HomeMy WebLinkAbout1946_04_03 Town Board Minutes 67 REGULAR MEETING OF THE TOWN BOARD, TOWN OF MAIvIARONECK, HELD APRIL 3, 1946 In the Recreation Room of the Weaver Street Fire House , Town of Mamaroneck, New York. The meeting was called to order by Supervisor Mandeville at 8:15 P.M. ( EasternStandard Time) . Present: Supervisor Mandeville Councilmen Stiner, Mills, Watson, Embury Absent: None The presence was also noted of Town Clerk Gronberg, Town Attorney Delius, Comptroller Orsino, and Accountant Finson The Supervisor suggested that in the future , before final approval by the Board, the minutes of the Town Board be examined and approved by the Tovm Attorney. The Board members agreed to this sug- gestion and the minutes of March 20, 1946 were held over for approval until the next meeting. A letter dated April 2, 1946, was received from Police Chief Paul A. Yerick, advising the Town Board that Patrolman Harry Dworak, a member of the Police Department for the past fourteen years, had resigned as of April 15 , 1946. The resignation was received with regret. A letter was received from Mr. Anthony Sansone, Secretary of the Westchester County Village Officialrs Association, together with. a prepared report of the County Affairs Committee . The letter was re- ferred to Town Attorney Delius for a report at the next meeting. A letter dated April 1, 1946, was received from the State Commission of correction, approving the report of inspection made of the Townes Lockup on March 6, 1946. The report was attached to the letter. The following reports for the month of March, 1946, were ordered placed on file: Report of the Receiver of Taxes and Assessments; Report of the Building Inspector; Report of the Plumbing Inspector; Report of the Mamaroneck Health Nurses; Report of the Westchester County Dog Protective Association. A letter dated April 1, 1946, was received from Mr. William H. Johnson, Village Manager, stating that at the last regular meeting of the Mayor and Board of Trustees$ the offer of Jules M. Gorlitz in the amount of $4,050. for property known on the Village of Mamaroneck tax assessment map as Section 9, Block 89B, Lots 17, 18 and 19, was a ccepted. A certificed copy of the resolution accompanied the letter . Following discussion, it was on motion by Councilman 'Matson, seconded by Councilman Stiner, upon roll call, unanimously RESOLVED, that this Board accepts the offer of Jules M. Gorlitz, in the sum of $4,050. to purchase the property known as Block 942, Parcel 405 on the tax -- assessment map of the Town of Mamaroneck; FURTHER RESOLVED, that the Town Attorney be and he hereby is instructed to draw the necessary contract for the sale of the property in accordance with the terms of the offer and acceptance, and that the Supervisor be and he hereby is authorized to acknow- lege and deliver the deed accordingly. The Supervisor asked if there was any one in the room who wished to address the Board. Mr. Richard T. Mood appeared before the Board and offered to pay the sum of $1,000. for all the tax liens, up to and including the sale of 1945, on Block 130, Parcels 466 and 486. He also informed the Board that in addition to this, he would pay the 1945 and 1946 taxes due on this property. Following discussion, Mr. Wood also agreed that in the event he would take over the two pending foreclosures, he would reimburse the Town for what they have expended for the title searches . On motion by Councilman Stiner, seconded by Councilman Embury, it was, upon roll call, unanimously RESOLVED, that the Receiver of Taxes and Assessments be and he hereby is authorized, empowered and directed to accept the sum of $1,000. from Richard T. Wood, for the following tax liens on the following described pro- perty: Block 130, Parcel 466: Sale Year Total Tax Lien 1937 r$ 167.54 1938 175 .67 1939 195.39 1940 168.82 1941 190.31 1942 190.02 1943 163.61 1944 163.51 1945 168.33 Block 130, Parcel 486: 1937 12.69 1938 13.51 1939 14.95 1940 14.47 1941 14.57 1942 14.56 1943 15 .00 1944 15 .00 1945 15 .65 FURTHER RESOLVED, that the Town Attorney is authorized to assign all rights of the foreclosures actions on the above parcels. Mr. Anthony P. Testa appeared before the Board to find out what disposition had been made regarding his offer of $400.00 for the purchase of tax liens on Block 124, Parcel 423, which property is located on Laurel Avenue . The Supervisor advised the Board that Mr. Charles Mayone , the owner of this property, had recently contacted and assured the Supervisor that he intended to clean up the unpaid taxes on this pro- perty. The Supervisor also stated that he believed that since Mr. Mayone is the owner of record, he should be given the first opportunity to purchase these liens . As some of the members of the Board we re not familiar with the property, it was decided to postpone action until the next meeting so that each would have an opportunity to inspect same . The Supervisor requested that the meeting proceed with reports of committees. Councilman Watson presented the following petitions received from the Assessor for the correction of the assessment roll so as to permit the apportionment of taxes . On motion by Councilman Watson, seconded by Councilman Embury, the following was, upon roll call, unanimously adopted: WHEREAS, the Assessor has presented petitions for the correction of the assessment roll for certain years, pursuant to the provisions of Section 33 of Chapter 105 of the Laws of 1916, as amended, known as the Westchester County Tax Act; and WHEREAS, after due consideration this Board finds it desirable to grant said petitions for the correction of said assessment roll; NOW, THEREFORE, BE IT RESOLVED , THAT THE assessment roll for the year 1945, taxes of' 1946, which shows property now appearing on the roll as follows: Section Block Lot Owner Land Imp. New York & Stamford RR 1,840 ( 902-664) Councilman Watson reported that some progress had been made on the grading work being done at the Incinerator. In connection with the notice regarding " Clean Up Week" , sent out with the tax bills, Councilman Watson suggested that a letter be sent to the owners of property located ajacent to the railroad tracks beginning at Chatsworth Avenue and running west, calling attention to the oportunity given them by the Town during the week of April 22, 1946. Following discussion, the Town Clerk was instructed to contact Mr. Foote . regarding this letter. The Supervisor also informed the members of the Board that he had had a conference with the Police Chief and that his Department would see to it that dumping of debris on vacant lots throughout the Town would be discontinued and that summons would be issued wherever necessary . Councilman Watson submitted a report on garbage incineration for the first quarter of the current fiscal year. Man-Hrs . of Labor per Ton 1.85 2.28 Labor cost -per Ton 1.50 1.83 Fuel 031 Consumption - Gallons 625 . 2925. 6M On Recreation, Councilman Watson reported that two soft ball leagues would operate in the Town of Mamaroneck during the coming season. He said that the Board of Education would provide some equipment and supervision for both leagues . Councilman Watson discussed with the members of the Board the advisability of forming a Planning Commission at this time in order that some control could be had over new developments . The Town Attorney advised that there is nothing at the present time to prohibit any one from filing with the County Clerk any subdivision ' map. After discussion, the Town Attorney was instructed to drat a resolution which would be submitted to the County Board of Supervisors to prohibit the filing of subdivision maps that do not have the approval of the Town Board. Councilman Embury discussed the need for the clarification of the parking ordinance effecting the Larchmont Station in view of the new regulations recently put into effect by the Park Commission. The Park Ordinances apply at the Station, but Town Attorney Delius pointed out that the Town Ordinance is also in effect allowing for a taxi stand at the North side of the Sta ton. On motion, by Councilman Embury, seconded by Councilman Stiner, it was,upon roll call, unanimously RESOLVED, that the following notice be published in the Daily Times: PUBLIC NOTICE PLEASE TAKE NOTICE that the Town Board of the Tovrn of Mamaroneck will hold a public hearing at 8:15 o' clock on April 17th, 1946, in the Council Room of the weaver Street Fire House on weaver Street in the Town of Mamaronec'_ for the purpose of considering amendments to the General Ordinances of the Town of Mamarcfneck originally adopted February 3rd, 1937, which amendments are as follows: (a) Repealing Section 6, Chapter:I:I of the General Ordinances, which section provided for public hack stands at the north side of the Larchmont Station of the New York, New Haven and Hartford Railroad Company. (b) Amending Section 3, Chapter Vl of the General Ordinances as last amended November 5th, 1941, so as to provide that an individual or corporation may obtain a permit to open a street or highway upon conditions satis- factory to the Town Superintendent of Highways , includ- ing, when required, a surety bond which is to be furnish- ed to the Town of Mamaroneck in an amount approved by the Superintendent of Highways and in such form as may be approved by the Town Attorney, indemnifing the Town against all liability and expense by reason of any act or omission in and about the opening of such street, pro- vided, however, that proper public liability insurance is carried by the applicant for a permit, his contractors, agents or servants, protecting the Town Superintendent of Highways against any claim for injury to person or property occasioned by the opening of such street. Gronberg, Town Clerk The Supervisor stated that he had at hand three offers to settle taxes on the basis of the face amount of the tax liens plus six per cent interest . On motion by Councilman Watson, seconded by Councilman Embury, it was, upon roll call, unanimously RESOLVED, that the Receiver of Taxes and Assessments be and he hereby is authorized, empowered and directed to accept payment at the face amount of the tax liens with interest at the rate of six per cent from the date of sale to the date of payment, from Christine Dierking for the following tax liens on property known as Block 601, Parcel 387: Sale Year Total Tax Lien 1941 $103.47 1942 89.30 1943 93.62 1944 91.18 1945 95 .71 On motion by Councilman Watson, seconded by Councilman Embury, it was, upon roll call, unanimously RESOLVED, that the Receiver of Taxes and Assessments be and he hereby is authorized, empowered and directed to accept payment at the face amount of the tax liens with interest at the rate of six per cent from the date of sale to the date of payment, from Mr. Samuel D. Mc- Andless for the following tax liens on property known as Block 817, Parcel 5510 Sale Year Total Tax Lien 1943 $229.01 1944 191.67 1945 199.93 On motion by Councilman Watson, seconded by Councilman Embury, it was, upon roll call, unanimously RESOLVED, that the Receiver of Taxes and Assessments be and he herby is authorized, empowered and directed to accept payment at the face amount of the tax liens with interest at the rate of six per cent from the date of sale to the date of payment from Mrs. Evelyn H. Ogilvy for the following tax liens on property known as Block 949, Parcel 26: Sale Year Total Tax Lien 1939 114.33 1940 120.59 1941 124.39 1942 125.66 1943 131.19 1944 128.03 1945 133.62 The Supervisor presented a statement of the receipts and disbursements on Block 832, Parcels 104 and 109, which property was foreclosed by the Village and sold to Mr. Joseph DeMaria. He stated further that the apportionable share of the net receipts due to the Town amounts to $1,281.98 plus the Mamaroneck Valley Sewer and School taxes on this property from the date of acquisition by the Village to the date of sale . On motion by Councilman Embury, seconded by Councilman Stiner, it was, upon roll call, unanimously RESOLVED, that the Receiver of Taxes is hereby authorized to accept the sum of $1,469.55 in full payment of all taxes and tax liens open on the Town of Mamaroneck tax records , up to and including the taxes for 1945. The Supervisor also presented a statement of receipts and disbursements on Block 8260 Parcel 178, which property was foreclosed by the Village and sold to Oreste Poccia. He stated further that the apportinable share of the net receipts due to the Town amounts to $381 .48 plus the Mamaroneck Valley Sewer and School taxes on this pro- perty from the date of acquisition by the Village to the date of sale. On motion by Councilman Embury, seconded by Council Stiner, it was , upon roll call unanimously RESOLVED, that the Receiver of Taxes is hereby authorized to accept the sum of $470.45 in full payment of all taxes and tax liens open on the Town of Mamaroneck tax records, up to and including the taxes for 1945. The Supervisor presented and read the following letter: Supervisor Owen A. Mandeville March 21, 1946 Members of the Town Board Town of Mamaroneck, N.Y. Gentlemen- As I am moving away from the Town of Mamaroneck, I find it necessary to tender my resignation as Building and Plumbing Inspector of the Town, to become effective as of April 15th, 1946. Allow me to take this opportunity to express my appreci- ation for all the courtesies you have extended to me and to tell you how much I have enjoyed working with you for the past years, and I want to thank you very much for same . -- Yours truly, /s/ Rutledge H. Rate Mr. Rate' s resignation was received with regret. The Supervisor also read a letter from Miss Connie S. Mondello tendering her resignation, effective as of March. 26, 1946. Hiss Mondello' s resignation was received with regret. In discussing the resignation of Mr. Rutledge H. Rate, the members of the Board believed ,it advisable to appoint Mr.A.J. Foote as Building and Plumbing Inspector, with an increase in salary of $240, per annum, and also to appoint as assistant for his various De- partments. In this connection, the Supervisor stated that he had at hand a letter from Mr. Foote recommending Mr. Thomas J. McKeever as his assistant . Following further discussion, it was on motion by Councilman Mills, seconded by Councilman Stiner, upon roll call, unanimously RESOLVED, that Mr.A.J. Foote is hereby appointed Building and Plumbing Inspector of the Town of Mamaro- neck, as of April 15, 1946, in addition to his other duties and that there be paid to him, as compensation, the additional sum of $'170. for the balance of the year 1946, to be charged against the salary of the Building Inspector for the 1946 Budget. On motion by Councilman Stiner, seconded by Councilman Embury, it was, upon roll call, unanimously RESOLVED, that there is hereby created the position of Assistant Building and Plumbing Inspector and Assistant Town Engineer, to be filled for the present by one appointee and appointment to which is to be made in accordance with the Civil Service rules and regulations and with the approval of the Personnel Officer of Westchester County. FURTHER RESOLVED, that in accordance with recommen- dation received from A .J. Foote, Town Superintendent of Highways, Thomas J. McKeever is hereby appointed Deputy Superintendent of Highways, as of April 15, 19462 his salary and compensation to be hereafter determined . The Supervisor informed the members of the Board that the First National Bank of Mount Vernon, N.Y. was awarded the $44,000 Tax Anticipation Notes, who bid at an interest rate of .25%. The following were ordered placed on file : Bank Balances as of April 1, 1946; Claims audited and paid by the Comptroller from March 20 to April 3, 1946, Councilman Stiner read a letter dated March 26, 1946, re- ceived from Mr. Charles A. Hughes, Assistant Engineer of the city of New Rochelle, N.Y. advising the Town that a contract had been awarded for the construction of a sanitary sewer on Beech- tree Drive . Attention was called to an agreement entered into on August 7, 1941, between the Town and the City of New Rochelle, in which permission was granted to discharge the sanitary sewer into the Mamaroneck Valley Sewer District in Bonnie Way. Councilman Stiner reported that Mr. Foote, the Town Engineer, would supervise the construction of the portion of the work located in the Town of Mamaroneck. w i Councilman Stiner also reported that the Peckham Road Cor- poration was constructing a sanitary sewer and storm drain on the Byron Estates and that Mr. Foote was also supervising this construction. Councilman Stiner reported that a bad break in the drain at Washington and Madison Streets, was in the process of being repaired. On personnel, Councilman Stiner reported that Mr. Foote recommended that the salary of Mr. Nick Librandi be increased from .82-1/2 to .90¢ an hour. On motion by Councilman Stiner , seconded by Councilman Watson, it was , upon roll call, unanimously RESOLVED, that the salary of Mr. Nicola Librandi, Road Maintainer in the Department of Public Works, be increased from .82-1/2 to .90¢ and hour. Councilman Mills presented a list of claims from the Fire Department, totaling $1,375.84. He stated that he had checked the bills and recommended their approval. The members of the Board sitting as the Board of Fire Com- missioners considered the claims and on motion by Councilman Mills seconded by Councilman Embury, it was, upon roll call, unanimously RESOLVED, that the following described claims be and they hereby are approved and the Supervisor and Comp- troller be and hereby are authorized to pay same out of the budget of the Fire Department: George W. He said that the cost would not exceed the..amount available in the Fire Department Budget. Councilman Bills brought up the matter of the condition of the so-called Palmer Cemetery located on Cooper Lane, and inquired what authority the Town had in connection with the cleaning up the cleaning up and general appearance of same. Following discussion, it was decided that Ialr. Mills contact Mr. William Fulcher, who is connected with The Old Town of Mamaroneck Historical Society, and report back at the next meeting. The Town Attorney presented the necessary papers , together with the proposed consent for the Town Board to sign, for the abandon- ment of that portion of Old Weaver Street, described as follows: BEGINNING at a point in the northeasterly corner of lot number 21 as shown on a certain map entitled "Map of Howell Park, Town of Mamaroneck, property of Howell Realty Co. " made by Carpenter and Duffy Civil Engineers and Surveyors, Feb. 1, 1913 and filed in County Clerk' s office, Division of Land Records (formerly Register' s Office) Feb. 8, 1913 as Map Igo. 2007 and running thence along the southerly side of "Old Weaver Street" and the northerly boundary of lots 21-20-19 and 18 on the above map the following courses and distances: S. 800-22" -0011 W. 228.99 ft . ;S. 70-021 -0011 w. 29.79 ft . ; S. 570-541 - 0011 W. 109.12 ft. to a point in the northerly boundary of Lot 18 and the southerly line of "Old Weaver Street" ; thence in a northwesterly direction across "Old iodeaver Street" No. 220-401 -Jolt W. 28.58 ft. to a point in the northerly line of said street; thence in a northeasterly direction along the :northerly line of said street N. 670- 1 1 -50"" E. 20.02 ft . , N. 540-401 -30" E. 29.65 ft. Said Lot, Plot or Parcel containing 0.095 acres. Said Lot, Plot or Parcel of land being shown on map en- titled: 11 Map showing a portion of Old Weaver Street to be abandoned as a Public Highway" made by A.J. Foote, Town Engineer, September 1, 1944 and filed in the Town Clerk' s Office , The Town Attorney explained that these proceedings were taken upon at the request of the abutting owners who had signed releases and a quitclaim deed to the Town of all land lying in the bed of the street in front of their properties . The Town Board thereupon signed the consent, and the consent, releases and order were turned over to the Town Clerk for filing in his office . The Town Attorney discussed with the members of the Board the employment of experts in connection with the certiorari proceedings in the matter of the Ralod Realty Corporation. He reported that the case was being moved for trial some time after the 15th of April . After discussion, he was authorized to hire experts to appear for the Town. At 10:30 P.IM. the Board unanimously resolved to adjourn. i Town Clerk
