SPECIAL MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK
HELD AUGUST 13th, 19479 IN THE COUNCIL ROOM OF THE WEAVER
STREET FIRE HOUSE, TOWN OF RAMARONECK, NEW YORK.
The meeting was called to order by Supervisor Mandeville at
8:15 o'clock P.M. ( Eastern Standard Time) .

Councilman Stiner, Embury, Mills and Watson
ABSENT: None
Presence was also noted of Town Clerk Gronberg and Town accoun-
tant Finson.
The Town Clerk presented an affidavit of publication of a
notice requesting bids covering the construction of the War
Memorial. The bids, which had been received, were then opened
and are as follows:

Councilman Embury stated that, in view of the prices bid,
some revision of the design would be necessary, as the bids
were in excess of the appropriation for the construction of
the Memorial.
Supervisor Mandeville suggested that the bids be laid on the
table and referred to Town Engineer Foote and Mr. John A.
Wang, Chairman of the Board of Park Commissioners, for
study and recommendation.
Upon motion made by Councilman Mills, seconded by Councilman
Stiner, it was unanimously
RESOLVED, that the Town Clerk be instructed to
return the checks to the bidders.
The minutes of the meetings of June 24th, 1947 and July 9th,
1947, respectively, were approved as presented.
The Town Clerk read a letter dated July 11th, 1947, from the
Board of Police Commissioners of the Town of Mamaroneck, en-
closing application of Officer John J. Gilfoy for retirement
effective August lst, 1947, under the provisions of the laws
governing the Police Pension Fund. The application was ordered
and regret was expressed at the loss of

A letter dated July 15th, 1947, was received from the Board of
Police Commissioners of the Town of Mamaroneck recommending that
a map of all of the areas of the town and a request for 11 area
zoning" at thirty miles per hour for the entire unincorporated
area of the township of Mamaroneck, be submitted to the State
Traffic Commission. It was pointed out that this is now per-
missive since the amendment of Section 95-C of the Vehicle and
Traffic Law.
Upon motion by Councilman_ Mills, seconded by Councilman
Embury, it was unanimously
RESOLVED, that a map of all of the areas of the
town and a request for "Area Zoning" at thirty
miles per hour for the entire unincorporated
area of the Township of Mamaroneck, be submitted
to the State Traffic Commission, addressed to the
Director of the New York State Traffic Commission.
A letter was received from the American Legion Post No. 347, express-
ing thanks to the Supervisor for the cooperation which he and
the Town Board had extended to that Post in connection with the
recent convention of the Westchester County American Legion.
With the letter was enclosed a copy of a resolution, adopted at
the convention by the members of the Westchester County American
Legion, expressing the gratitude of those members.
A letter dated July 12th, 1947, was received from Mamaroneck
Post No. 90 ( American Legion) submitting two claims for $200.
each representing maintenance of meeting rooms for the years
1945 and 1946, for consideration and approval by the Town Board.
After consideration and discussion, the Town Clerk was instructed
to notify the Post No. 90 that no money is available in the Budget
and that these claims cannot be approved.
-- The following reports for the month of July 1947, were ordered
placed on file:
Report of the Receiver of Taxes ;
The Report of the Town Clerk ;
The Report of the Building Inspector;
The Report of the Westchester County Dog Protective Association
for June and July;
The report of the County Transportation Company, covering the
6 month period which ended June 30th, 1947;
Statement of Bank Balances as of August 1st, 1947; and
List of claims audited and paid by the Comptroller during the
period from July 9th, 1947 to August 13th, 1947.
The Town Clerk presented copies of the list of polling places
for the purpose of designating the place in each election district in
the Town at which the meeting for the registration of voters and ffiecti
elections and primaries shall be held in the year following the
ensuing first day of October. He stated that the chairman of both majo
political groups had approved the same .
The members of the Board examined the list and upon motion made by
Councilman Watson, seconded by Councilman Stiner, it was, upon
roll call, unanimously
RESOLVED, that in accordance with the provisions of
Section 66 of the Election Law, being Chapter 17 of
the Consolidated Laws of the State of New York as
amended, the Town Board of the Town of tiamaroneck
hereby designates the place in each Election District
in the Town at which the meetings for the registration
of voters and elections and primaries shall be held in
the year following the ensuing first day of October:

Councilman Watson presented petitions received from the Assessor
for the correction of the assessment roll, sd as to permit the appor-
tionment of taxes .
Upon motion made by Councilman Watson, seconded by Councilman
Ezbury, the following resolution was, upon roll call, unanimously
adopted:
WHEREAS, the Assessor has presented petitions for
the correction of the assessment roll for certain
years, pursuant to the provisions of Section 33 of
Chapter 105 of the Laws of 1916 as amended, known
as the Westchester County Tax Act , and
WHEREAS, after due consideration, this Board finds
it desirable to grant said petitions for the cor-
rection of said assessment roll,

The Town Clerk read a petition received from/Assessor, requesting
the approval of a number of pages of the Assessment maps, showing the
corrections made by the Town Engineer as of June lst, 1947, such
corrections being due to the sale or transfer of lots or plots, filing
of the maps in the Department of Land Record in White Plains, and so
forth.
Upon motion by Councilman Watson, seconded by Councilman
Stiner, it was unanimously
RESOLVED, that the Board approves of the changes in
the assessment maps of the Town of Yamaroneck as of
June 1, 1947, and the said maps are hereby corrected
and rectified as of June 1, 19479 in the following

Councilman Embury. stated that he had nothing to report for his
departments.
Supervisor Mandeville informed the members of the Board that the
Personnel Officer of the County of Westchester, had advised that Edward
Proch is now eligible for a permanent appointment as Senior Engineering
Aide to the Town of Mamaroneck, having passed the required examination
and being the only Mamaroneck resident on this register®
Upon motion by Councilman Embury, seconded by Councilman Stiner,
it was, upon roll call, unanimously
RESOLVED, that Edward Proch be and he hereby is appointed
to the position of Senior Engineering Aide to the Town of
Mamaroneck, at an annual salary of $2, 600, effective September
1st, 1947®
The Supervisor presented two sales which had been approved by the
Trustees of the Village of Larchmont, covering properties acquired
by that Village in its foreclosure proceeding In Rem®
Upon motion by Councilman Watson, seconded by Councilman Mills,
the following resolution was adopted:
WHEREAS, the Village of Larchmont, through the institution
of an action begun on February 13, 1946 in the County Court

Foreclosure of Tax Liens pursuant to Article Seven-A, Title
3 of the Tax Law by the Village of Larchmont ( List of Delin-
quent Taxes for 1946)B° , had become and now is the owner of
a number of parcels of real estate situate in the Village of
Larchmont and the Town of Mamaroneck by virtue of a judgment ?.
in said foreclosure action, made and entered on June 19, 1946,
and conveyances to the Village by the Village Treasurer made
in pursuance of said judgment; and
WHEREAS, both the Village of Larchmont and the Town of
Mamaroneck held tax liens for unpaid taxes on said par-
cels of real property; and
WHEREAS, pursuant to Section 165-a of the Tax Law, and agree-
ment dated May 20, 1946, was entered into between the Village
of Larchmont and the Town of Mamaroneck, which among other
things, set forth the interests of said municipalties in the
properties being foreclosed , the disposition of said tax liens
and unpaid taxes, the manner of the sale of said parcels of
real property and the manner of the distribution of the pro-
ceeds received from said sales; and
WHEREAS, the Village of Larchmont hasp pursuant to said
agreement with the Town of Mamaroneck, advertised on June
12th, 1947 and held on June 17, 1947, a public auction and
received bids on certain of said parcels of real estate
now owned by the Village of Larchmont, such bids, however,
being received subject to approval by the Board of Trustees
of the Village of Larchmont and by the Town Board of the
Town of Mamaroneck, and subject to upset prices and terms
of sale as advertised; and
WHEREAS, the highest bids received at the aforesaid public
auction of June 17, 1947 for the respective properties so
offered at the public auction, are listed, with the name
of the highest bidder, as follows :

BE IT RESOLVED, that the sales prices bid for the par-
cels of real property listed above are hereby approved,
and that all consents and approval by the Town Board of
the Town of Mamaroneck for the sale of the aforesaid par-

under the provisions of the aforesaid agreement between

The Supervisor presented requests from the Village of Mamaroneck
for Town Board approval of the sales of properties acquired by the Village
of Mamaroneck in its foreclosure proceeding in rem®

seconded by Councilman Embury, the following/was, upon roll call, unani-
mously adopted:
WHEREAS, the Village of Mamaroneck, through the
Institution of an action in the County Court. of
Westchester County, entitled 41 In the Matter of the
Foreclosure of Tax Liens Pursuant to Article Vll-A,
Title 3 of the Tax Law, by the Village of Mamaroneck,
---- List of Delinquent Taxes for 1945 11, has become and
now is the owner of a nurber of parcels of real estate
situate in the Village of Mamaroneck and Town of
Mamaroneck; and
WHEREAS, both the Village of Mamaroneck and the Town
of Mamaroneck hold tax liens on said parcels of real
property; and
`NHEREAS, pursuant to Section 165H of the Tax Law, an
agreement was entered into between the Village of
Mamaroneck and the Town of Mamaroneck which, among other
things, set forth the interest of -said municipalties
in the properties being foreclosed, the manner of the
sale of said properties, and the manner of the dis-
tribution of the proceeds received from said sales ,

an agreement had with the Town of Mamaroneck, adver-
tised for and received bids on certain properties
owned by the Town of Mamaroneck, as well as on certain
properties owned by the Village of Mamaroneck in the

WHEREAS, the Board of Trustees of the Village of Mam-
aroneck have given consideration thereto and after due
deliberation, accepted the bids herinafter listed as
to price and terms therein set forth; and
WHEREAS, since receipt of said bids, this Board has
given consideration thereto, and after due delibera-
tion, it is

Upon motion by Councilman Stiner, seconded by Councilman Embury,
the following resolution was, upon roll call, unanimously adopted:
WHEREAS, this Board by resolution dated July 22, 1946
approved the bid heretofore made to the Village of mamaro-
neck, by Henry Stansbury, to pay the sum of $2,010, all
cash, for property known as Section 9, Block 86, Lot 9,
on the Village Assessment Map, and
WHEREAS, the Trustees of the Village of Mamaroneck have
- now accepted an amendment of the said bid, providing for
payment of 40% cash and the execution of a 60% five-year
mortgage with 4e° interest to be amortized at the rate
of 20% per year.
NOW, THEREFORE, BE IT
RESOLVED, that this Board hereby approves the amendment
of the bid of Henry Stansbury for the purchase of pro-
perty known as Section 9, Block 86, Lot 9, on the
Village Assessment Map, providing for payment of 40%
cash and the execution of a 60% five-year mortgage
with 41-% interest, to be laid amortized at the rate
of 20% per year.
Upon motion by Councilman Stiner, seconded by Councilman
Embury, the following resolution was, upon roll call, unanimously adopted:
WHEREAS, this Board by resolution dated August 7, 1946,
approved the bid heretofore made to the Village of Mamaro-
neck, by Anthony Walker to pay the sum of $1, 500. all cash,
for property known as Section 8, Block 749 Lots 2A and 2B
on the Village Assessment map; and
WHEREAS, the Trustees of the Village of Mamaroneck have
now accepted an amendment of the said bid., providing for
payment of 40% cash and the execution of a 60% five-year
mortgage with 4z% interest, to be amortized at the rate
of 20% per year .
NOW, THEREFORE, BE IT
RESOLVED, that this Board approves the amendment
of the bid of Anthony Walker for the purchase of
property known as Section 8, Block 74, Lots 2 A
and 2B on the Village Assessment Map, providing
for payment of 40% cash and the execution of a
60% five-year . mortgage with 4* % interest, to be
amortized at the rate of 20% per year.
The Supervisor presented a new lease between the Town Board of
the Town of Mamaroneck, acting as the Board of Fire Commissioners, and
Steffi Nossen, for the use of the Fire House Auditorium between the hours
of 10 and 11 A.M. and 3 and 6:30 P.M. on Fridays, and between the hours
of 3 and 6:30 P .M. on Wednesdays, from October 1st, 1947 to May 31st,
1948 at an annual rental of $600.
Upon aoticn made by Councilman Embury, seconded by Councilman
Mills, it was upon roll call, unanimously
RESOLVED, that the Supervisor be and he hereby is
authorized to sign and execute the lease between
Steffi Nossen and the Town Board of the flown of
Mamaroneck, acting as the Board of Fire Commis-
sioners, for the use of the Fire House Auditorium
between the hours of 10 and 11 A.M. and 3 and 6:30
P.M. on Fridays, and between the hours of 3 qnd
6:30 P.M. on Wednesdays, from October lst, 1947
to May 31st, 1948, at an annual rental of $600.

The Supervisor explained to the members of the Board that after
considerable negoiations, the American-LaFrance-Foamite Corporation had

Foamite Corporation had quoted a price of $3, 200. for a 204 hp engine
and that the $500. charge for 204hp motor represented a magnificent deal
for the Town inasmuch as it would cost considerably more to overhaul the
old motor which was 190hp.

RESOLVED, that the Town of Mamaroneck purchase
from the American-LaFrance-Foamite Corporation
a new 204hp engine for the aerial truck, register
No. L1253, at a cost of $500. FOB Elmira.
FURTHER RESOLVED that the old motor be returned
to the American-LaFrance-Foamite Corporation.
The Supervisor further stated that it was planned to place the
cost of the new motor in the 1948 Budget .

$17, 575.71 from surplus, in order to complete the payment of the #32,000
note which falls due on September 1st, 1947. He reminded the members of

borrowed from the Tax Reserve Fund in order
to make payment to the School Board of the: balance of 1946 school levy
and pending further collection of school taxes for that year . He stated
that there has been collected to date, $14,424.29 and the amount re-
quested to be transferred will be sufficient to re-pay the Tax Reserve
Fund, the entire $32,000.
Upon motion by Councilman Embury, seconded by Councilman

RESOLVED, that pursuant to Section 96A of Chapter
62 of the Laws of 1909 as amended, the Town Board
of the Town of Mamaroneck does hereby authorize and
empower the Receiver of Taxes of the Town of Mamaro-
neck to collect the 1947 school taxes for Union Free
School District No. 1 in the Town of Mamaroneck and
School District No. 2 Town of Scarsdale, which under
the provisions of Chapter 105 of the Laws of 1916 as
amended, known as Westchester County Tax Law, become
a lien and are payable on September lst, 1947, in two
partial payments, each amounting to fifty per cent ( 50%)
of any such school tax as levied.
FURTHER RESOLVED, that the Receiver of Taxes of the
Town of Mamaroneck is authorized and empowered to re-
ceive the payment of such partial payments or instal-
meets of the 1947 school taxes for Union Free School
District No.1 in the Town of Mamaroneck, and School
District No. 2, Town of Scarsdale, New York, at any
time but subject to the same penalties as are speci-
fied and provided in Section 18 of Chapter 105 of the
- - Laws of 1916, for neglect to pay the total amount of
the school taxes after , the levey thereof.

FURTHER RESOLVED, that the acceptance of any such
partial or instalment payment of the 1947 school
taxes for Union Free School District No. 1 in the
Town of Mamaroneck, and School District No. 2, Town
of Scarsdale, New York, shall not be deemed to affect,
in any manner any right of the Town of Mamaroneck
under any general or special act, to enforce collec-
tion of the unpaid balances of such taxes as may re-
main due and owing to said Town, but such rights and
powers shall remain in full force and effect to enforce
collection of the unpaid balance of such school taxes, together
with interest, penalties and other lawful charges .
On motion duly made and seconded, the following resolution

RESOLVED, that this Board hereby designates" the
Daily Times" a daily newspaper published in the
Village and Town of Mamaroneck, for the purpose
of publishing the notice of the collection of the

FURTHER RESOLVED, that in accordance with the pro-
visions of Section 26 of the Westchester County Tax
Act, the Town Board do and hereby does direct the
Receiver of Taxes and Assessments to mail to each
taxpayer of the Town of Mamaroneck, whose address
is known to said Receiver .of Taxes and Assessments,
a tax bill for 1947 school taxes, the expense thereof
to be a Town charge .
The Town Attorney requested permission to institute suit against
Anthony Hvizdos and/or Caroline Hvizdos for damages sustained to a Town
police car in an accident in May, 1947. The Supervisor stated the damage
was in the vicinity of $600. and that no effort had been m«de by Mr.
Hvizdos to effect a settlement with the Town.
Upon motion by Councilman Mills, seconded by Councilman Stiner,
it was, upon roll call, unanimously
RESOLVED, that the Town Attorney be and he hereby
is authorized to institutesuit against Anthony and/
or Caroline Hvizdos for damages to Atown of Mamaro-
neck police car, sustained in an accident which
occurred in May, 1947.
The Supervisor stated that he believed the Zoning Ordinance
should be amended to permit the Town to send notices to owners of vacant
property, to cut weeds and clean debris, and if, after a certain time
this notice were not complied with,i�guig_�ein on the property, clean
it up and bill the owner for the charge/in doing this work.
