HomeMy WebLinkAbout1946_12_04 Town Board Minutes 465 REGULAR MEETING AND PUBLIC HEARING BY AND BEFORE THE TOWN BOARD OF THE TOWN OF MAMARONECK, NEW YORK, HELD IN ACCORDANCE WITH THE TOWN LAW, HELD DECEMBER 4, 1946 In the Council Room of the Weaver Street Fire House, Town of Mamaroneck, New York. The meeting was called to order by Supervisor Mandeville at 8:15 P.M. ( Eastern Standard Time) . Present: Supervisor Mandeville Councilmen Stiner, Mills, Watson, Embury Absent: None The presence was also noted of Town Clerk Gronberg, Town Attorney Delius, and Accountant Finson. The Supervisor asked if there was any one who wished to appear before the Board on matters other than the proposed budget . Mr. Eligio Del Guercio appeared before the Board and read a prepared statement on behalf of the GI Civic Association of Mamaroneck requesting the cooperation of the Town Board in launching an independent veteran housing survey and asking that a committee of three councilmen be named to represent the unincorporated area of the Town. The Supervisor asked Mr . Del Guercio if he had any objection to the appointment of only one councilman on this committee . Mr. Del Guercio said that he had no objection and was agree- able to whatever suggestion the Supervisor made . The Supervisor stated that with the permission of the Board he would name the following to act on this committee : Councilman George E . Mills, Chairman, Mr . George Burchell, and Mr. Peter Kane . He suggested that a fourth member to this committee be appointed by the GI Civic Association. There being no one else to be heard, the Supervisor delcared the public hearing open for discussion of the proposed budget of the Town, for the year 1947. The Town Clerk read the affidavit of publication of the notice of hearing published in the Daily Times on November 23 and 30, 1946. It was agreed to follow the procedure of previous years . The Supervisor called out each page and asked for comments. At page 18, "Department of Highways - General Town, " Mayor B.J. Santoro of the Village of Mamaroneck asked that a letter addressed to the Town Board be read, which fully explained the wishes of his Board . The Supervisor read the following: ......... ...... 407 November 27, 1946 Town Board Town of Pdamaroneck, New York Gentlemen: At the regular meeting of the Village Board on Monday, November 24th, Mayor Santoro reported he had received a copy of the proposed Town Budget for the year 1947 from Supervisor Mandeville, Upon presenting same he called attention to certain items therein which provided for services to be rendered and equipment to be purchased for the sole benefit of the unincorporated area but that the cost of such services and equipment was to be spread over the whole town as a general town charge . Most of these items were contained on Page 18 of the budget . After discussion, it was unanimous opinion of the Board of Trus- tees that the Village should enter a protest against the inclusion of these items in the budget. Specifically, the items found to be objectional. are on Page 18 and comprise of machinery in the amount of $17, 500. , and show removal and miscellaneous items in the sum of $12,000. , making a total of $29, 500. While there may be other items in the budget which are objectionable for the same reason, specific protest is entered against the items listed on this page . It is our understanding that the Village of Larchmont has already raised the question of the propriety of the inclusion of these items and that they were advised that it was obligatory under the Town Law that they be included as a general Town charge . It is the feeling and recommendation of our Board that if your Honorable Board feels that these items must be included under the present law, that you join with our Village and the Villages of Westchester County in an effort to have legislation passed at the coming session thereof which will put an end to this inequitable procedure of taxation spreading items of a purely local nature over the entire township, thereby requiring the taxpayers in the Villages to not only pay for their own snow removal services and machinery but for snow removal services and machinery of the unincorporated area as well. Yours very truly, /s/Wm. H. Johnson, Village Manager The Supervisor also read in part a letter received from Orienta Point Association, protesting this item. Mr . David T . Iday, representing a delegation from the Pinebrcok District ' Property Owners Association, Inc . , also registered objections of the items appearing on Page 18, as General Toxin Charges . Mr . Anthony V. Sansone, Secretary of the Westchester County Villages Officials Association, stated that the Department of Audit and Control had ruled that the Highway Law should be strictly interpreted. He referred to Chapter 271-3, which states "Not more than $50, 000 shall be levied and collected in any town of Monre, Westchester, Nassau or Suffolk counties, the tonw of Union Broome County or in any town of the first class in - Erie County and not more than $15,000 in any town of the first class in Wayne County and not more than $10,000 in any other town, in any one year, 4019 for the purchase or repair of stone crushers, power rollers, motor trucks scarifiers , concrete` mixers, traction engines or road machines for grading and scraping, equipment, tools and other implements, unless duly authorized by the vote of a special or biennial Town election. " Mr . Sansone said that in view of the specific itema mentioned under this section, he felt that the Town should restrict the purchase of its equipment by adhering to this law. The Supervisor explained that a great deal of consideration has been given the necessity of the inclusion of these items in the budget. Due to war conditions it was impossible to purchase any of this equipment during the past years. He said if it had been possible , this expenditure would not have been as great this year . He also stated that this equipment was needed very badly and this was the only way of purchasing it under the present law. Councilman Embury stated that in his opinion this law was in- equitable and he would be willing to cooperate with the Villages in getting this unfair law amended. Councilman Watson, Mills and Stiner shared the same views as Councilman Embury. At Page 20, the item of $5,000. for Recreation was discussed. The Supervisor explained that the Fact Finding Committee ap- painted by the heads of the three municipalties had recommended in their Preliminary Report the need for a Recreation Program in the Town. He said that this item was included in the budget solely to be available in the event that this Recreation Program is carried out . The Supervisor also mentioned that he had received a telephone call from Mr . Willis B . Rice of 27 Orchard Road, saying that he was in favor of the inclusion in the budget of the amount of $5,000. for Recreation. recreation Councilman Watson explained that the/Committee has not yet completed their study, and that their final report probably will include - in more detail what sort of program they have in mind. the At Page 29, Mr. Herbert Baum asked what/present status is of the war memorial. The Supervisor asked Mr. Julian Cargill, a member of the Park Commission, to explain this. Mr . Cargill explained that there are 45 gold star names appearing on the Honor Roll. He said that ten of the names are from the unincorporated section of the Town and thiry-five from the Village of Larchmont . He stated that the Park Department have estimates from the architect and contractors showing that there is a ten per cent increase in the costs and it appears that the war memorial would cost somewhere under $10,000. He said that the Architect and the Park Commission are now waiting for authority from the Town Council to go ahead. with the work on the memorial. Councilman Embury . , . stated that the Village of Larchmont has been asked to participate in this plan. He added that it was hoped that they would, but the Town intends to complete this project since this item was included in the budget . After hearing all persons who desired to speak, and after a motion from the floor by Mr. Herbert Baum, approving the preliminary Tax Budget in the form in which it was presented, and being duly adopted by those present, the Supervisor declared the hearing closed. Y. Members of the Town Board: I am enclosing the recommended 1947 budget for the Town of Mamaroneck for your consideration. The net levy for 1947 is lower by $79,391.45 than the 1946 budget, despite the fact that our estimate for operating costs is $24,918.80 higher. As you know, our floating indebtedness is completely paid and no provision for payment of tax lien notes is included. This proposed budget includes salary increases and adjustments, some of which were granted in July, 1946, to bring the Town salary schedule on an equalized and equitable basis . In addition, the increased cost of supplies has received consideration, Credit for the estimated unexpended appropriations and for the Public Welfare surplus is given under the heading "Cash Available", and, in addition, the Town' s estimated share under the new Moore Plan appears for the first time in place of State shared taxes. Vize have operated during the past years with a minimum of equip- ment and improvements, but the time has come when these expen- ditures should no longer be postponed. Non-recurring items included in the recommendations include the following: 1 . Duplicate assessment cards for Tax Commission ( One-half cost $1,000. 2. New Brockway Truck 5,500. 3. Curb & Corner Roller 1,500. 4. Tractor 20500. 5. Steam Cleaning Machine 600. 6. Cleaning Sheldrake River Bed 500. 7. Althea Lane Seiner 3,000. S. Balance for Garbage Trucks 6,000. 9 . Dodge Pumper purchased from U.S, 1,800. 10, Honor Roll 5 000 $2 400. Members of the Town Bcard <- In addition, the highway budget provides for seal coating and resurfacing of 27 s ,reats at an estimated cost of $15,500. The County takes over the administration of Public ``delfare on January 1, 1947. The costs will be apportioned to the municipal- ities in the County budget on an equalized assessment basis . Under the Ostertag Law the Town may appoint a service officer, and it is recommended that this be done as the need for such an officer will be absolutely necessary in view of the change in welfare administration. We have at present a surplus of approximately $100,000. and the advisability of keeping this intact has been demonstrated this year by the use of surplus funds instead of the issuance of a temporary certificate for the payment to the County of the balance of the 1946 levy, By using this surplus as a revolving fund the effect is the same as a credit in the budget, as the necessity for temporary borrowing and an appropriation in the budget for its repayment is eliminated, The tax rates based on the .recommended figures indicate a decrease of $1.21 per thousand in the tan nate of the unincorporated area and $1.29 in the villages, This , however does not take into consideration the rate for the Stave and County tax which is expected to be higher than in 1945, by reason of increased salaries and costs, expanded services, the absorbtion of public welfare costs, and a general "pay-as-you-go" basis for improvements . The following resolution was then made by Councilmen Stiner WHEREAS this Board has heretofore made , compiled and filed with the Town Clark, a preliminary tax budget can- taining the estimated probable revenues and estimated expen- ditures for the several departments , officei and other town and Special district purposes for the Year 1947; and WHEREAS , notice of the completion and filing of said tax budget and calling a public hearing thereon has beer, duly published on November 23 , and November 30, 1946 , in the Daily Times , Mamaroneck in the manner required by law; and WHEREAS public hearing upon said tax Wget. was duly held this day in accordance with the notice So published; and , WHEREAS this Board has reviewed the items in said prelininary tax. budget as required by Section 113 of this Town Law WOW , THEREFORE , BE IT RESQUED, that the final estimates , as completed by the Town. The Supervisor stated that the efforts put forth by the members of tine Larchmont Gardens Association are always very helpful He said it is a great comfort to have such a group interested in making a study of the Town' s budget each year . He thanked' every one present for appearing at this hearing. Following discussion, it was on motion by Councilman Stiner, seconded by Councilman Embury, upon roll call, unanimously 419 RESOLVED, that the Receiver of Taxes and Assessments be and he hereby is authorized, empowered and directed to accept from Clarence Levy, the sum of $4,384.71, in full payment of the tax liens outstanding on Block 603, Par- cel 69 which payment represents penalties plus 6 % interest on the taxes for the years 1936 to 1942 inclusive, and the regular penalties and interest as prescribed by law on the taxes for the years 1943,1944 and 1945. The Supervisor informed the members of the Board that a statutory meeting for the approval of Highway Accounts must be held between the beriod, December 28-30, inclusive. Following discussion, , it was decided to hold the meeting on Saturday, December 28, at 10 A.P . at the Town Offices . The Supervisor recommended the approval of the application made by Pair. John C . Forrar for dog enumerator for the unincorporated area of the Town for the year 1947. On motion by Councilman Stiner, seconded by Councilman Embury, it was, unanimously RESOLVED, that pursuant to the provisions of Section 108 of the Agriculture and Markets Law, John C . Forrar be and he hereby is appointed as dog enumerator for the unincorporated area of the Town of Mamaroneck, New York for the year 1947. The Supervisor recommended the permanent appointment of Mrs. Donna 'Wiedemann to the position of Intermediate Account Clerk. On motion by Councilman Stiner, seconded by Councilman Embury, it was, upon roll call, unanimously RESOLVED, that Mrs . Donna Wiedemann be appointed to the permanent position of Intermediate Account Clerk --- Department of Town Offices effective December 4, 1946 at an annual salary of $1,810.00 Councilman Stiner read a letter dated December 3, 1946, received from Mr.A.J. roote, Town Engineer, recommending the appointment of Charles Rawlings to fill the vacancy in the Department of Sanitation caused by the resignation of Clifford Peeler. The Supervisor informed the Board that it had been necessary to print 500 copies of the Building Code because of numerous changes which had been made in this code . The bill for this printing amounted to $645. and no funds had been provided in the budget for its payment. He requested that the Board transfer from General Town surplus the sum of $645. to cover same . Following discussion, it was on motion by Councilman Watson, seconded by Councilman Embury, upon roll call. unanimously RESOLVED, that the item in the 1946 budget, Building and Plumbing Dept . "Supplies" be increased by the sum of $645. FURTHER RESOLVED, that these funds be transfered to the Building & Plumbing Dept. from General Town surplus. The Supervisor called attention to the offer of Mrs . Susan Casciaro, in the sum of $1,300 . , for the purchase of Block 132, Parcel 435, which had been laid over from a previous meeting. Following discussion, it was on motion by Councilman Stiner, -- seconded by Councilman Embury 425 RESOLVED, that this Board accepts the offer of Mrs . Susan Casciaro, 96 Myrtle Boulevard, Larchmont, N.Y. in the amount of $1, 300. cash, to purchase property known as Block 132, Parcel 435; FURTHER RESOLVED, that the Town Attorney be and he hereby is instructed to draw the necessary deed for the sale of the property in accordance with the terms of the offer and acceptance, and that the Supervisor be and he hereby is authorized to acknowledge and - deliver the deed accordingly. Floyd Cramer, Treasurer of School District No. 1, dated November 30, 1946, in which was enclosed a check for $10,800. on account of the unpaid 1932-33-34 school levies . The Supervisor read a letter dated December 2, 1946, received from Mr. C .D . DeVinne, Public welfare Officer of the Town, advising that Mr. Anthony V. Rapolla, ,who was granted a leave of absence for duty in the foreign division of the American Red Cross, has terminated his ser- vices with the American Red Cross and has applied for reinstatement to his former position. Mr . DeVinne further pointed out that for Mr. Rapolla to be transfered to the County of Westchester on January 1, 1947, under the provisions of the Ostertag Law, he must be an employee of the Town of Mamaroneck on December 31, 1946 and that his name appear and form part of the payroll for the period December 16 - 31 1946. On motion by Councilman Mills, seconded by Councilman Stiner, it was, upon roll call, unanimously RESOLVED, that Mr. Anthony V. Rapolla is hereby re- instated to his former position as Social Case worker in the Department of Public welfare, at an annual Salary of $1,680. , effective December' 16, 1946. The Supervisor read a letter from Mr. Frank Guadagnolo, pro- testing an assessment against his property for the cost of removing a fire hydrant at the time he was constructing the present improvement on his property. He explained that the replacement of this hydrant was de- cided by the Fire Chief in order to avoid damage to the same . Councilman Mills informed the Board that he had at hand a letter from Fire Chief Burton advising that he had authorized the removal of this hydrant . Following discussion, it was the opinion of the Board that this charge was erroneously made to the property owner. On motion by Councilman Mills, seconded by Councilman Embury, it was, upon roll call, unanimously RESOLVED, that there be cancelled from the list of water arrears certified to the Town of Mamaroneck on 421 November 29, 1946, the sum of $$6.61 for Block 133, Parcel E90, owner Frank G. Corporation, 194 Myrtle Ave . , Account No. 2348. The Supervisor stated that he had at hand a check in the sum of $4.13 from Isabel Hyland, in payment of the 1936 tax, sale of 1937, on Block 405, Parcel 283 . In preparing the In Rem list, the Supervisor explained, it was found that this tax was open on the books . Following discussion, it was on motion by Councilman Embury, seconded by Councilman Stiner, upon roll call, unanimously RESOLVED, that the Receiver of Taxes and Assessments be and he hereby is authorized to accept the sum of $4.13 from Isabel Hyland, representing the face amount of the 1936 tax in full on Block 405, Parcel 283 . Councilman Stiner reported that the work on cleaning out the catch basins would be finished shortly. Councilman Mills reported that he had at hand a number of bills from the Fire Department, totaling $1, 568.73, which he had checked and recommended the approval of the bills as presented . The Supervisor announced the purpose of the meeting and pre- sented his annual report of highway moneys for the year 1946. On motion by Councilman Embury, seconded by Councilman Watson, upon roll call it was unanimously RESOLVED, that the Supervisor ' s annual report of highway moneys for the year 1946 be and it hereby is approved. A letter dated December 17, 1946, was received from Village Clerk Margaret E . Lord, thanking the Town Board for a bus shelter which had been given to the Village of Larchmont . The letter was ordered placed on file . A letter dated December 7, 1946, was received from Mr. Joseph Di Buono. Constable of the Town of Mamaroneck, stating that he wished to resign from that office effective as of this date . Mr. DiBuono' s resignation was accepted and the letter plae.ed on file . A copy of report made by the President of the Pinebrook District Property Owner ' s Association, Inc . and sent to each member of the Associatio was ordered placed on file . A letter dated December 20, 1946, was received from Henry R. Dillon, Receiver of Taxes, requesting authorization to cancel some old tax liens on his records . Following discussion, it was on motion by Councilman Embury, seconded by Councilman Stiner, upon roll call, unanimously resolved WHEREAS, a receipt dated November 29, 1919, signed by Palmer Howell, Receiver of Taxes, for satisfaction of these liens was duly presented ; and WHEREAS, these liens have already been cancelled in - - the County Treasurer ' s office ; i 433 NOW, THEREFORE , BE IT RESOLVED, that the Receiver of Taxes and Assessments be Authorized to cancel the tax liens in the amount of $4.46 on the tax of 1905, sale of 1906 on property known as Block 830, Parcel 7 - old Waverly Subdivision, Grand Park, lots 158 and 159. A letter dated December 27, 1946, was received from Village Manager Wm. H. Johnson, stating that the Village Board of the Village of Mamaroneck had accepted the bid of Stanley Rosenthal of $16, 150. for property known as Section 8, Block 6, Plot 6B, and Section 8, Block 1, Plot 1A, terms to be 40% cash and 60% mortgage . He advised that since the acceptance of said proposal Mr. Rosenthal has arranged to finance this purchase and pay all cash, provided the Village would allow him a reduction in price to cover the cost of his financing in connection with the mortgage. He also stated that the Village Board will formally pass a resol ution approving the disposal of this property on an all cash basis, and allowing the discount as requested, at the meeting to be held on December 30, 1946 . The Supervisor stated that he had at hand a resolution from the Village of Mamaroneck approving the sale of Section 9, Block 72, lot 27, permitting the Ridgeside Holding , Inc . to pay 40% cash and execute a purchase . money mortgage for the balance of the purchase price of $16,000. , mortgage to provide for amortization at the rate of 20% a year, to bear interest at the rate of 4.5% Following discussion, it was on motion by Councilman Stiner, seconded by Councilman Embury WHEREAS, this Board, by resolution duly adopted the 7th day of August, 1946, approved the sale by the Village of Mamaroneck, to Ridgeside Holding, Inc . of certain property known and described- as Section 9, Block 72, Parcel 27 on the assessment map of the Village of Mamaroneck, and also described as Block 928, Parcel 200 on the assessment map of the Town of Mamaroneck, for a total cash consideration of $16, 000. ; and WHEREAS, Ridgeside Holding, Inc . has applied for permission to modify its bid for such property so as to pay for the same on the basis of 40% cash and 60% mortgage, to be amortized at the rate of 20% a year and bear interest at the rate of 4.5% said mort- gage to mature five years from date ; and WHEREAS, the Board of Trustees of the Village of Mamaroneck, by resolution duly adopted December 9, 1946, approved such application and consented to accept the purchase price for said property on the basis of 40% cash and 60% mortgage, as above stated, RESOLVED, that this Board hereby consents to the modification of the bid heretofore made by Ridgeside Holding, Inc . for premises known as Block 928, Par- cel 200 on the assessment map of the Town of Itiamaro- neck, for $16,000, 40% cash and 607 mortgage, such mortgage to be amortized at the rate of 20% per annum and -to bear interest at the rate of 42oper annum and to mature five years from date. The Supervisor stated that he had asked Fire Chief Burton to appear before the Board and give an account of the work accomplished by his Department during the past year, and to discuss a matter, which is the inspection of buildings that house crowds over the weekends for dancing and dining . He said that at this time of year there is a considerable amount of activity due to the holidays and school vacations . He asked the Chief what inspections had been made. Fire Chief Burton read the following: December 27, 1946 Mr. Owen A. Mandeville, Supervisor Town of Mamaroneck — Tlamaroneck, New York Dear Sir: The undersigned respectively submits the following annual report of the Fire Inspector for the Year 1946: There were in existence in the fire district the following institutions which were classed as possible fire hazards to the public, and they were constantly inspected throughout the year: 18 apartment house units 9 public garages 16 stores 10 clubs or taverns 1 public school A total of 110 inspections were made at the above places and violations were found during these inspections. These violations covered one or more of the following discrepancies : 441 'I I faulty or bad electric wiring poor stand pipe hose extinguishers fire escapes chimneys and oil burners lighting and obstruction of fire exits overcrowding inflamable decorations rubbish and trash elevators incinerators illegal parking All violations has been removed with the exception of two which are pending this date. In addition to the above mentioned inspections, there were checks made by a fireman every Saturday night at places of public assembly to guard against blocking of fire exits, over- crowding and illegal parking which might impede progress of fire apparatus. There have been six dance hall permits in existence during the past year, and a very thorough inspection was made in conjunction with the Building Inspector and Chief of Police before approval for permit was granted. with There was only one fire/damage amounting to approximately $50, at any of the above mentioned buildings . This fire loss is low and it is hoped that during the coming year the fire loss will be kept at a minimum with constant and efficient inspections to eliminate fire hazards . In the general discussion that followed, regarding exits in places of public assembly throughout the Town, it was suggested that Fire Chief Burton make a thorough investigation particularly to see that a new double door installed at the Post Lodge . Fire Chief Burton and Police Chief Yerick, who was also present, informed the members of the Board that these places have always; given 100% cooperation. Following further discussion, the Town Clerk was instructed to hold the license of the Post Lodge pending the approval of the Fire Chief. (401-227) Councilman Watson reported that he had made a little more study of the property along Fenimore Road, Griffen Avenue and Old white Plains Road. He said he would like to discuss the matter later in the meeting . Councilman Embury reported that work at the parking space at the Station had been completed except the exit driveway, for which bids will be received at the next Board meeting. He said there was some additional work to be done, which the Park Commission is endeavoring to have the Railroad complete . A general discussion was held relative to cutting down 26 trees on Town Highways affected with Dutch Elm disease . The members of the Board finally decided to wait until a recommendation was received from the Park Commission as to the purchase or rental of a saw to complete this work. Councilman Stiner reported that a meeting of the Examining Board of Plumbers was held on December 21, 1946 in the office at the Town Yard, for the purpose of examining applicants . It was on motion by Councilman Watson, seconded by Council- man Embury, upon roll call, unanimously RESOLVED, that the Town of Mamaroneck continue its membership in the Association of Townsof the State of New York for the year 1946 and that the annual dues of $98.00 be paid out of the item set aside for this purpose in the 1947 budget .. The Supervisor presented the proposed agreement between the Town of Mamaroneck and the Westchester County Dog Protective Association, Inc . to act as agents for the seizure and impounding of all dogs found unlicensed or untagged or running at large, in violation of the pro- visions of the Agriculture and Markets Laws of the State. On motion by Councilman Embury, seconded by Councilman Stiner, it was unanimously RESOLVED, that the Supervisor be and he hereby is authorized to sign the agreement between the Town of Mamaroneck and the Westchester County Dog Pro- tective Association, Inc. , which contract is sub- ject to final approval by the New York Department of Agriculture and Markets. The Supervisor presented the proposed agreement between the Town of Mamaroneck, Village of Larchmont, and the Larchmont Public Library. Following discussion, it was on motion by Councilman Watson, seconded by Councilman Embury, upon roll call, unanimously RESOLVED, that the Supervisor be and he hereby is -- authorized to sign the agreement between the Town of Mamaroneck, Village of Larchmont, and the Larch- mont Public Library, which agreement amends the ori- ginal agreement dated Sept. 15, 1930 and thereafter modified and as now modified by this agreement, shall terminate on December 31, 1947. The Town Clerk presented the lease for one year covering the rental of the , premises of 158 West Boston Post Road used for the Town Offices. It was on motion by Councilman Watson, seconded by Councilman Embury, upon roll call, unanimously RESOLVED, that the Supervisor be and he hereby is authorized to sign the lease for the rental of the premises used as the Town Offices at 158 West Boston Post Road, Village of Ramaroneck, which rental agree- ment is provided for in the 1947 budget. The Supervisor thanked the members of the Town Board and the entire Town Office Personnel for their cooperation during the past year. Councilman Watson brought up the matter of the rezoning of the property in the Griffen Ave . , Fenirore Road and Old white Plains Road areas, which he discussed with the members of the Board.
