HomeMy WebLinkAbout1946_11_07 Town Board Minutes 71 REGULAR MEETING OF THE TOWN BOARD TOWN OF MAMARONECK HELD NOVEMBER 7, 1946 In the Council Room of the Weaver Street Fire House, Town of Mamaroneck, New York. The meeting was called to order by Supervisor Mandeville at 8: 15 P.M. ( Eastern Standard Time) . Present: Supervisor Mandeville Councilmen Stiner, Mills , Watson, Embury Absent: None The presence was also noted of Town Clerk Gronberg, Town Attorney Delius , and Accountant Finson. The minutes of October 16, 1946, were approved with corrections. The Supervisor suggested that the Town Clerk read the communi- cations. A letter dated October 2, 1946, was received from the Secretary-Treasurer of the Building & Construction Trades Council of Westchester County, respectfully urging the Town Board to comply with the request of the G.I, Association of this community to install utilities and construct roads on a tract of land on Palmer Avenue where the associ- ation is planning to build homes for veterans. The letter was ordered placed on file. A letter dated November 7, 1946 was received from Mr. Anthony C. Perri making application for the position of Fire Truck operator. The letter was referred to the Fire Council. A letter dated October 29, 1946, was received from Mr. W.T. Fitzpatrick, of Griffen Avenue, asking that the Town Board give immediate consideration to the rezoning of property in the area of Griffen Avenue and old White Plains Road to provide for a minimum of a single residence on 100 feet frontage plots. The Town Clerk was requested to acknowledge the letter with thanks . The Town Clerk informed the members of the Board that two petitions were on file from the residents on. Griffen Avenue and Old White Plains Road requesting immediate consideration of the rezoning a of minimum of the property in that area to provide for a minimum of a private residence and garage on at least 15,000 square feet with road frontage of not less than 100 feet. The Supervisor asked if there was any one present who wished to be heard on this matter. Mr. W.T. Fitzpatrick stated that he had nothing to say at the present time. ' A letter dated November 4 1946 was received from Mr. James C . Harding, Commissioner of Public Works, County of Westchester : in connection with the removal of snow and ice on the State Highways in Westchester County pursuant to Chapter 305 of the Laws of 1946. Two ­373 I copies of the agreement for this purpose was also attached. It was on motion by Councilman Embury, seconded by Councilman Stiner, upon roll call, unanimously RESOLVED, that Town Superintendent of Highways A.J. Foote, be and he hereby is authorized to sign the agreements for the removal of snow on State Highways within the Township of the Town of Mamaroneck. A letter dated November 7, 1946, was received from Mr. Joseph Pittera making formal application .to the Board for the dedication of Lester Place and Williams 9 public streets in the Town. The Supervisor stated that the Town Attorney would discuss this matter later in the meeting. The following reports for the month of October, 1946, were received and ordered placed .on file: Reports of the Building and Plumbing Inspector Reports of the Receiver of Taxes and Assessments Report of the Westchester County Dog Protective Association Summary of receipts and disbursements, January 1 to September 30, 1946 Analysis of Budget Appropriations & Expenditures, January 1 to September 30, 1946; Analysis of Estimated Revenues, January 1 to September 30, 1946. List of Claims Audited and Paid by the Comptroller from October 16, to November 72 1946. Statement of Bank Balances as of November 1, 1946. The Town Clerk presented the affidavit of the publication of the. legal notice which appeared in the local newspaper for the sale of Town-owned property known as Block 132, parcel 435. He stated that only one bid was received from Mrs. Susan Casciaro in the amount of $12300. A certified check in the amount of $$130. was enclosed. Following discussion the members of the Board decided to re- ceive the bid and defer action until the next meeting. The Supervisor asked if there was any one present who wished to address the Board. Mr. T. Roosevelt Allen, appearing on behalf of the Humane Society, requested that consideration be given to an increase in the Budget for services rendered to the Town. He distributed a copy of the .1947 budget requirements to each member of the Board. He stated that the Village of 'Mamaroneck had increased their budget by 6150. last year and the Town of Harrison has agreed to give them a tax exemptions which would amount to $300. and the Town of Rye has agreed to raise its contract two or three hundred dollars. He said the Village of Port Chester has been added in order to obtain additional revenues. Ih addition to the monies received from the several municipalities it was necessary to raise funds from the various activities held by the Association and contributions made by the members. The Supervisor thanked Mr. Allen for appearing and stated that the matter would be given consideration later in the meeting when the departmental budget requests were discussed. on Mr. Allen eked the members of the Board to give considerate to an increase in the contract of $300. 375 Mr. Carmen Perciaseppe appeared to inquire if it were true that Cabot Road was to be used as an exit from the Station Park area. He said if this were done he believed it would be a very dangerous situation as there were numerous children living on this street. Councilman Embury informed Ivir. Perciaseppe that it was intended to open Cabot Road for a one-way traffic for the commuters leaving the park-I ing area, but that the one-way traffic would not apply to the people living on the street. The Supervisor informed Mr. Perciaseppe that the Police Department) and Park Commission will have the traffic situation so planned that he or - - any one else on the street would not be inconvenienced. The Supervisor stated that he had at hand a check in the sum of $3,705.48 from David Potts, Jr. Post, No. 1156, for the settlement of the back taxes on property known as Block 407, Parcel 165. On motion by Councilman Embury, seconded by Councilman Stiner, it was, upon roll call, unanimously RESOLVED, that the offer of David Potts, Jr. Post No. 1156, amounting to $3,705.48 to settle and pay the tax liens re- presenting taxes levied prior to April 1, 1941 and including State County and Town taxes which became due April, 1941 I upon premises known as Block 407, Parcel 165 on the Tax Map of the Town of Mamaroneck, be accepted; FURTHER RESOLVED, that the Receiver of Taxes is hereby auth- orized to accept payment of all taxes levied for State, County, Town, Town District and School Distriet purposes up to and including the tax levied for State, County and Town purposes for the year 1941 and which became due April 1, 1941, without penalties or interest as authorized by Chapter -- 917 of the Laws of 1934 as amended; FURTHER RESOLVED, that the acceptance of aforesaid sum in payment of taxes levied prior to April 1, 1941 is conditioned upon payment of all subsequent taxes and/or tax liens with penalties and interest to date of payment. The Supervisor suggested that the study of the tentative 1947 budget be made at this time as Councilman Embury wished to be excused early. ) The members of the Board discussed the budget, requests and recommendations made by the Supervisor concerning the 1947 tentative budget. After con- siderable study and the suggested changes made, which were agreeable to all the members of the Board, it was decided to meet on November 12, 1946 to adopt the tentative budget, in compliance with the law. The Supervisor stated that he had at hand a list of Village of Mamaroneck sales of in Rem properties located in Sections 8 and 9. He in- and the assess ed valuation for these properrtesamounto $91,040. It was his recommendation that these sales be approved. Following discussion and on motion by Councilman Embury, se- conded by Councilman Stiner, the following was , upon roll call, unanimously adopted& WHEREAS, the Village of Mamaroneck, through the institution of an action in the County Court of Vaestchester County, en- titled " In the Matter of the Foreclosure of Tax Liens Pur- suant to Article V11-A, Title 3 of the Tax Law by the Village of Mamaroneck,M k List of Delinquent Taxes for 1945", has be- come and now is the owner of a number of parcels of Real Estate situate in the Village of Mamaroneck an d Town of Mamaroneck; and WHEREAS, both the Village of Mamaroneck and Town of Mamaro- neck hold tax liens on said parcels of real property; and 37° WHEREAS, pursuant to Section 165H of the Tax Law an agree- ment was entered into between the Village of Mamaroneck and the Town of Mamaroneck, which among other things set forth the interests of said municipalities in the pro- perties being foreclosed; the manner of the sale of said properties; and the manner of the distribution of the proceeds received from said sales; and WHEREAS, the Village of Mamaroneck, has, pursuant to an agreement had with the Town of Mamaroneck advertised for --- and on October 14, 1946, received bids on certain properties owned by the Town of Mamaroneck, as well as on certain pro- perties owned by the Village of Mamaroneck in the Town of Mamaroneck; and WHEREAS , the Board of Trustees of the Village of Mamaroneck have given consideration thereto and after due deliberation accepted the bids hereinafter listed as to price and terms therein set forth; and WHEREAS , since receipt of said bids this Board has given consideration thereto, and after due deliberation, it is RESOLVED, that the bids hereinafter listed be accepted at the price and terms therein set forth; LIST OF BIDS ACCEPTED IN. Following discussion, it was on motion by Councilman Watson, seconded by Councilman Embury: WHEREAS. the Village of Larchmont, through the institution of an action begun on February 13, 1946 in the County Court of Westchester County; and entitled " In the Matter of the Foreclosure of Tax Liens Pursuant to Article Seven-A, Title 3 of the Tax Law by the Village of Larchmont. ( List of Delinquent Taxes for 1946) 11 , has become and now is the owner of a number of parcels of Real Estate situate in the Village of Larchmont and Town of Mamaroneck by virtue of a judgment in said foreclosure action made and entered on June 19, 1946 and conveyances to the Village by the Village Treasurer made in pursuance of said judgment; and WHEREAS, both the Village of Larcrimont and Town of Mamaroneck held tax liens for unpaid taxes on said parcels of real pro- perty; and WHEREAS, pursuant to Section 165-a of the Tax Law an agree- ment dated May 20, 1946 was entered into between the Village of Larchmont and the Town of Mamaroneck, which among other things set forth the interests of said municipalities in the properties being, foreclosed, the disposition of said tax liens and unpaid taxes, the manner of the sale of said parcels of real property and the manner of the distribution of the proceeds received from said sales; and WHEREAS, the Village of Larc1anont, has, pursuant to said agreement with the Town of Mamaroneck advertised on October 17, 1946 and held on October 21, 1946 a public auction and received bids on certain of said parcels of real estate now owned by the Village of Larchmont, such bids , however, being received subject to approval by the Board of Trustees of the Village of Larchmont and by the Town Board of the Town of Marnaroneok, and subject to upset prices and terms of sale as advertised; and WHEREAS, the highest bids received at the aforesaid public auction of October 21, 1946 for the respective properties so offered at the public auction are listed with the name of the highest bidder as follows: AUCTION SALE VILLAGE TAX TRAP HIGHEST UPSET PRICE BID ASSESS- BLOCK PARCEL BIDDER PRICE ( ALL CASH) MENT 601 1 Eric Domscheit 900. $ 900® $ 1,000. BE IT RESOLVED, that the sales prices bid for the par- eels of real property listed above are hereby approved, and that all consents and approval by the Town Board of the Town of Mamaroneck for the sale of the aforesaid parcels of real property by the Village of Larchmont required under the provisions of the aforesaid agreement between the Village of Larchmont and Town of Mamaroneck dated May 20, 1946, are hereby granted and allowed. The foregoing resolution was adopted by the following vote: AYES: Councilman Stiner, Mills, Watson, Embury NOT VOTING: Supervisor Mandeville The Supervisor stated that he had at hand a check for $3,924.62 from Clarence Levy offering to settle taxes on Block 603, Parcel 6. He informed the members of the Board that the tax arrears including interest and penalties amount to $5,182.10, and that the tax liens through 1941 and taxes and liens, interest and penalties -to date amount to 3,594.59. The amount asking to be waived is $$1,587.51. Following discussion, the members of the Board decided that the offer was not satisfactory in view of the type of property and its location. The Supervisor stated that he had at hand a lease from the New York, New Haven and Hartford Railroad Company for the rental of certain property used by the Park Department. Following discussion, it was on motion by Councilman Stiner, seconded by Councilman Embury, upon roll call, unanimously RESOLVED, that the Supervisor be and he hereby is authorized to sign the lease between the New York New Haven and Hartford Railroad Company and the Town of Mamaroneck , for the rental of three parcels of land located northerly of the tracks and easterly of Chats- worth Avenue, being portions of the West Bend Station grounds at Larchmont, N.Y. , for the period from November 1, 1946, and shall continue untill terminated by either party by a written notice to be given to the other party at least thirty days rior to the day of termination. The yearly rental of 1.00 is payable on the first day of November, in advance. The Supervisor recommended the following resolution, which was on motion by Councilman Stiner, seconded by Councilman Mills, upon roll call, unanimously 385 ' RESOLVED, that the sum of $2,013.83 be accepted by the Town of Mamaroneck as representing its share of the purchase price of the Dremises known as Section 9, Block 77, Lots 10 to 16 incl. , on the Village of Mamaroneck Assessment Roll, and known as Block 929, Parcel 51, on the Town of Mamaroneck Assessment Roll, and that the sum be applied first to the payment of the 1946 State, County, Town and School taxes unpaid and the balance to the outstanding tax liens on the above mentioned block and parcel, which tax liens are hefby cancelled. The . Supervisor discussed with the members of the Board the closing out of the Special Assessment Fund transferring cash and assess- ments receiveable to the General Fund and canceling the balance of $11,649.30 against surplus. He said this recommendation was made by Glick-Freedman in the Town audit report. On motion by Councilman Embury, seconded by Councilman Watson, it was, upon roll call, unanimously RESOLVED, that the Supervisor be and he hereby is authorized to transfer the assets and liabilities of the Special Assessment Fund to the General Fund and offset these amounts against the amount carried in the General Fund books as an advance to the Special Assessment Fund. FURTHER RESOLVED, that the balance of the advance to the Special Assessment Fund by the General Fund in the amount of $11,649.30 be charged against General Fund surplus. The Supervisor reported that the Townes share of In Rem pro- -- perties closed by the Village of Mamaroneek during October in Section 8 . amounts to $12,452.19 and the school taxes for 1946 on these properties amount to $1,022.84. The amount of check received is $13,475.03. In addition the Town° s share of mortgages is $3, 534.15. He said that the Town will pay to the school on the 1932-33-34 taxes the sum of $1,382.40, which is the amount of school taxes for these years on these properties. I The Supervisor reported that the net sales of Village of Larchmont In Rem foreclosed properties was $24,714.50 for which the Town has received a check for its share amounting to 10,948.34. The Supervisor reported that the Village of Mamaroneck had paid all the outstanding taxes, including interest and penalties , on the former legion property. In addition, the Village also refunded the amount of $140.52 representing disbursements made by the Town at the time of acquisition of the property. Councilman Embury presented the welfare report for the month of October, 1946, which showed as follows: i Year Cases Individuals Amount 1945 18 32 $ 949.64 1946 13 26 701.36 -" The Town Attorney recommended the following resolution, which was on motion by Councilman Mills, seconded by Councilman Watson, upon roll call, unanimously adopted: 3871 WHEREAS, a deed in lieu of foreclosure was given to the Town of Mamaroneck by Franklyn P. Branagan, pur- suant to Section 36 of the Westchetser County Tax Act, which deed conveyed to the Town of kamaroneck the pro- perty known and described as Block 410, Parcel 1 on the Assessment Map of the Town of Mamaroneck; and WHEREAS, certain taxes and/or tax liens were due and owing to the Town of lamaroneck as of the date of such - - acquisition RESOLVED, that the following taxes and/or tax liens appeasing upon the records of the Town of Mamaroneck be cancelled: Year of Tax S/C/T School 1932 $119. 92 1933 $185.48 91.56 1934 241.15 85.37 1935 171.27 84. 72 1936 180.65 86.53 1937 194.35 90.92 1938 225.43 91.92 1939 216.43 90.20 1940 216.34 92. 67 1941 218.41 89.64 1942 225.22 92.85 1943 224.38 93.51 1944 191.73 88.40 1945 160.56 80.41 1946 169.80 87.68 FURTHER RESOLVED, that all officers having custody of the books and records of the Town of Mamaroneck are hereby authorized and directed to make such entries as are necessary to effect such cancellation. In discussing the Pittera matter, the Supervisor advised the members of the Board that he has asked Mr. Foote to prepare an estimate of the cost of improving Lester Place and Williams Place. Also, in his discussion with Mr. Pittera, the Supervisor informed him that no pro- vision had been made in the budget for this item. That this street could not be taken over until such time as the costs could be determined. Councilman Batson stated that the Special Committee appointed by the Supervisor had prepared a written report which he believed should be read because it had considerable bearing on the two petitions filed with the Town Clerk, and the petition filed with this report. The report stated that the committee had examined the situation of the Hall property with the Town Assessor and the Town Engineer. The Assessor's maps indicated that a portion of the property in question is located in the Town of Scarsdale. Records of the Engineer indicated that the only water available within about two-thirds of a mile of the Hall property is Scarsdale water, and that no sewer system outlet is readily available. A visit to the proposed project revealed that the general character of the surrounding properties consist mainly of large homes on about one-half acre plots . A consultation with Mr. Reeves Newsom, Village Manager of Scarsdale, which is confirmed by Mr. Newsom' s letter attached to this report, also revealed that their Village is now preparing a revised zoning ordiance requiring in that part of Scarsdale adjacent to the town line/in, general the minimum size lot be 20,000 square feet, and that they would be definitely opposed I i project to the proposed multiple dwelling/on the Hall estate. The Special Committee met with Attorney. Gagliardi and his clients at the Weaver Street Fire house on October 28. At his invitation, a considerable number of property holders from the vicinity of the proposed project attended this meeting. Following considerable discussion on this pro- posed project, a poll of 18 persons from the Town of Mamaroneck and 37 persons from the Town of Scarsdale, indicated their disapproval of this project. A detailed record of this meeting is also attached to this report. In answering questions by the residents of the Griffen Avenue area, present at the meeting, the Supervisor stated that no formal ap- plication to rezone this area was ever presented. He also stated that if and when an application is presented, a public hearing would have to be held, public notice printed, and each owner notified. In regard to the petitions of the residents of the Griffen Avenue area, for rezoning, the Supervisor stated that this would be dis- cussed at a later meeting, pending further information obtained by Councilman Watson regarding the proposed rezoning by the Town of Scarsdale. Councilman Watson presented the following petitions received from the Assessor for the correction of the assessment roll so as to permit the apportionment of taxes. On motion by Councilman Watson, seconded by Councilman Stiner, the following was, upon roll call, unanimously adopted; WHEREAS, the Assessor has presented petitions for the correction of the assessment roll for certain years pursuant to the provisions of Section 33 of Chapter 105 of the Laws of 1916, as amended, known as the Westchester County Tax Act; and WHEREAS' after due consideration this Board finds it - desirable to grant said petitions for the correction of said assessment roll; NOW, THEREFORE, BE IT RESOLVED, that the assessment roll for the year 1945, taxes of 1946, and the assessment roll for the year 1946, taxes of 1947, which show property now appearing on the rolls as follows: Section Block Lot Owner Land Only 6 41 29 to 33 Bassi Freres Realty 43,000 (616-297) be corrected as follows, in accordance with the pro- visions of subdivision 5 of Section 33® Section Block Lot Owner Land Only 6 41 33 'N.E.
