HomeMy WebLinkAbout1946_07_03 Town Board Minutes 165 REGULAR MEETING OF THE TOWN BOARD, TOWN OF MAMARONECK HELD JULY 3, 1946 In the Council Room and Auditorium of the Weaver Street Fire House Town of Mamaroneck, New York. The meeting was called to order by Supervisor Mandeville at 6:15 P.M. ( Daylight Savings Time) . Present: Supervisor Mandeville Councilmen Stiner,, Mills, Watson Absent Councilman Embury The presence was also noted of Town Clerk Gronberg, Town Attorney Delius and Accountant Finson. The Town Clerk presented the affidavit of publication calling for a public hearing to consider an amendment to the Zoning Ordinance of the Town of Mamaroneck reclassifying the property on the South side of Palmer Avenue between Burton Road and Weaver Street, from "A" Resi- dential to "B" Multiple Family or Apartment House . Three petitions dated June 22, 1946, containing 44 signatures protesting the proposed change were handed to the Town Clerk for filing by Mr . Lee H. Whitestone, 190 Palmer Avenue, Larchmont, New York. The Supervisor called upon Mr . Whitestone, Chairman of the Committee filing the protest to speak. Mr. Whitestone read a list of objections among which were that a change in the zoning would deteriorate the property and the community; that rezoning to class "B" would lower the value of the land, that the people in this section had bought their homes with the understanding that this section would remain Class "A" residential. The Supervisor called upon Mr. John Merritt, one of the organizers of the proposed project, who in turn called upon Mr. Albert Kohler to present the case on behalf of the Larchmont Veteran's Housing Association. Mr. Kohler outlined the works of the Association, its member- ship, and its plans, in relation to the proposed housing project. Mr. Kohler asked Mr. Gerald O'Reilly, Architect for this housing project to answer questions concerning the construction. Mrs. A.J. Frey, 12 Burton Road, an abttting owner, spoke in opposition to the rezoning stating that she purchased her home , as did the surrounding owners, with the understanding that this area would re- main Class "A" residential. Further, that no member of the Veterans' Housing Association had contacted her, or any of the abUting owners, as to this proposed housing project. Mrs. F.J. Haugelstine and Mrs. V.J. Kraft, abutting owners, also spoke in opposition to the project . Mr. Lee H. Burton representing Mr. Benno Elkan, stated that Mr. Elkan was desirous of doing everything he could to help the veterans and the request made by his client for the rezoning of five acres should not necessarily hinge on the 15 additional acres all simultaneously be rezoned for something he knows nothing about. The Supervisor replied to his statement by saying that the Board wished to Dive careful consideration to the property on both sides of this tract and that was why the additional 15 acres were included in the Public Notice. I 167 Mr. Edward Keeler, speaking in behalf of Howell Park Associa- tion, stated that the Howell Park Association is firmly opposed to a change and is interested in keeping this district strictly one-family Class "A" residential. He said that the Association is in sympathy with the veterans and suggested that if they want to develop this housing project that perhaps the Town would grant them a variance . Mr. Keeler also stated that the Howell Park Association would be glad to meet with the members of the Veterans' Housing Association to discuss their problems . Mr. Herbert Baum, President of Larchmont Gardens Association; Mr . Cornelius Van Buren, Realtor; Mr. Walter F. Brady; Mr. Philip Holden , and others speaking in opposition to a change in zoning, were agreeable to the suggestion made by Mr. Keeler. Mr. L. Howard Katz, Past Commander of David Potts, Jr. Post, Veterans of Foreign Wars, and Mr. Walter Needham, also a past Commander and a veteran of both wars, spoke in behalf of the veterans' housing project stating that the people in the Town should do everything in their power to aid the veterans in obtaining proper housing. After hearing all those who..desired to speak, Supervisor Mandeville asked how many people in the room would be agreeable to the rezoning of the Elkan property provided that this district is used for the erection of not more than 2-1/2 story multip;e dwellings. There was no opposition from the floor to this suggestion except 'Mrs. F.J. Haugelstine, 200 Palmer Avenue, who opposed to any changes whatsoever. The Supervisor asked if there was any one else who wished to speak. There being no one, he declared the hearing closed The Supervisor recommended that the Board proceed with the regular meeting. The minutes of May 28, 1946, were approved as presented. A letter dated June 19, 1946, was received from Mr. John A. Nang, Chairman of the Board of Park Commissioners stating that Mr. Thos. Aitchison, Jr. , wished to be reinstated as Park Foreman, effective July 11 1946. Following discussion, it was on motion by Councilman Stiner, seconded by Councilman Mills, upon roll call unanimously RESOLVED, that Fair. Thos. M. Aitchison, Jr. , be and he hereby is reinstated to the position of Park Fore- man, effective July 1, 1946, at an annual salary of $2,700.001 The Town, Clerk read a petition received from the Assessor requesting the approval of a number of pages of the Assessment Maps, showing corrections made by the Town Engineer as of June 11 1946, such corrections being due to the sale or transfer of lots or plots, filing of maps in the Department of Land Records in White Plains, and so forth. On motion by Councilman Stiner, Seconded by Councilman Mills, it was unanimously RESOLVED, that the Board approves of the changes in the Assessment Maps of the Town of Mamaroneck as of the first of June, 1946, and the said maps are here- by corrected and rectified as of Junel, 1946, in the following places: l 169 Page: 101,107, 1090 1103 111, 205, 208, 209, 320' 327 , 329, 401, 405, 406, 4090 5011 Page: 116, 120, 121, 124, 133, 211, 215, 216, 330, 333, 3400 34AO 410, 411, 4120 416, 508, 509 In answer to the advertisement published in the Daily Times on May 21, 1946, bids to be received on or before June 3, 19460 the Town Clerk reported that he had received one bid for property known as Block 133, Parcel 148, from Patsy ER. Giacomo. The offer made by Mr. Giacomo was in amount of $700.00. A certified check in the amount of $70.00 accompanied the bid. Following discussion it was on motion by Councilman Stiner, seconded by Councilman Mills, upon roll call unanimously i RESOLVED, that this Board accepts the offer of Patsy Pd. Giacomo, in the amount of $700.00 for property known as Block 133, Parcel 148. FURTHER RESOLVED, that the Town Attorney be and he hereby is instructed to draw the necessary,=con- tract for the sale of this property in accordance with the terms of the offer and acceptance and that the Supervisor be and he hereby is authorized to acknowledge and deliver the deed accordingly. The Town Clerk reported that in response to letter of May 2, 1946 received from the Board of Elections, White Plains, N.Y. it was necessary to alter the fourteenth and Fifteenth Districts due to the fact that their registrgtion has exceeded the thousand mark. The Town Clerk presented a map showing the necessary al- terations which affect the surrounding districts. Railroad tracks. The audit report of Glick-Freedman, for the year ended December 31, 1945, was discussed by the memebers of the Town Board. Following discussion, it was on motion by Councilman Mills, seconded by Councilman Stiner, upon roll call, unanimously RESOLVED, that the annual report made by Glick-Freed- man, for the year ended December 31, 1945: be accepted with the recommendations contained therein. The Town Clerk presented the affidavit of publication of re- solution originally adopted by the Town Board which would convey to the Village of Mamaroneck the property known as the Old Town Hall , on Prospect Avenue, for the sum of $100.00. He also stated that the expiration date was July 3, 1946, and no objections regarding this resolution had been filed with him. Councilman Matson presented the following petitions received from the Assessor for the correction of the assessment roll so as to permit the apportionment of taxes . Jobson 4,750 7,000 11,750 (111-73) Councilman Stiner, reporting for the Board of Review, advised that upon Mr. Eugene Reviere' s return from vacation, the Board, would meet to act upon the 96 protests that were filed with said Board® i I Councilman Stiner reported that a meeting of the Board of Plumbing Examiners was held and of the two applicants who appeared only one was successful. Councilman Mills reported that he had at hand a number of bills from the Fire Department, totaling $1,210.77, which he had checked. He recommed the approval of the bills as presented. The members of the Town Board sitting as the Board of Fire Commissioners considered the claims, and on motion by councilman Mills, seconded by Councilman Stiner, it was, upon roll call, unanimously RESOLVED, that the following described claims be and they hereby are approved and that the Supervisor and Comptroller be and they hereby are authorized to pay same out of the budget for the Fire Department: A & A Automotive Co. 44.27 Alpine Disinfecting Co. 14.25 R.G. Fordyce 156.70 §1210.77 Councilman Mills brought up the question as to the value of the new Dodge Pumper purchased by the Fire Department. i After discussion it was agreed that the truck be insured for the stun of $7,500.00. Councilman Mills resented a record of inspection made by Lt. Michael F. Gallagher of the Town of Mamaroneck Fire Department, which showed as follows: "June 10, 1946 1, Larchmont Gables Apartments, Post Road and Alden Road- No Violations found. 2. Larchmont Acres Apartments, Palmer Avenue and Richbell Road- no violations found. Alarm system to Headquarters tested and found to be in proper order. 3. Alden House Apartments, Post Road and Alden Road- Incinerator screening found to be in poor condition and Superintendent ordered to replace same immediately. Superintendednt__also ordered to have all fire hose in stair wells tested. Reinspected June 14, 1946, and violations were removed. 4. Post Lodge, Post Road between Weaver Street and Richbell Road - No.vioiations found. 13 5. Sagamore Inn, Post Road between Dean Place and Dillon Road no violations found. June 11, 1946 1. Avonmore Apartments, Post Road and Dillon Road - Cardboard boxes, newspapers and trash found in basement store room. Superintendent ordered to remove same immediately. Reinspected June 14, 1946 and found violation removed. 2. Larchmont Hills Apartments, Chatsworth Avenue and Myrtle Boulevard - Superintendent ordered to have all fire hose in stair wells tested. Reinspected June 14, 1946, and found fire hose in good condition. 3. Chatsworth Gardens Apartments, Chatsworth Avenue and Murray Avenue - Superintendent ordered to have all fire hose in stair wells tested and all hose gaskets replaced. Reinspected June 270 1946, and found fire hose in good condition. Hose gaskets still on order. 4. Stone-crest Apartments, 21 North Chatsworth Avenue - Super- intendent ordered to have all fire hose in stair wells tested. Reinspected June 27,1946, and found fire hose in good condition. 5. Oak Haven Apartments, 172 Myrtle Boulevard - Stanpipe in front of building out of order. Superintendent ordered to have same repaired immediately. Superintendent also ordered to have all fire hose in stair wells tested. Reinspected June 14, 1946, and found violation removed and fire hose in good condition. 6. Nanits Restaurant; Post Road between Weaver Street and Mamaroneck Village line - no violations found. 7. Tally-Ho Tavern, 170 Myrtle Boulevard - Wires to music box and amplifier found to be in poor condition.. Proprietor ordered to install new wires to both units immediately. i Reinspected June 27, and found violations removed. 2. Alyce Cleaners & Dyers, 170 Myrtle Boulevard - no violations found. 3. Schenley Research Laboratory, 200 Myrtle Boulevard - no violations found. 4. Winged Foot Club House, Fenimore Road - no violations found. i i I 5 . Alden Tavern, Post Road and Alden Road - no Violations found. 11- Myrtle Avenue Garage, 200 Myrtle Boulevard - no. violations found. June 16, 1946 1. Bonnie Briar Club House, Weaver Street - no violations found. All fire hose newly installed upon previous recommendation. I June 27, 1946 1 . Chatsworth Garage, 1 Vine Street - All soda and acid extin- guishers overdue for recharging. Proprietor ordered to recharge same immediately. Reinspected June 29, 1946 - violation not removed. New charges on order. 2. Residence of Albert Swanki, 15 Spruce Road - New Emerson type oil burner and 275 gallon tank installed by Mr. Parker of Mt. Vernon, installation found to be in proper order. Recommended covering ceiling beams with sheet rock for additional fire protection. Each Saturday evening a tour of all Public Assembly places in the district is made overcrowding, fire stairways and exits, lighting, parking and other safety measures for the Public. The Supervisor stated that he had a letter dated July 3, 1946, advising that the Board of Police Commissioners had granted approval to Police uhief Yerick to attend the Police Conference to be held at Utica, July 23, 24 and 25, and that approval was also requested of the Town Board. Following discussion, it was on motion by Councilman Watson, seconded by Councilman Stiner, upon roll call unanimously RESOLVED, that Police Chief Yerick be and he hereby is authorized to attend the Police Conference to be held at Utica, N.Y., July 23, 24 and 25, and that the expenses not to exceed $60.00, be paid out of the Bud- get item in the Police Department, The Supervisor presented a statement of receipts and disburse- ments on Block 826, Parcel 445 and Block 826, Parcel 353, which property was foreclosed by the Village and sold to Happiness Laundry, Inc. He i stated that the apportionable share of the net receipts due the Town amounts to $860.88 and that this amount does not include the Mamaroneck Valley Sewer and School taxes on this property from the date of acqui- sition by the Village to the date of sale, which will be received in addition. On motion by Councilman ,Watson, seconded by Counccilman Stiner, it was, upon roll call, unanimously RESOLVED, that the Receiver of Taxes is hereby auth- orized to accept the sum of $952.31 in full payment of all taxes and tax liens open on the Town of Mamaro- neck tax records, as of this date, on property known as Block 826, Parcel 445 and Block 826, Parcel 353. The Supervisor presented the following resolution, which was on motion by councilman Stiner, seconded by Councilman Watson, upon roll call, unanimously adopted: WHEREAS, on April 3, 1946, the Town Board of the Town of Mamaroneck passed a resolution accepting the offer of Jules III. Gorlitz to purchase property known as Block 942, Parcel 405 on the tax assessment map of the Town of Mamaroneck, said resolution being con- ditioned upon the approval of said offer by the Village of Mamaroneck; and WHEREAS, on April 1, 19462 the Village Board of the Village of Mamaroneck, by resolution duly approved said offer of sale; and WITTEREAS, on the 20th day of May, 1946, title was con- veyed to said Jules M. Gorlitz, or his assignee; and WFEREAS, the receipts and disbursements in connection with said property are as follows: Receipts: Sales Price 44,050.00 Tax Apportionment Credit Allowed 2-2/3 months, 1946 Village Tax (4228.23) 50.72 Less: Charge 1946 S.T.C. Van Sciver, Clerk of the Board of Education, Union Free School District No. 1, requesting payment of the balance of tax arrears for the years 1932-1934 inclusive, in the sum of $48,135.11, plus interest which had not been paid to the school district. This matter was discussed by the members of the Board but no definite action was taken at this time . The Supervisor stated that the Town Board is required to appoint - the chairman of the Board of Appeals for zoning and that he recommended the appointment of Mr. Munn Brewer. Following discussion, it was on motion by Councilman Watson, seconded by Councilman Mills, upon roll call, unanimously RESOLVED, that Mr. Munn Brewer be and he hereby is designated chairman of the Board of Appeals for Zoning in the unincorporated section of the Town of Mamaroneck, for the term expiring February 19, 1950. The Supervisor presented for the approval of the Town Board a renewal of agreement between the Westchester Lighting Company and the Town of Mamaroneck.. extending contract of March 11, 1941 to and including December 31, 1946. On motion by Councilman Watson, seconded by Councilman Stiner, it wasm upon roll call, unanimously RESOLVED, that the Supervisor be and he hereby is authorized to sign the following agreement: "It is agreed between the Westchester Lighting Company and the Town of Mamaronec'; parties to an agreement dated March 11, 1941, and expiring on March 11, 1946 providing for the lighting of the streets of said Town, to renew said agree- ment and make its terms and conditions applicable to the period from the expiration date thereof to and including December 31, 1946." The Supervisor stated that he had at hand a letter dated June 19, 1946, received from Commissioner of Public Works, James C. Harding, together with an agreement concerning snow removal on State Highways . Following discussion, it was on motion by Councilman Mills, seconded by Councilman Watson, upon roll call , unanimously RESOLVED, that Town Superintendent of Highways A.J. Foote be and he hereby is authorized to sign the agreement for the removal of snow on State High- ways within the township of the Town of Mamaroneck. The Supervisor presented to the Board a proposed and tentative schedule of increases compensation for employees in the Town receiving less than $4,000 per annum. He referred to the fact that the increase in the cost of living had convinced him that some increase is necessary even for the remainder of the year 1946 regardless of what the budget appropriation or compensation plan previously adopted may provide. In general, he felt that employees in the lower brackets should receive proportionately larger increases and referred to the statistics and analysis made by experts in connection with the County Plan for in- creased salaries. Griffen , Attorney for Harold Davidson to pay to the Town the sum of $5,252.20, which represents the face amount of taxes without penalties or interest as included in tax liens owned by the Town and purchased at the tax sales held in 1939, 1940 1941 and 1942, and the balance of all taxes including current taxes with full penalties and interest. The Town Attorney explained further that these liens covered a vacant piece of property formerly owned by the warranty Realty Cor- poration on Mamaroneck Avenue, which is now under foreclosure and which a motion has been made to appoint a referee. The Supervisor then explained to the Town Board that he be- lieved the offer to be a good one particularly in view that the Village of Mamaroneck had foreclosed or acquired a parcel which they have been unable to sell at a price which would be comparable to the above men- tioned offer. Following discussion, it was on motion by Councilman Mills, seconded by Councilman Watson, upon roll call, unanimously RESOLVED, that the offer of Harold Davidson for the settlement of foreclosure proceedings covering liens for the years 1939 to 1946 inclusive, on premises known as Block 327, Parcel 1, for the sum of $4,890.75 be accepted and that the amount so paid be applied in face amount without penalties or interest, and the balance to the payment of taxes with the penalties and interest in full to date. FURTHER RESOLVED, that the Receiver of Taxes and Assessments be and he hereby is authorized to accept such payment and the Town Attorney is instructed and directed to discontinue the foreclosure action without costs. O' clock, to consider amendments to the provisions of the Zoning Or- dinance of the Town of amaroneck and to the map accom- panying and forming part of the Zoning Ordinance . Such amendments to the Ordinance and changes in the Zoning Map are substantially as follows: (1) To correct a verbal error in Section 4, subsection - 14, so as to refer to "Section 5" instead of "Section 6" . To provide in Residence District A-3 for accessory garages for not more than one non-commercial vehicle for each dwelling section, within the walls of such row or group dwelling on or below grade, or in groups of one story fire resisting units on the same plot with the row or group dwelling to which such garages are appurtenant provided such group of garages shall not be built within two hundred feet of any street. i (3) To create a new area district to be known as Area District A-3 and to provide for set-backs, side-yards and rear-yards as follows; A. No part of the building shall be built with- in 30 feet of any street line. B. Two side yards shall be provided, the least dimensions of which shall be 15 feet. (4) To create a new height district to be known as Height District A-3 and to provide that buildings erected in such height district shall be limited to a height not more than 25 feet and two and one-half stories, as defined in the building code. (5) To amend Article 111, Section 14, so as to provide that in "A-3" area districts, no dwelling shall be erected accomodating or making provision for more than 21 families on an acre of land nor more than a proportional number of families on a proportional acre of land. (6) To provide that in area districts "A" , "A-211 and `rA-3" , every room in which persons habitually live, sleep, eat, rest or work shall have a total window area equal to twelve (12) per cent of the floor area of such room and from the inner edge of the lowest sill of every such window - there shall be an open unobstructed angle of light of not less than 45 degrees to the sky, measured from the vertical, measured over the average level of the opposite wall of any court, or over a line representing the maximum height to which the opposite wall of a building on an adjoining lot, or across a street may be erected, but towers, spires, and I 20 similar projection which may exceed such height as pro- vided in Section 19 of the Zoning Ordinance shall be ex- cluded in computing such angle of skylight. (7) To provide that in any district, a residence.: structure permitted in a more restricted district, may be erected provided that if it is a one family: dwelling, it shall conform with the area requirements of Area and Height "A" Districts, and provided that if it is a two family dwell- ing, it shall conform with the requirements of Area and Height "A-2" Districts, and provided that if it is a group or community dwelling, it shall conform with the require- ments of Area and Height "A-3" Districts. (8) To provide that in Area Districts "A" and "A-211 , no dwelling or house shall be constructed with a total gross floor area of less than One Thousand One Hundred (1,200) square feet, not including basements, enclosed porches and attics which are not intended to be used for residence purposes, and that in area District " A-3" no dwelling or house shall be constructed with a total gross floor area of less than 900 square feet, not including basements, enclosed porches and attics which are not in- tended to be used for residence purposes. (9) To amend the map which accompanies the Zoning Ordinance so as to show the following described property in use, area and height, as District A-3. ( residence) : All that parcel of land shown on the Town of Mamaroneck Assessment Map as Section 4, Block 407, Par- cel #1. Said parcel being more particularly bounded and described as follows: BEGINNING at a point in the southerly line of Palmer Avenue where the same is intersected by the dividing line of property belonging to Campbell and Elkan, the same be- ing one hundred fifty (150) feet Westerly from the South- westerly corner of Burton Road and Palmer Avenue; thence running in a Southeasterly direction 653.49 feet to the lands belonging to Bingham; thence along lands of Bingham Southerly 11.82 feet; Westerly 32.77 feet, Southwesterly 157.40 feet; thence still Southwesterly 276.20 feet along the land - now or formerly - of Larchmont National Bank to land belonging to the Town of Mamaroneck; thence Westerly 97.40 feet; Northerly 16.98 feet along the lands of the Town of Mamaroneck to the dividing line of lands now or formerly - Reynolds: thence along 'the lands of Reynolds Northerly 22.10 feet; Northwesterly 369.30 feet to the Southerly side of Palmer Avenue; thence along the Southerly side of Palmer Avenue in a Northeasterly direction 399.42 feet-, to the point or place of beginning.
