HomeMy WebLinkAbout1946_10_02 Town Board Minutes :5 REGULAR MEETING OF THE TOWN BOARD, TOWN OF MAMARONECK, HELD OCTOBER 2, 1946 In the Council Room of the Weaver Street Fire House, `Town of Mamaroneck, New York. The meeting was called to order by Supervisor Mandeville at 8:15 P.M. ( Eastern Standard Time) . Present Supervisor Mandeville Councilmen Stiner, plills, Watson Absent- Councilman Embury The presence was also noted of Town Clerk Gronberg, Town Attorney Delius, Comptroller Orsino, and Accountant Finson® The minutes of August 7 and September 4, 1946, were approved as corrected. The Supervisor requested the Town Clerk to read the communications. A letter dated September 120 1946, was received from Mr. Vincent Mareellino, Secretary of Lodge Alessandro Manzoni, No. 258, asking that a representative of the Town Board be present at a meeting on the evening of October 10 at 8 P.M. at the Lodge Room to discuss the matter of flood conditions along the Mamaroneck and Sheldrake Rivers with a view to an eventual elimination thereof. The Town Clerk was instructed to reply to the letter notifying that a representative of the Town would attend this meeting. A letter dated September 11, 1946, was received from Village Manager Johnson together with a certified copy of resolution approving the sale of Block 913, Parcel 260 ( John E. Freeland) . A letter dated September 5, 1946, was received from Donald M. MacLeay, Adjutant of David Potts, Jr. Post No. 1156, advising that one of their recent meetings was devoted to reports and discussions on housing for veterans. This meeting was attended by builders and veterans housing officials of Mamaroneck and neighboring communities. It was the wish of the members of the Post to ascertain whether the Town Board contemplates restricting the occupancy of veterans housing, under its jurisdiction, to local veterans. The Town Clerk was instructed to reply that there is no housing project at the present time over which the Town has any jurisdiction. A letter dated October 2, 1946, was received from Police Chief Paul A. Yerick advising that the Board of Police Commissioners had grant- ed approval to Detective Chauncey Smith to attend a conference of the National Identification Association on October 7, 8 and 9, at Hartford, Conn. He also stated that the expenses involved would be about 535.00 and that this had also approved by the Board of Police Commissioners. On motion by Councilman Stiner, seconded by Councilman Mills, it was, upon roll call, unanimously -- RESOLVED, that detective Chauncey Smith be and he hereby is authorized to attend the National Identification Associ- ation on October 7, 8 and 9, at Hartford, Conn. and that the expenses not to exceed $35.00 be paid out of the budget item in the Police Department. 317 A letter dated October 2, 1946, was received from Public Welfare Officer DeVinne recommending that Mrs. Myra K. Neumann be granted half time leave of absence from October 1 to December 15, 1946 inclusive } without pay. On motion by Councilman Stiner, seconded by Councilman Watson, it was, upon roll call, unanimously RESOLVED, that Mrs . Myra K. Neumann be granted a half time leave of absence from October 1 to December 15; 1946 inclusive , without pay. He said the lease had been properly drawn by the Town Attorney and contained certain provisions that would not interfere with the Fire Department' s use . Councilman Mills said that he questioned the legality of the procedure stating that he was advised that the law could be interpreted in two ways and that the Town might be subject to a suite The Supervisor stated that the Town Attorney had drawn up the lease and since he is paid to advise the Board., he was willing to accept his decision. The Town Attorney explained that the law provides that in towns which/no fire commissioners on June 1, 1933, the Town Board should exercise all the powers conferred upon fire district commissioners and therefore in accordance with this law there is ample authority for the Board acting as Fire Commissioners to make this lease . 329 Councilman mills read two letters addressed to him, one, dated September 23, 1946 from Fire Chief Burton, and the other, dated October 1, 1946, from H. Clay mangles, Secretary to the Fire Council, in which reasons were given objecting to the granting of this lease to Pairs. Steffi Nossen.. The Supervisor stated that he saw no reason for denying this application since the space is there for little or no purpose . He also stated that the lease had been prepared following his letter to the members of the Town Board to which all replied that they were in favor of granting this lease. Following discussion, it was on motion by Councilman Stiner, seconded by Councilman Watson i RESOLVED, that the Supervisor. ce and he hereby is authorized to execute lease between the Town Board of the Town of Mamaroneck acting as Board of Fire Commissioners in Fire District No. 1, and Steffi lossen. The vote on the foregoing resolution showed as follows, AYES; Supervisor Mandeville Councilmen Stiner and Vfatson Not Voting: Councilman Mills The Supervisor stated that he had at hand an offer to compro- miss interest and penalties on taxes levied. prior to April 1, 1941 on Block 216, Parcel 460, owned by Walter J. Dockerill- the interest and penalties to be waived amount to $154.03. Following discussion, it was on motion by Councilman Stiner, seconded by Councilman Mills, upon roll call, unanimously RESOLVED, that the offer of 'Walter J. Dockerill, in the amount of $979.36, to settle and pay the tax liens representing taxes levied prior to April 1, 1941 and including State, County and Town taxes which became due April, 1941 , upon premises known as Block 216, Parcel 460 on the Tax Map of the Town of Mamaroneck, be accepted; FURTHER RESOLVED, that the Receiver of Taxes is hereby authorized to accept payment of all taxes levied for State, County, Town., Town District and School Districts purposes up to and including the tax levied for State, County and Town purposes for the year 1941 and *hich became due April 1, 1941, without penalties or interest as authorized by Chapter 917 of the Lays of 1934 as amended; FURHTER RESOLVED , that the acceptance of aforesaid sum in payment of tales levied prior to April 1, 1941 is conditioned. upon payment of all subsequent taxes and/or tax liens with penalties and interest to date of payment. 331 The Supervisor recommended the following resolution, which was on motion by Councilman Stiner, seconded by Councilman Watson, upon roll call, unanimously RESOLVED, that the sum of $5,490.21 be accepted by the Town of Mamaroneck as representing its share of the purchase price of the premises know n as Section 9, Block 69, Plot, on the Village of Mamaroneck Assess- ment Roll, and known as Block 926, Parcel 43, on the Town of Mamaroneck Assessment Roll, and that said sum be applied- first to the payment of the 1946 State , County, Town taxes unpaid and the balance to the out- standing tax liens on the above mentioned block and parcel, which tax liens are hereby cancelled. On motion by Councilman Stiner, seconded by Councilman Watson it was, upon roll call unanimously RESOLVED, that the sum of $2,890.95 be accepted by the Town of Mamaroneck as representing its share of the purchase price of the premises known as Section 8, Block 112, Lots 35 to 55 incl . or the Assessment Eap of the Village of illamaronsck, and known as Block 823, Parcels 9 and 44 (formerly known as Block 823, Parcel 9) on the Assessment Map of the Town of Mamaro- neck, and that said sum be applied first to the state, County and tolan taxes on Block 823, Parcel 9 and the balance to the tax liens outstanding on Block 823, Parcel 9, which tax liens are hereby cancelled. The Supervisor presented the following resolution, which was on notion by Councilman Watson, seconded by Councilman Stiner, upon roll call , unanimously WHEREAS, on July 22, 1946, the Town Board of the Town -- of Mamaroneck passed a resolution accepting the offer of S .L. Paylo to purchase the property designated on the assessment roll of the Town of Mamaroneck as Block 942, Parcels 31 and 224 for the sum of $7,555 .00, said resolution being conditioned upon the approval of said offer by the Village of Mamaroneck; and WHEREAS, on July 160 1946, the Village Board. of the Village of Mamaroneck, by resolution duly approved said offer of sale; and WHEREAS on the 21st day of Sept 19, 19 46 title was conveyed to said Lavlo or his assignee, and WHEREAS, the receipts and disbursements in connection with said property are as follows: Receipts., Purchase Price $7,555.00 Tax Apportionment 599 .52 Total Receipts $8,154,52 Disbursements, Commission Taxes Accrued. 1942-46 Town. FURTHER RESOLVED, that this disbursement be made from the receipts of the aforementioned transaction. The Supervisor stated that he had at hand a check in the amount of $37 .80 from Richard T. Wood, President of Rockcliffe Estates, Inc. representing the face amount of the tax liens covering 1940 taxes on Block 106, Parcels 509, 511 and 513. On motion by Councilman Watson, seconded by Councilman Stiner, it was, upon roll call, unanimously RESOLVED, that the Receiver of Taxes and Assessments be and he hereby is authorized, empowered and directed to accept the sum of 107.80 to pay tax liens covering 1940 taxes on Block 106, Parcels 509, 511 and 513, at the face amount of the tax liens. The Supervisor stated that he had at hand a resolution from the Village of Mamroneck approving the sale to Augusta W. Epstein for Property known as Section 8, Block 103, Lots 15 and 16 ( Town description Block 823, Parcel 364) . Following discussion, it was on motion by Councilman Mills, seconded by Councilman Stiner, upon roll call, unanimously resolved. WHEREAS, the Village of Mamaroneck has submitted to this Board for approval, an offer of Augusta W. Epstein to purchase a parcel of property, title to which was acquired by the Village in the In Rem foreclosure proceedings, and which is known as Block 823, Parcel 364 on the Tax Assessment Map of the Torn of Mamaroneck, which offer is in the sum of $2,635, terms of which are 40; cash and the balance on a five year mortgage bearing interest at the rate of 4 1/2%; NOW, THEREFORE, BE IT RESOLVED, that this Board accept the offer of Augusta W. Epstein, in the sum of $2,635, cash and mortgage, for property known as Block 823, Parcel 364 ,, on the Tax Assessment Map of the Town of Mamaroneck. 333 showing the net receipts to be apportioned between the Town and Village of Mamaroneck to be $4,359.199 and WHEREAS, the amount of unpaid taxes and percentage due to the Village and Town are as follows: Town Village Total Tax Liens to 1/2242 95,516 .34 56,214.86 .$11,731.20 Percentage 47 .02 52.98 l0G.00 Amount to be Distributed 2;049 .69 21309 .50 4,359.19 NOW, THEREFORE, BE IT RESOLVED, that in accordance with the percentage above set forth there be paid to the Village of vamaroneck 52 .98% of the net proceeds of $6,214.86 or $2,309.50 FURTHER RESOLVED, that this disbursement be Made from the receipts of the aforementioned transaction. Following discussion, it was on motion by Councilman Mills, seconded by Councilman Stiner, upon roll call, unanimously resolved WHEREAS, the Village of Mamaroneck has submitted to this Board for approval, an offer of Augusta W. Epstein to purchase a parcel of property, title to which was acquired by the Village in the In Rem foreclosure proceedings, and which is known as Block 823, Parcel 364 on the Tax Assessment Map of the Town of Mamaroneck, which offer is in the sum of $2,635, terms of which are 40o cash and the balance on a five year mortgage bearing interest at the rate of 4-1/2% NOW, THEREFORE, BE IT RESOLVED, that this Board accept the offer of Augusta W. Foote had examined the truck bids and specifications submitted by the 'Jack-International Motor Truck Corp. and the Brockway Company, Inc . , and that the specifications submitted by the Brockway Company fully meets our specifications . He recommended the purchase of same . I Following discussion and on motion by Councilman ',Watson, se- conded by Councilman Mills , the following was, upon roll call unanimously adopted: WHEREAS, the Town, Superintendent of Highways did on the lst day of August, 1946, duly recommend the purchase of certain equipment pursuant to the provisions of Sec- tion 142 of the Highway Law, and a notice of such re- commendation has been duly published as provided in such action' NOW, THEREF0RE, BE IT RESOLVED, that pursuant to Section 142 of the Highway Law the Town Superintendent of Highways is hereby authorized to purchase from Brockway Motor Company, Inc. with the approval of the County Superintendent of Highways: One (1) Brockway Model 152-iI , G.V.W. 24,000 lbs, chassis, cab and body with spare wheel and tire, for a total price of Five Thousand Four Hundred Ninety ($5,490.00) Dollars, delivered at Mamaroneck,, N.Y. and to be delivered on or about January 1, 1947. He recommended that the Town Board go on record as favoring this project. Following discussion and on motion by Councilman Watson, se- conded by Councilman Mills, the following resolution was unanimously adopted, WHEREAS, the United States Engineers will hold a public hearing on October 10th, 1946 at the Village Hall, in 337 Mamaroneck, upon the application of the Village of Mamaroneck for the dredging of the East Basin of p4amaroneck 'Harbor; and WHEREAS, residents of a large part of Westchester County, including many inland arears thereof, in constantly in- creasing numbers, desire to use Long Island Sound for boating purposes, and the limited Harbor facilities now available giving access to Long Island Sound,, are in- adequate; and WHEREAS, Mamaroneck Harbor by reason of the convenient location., its lanlocked inner harbor of which the East Basin forms part, and its public landings affording free access to its waters, is a natural outlet of Westchester County to Long Island Sound; and WHEREAS, it is of great importance to 'Westchester County that its residents be given the advantages of the much needed additional aeeomodaticn for boats which the proposed improvement will afford and the benefits of better accomodation for commercial craft which such improvement will provide; NOW, THEREFORE, IT IS RESOLVED, in the interest and for the benefit and welfare of the residents of the Town of Mamaroneck and County of Westchester, that the proposed developrnent of Mamaroneck Harbor is strongly endorsed and approved., and recommended to the War De- partment for adoption and execution; and it is further RESOLVED, that the Town Clerk of the Town of Mamaroneck is requested to forward a certified copy of these re- solutions to the United. States Engineers. The Supervisor offered for consideration a claim of Assessor Smith in the amount of 39.54 for expenses in connection with attendance of the Twelfth National Conference on Assessment Aaministration spon- sored by the National Association of Assessing Officers, on Sept. 24, 25 and 26. On motion by Councilman Watson, seconded by Councilman Stiner it was, upon roll call, unanimously, RESOLVED. that the claim of James M. Smith, Assessor; in the amount of $39.54 be and it hereby is approved for payment out of funds in the Assessor' s budget for traveling expenses The Supervisor stated that he had at nand an offer of $500.00 from the office of Charles L. Davmon, for a client, for the purchase of property known as Block 403, Parcel 268. A check for :$50.00 accompained the bid representing ten per cent of the offer. Following discussion the members of the Board decided to advertise the property, and on motion by Councilman Watson, seconded by Councilman Stiner, the following notice was authorized for publication in the Daily Times : ADVERTISEMENT FOR BIDS The Town Board of the Town of Mamaroneck will accept bids for the purchase of a parcel of property located in the Town of Mamaroneck, acquired in tax lien foreclosure proceedings. 339 Following is the description of said parcel: All those certain lots, pieces or parcels of land, situate, lying and being in the Town of Mamaroneck, County of Westchester and State of New York, known and designated as Lots Nos. 40 and 41 on a certain map entitled: "Map of Blossom Heath;, Property of W.D. Cronberg, Town Clerk The Supervisor said that he had expected a group from the Larchmont Veterans Housing Association to applar before the Board to request the installation of water, gas, curos,fpaving of streets mma in connection with their project. The Supervisor read an estimate made by Mr.A .J. Foote showing the cost of the aforementioned improvements to be approximately $32,190.00 I The members of the Board discussed fully the methods of financing these improvements, if they should be done. The Town Attorney reminded the Board that bonding for a sewer does not require a referendum, if the other improvements were to be put to the people for a vote . 341 Following farther discussions the Supervisor suggested that the members give this matter plenty of thought as it would be discussed again at the next meeting. Councilman Stiner reported that a storm water drain on Griffen Avenue was near completion. that Councilman Mills reported/the Town Fire Department would hold a drill on October 11, at 8 P.M. in connection with Fire Prevention Meek. The drill is to be held near the Town Park. An invitation was extended to the members of the Town Board to attend. Councilman Mills stated that he had at hand a number of bills from the Fire Department totaling $1,182.32, which he had checked. He recommended the approval of the bills as presented. He stated that his reason for bringing this matter before the Board was to clarify to the members whether or not the Town would be involved in this proposed project. The Supervisor asked Councilman Mills to explain the ideas to the members of the Board, Councilman Mills informed the members of the Board that in his talk to the Rotary Club in Larchmont he spoke as a Rotarian and not as a member of the Board. It was his plan that it might be possible to develop some type of a cooperative apartment house which would serve a greater number of veterans at a cost that the average veteran could pay. it was also his idea that a group representing types of business and professional men could devote their services to develop this pro- posed project. _ Then asked by Councilman 'Watson if it would be necessary for the Town to finance the improvements for the proposed project, Council- I I 343 man Mills replied that it is hoped to find a piece of property with the improvements already installed. The Town Attorney reported tiaat work is progressing on the Town "in Rem" foreclosures and hopes to have a tentative list ready be- fore the next meeting. The Supervisor asked him to find out if insurance can be obtained from a title company oft these foreclosed properties as he was very anxious to see this done. The Town Attorney agreed with the Supervisor and stated that he had already contacted one of the title companies. The Supervisor reported that due to moving to New York City, Mrs. Harriot Price had tendered her resignation as caretaker of the Town Offices. On motion by Councilman Stiner seconded by Councilman Watson it was unanimously RESOLVED that the resignation of Mrs. Harriot Price effective September 15, 1946 be accepted with regret. Councilman Watson informed the members of the Board that he had just received a copy of the report of the Town Recreation Committee.
