SPECIAL MEETING OF THE TOWN BOARD, TOWN OF MAMARONECK
HELD JULY 99 1947
- - In the Council Room of the Weaver Street Fire house, Town of
Mamaroneck, New York.
-- The meeting was called to order by Supervisor Mandeville
at 8: 15 P.M. ( Eastern Standard Time) .
Present: Supervisor Mandeville
Councilman Stiner, Mills, Watson, Embury
Absent : None
The presence was also noted of Town Clerk Gronberg, Town
Attorney Delius, and Town Accountant Finson®
The minutes of June 4 and June 18, 1947, were approved as
presented.
A letter dated July 39 1947, was received from Edward Ely
. Hoxie, in which an offer of $500. was made for certain lots on Myrtle
Avenue for the erection of a temporary Community building. An offer
of $1.00 was also made for a triangular piece adjoining the Town Yard.
The letter was referred to Town Engineer Foote for report
at the next meeting.
A letter dated July 3, 1947, was received from the President,
Mr. G .W. Merrell, of the Larchmont Fair Trade Association, Inc . , request-
ing the Town to install several benches of the Central Park type in
Station Park Plaza.
The letter was referred to Councilman Embury, Committee on
Park Department matters for report at the next meeting .
A letter dated July 9, 1947, was received from the Secretary
of the Larchmont Fair Trade Association, Inc. requesting the Town to
drill flagpole holes at the curb line in front of each store on North
Chatsworth and Myrtle Boulevard.
The letter was referred to Per. A.J. Foote with instructions
to proceed with the work as soon as possible.
The following reports for the month of June, 1947, were ordered
placed on file: Report of the Receiver of Taxes; Report of the Town
Clerk; Report of the Building Inspector.
The Town Clerk reported that pursuant to the provisions of
the Election Law, the chairman of each major political party had filed
their lists of recomn-endations for the appointment of election inspectors.
The lasts were examined by the members of the Board and passed on to the
Supervisor for his action.
The Supervisor filed the following certificate:

The Town Clerk called attention to one change in the last list
of polling Places, namely in the ninth Election District, to be considered
for approval.
On motion by Councilman Stiner, seconded by Councilman Mills,
the following resolution was unanimously adopted:

WHEREAS, this Board by resolution adopted July 22, 1946
designated polling places for; the purpose of primary,
registration and election days in the sixteen Election
Districts of the Town of Yamaroneck, which designation
is for the election year October 1, 1946 to September
309 1947; and
WHEREAS, it has become necessary to change the location
of the polling place in the Ninth Election District
from its present location at 1967A Palmer Avenue,
Larchmont, N.Y. to the New Building, Chatsworth
Avenue School, Forest Park Ave., Larchmont, N.Y.
NOW, THEREFORE, BE IT
RESOLVED, that the polling place in the Ninth Election
District in the Town of Mamaroneck be changed from
1967 A Palmer Avenue, Larchmont, N.Y. , to the New
Building, Chatsworth Avenue School, Forest Park Ave .,
Larchmont, N.Y.
The Supervisor asked if there was anyone present who wished
to be heard.
Mr. John Setino of 200 Myrtle Blvd. , Larchmont, N.Y. appeared
and stated,.' that on April 28, 1947 he issued a check to the Town for
$2,308.78 in payment of his taxes. In checking over his Bank Statements
and finding that it had not Cleared he immediately went to see Mr. Dillon
who notified him that his check had not been received and that he could
not accept payment of his tax unless it also included the five per cent
penalty if payable during the months of June and July.
The members of the Bogrd asked Mr. Setino numerous questions
in an effort to be as fully informed on the matter as possible .
The Supervisor informed Er. Setino that the Board would consider
his case later in the evening. He further explained to br. Setino that
in his opinion he doubted if the Board had any legal discretion in this
type of adjustment, but that the Town Attorney would advise the Board
and if the law did allow the Board any discretion, the facts presented
by 1r. Setino would be seriously considered.
The Supervisor suggested that the meeting proceed with the
reports of the Comrr_ittees .
Councilman Watson presented petitions received from the Assessor
for the correction of the assessment roll so as to permit the apportion-
ment of taxes.
On motion by Councilman Watson, seconded by Councilman Stiner,
it was, upon roll call, unanimously resolved:
7IEREAS, the Assessor has presented petitions for the
correction of the assessment roll for certain years
pursuant to the provisions of Section 33 of Chapter
105 of the Laws of 1916 as amended, known as the
Westchester County Tax Act; and
WHEREAS, after due consideration this Board finds it
-- desirable to grant said petitions for the correction

Councilman Embury presented a sketch of the proposed WarT,Temorial,
which is the final design approved by the Board of Park Commissioners and
the joint War Memorial Committee. He explained to the members of the
Board various details as to its location and construction and stated that
the architects are presently engaged in preparing the general specifications
and detailed. plans for its construction and that they would be ready within
the next few days. He said it was the opinion of the Town Attorney that
the Town would have to advertise for bids for the construction of the
memorial and the molding and casting of the eagle.
The Town Attorney explained that letting a contract for municipal
improvements would have to be in terms of unit costs and it was suggested
that Mr. Foote, Mr. Ward, Mr. Cargill and the Town Attorney work together
to prepare the proper specifications for advertising so that bids
can be received and opened at the next meeting of the Board.
Councilman Embury stated that after considerable discussion,
study, and research, it was decided that the legend to be placed on the
-- Memorial would be P1 Faithful Unto Death" .

RESOLVED, that the following notice be inserted in the
Daily Times, the official newspaper of the Town, at
least (10) days prior to August 13, 1947:

NOTICE TO BIDDERS
Notice is hereby given that sealed bids will be received
by the Town Board of the Town of Mamaroneck, Westchester County,
New York between 8 and 8:15 o°clock P.M. Daylight Saving Time
on August 13, 1947 in the Council Room at the Weaver Street Fire
House, and there at a regular meeting of the Town Board will be
-- publicly opened and read aloud, for furnishing all materials,
Tools, Machinery, Equipment and Appliances of every kind and
descriptions whatsoever, and providing the Labor required for
construction of:
WAR MEMORIAL
At the Larchmont Station Park in the Unincorporated Section of
the Town of Mamaroneck, New York, in accordance with the Plans
and Specifications drawn and prepared by Eggers and Higgins,
Architects, 542 Fifth Avenue, New York, and now on file in the
office of the Town Clerk at 158 'Nest Boston Post Road, Mamaroneck,
New York. Copies of Instructions to Bidders, Form of Bid, Form
of Contract, Form of Performance Bond and Plans and Specifi-
cations may be inspected at the office of the Town Clerk and all
information regarding this work may be obtained from Eggers and
Higgins, Architects.
The principal items of work consist of:
(a) Excavating®Filling®Backfilling and Grading
(b) Masonry Work
(c) Bronza_Work
Each bid must be accompanied by a certified check in the sum of
- five per cent ( 5%) of the amount of the bid, payable to the Town
of Mamaroneck, drawn upon a State or National Bank or Trust Company
authorised to do business in the State of New York, and no bidder
may withdraw his bid and in case the successful bidder shall fail
or refuse to enter into a Contract in accordance with the Proposal,
the Proceeds of said check will be retained by the Town.
The successful bidder will be required within ten (10) days after
the awarding of the Contract to furnish and file with said Town
Board, in such form and with such insurer and guarantor as the
Town may approve, policies insuring the Town of Mamaroneck against
any loss and/or damages, resulting either directly or indirectly
from or during the prosecution of the work provided for, under the
faithful performance of the Contract.
The Town Board reserves the right to consider bids for ten (10) days
after receiving same, before awarding the Contract, and the right
is reserved to include or exclude any alternate estimate called for
herein, if any, as may be determined by the Town Board; to reject
any or all bids, or to accept any bids or bids which the Town Board
may deem advantageous to the Town of Mamaroneck and to award the
Contract to other than the lowest bidder.
Copies of the Plans and Specifications may be obtained from the
Town Clerk, upon payment of Ten ($10.) dollars for each set. A
- refund of Ten $10.) dollars will be made to each bidder and a re-
fund of Five ($5.) dollars to each non-bidder upon return of such
sets in good condition within thirty (30) days after receipt of bids .

Councilman Stiner reported that the Department of Public Works
is busily engaged in cleaning out the sewers and flushing the drains
throughout the Town.
He further stated that the sewer and water portion of the
Elkan Park improvements are practically completed and. the job moving
along nicely.
He presented and read the report of the Board of Review which
showed as follows:

Seventy-eight (78) applications for reduction of assessed
value were received by the Board of Review.
Public hearings were held by the Board on ,Tune 17, 18, 19
and 20 from 10 A.M. to 4 P.M.
A careful study of all complaints received, as well as a
personal inspection of properties were made, where it was considered
desirable in order to render fair and equitable decisions, the objective
being maintaining equality in the roll.
The result is a total reduction of only $36, 595.
The total assessed value of the Town of Mamaroneck now
stands at $78, 891,754•
The roll 1946 for 1947 taxes was -----------$77,677 871.

Councilman Mills presented a list of claims from the Fire De-
partment, totaling $1,117.66. He stated that he had checked the bills
and recommended their approval.
The members of the Board sitting as the Board of Fire Com-
missioners considered the claims and on motion by Councilman Mills, se-
conded by Councilman Embury, it was, upon roll call, unanimously

The Supervisor presented the proposed terms of sale in inviting
bids on various properties which the Town is now in a position to sell.
He read the notice which is to be circulated and published in the news-
paper and terms of sale to be signed by the buyers at the auction.
I4substance the notice amounts to the following:
A notice will be inserted in the Daily Times on July 30, 1947,
announcing that the Town will accept bids for certain properties
shown on a list and on a map which is on file in the Supervisor' s
office .
Bids must be equal to or more than one-third of the assessed value
of the property shown on the list. If bids are received for any
of the property, a public auction upon which bids have been re-
ceived will he held on September 2, 1947 at the Weaver Street
Fire House, Larchmont, N.Y. , and the property will be sold to the
highest bidder whether this be the person making the bid, or some
other person. Brokers will be protected to this extent. If the
broker through whom the original bid is made is also the broker
whose client eventually purchases, he will be entitled to a full
commission, but if a higher bid is received the broker who submits
-- the original bid will receive one-half of the original commission
and the other one-half to the successful bidder.
Brokers in order to be recognized must register with the Supervisor
before the auction begins.
The terms of sale in brief are as follows: Ten (10%) per cent to
be deposited at the time of the original bid, or at the time of
the auction. Balance in cash upon closing of title .
All properties will be sold subject to covenants, restrictions,
easements and rights of way, if any, any state of facts which an
accurate survey or a careful inspections will show, zoning ordinances
of the Town z1xMxmxrz=ak or Villages as the case may be, and in all cases,
sales are subject to the approval of the Town Board, or where pro-
perties are situated in the Villages subject to the approval of the
Board of Trustees of the Villages respectively.
The Town reserves the right to withdraw from the auction any of
the listed properties .
The Supervisor reported that Atlantic Municipal Corporation
owners of property known as Block 505, Parcel 446, which is included in
the In Rem proceeding, had requested that they be allowed to redeem the
property by payment of taxes in full with interest and penalties to date,
although both the time to redeem and the time to answer had expired upon
his refusal to accept this amount for redemption. The Atlantic Municipal
through its attorney obtained from the County Court an order staying the
entry of judgment until a hearing and determination of a motion made by
them for an order authorizing the acceptance of this money and the re-
demption of the property.

He stated further that he had instructed the Town Attorney to
oppose this motion which he had done and that the County Judge had rendered
a decision denying the motion but that this decision is based upon a de-
cision in a similar proceeding brought against the city of Peekskill in
their In Rem proceeding which had been decided by the Appellate Division
recently in a three-to-two decision.
He recommended that because of the possibility of an appeal and
reversal of the Town notwithstanding these circumstances accept the full
amount of these taxes with interest and penalties and in addition $100.
for costs offered by Atlantic Municipal Corporation and allow the pro-
perty to be redeemed.
Following discussion, it was on motion by Councilman Stiner,
seconded by Councilman Embury, upon roll call, unanimously
RESOLVED, that Atlantic Municipal Corporation, owners
of property known as Block 505, Parcel 446, be allowed
to redeem the same upon payment to the Receiver of Taxes
of all taxes and/or tax liens with interest and penalties
and charges in full, and in addition the sum of $100. for
costs'
FURTHER RESOLVED, that upon receipt of $2,045.70, the
Receiver of Taxes be authorized to prepare and issue a
certificate of redemption on this property and cancel
these taxes.
The Supervisor explained to the members of the Board that under
the agreement with the Villages of Larchmont and Mamaroneck on the dis-
posal of In Rem Property, the Villages are required to first pay to
the Town as a disbursement all taxes which have accrued subsequent to
their acquisition by the Villages.
He seed that in accordance with this agreement the Town is
now beginning to receive payment for the 1946 school taxes which were
sold in May and purchased at the tax sale by the Town. These moneys as
they are received from the Villages should be applied in payment of the
outstanding tax liens and they, therefore, would be paid to the Receiver
of taxes . However, in paying these tax liens it is foolish to include
the interest and penalties on the tax liens in question inasmuch as it
is practically taking it from one pocket and putting it into the other,
as the town would be paying it to itself.
Following discussion, it was on motion by Councilman Embury,
seconded by Councilman Stiner, upon roll call, unanimously
RESOLVED, that the Receiver of taxes be authorized to
accept payment in the face amount of the taxes on any
liens outstanding on properties the proceeds of which
are derived from the Town' s share of the sale of pro-
perties acquired by the Villages in In Rem action and
in accordance with the agreement prevailing between
the Town and the Villages of Larchmont and Mamaroneck.
The Supervisor presented certificate of payment for contract
work on Contract #106, Exit Drive from Larchmont Station Parking space,
which shows that under the terms of the contract final and only payment
is due the Daniel F. YacIJamee Co. Inc . , in the amount of $1,907.25•
Following discussion, it was on motion by Councilman Embury,
seconded by Councilman Stiner, upon roll call, unanimously

RESOLVED, that the amount of $1,907.25, for the
various items of work completed by Daniel F. Mac-
Namee Co. Inc . , under Contract X106, Exit Drive
from Larchmont Station Parking space, as certified
by the Town Engineer is hereby approved.
FURTHER RESOLVED, that for the purpose of making the
payments required to be made under the provisions of
the contract with Daniel F. MacNamee Co. Inc . for
Contract #106, Exit Drive from Larchmont Station _
Parking space, the sum of $1907.25 be appropriated
from surplus money ( General Town Fund) to the High-
way Budget for the year 1947, AB Item IV, Miscellaneous.
The Supervisor informed the members of the Board that the
Board of Supervisors of Westchester County at its last meeting had put
into effect the full 40-hour a week of all County employees.
He stated that the estimated cost of this change would amount
to approximately $550,000. and pointed out that it is anticipated when
the full years' cost of such a change is included in the County budget
the tax rate will be probably higher that it it was in 1947. He further
pointed out that the taxes for the school had increased in a substantial
amount and that the burden on real estate has become very oppressive.
He said in his opinion some effort to raise moneys should
be seriously considered to relieve the burden on real estate and suggested
that this Board go on record requesting the County of Westchester to
consider the possibility of a sales tax as a means of accomplishing
this result .
The Board members discussed the matter of great length as to
its effect on business in Westchester County and the relief which the
revenues from such a sales tax might be to the taxpayers .
The Board did not feel that they would recommend to the
County the adoption of a general sales tax, but they would request the
County to give serious consideration to the possibility of such a tax
being imposed as a relief upon real estate.
Following further discussion, Councilman Embury moved the
following resolution, which was seconded by Supervisor Mandeville,
WHEREAS, Chapter 278 of the Laws of 1947 enables certain
counties and cities of this State, including Westchester
County, to adopt local laws, ordinances, or resolutions
imposing certain specified types of taxes and to provide
for the distribution of the revenues therefrom, which
specified type of taxes include among other things taxes
on retail sales of tangible personal property at the rate
of not in excess of two (2) per cent, except food products;
drugs, medicines, newspapers, periodicals and cigarettes ;
and
WHEREAS, the costs of County Government have greatly in-
creased as shown in the last County budget adopted for
the year 1947 and from subsequent proceedings of the
Board of Supervisors with more particular reference to
the County payroll and the limitation of the hours of
work;
