( Daylight Savings Times Present: Supervisor Mandeville Councilmen Stiner, Mills, Watson, Embury Absent: None The presence was also noted of Town Clerk Gronberg Town Attorney Delius, and Comptroller Orsino. A letter dated July 27, 1946, was received from Mr . Edward Ely Hoxie of 49 Edgewood Avenue , Larchmont, N.Y., calling attention to the unsightly appearance of a piece of property at the end of Edgewood Avenue The Supervisor informed the members of the Board that he had discussed the matter with the Chief of Police and since the receipt of this letter the matter had been taken care of and there is no indication that any business is being carried on at this location. A letter dated August 2, 1946, was received from Mr. Edward Ely Hoxie on behalf of the "The Museum of Arts and Industrial Crafts" outlining suggestions for a recreational program. The letter was referred to Councilman v;atson. A letter addressed to Councilman Stiner, dated August 6, 1946, was received from Mr. Michael A. Merola, Assistant Supt. of Public Works requesting a leave of absence from August 15, 1946 to August 318 1946. Following discussion, it was on motion by Councilman Embury, seconded by Courcilman ,Watson, upon roll call, unanimously RESOLVED, that Michael A. Merola, Assistant Superintendent of Public Works, be granted a leave of absence from August 15 to August 31, 1946: without pay. The Town Clerk presented the affidavit of publication request ing bids for the sale of three (3) International dump bodies and hoist trucks. FURTHER RESOLVED , that the offer of Harriet E. Green, in the amount of 02,000 be accepted for property known as Section 8, Block 81, Lot 26 on the tax assessment map of to Village of Mamaroneck and known as Block 832, part parcel 294 on the tax assessment map of the Town of Mamaroneck. Terms to be 50 / cash and 509 mortgage, the interest to be not less than 4-1/2 and the mortgage to mature not later than fine years from date . The Supervisor stated that he had at hand a resolution from the Village of Mamaroneck approving the sale Block 820, Parcels 330, 335 and 257, this offer being subject to a variance/granted by the Zoning Board of Appeals. It was his recommendation that the offer be accepted subject to the granting of this variance . Following discussion and on motion by Councilman Watson, se- conded by Councilman Embury, the following was unanimously adopted. WHEREAS, the Village of Mamaroneck heretofore accepted an offer from Barney Epstein on behalf of Century Cur- tain Co. and Mohawk Curtain Co. , for the purchase of property designated as Section 8, Block 57, Lots 2 to 11 inclusive and Section 8 Block 54, Lots 11 and 12 on the Tax. Assessment Map of the Village of Mamaroneck, and known and described as Block 830, Parcels 330, 335, and 257 on the Assessment Map of the Town of Mamaroneck, which property the Village acquired in an In Rem fore- closure proceeding; and WHEREAS, such bid was made contingent upon and subject to the granting of a variance by the Zoning Board of Appeals to the Village of Mamaroneck, to allow the erection of a building to be used for light manufacturing; and WHEREAS, the offer so made, was accepted by the Village of Mamaroneck, subject to approval by the Town Board, NOW, THEREFORE, BE IT i 265 RESOLVED, that the offer as made to and accepted by the Village of Mamaroneck, subject to the granting of a variance by the Zoning Board of Appeals of the Vil- lage, for the erection of a building to be used for light manufacturing, is hereby approved. FURTHER RESOLVED, that the proceeds of the sale, when consumated, be divided and apportioned on the basis of tax liens held by the Town and `tillage respectively and in accordance with the agreement previously made between the Town and Village of Mamaroneck, which an- titles the Village to 49% of such proceeds and the Town to 51% thereof, the TownTs share being $7,650. The Supervisor stated that he had at hand a resolution from the Village of Mamaroneck approving the sale to Ridgeside Holding, Inc . ,, for property known as Block 928, Parcel 200. Following discussion and on motion by Councilman Stiner, se- conded by Councilman Embury, the following was presented: WHEREAS, the Village of Mamaroneck has submitted to this Board for approval, an offer of Ridgeside Hold- ing, Inc. to purchase a parcel of property, title to which was acquired by the Village in the In Rem fore- closure proceeding, and which is known as Block 928, Parcel. 200 on the Tax Assessment Maa of the Town of Mamaroneck, which offer is in the sum of 616,000. all cash NOW, THEREFORE, BE IT RESOLVED, that this Board accept the offer of Ridge- side Holding, Inc. , in the sum of $16,000. all cash, — for property known as Block 928, Parcel 200, on the Tax Assessment Map of the Town of Mamaroneck. I The foregoing resolution was adopted by the following vote: AYES; Councilmen Stiner, Mills Watson, Embury NOT VOTING: Supervisor Mandeville The Supervisor stated that he had at hand a resolution from the Village of Larchmont approving the sale of certain properties offered at a public auction held on July 22, 1946. I 269 The foregoing resolution was adopted by the following vote: I AYES: Councilmen Stiner, Bills ,,5atson, Embury NOT VOTING: Supervisor Mandeville The request of Assessor Smith, contained in his letter of July 19, 1946 and presented at a previous meeting, asking to cancel taxes on Block 718, Parcel 500, which covers two small islands known as Great Knob and Little 'Knob, and laid over from the last meeting was discussed by the members of the Board, It was decided to refer the matter to the Town Attorney and notices to redeem be sent to the owners of this property. Councilman Watson presented the following petitions re- ceived from the Assessor for the correction of the assessment roll so as to permit the apportionment of taxes. On motion by Councilman Watson, seconded by Councilman Stiner, the following was, upon roll call, unanimously adopted: WHEREAS, the Assessor has presented petitions for the correction of the assessment roll for certain years pursuant to the provisions of Section 33 of Chapter 105 of the Laws of 1916 as amended, known as the Westchester County Tax Act; and I WHEREAS, after due consideration this Board finds it desirable to grant said petitions for the cor- rection of said assessment roll; NOW, THEREFORE, BE IT RESOLVED, that the Assessment Roll of 1945, taxes of 1946, which shows property now appearing on the roll as follows: Section Block Lot. He also advised that due to the moving of the Department of Public Welfare to the Town Offices, which was necessitated by the sale of the Town Hall to the Village of Mamaroneck, that the position of custodian of the .Welfare Department was no longer needed. 275 Following discussion, it was on motion by Councilman Embury, seconded by Councilman Stiner, unanimously RESOLVED, that the resignation of Ruben Catoe as caretaker of the Town Offices, effective June 30, 1946 be accepted. On motion by Councilman Embury, seconded by Councilman Stiner it was, unanimously RESOLVED, that the position of custodian of the Wel- fare Department be and it hereby is abolished as of June 30, 1946. On motion by Councilman Stiner, seconded by Councilman fiatson, it was , upon roll call, unanimously RESOLVED, that Mrs . Earriot Price be appointed to the position of caretaker of the Town Offices ef- fective July 1, 1946, at the annual salary of b90O. The Supervisor stated that Mr. C .W. Moody of Rouken Glen Properties, Inc . , had made an offer to settle tax arrears on Block 222, Parcels 48 and 30; Block 224, Parcel 714, for the face amount of the liens ( sale Nears 1942 through 1946) plus interest at six per cent. Following discussion the Supervisor stated that he would in- form Mr, Moody of the Board's willingness to accept payment in the amount of $1,711.16 providing same is made prior to Augist 31, 1946. The Supervisor stated that he had at hand a check for $408.57 received from C .L. Norris, to settle tax arrears on Block 112, Parcel 608 for the sale years 1930 to 1945 inclusive . -- Follow ing discussion, it was on motion by Councilman Stiner, seconded by Councilman Embury, upon roll call, unanimously RESOLVED, that the Receiver of Taxes is hereby authorized to accept the sum of $408.57 for the sale years 1930 to 1945 inclusive, upon property known as Block 112, Parcel 6080 which represents the face amount of the tax liens for the years 1929-1941 and the taxes plus penalties and interest for the years 1942-1944. The Supervisor stated he had at hand a check for $125.65 received from Angelo Fraioli representing the face amount of the tax liens on property known as Block 819, Parcel 467 for the sale years 1941 and 1942. Following discussion, it was on motion by Councilman Stiner, seconded by Councilman Watson, upon roll call, unanimously RESOLVED, that the Receiver of Taxes is hereby authorized to accept the sum of 1125.65 representing payment of tax Bens for the sale years 1941 and 1942 at the face amount of property known as Block 819, Parcel 467. The Supervisor stated that he had at hand a check for $1,878.41 received from Carmelo Santoro 2: Son for the settle went of tax arrears on property known as Block 831, Parcel 20; Block 831, Parcel 113, Block. 222, Parcel 81 . i Following discussion, it was on motion by Councilman Embury, seconded by Councilman Watson, Upon roll call, unanimously RESOLVED , that the offer of Carmelo Santoro 9: Son to settle and a the tax liens s representing taxes levied prior to April 15 1941 and including State, County and Town taxes which became due April, 1941, upon premises known as Block 831, Parcel 26; Block 831, Parcel 113; Block 222, Parcel 81 on the Tax Map of the Town of Mamaroneck, be accepted; FURTHER RESOLVED, that the Receiver of Taxes is hereby authorized to accept payment of all taxes levied for State, County, Town, Town District and School Districts purposes up to and including the tax levied for State , County and Town purposes for the year 1941 and which became due April 1, 1941, without penalties or interest as authorized by Chapter 917 of the Law of 1934 as amended; FURTHER RESOLVED, that the acceptance of aforesaid sum in payment of taxes levied prior to April 1, 1941,is conditioned upon payment of all subsequent taxes and or tax liens with penalties and interest to date of payment The Supervisor stated that he had at hand a letter from Assessor Smith requesting that certain tax arrears placed against the wrong property be transferred to the proper parcel, as had been re- quested by Mr. Martin E . King. Following discussion and on motion by Councilman 1, Watson, se- conded by Councilman Embury, the following was, upon roll call, unani- mously adopted- WHEREAS, request has been made by Mr. Martin E . King, representing JOHNETHEL REALTY CORPORATION, for the correction of the records of the tax arrears of the Tovvm, with respect to property known as Block 802, Parcel 500 and Block 803, Parcel 159, with regard to the sale of tax liens or leases for the year 1912, to the Town, for $9.99' , and in the sale of tax liens or leases for the year 1904, to J. Carroll, for $2.83 and in ' the sale of tax liens or leases for the year 1901, to J. Carroll, for $3.53; and WHEREAS, the Assessor has certified to this Board that these tax arrears were erroneously placed against Block 802, Parcel 500 and Block 803, Parcel 159, and that said such arrears are actually against property now known on the Tax Assessment Map of the Town of Mamaroneck as Block 802, Parcel 184 and should have been so posted, NOW, THEREFORE, BE IT RESOLVED, that all officers having charge of the re- cords of the Town, are hereby authorized and directed to correct the record of tax arrears and/or tax liens or leases, so as to show the following: Sale Year Sold to Amount 1912 Town X9.99 1904 J. Carroll 3.53 to be liens against Block 8020 Parcel 184. 279 The Supervisor stated that he had at hand a check for $298.81 received from Miss Violet Stellah offering to settle tax arrears on property known as Block 610 Parcel 228 and Block 126, Parcel 499. Following discussion it was on motion by Councilman Stiner, seconded by Councilman Mills, upon roll call., unanimously RESOLVED, that the Receiver of Taxes is hereby authorized to accept the sum of $298.81 representing payment of tax arrears for the sale years of 1941 to 1946 inclusive on Block 610, Parcel 228; and the sale years 1941 and 1943 on Block 126, Parcel 499, with penalties, etc. , of $7.04. The Supervisor recommended the following., which was on motion by Councilman Embury, seconded by Councilman Watson, upon roll call, unanimously I RESOLVED, that pursuant to Section 96A to Chapter 62 of the Laws of 19092 as amended, the Town Board of the Town of Mamaroneck does hereby authorize and empower the Receiver of Taxes of the Town of Mamaroneck to collect the 1946 school taxes for Union Free School District No. 2 Town of Scarsdale, New York., which, under the provisions of Chapter 105 of the Laws of 1916, as amended, known as the Westchester County Tax Law, become a lien and are payable on September 19 1946, in two partial payments each amounting to fifty per cent (50%) of any such school tax as levied; FURTHER RESOLVED, that the Receiver of Taxes of the Town of Mamaroneck is authorized and empowered to re- ceive the payment of such partial payments of instal- ments of the 1946, school taxes for Union Free School. District No. 1 in the Town of I.iamaroneck, and school District No. 2, Town of Scarsdale, New York, at any time - but subject to the same penalties as are specified and provided in Section 18 of Chapter 105 of the Laws of 1916 for the neglect to pay the total amount of the school taxes after the levy thereof: FURTHER RESOLVED, that the acceptance of any such partial or instalment payment of the .1946 school taxes for union Free School District No.1 in the Town of Mamaroneck, and School District No. 2 Town of Sears- dale, New York, shall not be deemed to effect in any manner any right of the Town of Mamaroneck under any general or special Act, to enforce collection of the unpaid balances of such taxes as may remain due and owing to said Town., but such rights and pourers shall remain in full force and effect to enforce collection of the unpaid balance of such school taxes, together with interest., penalties and other lawful charges. On motion duly made and seconded the following resolution was unanimously adopted: RESOLVED, that this Board do and it hereby does desig- nate "The Daily Times" , a daily newspaper published in the Village and Town of Mamaroneck, for the purpose of publishing the notice of the collection of the 1946 school __ taxes as required by law; and be it 281 FURTHER RESOLVED, that said notice be published in "The Daily Times" on Tuesday, August 20, 1946; and be it FURTHER RESOLVED, that in accordance with the pro- visions of .Section 26 of the Westchester County Tax Act, the Town Board do and it hereby does direct the Receiver of Taxes and Assessments to mail to each taxpayer of the Toms of Mamaroneck, whose address is known to said Receiver of Taxes and Assessments., a tax bill for 1946 school taxes, the expense thereof to be a Town charge Councilman Stiner stated that he had nothing to report for his Departments. Councilman Hills stated that he had at hand a number of bills from the Fire Department totaling 4224.43, which he had checked. He recommended the approval of the bills as presented. The members of the Tarn Board sitting as the Board of 'Fire - Commissioners considered the claims , and it was on motion by Councilman Mills, seconded by Councilman Embury, upon roll call, uvanimouslui RESOLVED, that the following described claims be and they hereby are approved and that the Supervisor and Comptroller be and they hereby are authorized to pay same out of the budget for the Fire Department: New York Telephone Company $2.50 New York Telephone Company 6.75 Nev. Turner 80.25 Total . . . $224.43 Councilman Mills asked the Town Attorney if the New York Board of Fire Underwriters had been notified of the violations existing in the Alden house Apartments. Upon examination it was discovered that the wrong bureau of the Diem York Board of Underwriters had been notified. Following dis- cussion, it was on motion by Councilman Mills, seconded by Councilman Watson, it was unanimously RESOLVED, that the Town Attorney be authorized to take whatever action is necessary to correct the violations existing at the Alden House Apartments. The Town Attorney stated that he had received an application from Alfred H. Schaffer, Esq. , the owner of premises known as Block 813, Parcel 293, formerly Section 8, Block 15, Lots 5c, 6a, 7a and 8a on the Tax Assessment Map of the Town of Mamaroneck and also known as Lots Nos. 544 to 547 on Second Map of Harbor Heights on the Sound, made by Fletcher Herdt, dated January 20, 1905 and filed in the Clerk' s office of West- chester County on March 29, 19050 as Map No. 1482, in which it is stated that certain tax liens sold at the sale held by the Supervisor of the Town of Mamaroneck in the year 1926, for the taxes of 1925, had been lost, and requesting the issuance of duplicates, pursuant to the pro- visions of the Westchester County Tax Act. 283 The Attorney stated that an affidavit of one Lillian Barker is submitted with this application, showing that, while the liens were originally sold to Bonded Municipal Corporation, she purchased these liens by assignment, on July 28, 1936, and is still the owner of said tax liens and that due and diligent effort has been made to 'locate these tax liens but the same have been lost and cannot be found, Also submitted with the application of Alfred H. Schaffer, is an indemity agreement executed and acknowledged by the said Alfred H. Schaffer, agreeing to hold the Town of Mamaroneck harmless for any loss or damage by reason of the production of these liens. The Town Attorney further stated that the purpose of issuing the duplicate liens was to surrender thew and have them cancelled by Lillian Barker, vuno is to receive, or has received payment therefor, from Alfred H. Schaffer. Upon motion rude by Councilman Embury, seconded by Courcilman Watson, it was, unanimously RESOLVED, that the Receiver of Taxes be and he hereby is authorized and directed to issue duplicate liens covering the sale for the year 1926 for the taxes of 1925, for the following: Lien No. Section S. Block 15 , Lot 5c x;52.26 8 " 15 6a 5.44 ° 8 " 15 " 7a 5.44 tv 8 rr 15 f° 8a 5 .44 G The Supervisor read a letter from William S. Brill, requesting correction of the arrears record, with regard to Block 908, Parcel 404, formerly Section 9, Block 29, Lot 16, also known as Lot No. 39 on Map of Grand Park First Subdivision, filed in the Register' s Office as Map No. 459. The letter stated that the Town records show that this aarcel is encumbered by a tax lease sold on October 25, 1876 to John W. Revere for 90 years and that the sale was made for arrears of taxes amounting to $6.52. The letter further stated that there is a notation upon the record indicating redemption of this November 15, 1876, by H.R. Sprague . The .Supervisor stated that the Assessor had looked into the matter and believed that this indicated payment of the 'amount secured by this lease. Upon advice of the Town Attorney, the following resolution was moved by Councilman Embury, seconded by Councilman Stiner, and unanimously adopted: RESOLVED, that all persons having charge and custody of the records of the Town of Mamaroneck are hereby authorized and directed to correct the record of tax arrears so far as they pertain to Block 908, Parcel 404, formerly Section 9, Block 29, Lot 16, also known as Lot No. 39 on Map of Grand Park First Subdivision, filed in the Register' s office as Map No. 459, so as to show redemption or payment of a certain lease covering Lot 39, sold October 25, 1876 to John N. Revere , for $6.52, this being a tax lease for 90 years . I 285 The Town Attorney discussed with members of the Board the matter of "In Rem" foreclosures effecting property in the Town. of Mamaro- neck with tax arrears that are four years old or more . The Towm Attorney explained that it would be necessary to hire additional temporary help to perform the clerical detail work necessary for this type of fore- closure . I Following discussion the members of the Board agreed that "In Rem" foreclosures in the Town should be started and that the additional temporary help required be employed at once . The following reports were ordered placed on file: List of claims audited and paid by the Comptroller from July 22 to August 70 1946; Bank balances as of August 1. 1946. . at 10:15 P.M ..
