HomeMy WebLinkAbout1947_05_07 Town Board Minutes X21 PUBLIC HEARING AND REGULAR IIEETING OF THE TOWN BOARD, TOTIN OF MA11ARONECK, HELD MAY 7, 1947 In the Council Room of the Weaver Street Fire House, Town of Mamaroneck, New York. The meeting was called to order by Supervisor Yandeville at 8 : 15 P .Y. ( Daylight Saving Time) . --- Present Supervisor Y andeville Councilmen Stiner, Bills, Watson, Embury Absent None The presence was also noted of Town Clerk Gronberg, Town Attorney Delius, Town Accountant Finson, and Town Assessor Smith. The Town Clerk presented the affidavit of publication calling for a public hearing upon the proposed improvement of Elkan Park ( Larchmont Veterans ' Building Corporation) , by the construction of streets, ( including pavement and curbing) , sanitary sewers and water mains. The Supervisor asked if there was any one in the room opposed to the Town' s awarding the contract to the lowest bidder for the installation of the utilties for the veterans ' housing project. There being no op- position, the Supervisor stated that it 1,%s safe to assume that every one present was in favor of the installation of these public utilties. The Supervisor then asked the , veterans delegation if they had any preference as to whether stone or concrete curbing be installed. Mr. Albert Kohler replied that this matter be left entirely to the discretion of the Town Engineer. - After further discussion, it was on motion by Councilman Stiner, seconded by Councilman Errbury, upon roll call, unanimously RESOLVED, that the bid made by Daniel F . NIacNamee & Co. , Inc . for improvement at Elkan Park, consisting of street improvements, including paving and curbing, sanitary sewers and water mains , be accepted with respect to items 1 to 28 inclusive, in the total sum of 843, 283 . 50 and that the Town Attorney be and he hereby is instructed to prepare the contract in the form attached to the "in- structions to bidders" and obtain signature thereof . FURTI3ER RESOLVED, that the sum included in this contract for highway improvement items, be transferred from General Town Surplus to Item 1V, Highvay Budget. 1947 and that the budget heretofore adopted by this Board for the year 1947, be amended accordingly. i FURTHER RESOLVED, that the sum included in the amount of the above contract for sewer District improvements, be obtained by borrowing the sum upon a budget note in Sewer District No. 1, as provided in Section 29.00 of the Local Finance Law, such budget note to be issued to the Town of Is_an_aroneck F1 General Fund" , not exceeding however, one (1) per cent of the amount levied in Sewer - District No. 1 for the year 1947. 623 FURTHER RESOLVED, that the type of curbing be selected by the Town Engineer; FURTHER RESOLVED, that the Town Clerk be instructed to return all deposit checks to the unsuccessful bidders ; FURTHER RESOLVED, that the Town Attorney be instructed to take all necessary steps. to procure the signature of the contract with Daniel F . L_acNamee & Co. , Inc . obtain a completion bond and the required certificates of public _ liability insurance and also to obtain from the Larchmont veterans ' Building Corporation, the necessary easements for streets and sewers and record the same. Pr?r . 'x'm . G . Thompson commended the Board for their efforts in this mattes and added that the veterans then.selves deserve a great deal of credit. i1r . John C . Ycrritt, President of the Corporation, expressed on behalf of its members, their appreciation to the Board for their assistance. Mr . William H. Fernschild, President of the Larchmont Democratic Club stated that a resolution had been adopted by their Organization approving of these improvements by the Town. The Supervisor thanked the delegation for attending and suggested that the meeting proceed with the regular order of business . The minutes of April 23, 1947, were approved as presented. A letter dated May 1, 1947, was received from Dated Potts, Jr . Post, No. 1156, inviting the Tom: Board to participate in the lemorial Day Parade. The Town Clerk was instructed to thank this Organization for their kind invitation and to notify them that Councilman Stiner would officially represent the Town Board. A letter dated Lay 5, 1947, was received from the Larchmont Democratic Club, containing a resolution urging the Town Board to ap- propriate the funds necessary for the installation of the public utilties at the Larchmont Veterants ° Housing Project. The Town Clerk was instructed to acknowledge receipt of the communication. The Town Clerk reported that an application for a dance hall license was received from David Potts, Jr. Post No. 1156, V.F.W. , which application had been approved by the Police Department, Fire Department, and Building Inspector. On motion by Councilman Watson, seconded by Councilman Mills, it was, upon roll call, unanimously RESOLVED, that the application of David Potts, Jr. Post No. 1156, V.F.TVd. , for a dance hall license for the year 1947 be approved and the Town Clerk be di- rected to issue same . --- The following reports for the month of April, 1947, were re- ceived and ordered placed on file : Report of the Town Clerk; Report of the Building and Plumbing Inspector; Report of the ?Uestchester County Dog Protective Association; Report of the Receiver of Taxes and -Assess- 625 rents ; Statement of Bank Balances as of Lay 1, 1947; List of Claims Audited and paid by the Comptroller from April 23, 1947 to Lay 7, 1547• On Incineration, Councilman "Watson reported that there has been quite a noticeable improvement in the dumping of trucks since the partition has been removed from the receiving hopper . He said the truck drivers like the new arrangement very much, which seems to be working out very sucessfully, particularly in regards to the handling of the garbage trucks. He said the partition in the second hopper will be cut out the same way. Councilman Embury presented and read a letter received by Supervisor Landeville from Navor Greason of the Village of Larchmont, advising that under the authority of the Enabling Act that was recently passed, the Village of Larchmont was going ahead with the Town of Lamaro- neck in the erection of the joint war memorial. The letter also advised that it was their understanding that before any contracts are actually signed. the Village is to be notified and that payments for the memorial would be made in equal instalments by the Village and Town. The letter also advised that the sum of $10,000. had been included in their budget to equal the Town' s® Councilman Embury was requested to reply to Layor Greason explaining that the Ka,yor ' s understanding of the procedure is in agreement with the thoughts of the Town Board. The Supervisor reported that on April 28, 1947, the Village of Mamaroneck passed a resolution approving the sale of property in their In Rem action. It was his recommendation that this sale be approved . On motion by Councilman Embury, seconded by Councilman Watson, it was, upon roll call, unanimously resolved 71HEREAS, the Village of Mamaroneck through the institution of an action in the County Court of `rtestchester County, entitled"In the Matter of the Foreclosure of Tax Liens Pursuant to Article Vll-A, Title 3 of the Tax Law by the Village of Mamaroneck, List of Delinquent Taxes for 194511 , owner of a number of parcels n now is the o er p has become and of Real Estate situate in the Village of hamaroneck and Town of Yararoneck; and WHEREAS, both the Village of 1'iar.aroneck and Town of Mamaroneck hold tax liens on said parcels of real property; and i"'HEREAS , pursuant to Section 165E of the Tax Law an agreement was entered into between the Village of Yamaroneck .and the Torn of Mamaroneck, which among other things set forth the interests of said munici- palities in the properties being foreclosed; the manner of the sale of said properties; and the manner of the distribution of the proceeds received from said sales ; and YTHEREAS, the Village of Mamaroneck, has pursuant to an agreement had with the Town of TJiamaroneck advertised for and has heretofore received bids on certain properties - owned by the Town of B. amaroneck as well as on certain properties owned by the Village of Mamaroneck in the Town of LT:amaroneck; and . .- ..... .-. 631 guarantor as the Town may approve , policies insuring the Town of lamaroneck against any loss and/or damages resulting either directly or indirectly from or during the prosecution of the work provided for under the Contract, and a bond in the amount of the Contract guaranteeing the faithful performance of the Contract . The Town Board reserves the right to consider bids for ten (10) days after receiving same, before awarding the Con_ tract, and the right is reserved to include or exclude any alternate estimate called for herein, if any, as may be determined by the Town Board, to reject any or all bids, or to accept any bid or bids which the Town Board may deem ad- vantageous to the Town of 1,Iamaroneck and to award the con- tract to other than the lowest bidder. Copies of Plans and Specifications may be obtained from the Town Clerk, 158 77est Boston Post Road, upon payment of Ten ( $10,00) Dollars for each set . A refund of Ten ($10.00) Dollars will be made to each bidder -and a refund 'of Five ($5.00) Dollars to each non-bidder upon return of such sets in good condition within thirty ( 30) days after receipt of bid . By order of the Town Board of the Town of Mamaroneck CHARLES J. "GRONBERG Town Clerk Councilman Stiner reported back on the letter that had been referred to him in connection with a 251 lot near the Murray Avenue School. He said both he and Lr. Foote had examined the property and it was found that the Hatzel' s, whose property also adjoins this parcel, have been using it for some time . He said 1r. Foote had suggested that this pro- -"- perty could be used as an entrance to the Murray Avenue School Playground. Following discussion, Councilman Embury offered to contact Yr. Hatzel to find out if he were interested in purchasing. He said he would also contact some of the members of the School Board. Councilman !Mills presented the following reports. He said objections have been raised to the appearance of both the shack at 'he rear of the building and the gas pure. He said he would make a further report at the next meeting . The Town Attorney reported that he had written to the three families living along Emerson Place and said he had received replies from two - one for and the other against - changing the name to Paaple Hill Drive . He said he had not received a reply from the third party. The Town Attorney requested permission from the Board to attend the testimonial dinner in honor of the State Comptroller and to attend a meeting of the Executive Committees of the Association of Towns on Wednesday and Thursday, hay 14 and 15 , 1947 in Albany. On motion by Councilman Embury, seconded by Councilman V;atson, it was, upon roll call, unanimously RESOLVED, that Town Attorney Delius be authorized _to attend the meeting and dinner in Albany, N.Y. on Iaay 14 and 15, 1947; FURTH7R RESOLVED, that the expenses of the trip shall be paid out of the item in the budget set aside for that purpose . The Supervisor reported on the condition of the police cars and stated that the two cars that have figured in recent accidents, ore of them had been turned in for a new one, as had been planned previous to the accident ; the other would be turned in if it was determined that the chassis had been bent . He also reported that the automobile that had damaged the detective ' s car was insured and the Town will not lose the amount of trade in value on this car. The Supervisor presented a letter dated I'ay 7, 1947 received from the Chairman of the Yamaroneck Republican Town Committee recommend- ing the appointrent of Yessrs . Percy 11, Bibas, Charles L. Dayron , and Eugene Riviere, as members of the Board of Review. Following discussion, it was on motion by Councilman Stiner, seconded by Councilman Watson, upon roll call, unanimously RESOLVED, that in pursuance of Section 7a of the Westchester County Tax Act, a Board of Review is hereby appointed to consist of Yessrs . Percy K. Bibas, Charles L. Daymon; , and Eugene Riviere, all being resident taxpayers of the Town, who shall serve at the pleasure of the Town Board: t r7 !I ill 637 I FURTHER RESOLVED, that the compensation of the afore- mentioned members is hereby fixed at the sum of $250® each® The Supervisor commended Councilman Stiner for his faithful services while serving as a member of the Board of Review and said he _ had been very helpful to the Assessor® Meeting adjourned at 9:30 Pm1Im r � j Town Cl�rls�'
