REGULAR MEETING OF THE TOWN BOARD
TOWN OF MAMARONECK NEW YORK
HELD OCTOBER 16, 1946
In the Council Room of the Weaver Street Fire House , Town of
Mamaroneck, New York.
The meeting was called to order by Supervisor Mandeville at
8:15 P.M . ( Eastern Standard Time) .
Present: Supervisor Mandeville
Councilmen Stiner, Mills, Watson, Embury
Absent: None
The presence was also noted of Town Clerk Gronberg, Town Attorney '
Delius,, Comptroller Orsino and Accountant Finson.
The Supervisor suggested. that the regular order of business
be suspended in order to hear those who wished to speak. He called upon
Hunter iieighar, who in turn introduced Mr. Albert Kohler to speak
on behalf of the Larchmont Veterans Housing Association.
Mr. Kohler started that in connection with the proposed Larch-
" mont Veterans Housing project there was need for roads, sewer, water ,
gas and light, which he believes come under the heading of public
utilties. He pointed out that in going over their cost sheets they
are trying to maintain standards in their building and personnel to
compare with the standards as they are in Larchmont . He said they
want no jerry type of construction. He said if they as a group are
forced to put in their own roads and utilties it is going to seriously
jeopardize this undertaking. He asked the Town Board what they could
do for them in the way of helping there out with the problem of road
utilties .
The Supervisor asked who the owner of this property is now.
Mr. Kohler stated that the property is still in the name of .
Mr. Bent, Elkan and that it had been held up pending a change in the
description by Mr. A .J. Foote .
The Supervisor asked if the plans have been completelfor
this development.
Mr. Kohler replied that he believed the plans are ready for
filing, but to the best of his knowledge they are not in blue print
form as vet although Mr. O'Reilly, the Architect , had a set of flimsies.
Mr. Kohler was then asked about the financing of this project.
He stated that it had been taken care of, that they were sure of the
money, and they had a cornitment from a bank,
The Supervisor inquired what the cost was for the property.
Mr. Kohler stated that he preferred not to give this information
until the deed has been passed on to him.
The Supervisor asked what the commitment is for the construction
of these houses per unit.

Mr. Kohler replied that they had a general commitment of
$10,000, per house .
Councilman INatson asked if thev had, an itemized list of the
cost for each unit.
Mr. Kohler stated that in the cost sheets prepared by Mr.
OwReilly, it was figured that the cost per unit, including roads and
sewers, would rim between 89,900. and 0`10,000.
Councilman Bulls asked what the carr,ting charges on X103000.
would be .
Mr. Kohler replied that it would be $52.80 per month, plus
taxes , and that the bank was willing to give them a 25-year mortgage .
He said that each member is planning to pa . down at least 50 .
The Supervisor asked if the contractor is to be a local one.
Mr. Kohler said that he was not, but that he will get every
suacontractar he could in Westchester County. Also that he expects to
employ a great many of the laborers from here
When asked by the Supervisor if there was any unforeseen pro-
blem to stop them from going ahead., Mr. Kohler replied that the title
has been cleared and they are just waiting to take it over. He added
that the contract should be signed this weekend and that most of the
major points have been licked.
Mr. Kohler displayed a builders' model of the development show-
ing the location of the proposed dwellings.
The Supervisor asked if there were any more questions. There
being none , he informed Mr. Kohler that the matter would be taken into
consideration and discussed later in the meeting
Mr. Merritt stated that if there are any further questions or
other information the Board would like before making a final decision,
they would appreciate the opportunity of being heard once more.
Mr.Frank rag iardi, Attorney, appeared before the Board on
behalf of a client, offering for consideration the development of the
former Hall property located on Old white Plains Roads, which calls for
the construction of 40 units, each unit to house from four to six families
and would be on a cooperative basis. He suggested that in view of the
changes in the zoning ordinance that would be necessary if this develop-
went materializes, a special committee be appointed to confer with theea
to ascertain the wishes of the surrounding neighbors as to whether or not
it will meet with their approval. He pointed out that a development of
this nature would ingrease the valuation of the assessment roll by two
million dollars .
Sketches and. layouts of the proposed project were submitted by
Messrs. Civkin and Levinson, , Associate Architects . Mr . Levinson ex-
plained that the buildings would be two stories and would present a very
attractive development. He said the community building would contain a
library, nursery and an arts and crafts shop. He said that the buildings
and grounds would be maintained by their own staff of gardeners and handy
men , together with bus service to and from the station.
Mr. Gagliardi informed the members of the Board that be Town
would not be asked to provide utilties. That there would be no garbage

disposal problem as each apartment is to be equipped with a garbae
disposal unit.
Mr. Gagliardi stated that the estimated cost of these build-
ings per room is $2,000. and. the carrying chsarges ,could be approllimately
$70. to $80. per month, including amortization.
The Supervisor asked Mr . Gagliardi if he was here to present
a formal apalication for re-zoning.
Mr . Gagliardi said that they were not in a position to do
so at this time and again suggested that a special commazttee be ap
pointed.
The Supervisor stated that a special committee would be ap-
pointed before the night was over and that he would be notified of its
membership by the Town Clerk.
There being no one else to be heard., the Supervisor suggested
that the meeting proceed with the regular order of business .
The minutes of October 2, 1946, were approved as corrected.
The Supervisor requested the Town Clerk to read the conrmuni-
cations. .
A letter dated October 11, 1946, was received from Mr. Reeves
Newsom, Village Manager of the Village of Scarsdale acl nowledging with
thanks ouestionaire regarding data on salaries and wages in effect in
the Town of Mamaroneck, The letter was placed on file .
A notice dated October 14, 1946, was received frer the Public
Service Commission, Albany N.Y . , advising that a public hearing would
be held before the Commission at 233 Broadway, New York City, on Thurs-
day Oct . 17, 1946 at 10 A .M. in the matter "Proceeding on motion of the
Commission as to the rates and charges of Westchester Lighting Co. RE-
STRICTION OF GAS FOR SPACE HEATING . The notice was olaced on file.
The Town Clerk presented copies of the list of Polling Places
for the 1946 Fall election and. stated. that the Chairman of both major
political groups hasft approved same.
The members of the Board examined the list, following which
it was on motion by Supervisor Mandeville, seconded. by Councilman Watson,
upon roll call, unanimously
RESOLVED, that in accordance with the provisions
of Section 66 of the Election or Law, being Chapter
17 of the Consolidated Las of the State of Idew
Work,as amended, the Town Board of the Town of
Mamaroneck hereby designates the place in each
Election District in the Torn at which the meet-
ing for the registration Of voters and elections
and primaries shah be held. in the year following,

The following reports for the monde of September, 1946, ,were
ordered placed on file : Report of the Town Clerk; Report of the Re-
ceiver of Taxes & Assessments; Report of the Westchester County Dog

The Town Clerk reported that the 1947 departmental budget
requests have been received and are now on file
The Town Clerk Presented the affidavit of the publication of
the legal notice which appeared in the Daily Times on October 10, 1946
for the sale of Town-owned property known as Block 403, Parcel 268. He
informed the members of the Board that one bid had been received,, which
was from the office of Charles L . Day on on behalf of a client , and which
offer was in the amount of $500. cash. Enclosed was $50. in cash repre-
senting ten per cent of the purchase price .
Following discussion, it was on motion by Councilman Stiner,
seconded be Councilman Watson, upon roll call, unanimously

RESOLVED that the Supervisor be and he hereby is
authorized to sell to Ruth and William Cru;ckshank.
property known as Block 403, Parcel 260 on the tax
map of the Town of Mamaroneck;
FURTYER RESOLVED, that the Supervisor is hereby auth-
orized to sign the necessary contract and Deed. con-
keying title to Ruth and William Cruickshank;
FURTHER RESOLVED, that the Town recognizes Charles L.
Daymon, Real Estate Broker, as the broker who brought
about this sale and that he shall be paid the rate of {
commission fixed by the Westchester County Realty Board
from the proceeds of this sale .
The Supervisor suggested that the meeting proceed with the
reports of committees.
Councilman Watson presented the following petitions received
from the Assessor for the correction of the assessment roll so as to
permit the apportionment of taxes.
On motion by Councilman Watson, seconded by Councilman Stiner,
the following was, upon roll call, unanimously adopted-

Councilman Watson said that the Garbage Corrnnis,sion now consists
of the ta.yor of the Village of Larchmont and the Supervisor of the Town ,
who meet with the Trustees of the Village and one Councilman from the
Town as well as the Treasurer of the Commission, Mr. Bracken and Super-
intendent of the Plant, Mr . A.J. Foote . He stated that at the latest
meeting, it was voted to continue Mr. Foote as Superintendent for another
year , starting December 1.
The Supervisor informed the members of the Board that Councilman
Watson had made a recommendation, which is to be carried out, changing the

location of the seales from the office room level to the stoking room
level .
On Recreation, Councilman 'Matson reported that he had studied
the preliminary report of the Joint Fact Finding Cornrmittee, copies of
rahich were presented to the members of the Town Board.
He informed the members of the Board that he had also furnished
copies to Mr. Pease, President of the School hoard, and Mr. T.J. Ahern,
Superintendent of School; also to the Secretary of the Larchmont
Gardens Association and the President of the Howell Park Association
Councilman Watson gave a brief summary stating the report men-
tioned that recreation is a conmiunity need and that recreation is a func-
tion of government. That the municipalities must ,provide for recreation
as they do for education and welfare ana that provision should be made
for all ages , throughout the year. In Westchester County there are 29
units with public recreation programs . In studying the various recreation
reports the Committee finds that it is necessary to have a Recreation i
Commission, an adequate budget, adequate indoor and outdoor facilities
and competent experienced. leadership. In conclusion, the Committee states
that it is their firm belief that it' the three local governments join
forces with the schools , it is possible to provide throughout the Township
at a minium cost. They recommend that this can be done under a budget of _.
20,000. a near, to which the two villages, the Town , and the school will
contribute $5,000 each.
Councilman Watson stated that his reaction to this preliminary
report shows real progress. That it has considerable merit and worthy
of the Board's most careful consideration. That it seems to have the
makings of a workable plang although it may need revision in some respects
to meet the .needs and requirements of all concerned. He said that the
Town Attorney has been asked to review it from a legal standpoint and
now has it under consideration
The Supervisor said that a recreation program is necessary in
the Town, and an item of ,$5,000. has been Oiaced in the tentative budget,
which matter can be discussed at the budget hearing. He said it would
be advisable to get the reaction of the two villages as well as the school
Councilman Watson said that the Larchnont Gardens Association
will discuss the matter at one of its meetings.
Council man watson suggested that a letter be written to the
Town Recreation Committee expressing the Board' s thanks commending the
Committee upon their fine work and asking them to continue their work
towards completing their studies and reports.
The Supervisor asked Councilman Watson to write the letter, and
Councilman Watson replied that he would be glad to do so.
Councilman Embury reperted that the New Haven Railroad expects
to start work on the extension of parking place , although the Park
Department was told that it would be completed by November 1.

Regarding the Honor Roll, Councilman Enbury advised that Mr.
Otto Eggers, the Architect , has been getting some revised estimates in
connection with the plans for a war memorial .
The Supervisor suggested that Councilman Embury contact the
Mayor of the Village of Larchmont to ascertain their plans regarding the
war memorial .
The Supervisor stated that he had at hand tiro resolutions passed
bqr the Village of Mamaroneck for the sale of property which was omitted in
the In Rem original sale .
Following discussion, it was on motion by Councilman Embury„ ,
seconded. by Councilman Watson, uper roll call, unanimously resolved;
WHEREAS, the Village of Mamaroneck has submitted to
this Board for approval , an offer of Edward G. Smith
to purchase a parcel of property, title to which was
acquired by the Village in the in Rem foreclosure pro-
ceeding, and which is known as Block 326, Parcel 455
on the Tax Assessment Map of the Town of Mamaroneck
which Offer is in the sum. of $300. cash;
NOW, THEREFORE, BE IT
RESOLVED, that this Board accept the offer of Edward
G. Smith, in the sum of $300. cash, for property knowr_
as Block 526, Parcel 455 on the Tax Assessment Map Of
the Town of Mamaroneck-
On motion by Councilman Embury, seconded by Councilman Watson,
it was, upon roll call, unanimously resolved:
WHEREAS, the Village of Mamaroneck has submitted to
this Board for approval, an offer of Pietro Abbate
to purchase a parcel of property, title to which was
acquired by the Village in the In Rem foreclosure pro-
ceeding, and which is known as Block 830, Parcel 176
on the Tax Assessment Map of the Town of Mamaroneck
which offer is in the sum of $300 cash
NOW, THEREFORE BE IT
RESOLVED; that this Board accept the offer of Pietro
Abbate , in the sum of $300. cash for property known
as Block 830, Parcel 176, on the Tax Assessment Map
of the Town of Mamaroneck.
The Supervisor informed the members of the Board that he had
at hand a check, from the Village of Mamaroneck in the amount of $6,342 .79
which represented the first check to be received by the Town for its share
in the sale of in Rem foreclosed. properties Of this amount, he said,
$760.39 is to be applied to cancel the 1934-33-32 taxes on these properties
and $363.19 to pay the 1946 school taxes .
The Supervisor advised that the Board of Park Commissioners
recommended that Mr . Thomas Aitchison, Sr. be continued on an annual , . !eaa ,rro ---d-:man®
basis of $2,200 per annum beginners October 1, 1945 as Head Groundsman
On motion by Councilman Embury, seconded by Councilman Stiner,
it ,was, upon roll call, unanimously
RESOLVED' 'that Thomas Aitchison, Sr. be and he hereb -
is employed by the Park Department, as Head. Groundsman,
at an annual salary of $2 ,200. effective October 1, 1946.
The Supervisor stated that he had an offer of $726.56 from
Mr . Euclide Brondoli, offering to settle tax arrears on property known as
Block 125, Parcel 19. He advised that Mr . Brondoli will pay the balance
of the liens comprising taxes for 1942, 1943, 1944 and 1945, plus the
current 1946 Town and School, within the next thirty to sixty days .
Following discussion., it was on motion by Councilman. Stiner,
seconded by Councilman Embury, upon roll call, unanimously
RESOLVED that the offer of Euclide Brondoli in the sum of $726.86 to settle and pay
the tax liens representing taxes levied prior to April 1 1941 and

including States County and Town Taxes which became
due April, 1941, upon premises known as Block 125,
Parcel 19, on the tax map of the Town of Mamaroneck,
be accepted;
FURTHER RESOLVED, that the Receiver of Taxes is hereb
authorized to accept payment of all taxes levied for
State , County, Town, Town District and School Districts
purposes up to and including the tax levied for State ,
County and Town purposes for the year 1941 and .fnich
became due April 1, 1941, without penalties or interest
as authorized by Chapter 917 of the Laws of 1934 as
amended.
The Supervisor stated that he had at hand an offer of 1n1,300.

Parcel 435 . A check for $130. accompanied the bid.
Following discussion, the members of the Board decided to ad-
vertise the property, and on motion by Councilman Embury. seconded by
Councilman Stiner, the following notice was authorized for publication
in the Daily Times:

The Town Board of the Town. of Isiamaroneck will accept bids
for the purchase of a parcel of property located- in the Town of
Mamaroneck, acquired in tax foreclosure proceedings .
Following is the description of said paroel:
All those certain lots , nieces or parcels of land
situate, lying and being in the Town of Mamaroneck,
County of Westchester and State of New York, knocr'n
and distinguished as Lots Nos . 29, 30 and 31 on a
certain map entitled: "Subdivision of Lots 30, 31
and 32; Map of Chatsworth, situate in the Town of
Mamaroneck, 'Westchester County, New York, property
of James J. Burnet, Esq dated November 1891,
Fletcher Herdt, Surveyor, and filed in the office
of the Register of Westchester County May 9, 1921
by the No. 2301; said premises being also formerly
known as Lots Mos. 6, 7 and 23, Section 1, Block
80 on Tax Map of the Town of Mamaroneck Westchester
County State of New York and now know as Block 152 Parcel 435
on said map.
The propert, is offered subject to:
Building and. zoning ordinances of the Town of Mamaroneck
and any amendments thereto, or any possible violation thereof;
Any state of fasts, including changes in street lines which
an accurate survey would snow.
All bids :must be accompanied by a certified check for
10% of the amount of the bid and in the event the bid is re jested
such check will be returned to the unsuccessful bidder.
All bids should be contained in an envelope addressed to the
Town Clerk of the Town of Mamaroneck and should be plainly marked
"Bid for Property."
Bids must be received by the Town Clerk on or before 5 P.M.

The right to reject any or all bids is reserved by the
Town Board.

The Supervisor stated that he had at hand an agreement in tripli-
cate from the Westchester County: Para Commission for the rental of part,
property throughout the Town.
Fcllcwing discussion, it was on motion by Councilman Embury,
seconded by Councilman Stiner, upon roll call, unanimously
RESOLVED, that the Supervisor be and he hereby is
authorized to sign the agreement which provided for
the extension of the lease betmreen the Town of Mamaro-°
neck and the ,Westchester County Park Commission, cover-
ing vacant land known as Parcel 45 and a portion of
Parcel 1-B, Sheet 9, Pelham Port Chester Parkway, for
a period of one year ending October 31, 1947, at the
same annual recital of $1 .00 and. subject to the terms
of the original lease .
In reference to the unpaid 1932-33-34 school levies in the
amount of $48,135 .11 which is still due to the School Board , the Supervisor
explained. in greater detail the proposed raetrod of liquidating this inw
debtedness subject to the approval of both Boards. It is the opinion
of the members of the Town Board that this would be acceptable in the
evert the School Board is agreeable .
It was decided that as sour, as word was received from the
School that the matter would be taken up main.
Councilman Stiner stated that he had nothing to report for his
Committees.
Councilman Mills stated that he has a claim from the Fire -De-
partment in the amount of $1,800. which he had the checked and recommended.

The members of the Board sitting as the Board of Fire Commissioners
considered the claim and on motion by Councilman Embury it was upon roll call unanimously
REESOLVED, that the following described claim be and
it hereby is aporoved and the Supervisor and comp
troller be and they hereby are authorized "Go pay

Councilman Mills distributed pictures of the demonstration re-
centiy held by the Fire Department .
The Town Attorney reported that progress is being made on the
In Rem work and that a tentative list will be ready in about ten days Or
two weeks . He also reverted that he has discussed faith the Lawyers Title
Company the possibility of obtaining a blanket title policy on the parcels
included in the In Rem list
The Supervisor asked Councilman Watson Stiner and Mills to serve on the
Special Committee to confer with Mr. Frank Gagliardi Attorney in connection
with the matter discussed earlier in the meeting
The Supervisor then brought up for a discussion the request of the Larchmont
Veterans Housing Association for improvement and public utilities
The members of the Board agreed to defer action at this time until : 1) there is
something definite insofar as the plans are concerned 2)the name of the contractor
and his reputation 3) the bank or institution that is to finance the project
Some of the members of the Board requested that the next Town Board meeting
be held on November 7 instead of the regular date. This was agreed to
