HELD JANUARY 8, 1947
In the Council Room of the weaver Street Fire House, Town of
Mamaroneck, New York.
The meeting was called to order by Supervisor Mandeville
at 8: 15 P.M. ( Eastern Standard Time) .
Present: Supervisor Mandeville
-- Councilman Stiner, Mills, Watson
Absent : Councilman Embury
The Town Clerk presented and read the affidavit of publication
of the Advertisement which appeared in the Daily Times on December 14,
21 and 28, 1946, for grading, draining and surfacing Exit Driveway at
the Larchmont Station.
The Supervisor asked if there was any one present who wished
to submit a bid. There being no response, he requested the Town Clerk
to open the bids .

After discussing the bids, it was on motion by Councilman
Stiner, seconded by Councilman Mills, upon roll call, unanimously
RESOLVED, that contract No. 106, for grading, drain-
ing and surfacing a twenty (20) foot right of way
or street extending from land of the N.Y. , N.H. & H.
R.R. ( New Parking Space) to the dead end of Cabot
Road in the unincorporated section of the Town of
Mamaroneck, N.Y. , in accordance with the plans and
specifications drawn and prepared by A.J. Noote,
Town Engineer and Supt . of Highways, and notice
published in the Daily Times on December 14, 21 and
289 1946, be awarded to DANIEL F. LACNAP;EE, INC . for
the sum of $1, 965.
FURTHER RESOLVED, that the Supervisor is hereby auth-
orized to sign the same, upon compliance by the con-
tractor with all the terms and conditions provided
in the instructions and specifications ;
FURTHER RESOLVED, that the Town Clerk is hereby
directed to return the deposit and bid checks to
the unsuccessful bidders .

Mr. John C . Merritt and a delegation from the Larchmont Veterans
Association appeared to report on the progress being made on their project .
Mr . Merritt said they had wanted to present more cost data but
the information was not available at this time. Reporting on the progress
Mr. L:erritt advised that three major contracts had been awarded, namely,
the excavation work, foundation work and masonry. He said thus far the
costs have exceeded what had been anticipated just about a year ago.
He stated it was going to be a real burden to all concerned and they know
that they can certainly use some assistance from the Town. He said that
in about two months they will be in a better position to discuss the
matter and know what their costs will be, which figures they will present
to the Board at that time .
Yr . Lerritt advised that their project has been receiving a
great deal of interest b various organizations all over the country.
He said they had prepared and sent out a brief resume on how the plans
operate . A model of the project made by Yr. Kohler, a member of the
Association, was exhibited giving the members of the Board ,an idea of
what the development will look like ,Fhen it is completed.
The Supervisor commented that it was very encouraging to see
the progress being made and asked the delegation to return when their
cost data is complete .

Councilman `��ayson said they are to be congratulated on the
progress made so far.
A letter dated December 30, 1946, was received from Ir. Edward
F.V. Uthe, Executive Secretary of the Association of Towns giving notice
of the annual meeting that would be held in Albany of February 19, 20
and 21. Also enclosed was a Certificate of Designation for the Town' s
voting delegate and alternate at this meeting .
The Supervisor recommended that Town Attorney Delius, Town
Clerk Gronberg and Town Accountant Finson be designated to represent
--_ the Town.
On motion by Supervisor Uandeville, seconded by Councilman
Watson, it was, upon roll call, unanimously
RESOLVED, that Town Attorney Delius, Town Clerk Gronberg,
and Town Accountant Finson be and they hereby are desig-
nated and authorized to represent the Town of Mamaroneck
at the annual meeting of the Association of Towns of the
State of New York to be held in Albany, on February 19,
20 and 21, 1946 ; and be it
FURTHER .RESOLVED, that the Comptroller is hereby author-
ized to audit their claims for the expenses of the trip,
said amounts to be paid out of the items in the budget
for traveling expenses, respectively.
A letter dated December 30, 1946, was received from Yr . lo'.errill
J . Brurmell, stating that he would like to improve the Town-oTnned property
adjacent to his home and requesting if some arrangements can be worked out
that might be suitable to the Town.
The Supervisor explained that this matter concerns a plot
50 x 100, through which runs as easement.
Following discussion, the matter was referred to the Town
Attorney for further study and recommendation.

The deed received from ,_r. Joseph Pittera, et al, was transferred
to the Town Attorney.
The following reports for the month of December, 1946, were

Councilman Watson presented the following petitions received
-- from the Assessor for the correction of the assessment roll so as to
permit the apportionment of taxes .
On motion by Councilman "Tatson, seconded by Councilman Stiner,
the following resolution was, upon roll call, unaimously adopted:
WHEREAS, the Assessor has presented petitions for
the correction of the assessment roll for certain
years pursuant to the provisions of Section 33 of
Chapter 105 of the Laws of 1916 as amended, known
as the Westchester County Tax Act; and
'KEREAS, after due consideration this Board finds
it desirable to grant said petitions for the cor-
rection of said assessment roll;

Councilman Watson stated that he had just received a report
of the operations of the Incinerator and would give a full report at the
next meeting.
The Supervisor stated that he had at hand a check in the amount
of $2,366.69 representing the Town' s share of property known as Block 902,
Parcel 556 ( Colonial Rubber Co. ) .
Following discussion, it was on motion by Councilman Stiner,
seconded by Councilman Watson, upon roll call, unanimously
RESOLVED, that the sum of $2,366 .69 be accepted by
the Town of Mamaroneck as representing its share of
the purchase price of the premises known as Section
- 9, Block 10, Lot 1A on the assessment map of the
Village of Mamarcneck and known as Block 902, Parcel
558 on the assessment map of the Town of Mamaroneck,
and that said sum be applied in full payment of all
tax arrears, which tax liens are hereby cancelled.
The Supervisor presented the following resolution, which was
on motion by Councilman Stiner, seconded by Councilman Watson, upon roll
call, unanimously adopted:
WHEREAS, on September 4, 1946, the Town Board of the
Town of Mamaroneck passed a resolution accepting the
offer of John Freeland, to purchase the property
designated on the assessment roll of the Town of
Mamaroneck as Block 913, Parcel 260, for the sum of
$6, 200. , said resolution being conditioned upon the
approval of said offer by the Village of Mamaroneck;
and
WHEREAS, on September 9, 1946, the Village Board of
the Village of Mamaroneck by resolution duly approved
said offer of sale ; and
71HEREAS, on the 3rd day of January, 1947, title was
conveyed to said John Freeland, or his assignee ; and
WHEREAS, the receipts and disbursements in connection
with said property are as follows :

RESOLVED, that in accordance with the percentages
above set forth there be paid to the Village of
Mamaroneck 45.89% of the net proceeds of $6, 832.77
or $1, 937.90.
FURTHER RESOLVED, that this disbursement be made
from the receipts of the aforementioned transaction.
The Supervisor stated that he had at hand a resolution from the
Village of Larchmont approving the sale of certain properties offered at
public auction on December 23, 1946.
Following discussion and on motion by Councilman Watson, se-
conded by Councilman Stiner, the following resolution was presented:
'�tHEREAS, the Village of Larchmont, through the institution
-- of an action begun on February 13, 1946 in the County
Court of Westchester County, and entitled "In the Matter
of the Foreclosure of Tax Liens pursuant to Article Vll-A,
Title 3 of the Tax Law by the Village of Larchmont (List
of Delinquent Taxes for 1946) 11, has become and now is
the owner of a number of parcels of Real Estate situate
in the Village of Larchmont and Town of Mamaroneck by
virtue of a judgement in said foreclosure action made and
entered on June 10, 1946 and conveyances to the Village
by the Village Treasurer made in pursuance of said judg-
ment; and
WHEREAS, both the Village of Larchmont and Town of Mamaroneck
held tax liens for unpaid taxes on said parcels of real
property; and
WHEREAS, pursuant to section 165-A of the Tax Law an
agreement dated I44ay 20, 1946 was entered into between
the Village of Larchmont and the Town of Mamaroneck,
which among other things set forth the interests of said
n foreclosed,
municipalities in the properties being the
disposition of said tax liens and unpaid taxes, the
manner of the sale of said parcels of real property and
the manner of the distribution of the proceeds received
from said sales ; and
WHEREAS, the Village of Larchmont has, pursuant to said
agreement with to Town of Mamaroneck advertised on De-
cember 19, 1946 and held on December 23, 1946 a public
auction and received bids on certain of said parcels of
real estate now owned by the Village of Larchmont, such
bids, however, being received subject to approval by the
Board of Trustees of the Village of Larchmont and by the
Town Board of the Town of Namaroneck, and subject to up-
set prices and terms of sale as advertised; and

WHEREAS, the highest bids received at the aforesaid
public auction of December 23, 1946 for the respective
properties so offered at the public auction are listed
with the name of the highest bidder as follows :

BE IT RESOLVED, that the sales prices bid for the par-
cels of real property listed above are hereby approved,
and that all consents and approval by the Town Board of
the Town of Mamaroneck for the sale of the aforesaid
parcels of real property by the Village of Larchmont
required under the provisions of the aforesaid agreement
between the Village of Larchmont and Town of Mamaroneck
dated May 20, 1946, are hereby granted and allowed. _
The forefoing resolution was adopted by the following vote :
AYES: Councilmen Stiner, Mills , Watson
NOT VOTING : Supervisor Mandeville
ABSENT: Councilman Embury
The Supervisor presented each member of the Board with a
schedule of the proposed upset prices on the remaining parcels of pro-
perty which the Village of Larchmont is offering for sale .
Following discussion, it was on motion by Councilman Watson,
seconded by Councilman Stiner, upon roll call, unanimously
RESOLVED, that the upset prices as presented by the
Village of Larchmont be and they hereby are acceptable
to the Town Board and are to be the minimum prices for
these properties, in accordance with the list filed in
the Town Clerk' s office .
The Supervisor requested the following transfers and on motion
by Councilman Stiner, seconded by Councilman Mills, it was, upon roll
call unanimously
RESOLVED, that the Comptroller and Supervisor be and
they hereby are directed to make transfers within the
1946. budget as follows:

Councilman Stiner reported that he had made a tour of inspection
1"around the Town and found everthing to be in order. He also reported
that Eir. Foote, Town Engineer, was ill at home with a cold and that
he had visited Mr . Orsino who was confined to the hospital and was coming
along nicely.
Councilman Mills reported that he had attended a meeting of
the Joint War Memorial Cor-mittee at the Larchmont Village Hall. He said
that a general discussion was held regarding the Village of larchmont
joining with the Town of Mamaroneck in the construction of a joint
memorial at the Larchmont Station. It was also the plan of the Com-
mittee to move the World "ar 1 memorial from its present site to the
- Larehmont Station Park. Also that the sum of $10, 000 is to be requested
from the Village of Larchmont to equal that appropriated by the Town of
Mamaroneck.
Councilman Mills reported that the questionaire regarding the
veterans ' housing had been prepared and would be mailed at a time so as
not to conflict with the Village of Mamaroneck program.
The Town Attorney presented the following resolution, which
was on motion by Councilman Watson, seconded by Councilman Mills, upon
roll call, unanimously
RESOLVED, that from and after January 8, 1947, the
Town of Mamaroneck elects to adopt the provisions
of Title 3, Article Vll-A of the Tax Law, for the
purpose of enforcing the collection of delinquent
taxes in such Town of Mamaroneck, W stchester County,
New York.
FURTHER RESOLVED, that the Supervisor of the Town of
Mamaroneck, pursuant to subdivision C of Section 161
of the Tax Law, is designated as Collecting Officer
for the purpose set forth in Article Vll-A of the
Tax Law.
The Supervisor designated the two local newspapers, the
Mamaroneck Daily Times and the Larchmont Daily Times, for the purpose
of publishing the notice .
The Town Attorney stated that some corrections to the assess-
rent roll were necessary in connection with foreclosure proceedings in
rem, which concern only names of persons assessed as owners of property,
and further stated that the matter had been taken up with the Assessor
who recommended the changes .
Upon motion duly made by Councilman 7'atson, seconded by Council-
man Mills, it was, uananimously
RESOLVED, that the assessment roll for the year 1946
be corrected so as to show the following described par-

The members of the Board discussed the mart r of rezoning the
property along Griffen Avenue and Old White Plains, /Pter which the follow-
ing resolution was moved by Councilman Watson, seconded by Councilman
Stiner, and unanimously adopted:
RESOLVED, that a public hearing be held upon the
question of amending the Zoning Ordinance. and map
- - which accompanies the same, at the regular meeting
of this Board, to be held February 5th at 8:15 o '
clock P.M. in the Council Room at the weaver Street
Fire House ;
FURTHER RESOLVED, that notice be given of such public
hearing pursuant to provisions of the Town Law and
that the following notice be inserted in the Mamaroneck
Daily Times, at least ten (10) days prior to the hearing :
PUBLIC NOTICE
TAKE NOTICE that the Town Board of the Town of Mamaroneck
will hold a public hearing, pursuant to Section 264 of the Town
Law, in the Council Room at the weaver Street Fire House, Weaver
Street and Edgewood Avenue in the Town of 'Mamaroneck, on February
5th9 1947, at 8: 15 o ' clock. P .M. , to consider amendments to the
provisions of the Zoning Ordinance of the Town of Mamaroneck and
to the map accompanying and forming part of such Zoning Ordinance.
Said amendments to the Ordinance and changes in the Zoning Map
are substantially as follows :
(1) To create a new
Residence District A-4, inawhichlnoo building ilding
Known shall be
erected which is arranged, intended or designed to be used as
- - a house or dwelling for more than one family and in which Resi-
dence District A-4, no house or dwelling shall be erected on
• plot less than 20,000 square feet in area or on any plot having
• frontage of less than 100 feet on any street or avenue dedicated
to public use;
( 2) To provide that in such Residence District A-4 ( use,
height and area) the following shall apply:
a. No part of any building shall be built within
40 feet of any street line .
b . There shall be a rear yard having a depth of
at least 25 feet.
c . Two side yards shall be provided, the least
dimension of which side yards to be not less
than 12 feet.
d. The height of buildings in said district
shall be limited to 40 feet.
-- e . No house or dwelling shall be erected or al-
tered in said district, to accommodate or make
provision for more than two families on any acre
of land nor more than a proportional number of
families on a proportional acre of land.

(3) To amend the map which accompanies the Zoning
Ordinance , so as to show the following described property in
use, area and height districts as Residence District A-4:
BEGINNING at a point formed by the intersection of
the easterly side of Fenimore Road and the boundary
line of the Town of Mamaroneck and Town and Village
of Scarsdale ; thence in a northeasterly direction
along the said boundary line to lands now or formerly
of Isaac Hall; thence still in the same direction,
through lands now or formerly of Isaac Hall to the
lands of the Westchester County Park Commission
( Saxon Woods Park) ; thence southeasterly, southerly
and southwesterly along said lands of the Westchester
County Park Commission and along lands now or formerly
of Hall, Prince and Seymour, to the easterly side of
Old white Plains Road; thence southerly, along the
easterly side of Old white Plains Road, to lands now
or formerly of John J. Idiurdock, designated as Block
326 on Town of 4damaroneck Assessment Map; thence
easterly, southeasterly and southerly, along lands now
or formerly of John J. T.'urdock and lands of Westchester
County Park Commission (Saxon Woods Park) to the easterly
side of Old White Plains Road; thence southerly along
the easterly side of Old White Plains Road to lands of
Westchester County Park Commission (Cross County Park-
way) : thence westerly, along the northerly line of said
Parkway and lands now or formerly of John J. Yurdock,
to the easterly side of Fenimore Road; thence north-
westerly along the easterly side of Fenimore Road, to
a point formed by the easterly side of Fenimore Road .
and the southerly boundary line of Subdivision of
Boulder Brae as shown on map filed in the County Clerk' s
Office as hap x#3906 ; thence northeasterly and northerly
along said Subdivision and lands of winged Foot Holding
Corporation, to a point formed by the northerly line of
Subdivision of Boulder Brae and Subdivision of Fenimore
Cooper Park as shown on map filed in the County Clerk' s
office in Volume 559 page 79 of maps and the winged Foot
Holding Corporation; thence southwesterly along the boun-
dary line of said Boulder Brae and Fenimore Cooper Park
Subdivisions, across Wilson Lane ; thence still south-
westerly along the northerly side of Wilson Lane to the
easterly side of Fenimore Road; thence northerly along
the easterly side of Fenimore Road to the boundary line
of the Town of 11amaroneck and the Town and Village of
Scarsdale, the point or place of beginning.
The exterior boundaries of the proposed Residence District
A-4 are indicated on the appended map by cross-hatching .
TAKE FURTHER NOTICE that all persons interest will have
an opportunity to be heard at the above stated time and place .
