October 3, 1947, giving a list of
the places of registration within the Town of Mamaroneck,
a statement of the days and hours of registration and a
brief description of the boundaries of each election
district in the Town.
The Supervisor suggested that the meeting proceed with the
reports of the Committees .
Councilman Watson presented petitions received from the Assessor
for the correction of the assessment roll so as to permit the apportion-
ment of taxes .
On motion by Councilman Watson, seconded by Councilman Stiner,
it was, upon roll call, unanimously resolved:
MHEREAS, the Assessor has presented petitions for the
correction of the assessment roll for certain years
pursuant to the provisions of Section 33 of Chapter
105 of the Laws of 1916 as amended, known as the
Westchester County Tax Act ; and
WHEREAS after due consideration this Board finds it
desirable to grant said petitions for the correction
of said assessment roll;
NOW, THEREFORE, BE IT

Councilman Watson read a petition received from the Assessor
requesting the approval of a number of pages of the assessment maps
showing corrections made by the Town Engineer as of June= l, 1947; such
corrections being due to the sale or transfer of lots or plots, filing
of maps in the Department of Land Records in White Plains, and so forth®
On motion by Councilman Watson, seconded by Councilman Mills,
it was, unanimously
RESOLVED, that the Board approves of the changes in
the assessment maps of the Town of Mamaroneck as of
June 1, 1947 and the said maps are hereby corrected
rectified as of June 1, 1947, in the following places :

The Supervisor stated that he desired to recommend to the
Board, the sale of three parcels of property acquired by the Town in the
recent foreclosure proceeding In Rem, which property had not been included
in the recent auction sale .
The first isgMflr das Block 610, Parcel 344, which property is
used partly for a stree an paved by the Village of Larchmont, known as
Winslow Place, and he suggested that it be conveyed to the Village for
a consideration of $1®00.
The second is known as Block 132, Parcel 370, and is used as
a church® For this the Supervisor reported the New York Annual Conference
of the African Metho,dist Espicopal Church has made an offer of $195®39,
representing its cost to the Town, the property being .located on Byron
Place ®
The third is known as Block 815, Parcel 190, and an offer
has been made for this by Marvin Abrahams, a disabled veteran, for $260®329
representing its cost to the Town®
Following discussion, it was on motion by Councilman Stiner,
seconded by Councilman Mills, upon roll call, unanimously

The Supervisor presented the list of Town-Owned properties that
were recently sold, and on motion by Councilman Watson, seconded by
Councilran Stiner, it was, upon roll, unanimously resolved
WHEREAS, the Town of Mamaroneck, through the institution
of an action in the County Court of Westchester County,
entitled"3n the Matter of the Foreclosure of Tax Liens
Pursuant to Article Vll®A, Title 3 of the Tax Law by the
Town of Mamaroneck, List of Delinquent Taxes for 1947",
has become and now is the owner of a number of parcels
of Real Estate situate in the unincorporated section
of the Town of Mamaroneck; and
WHEREAS, the Town of Mamaroneck advertised for and held
on September 2, 1947, a public auction and received bids
on certain of said-parcels of real estate now owned by
the Town of Mamaroneck;
WHEREAS, since the receipt of said bids this Board has
given careful consideration thereto, and after due
deliberation, it is

FURTHER RESOLVED, that the Supervisor is authorized
and directed to execute and deliver deeds to these
parcels in accordance with the terms and contracts
of sale and the Town Attorney is authorized to take
all steps necessary to complete the sale and transfer
these parcels .
On motion by Councilman 5tiatson, seconded by Councilman Stiner,
the following resolution was unanimously adopted-
WHEREAS, the Town of Mamaroneck, through the institution
of an action in the County Court of Westchester County,
entitled 19 In the Matter of the Foreclosure of Tax Liens
Pursuant to Article Vll-A, Title 3 of the Tax Law by the
Town of Mamaroneck, List of Delinquent Taxes for 1947",
has become and now is the owner of a number of parcels
of Real Estate situate in the Village of Larchmont and
Town of Yamaroneck; and
WHEREAS, both the Village of Larchmont and Town of
Mamaroneck held tax liens on said parcels of real pro-
perty; and
?AREAS pursuant to Section 165H of the Tax Law an
agreement was entered into between the Village of Larch-
moat and the Town of Mamaroneck, which a€aong other things
setforth the interests of said municipalities in the
properties being foreclosed ; the manner of the sale of
said properties ; and the manner of the distribution of
the proceeds received from said sales ; and
WHEREAS, the Town of Mamaroneck has, pursuant to an
agreement had with the Village of Larel-o!ont advertised
for and has heretofore received bids on certain properties
owned by the Town of Mamaroneck; and

FURTHER RESOLVED, that the foregoing acceptance with
respect to each parcel is subject to approval by the
Village Board of the Village of Larchmont ;
FURTHER RESOLVED, that upon approval of any or all
bids by the Village Board of the Village of Larchmont,
the Town Attorney is authorized to proceed with the
preparation of contracts, and such other documents as
are necessary to pass title to said properties, and
the Supervisor is hereby authorized to sign such con-
tracts and deeds as are necessary to pass title to
said properties .
On motion by Councilman Watson, seconded by Councilman Stiner,

FURTHER RESOLVED, that the terms on all of the above
bids are all cash;
FURTHER RESOLVED, that the foregoing acceptance with
respect to each parcel is subject to approval by the
Village Board of the Village of Mamaroneck;
FURTHER RESOLVED, that upon approval of any or all bids
by the Village Board of the Village of Mamaroneck, the
Town Attorney is authorized to proceed with the pre-
paration of contracts, and such other documents as are
necessary to pass title to said properties, and the
Supervisor is hereby authorized to sign such contracts
and deeds as are necessary to pass title to said pro-
__ perties .
The Supervisor stated that he had at hand a check in the
amount of $1,352.10 from the Village of Mamaroneck, in full payment
of the 1947 State, County and Town Taxes and prior years ' taxes on
1 26 2 and 28 . He explained that this is part
Block 901, Parcels 5, 75 5 p
of two parcels deeded back to the Village from the Town's In Rem action,
and is in accordance with our agreement regarding distribution on parcels
sold.
Following discussion, it was on motion by Councilman Mills,
seconded by Councilman Stiner, upon roll call, unanimously
RESOLVED that the Receiver of Taxes be authorized
to accept the sum of $1,352.10 in full payment of
the 1947 State, County and Town taxes and prior
years ' taxes on Block 901, Parcels 265, 275 and 285.
The Supervisor informed the members of the Board that it is
necessary to give consideration at this time to diverting the discharge
line which covers the Larchmont Ridge Section, and Fenimore Road from
Boulder Brae Lane, Southeast, that now empties into the Village of
Mamaroneck sewer line .
The Supervisor stated that he had discussed this matter at

Village of Mamaroneck. He said it would be necessary to correct this con-
- dition as this section is affected during the dry, as well as the wet
periods of the year, due to the fact that rain waters empty into this line .

Councilman Mills read aletter dated September 10, 1947, received
from Fire Chief Burton advising that upon an inspection of Cabot Road it
was found that the street is entirely without water supply except for a
very short two inch main. He recomr.ended the installation of a six
inch main on Cabot Road to connect with the water main at Myrtle Boulevard,
including a fire hydrant approximately 5008 in on Cabot Road.
Following discussion, the Town Clergy: was instructed to write
to Mr. W.E . thrasher, Superintendent of the Westchester Joint Water Works
No. 1, requesting him to prepare and submit as estimate of the cost of
this work.
Councilman Mills presented a list of claims for Fire Department
expenditures and stated that he had checked the bills and recompended
approval and payment .
The members of the Town Board sitting as the Board of Fire
Commissioners , considered the claims, and on motion by Councilman Mills,
seconded by Councilman Stiner, it was, upon roll call, unanimously
RESOLVED, that the following described claims be and
they hereby are approved and that the Supervisor and

The Town Attorney submitted an affidavit by Alex ileffert
President of the 601estchester Realty Ilanagement, Inc . which sets forth
that said corporation is the owner of premises known as Block 721, Par-
cel 234 on the Assessment Map of the Town of Mamaroneck; that a certain
tax lien #315 covering said premises for the tax of 1931 was sold by
the Town of Mamaroneck on P;Iay 25, 1932 to Bonded Municipal Corp. for the
sum of $524.01. The affidavit states that the deponent is unable to
locate the original tax lien as above mentioned after making a diligent
search for the same ; that the owner will indemnify the Town against any
loss in the event this lien subsequently is found.
The Town Attorney recommended the issuance of a duplicate tax
lien and on motion by Councilman Yiatson, seconded by Councilman Mills,
it was
RESOLVED, that the Receiver of Taxes and Assessments
be and he hereby is authorized to issue duplicate Tax
Lien No. 315, Sale of 1932, in the amount of $524.01,
against premises known as Block 721, Parcel 234.

The Town Attorney submitted an affidavit of Oreste Poccia
which sets forth that he is the owner of property known as Block 920,
Parcel 20, against which there is an unsatisfied lien of $88.179 which
lien is No . 227 of the Tom of Mamaroneck; that he purchased the premises
from the Huguenot Trust Company in 1937 and at that time was represented
by one Ernest W. Eckley, attorney. Tiie Huguenot Trust Company had de-
livered to his attorney a satisfaction of the aforementioned lien and
his said attorney was to file same with the Town but failed to do so ;
that said attorney has since died and all his records destroyed; that
the record owner of the lien, Vincil Realty Corp. , has agreed to give
- him a new satisfaction of said lien. The deponent has agreed to indem-
nify the Town against any loss in the event that said tax lien is
ever found.
The Town Attorney said there was also attached affidavit of the
Vincil Realty Corporation and satisfaction of transfer of said Tax Lien
No. 227 by the Vincil Realty Corp ; that these were all in order and re-
comiended the issuance of a duplicate tax lien.
On motion by Councilman 'Matson, seconded by Councilman Mills,
it was
RESOLVED, that the Receiver of Taxes and Assessments
be and he hereby is authorized to issue duplicate Tax
Lien No . 227, Sale of 1935, in the amount of $88.17

The Town Attorney and Chief Yerick recommended that the claim
against Caroline Hvizdos for damages done to a 'Town Police car in May,
1947, as a result of negligence of Anthony Hvisdos , the operator of
the car, be comprised and settled upon payment of $450.00.

RESOLVED, that the claim against Caroline Hvizdos be
compromised at $450. and the Supervisor is hereby
authorized i,o sign the necessary release and the Town
Attorney is hereby instructed to settle the case now
pending on that basis .
The Tovrn Attorney presented Notice which is to be advertised
in connection with the proposed amendment to the General Ordinances re-
garding removal of rubbish, weeds, etc .
On motion by Councilman TT"datson, seconded by Councilman Mills,

RESOLVED, that the following notice be inserted in
the Daily Tines at least ten days prior to Septem-
ber 24, 1947:
PLEASE TAKE NOTICE that on the 24th day of September, 1947,
at 8 :15 o 'clock P.M. , at the Council Room in the Weaver Street
Fire House, Weaver Street and Edgewood Avenue , in the Town of
Mamaroneck, New York, a public hearing will be held on a proposed
amendment to Section 3 Chapter 1V of the General Ordinances of the
Town of Mamaroneck, adopted February 17, 1937, which amendment
shall provide that in addition to enforcement by fine or penalty,
where an owner, tenant or occupant of property fails to cut, or
trim all brush, grass , rubbish, noxious tF,Yeeds, litter or other
similar unsightly or objectionable material at his own expense,
the To�rvn Clerk may serve written notice, requiring such owner,
L, or occupant to trim, prune and, if necessary, remove
noxious weeds, rubbish, litter or other such material within ,
days, and providing that in default thereof, the Town may do so
and collect the expense thereof from the owner or assess it upon
the land, and further providing for the method of giving such
notice.
TAKE FURTHER NOTICE thal all persons interested will have an
opportunity to be heard.

purpose .
