MAMARONECK,HELD MARCH 6, 1946
In the Council Room of the Weaver Street Fire House, Town of
Mamaroneck, New York.
The meeting was called to order by Supervisor Mandeville
at 8:15 P.M. ( Eastern Standard Time) .
Present: Supervisor Mandeville
Councilman Stiner, Mills, Watson, Embury
Absent: None
The presence was also noted of Town Clerk Gronberg, Town
Attorney Delius, and Comptroller Orsino.
The minutes of February 20, 1946, were approved as presented.
The Supervisor requested the Town Clerk to read the Communi-
cations .
A letter dated March 2, 1946, addressed to the Town Board,
was received from Mrs. A. Stirling Smith, calling attention to the
condition of the sidewalks, after a snowfall, on Weaver Street between
Dante Avenue and Myrtle Boulevard.
After discussion, it was decided that this matter be re-
ferred to the Police Department.
The following reports for the month of February, 1946,
were received and ordered placed on file: Report of the Public Wel-
fare Department. Report of the Receiver of Taxes and Assessments;
--.- Report of the Plumbing Inspector; Report of the Building Inspector;
Report of the Westchester County Dog Protective Association.
Mr. Philip Guglielmo, accompained by his son, appeared be-
fore the Board to find out what disposition had been made in connection
with his offer which was presented at the last meeting of the Board.
This was held up due to the fact that some of the members of the
Board whished to inspect the property.
Following discussion, it was on motion by Councilman Stiner,
seconded by Councilman Embury, upon roll call, unanimously
RESOLVED, that the Receiver of Taxes and Assessments
be and he hereby is authorized, empowered and directed
to accept from Mr. Philip Guglielmo, the sum of x}952.88
in full settlement of the following tax liens on the
following described property:

The Supervisor requested that the meeting proceed with
the reports of committees .
Councilman `Watson presented petitions received from the
Assessor for the correction of the assessment roll so as to permit
the apportionment of taxes .
On motion by Councilman Watson, seconded by Councilman
Embury, the following resolution was, upon roil call, unanimously
adopted:
WHEREAS, The Assessor has presented petitions for
the correction of the assessment roll for certain
years, pursuant to the provisions of Section 33 of
Chapter 105 of the Laws of 1916, as amended, known
as the Westchester County Tax Act; and
WHEREAS, after due consideration this Board finds it
desirable to grant said petitions for the correction
of said assessment roll;
NOW, THEREFORE, BE IT
RESOLVED, that the assessment roll for the year 19458
taxes of 1946, which shows property now appearing on

Councilman Embury presented the Welfare report for the
month of February, 1946, which showed as follows:

Councilman Embury reported that the Board of Police Com-
missioners met in reference to the parking situation at the railroad
station and were in accord with the plan submitted by the Park Com-
mission. He also stated that both Commissions would meet in the
very near future to complete the details .
Reporting back on the matter of the Servicemen' s Center,
which was discussed at recent meetings, the Supervisor informed the
members of the Board that he had written a letter to Major A.E. Tuck,
President of the Larchmont Community Chest, and up to the present he
had not received a reply and could not discuss it further. In his
-- letter to Major Tuck, the Supervisor outlined the purpose of this
proposed Servicemen ' s Center and inquired if the item for the salary
of a director could be included in their budget, as the members of
the Board felt that if these funds were to come from the Community
Chest, this matter would be removed entirely from the realm of poli-
tics. He asked that this request be taken up with the Directors of the
Community Chest.
The Supervisor. presented the following resolutions, which
were on motion by Councilman Mills, seconded by Councilman Watson,
upon roll call, unanimously adopted.

WHEREAS, on January 16, 1946, the Town Board of the
Town of Mamaroneck passed a resolution accepting the
offer of Donald B Abbott to purchase the property
designated on the assessment roll of the Town of
Mamaroneck as Block 915 , Parcel 32, for the sum
of $2,105.00, said r°esoll;tion being conditioned upon
the approval of said offer by the Village of Mamaro-
neck; and
WHEREAS, on January 14, 1946, the Village Board of the
_ Village of Mamaroneck, by resolution duly approved
said offer of sale; and
- WHEREAS, on March 6, 1946, title was conveyed to said
Donald B. Abbott, or his assignee, and
WHEREAS, the receipts and disbursements in connection
with said property are as follows:

On motion by Councilman Mills , seconded by Councilman_
Watson, the following resolution was upon roll call, unanimously
adopted:
WHEREAS, On December 5, 1945: the Town Board of the
Town of Mamaroneck passed a resolution accepting the
offer of Jacob Ackerman and John Baltz to purchase
the property designated on the assessment roll of
the Town of Mamaroneck as Block 942, Parcel 124,
for the sum of $4,750.00, said resolution being con-
ditioned upon the approval of said offer by the
Village of Mamaroneck; and
WHEREAS, on December 10, 1945, the Village Board
of the Village of Mamaroneck, by resolution duly
a pproved said offer of sale; and
WHEREAS, on March 5, 19460 title was conveyed to
said Jacob Ackerman and John Baltz ,. or their assig-
nees; and
WHEREAS, the receipts and disbursements in connection
with said property are as follows :

On motion by Councilman Mills, seconded by Councilman
Watson, the following resolution was , upon roll call, unanimously
adopted:
WHEREAS, on October 17, 1945, the Town Board of the
Town of Mamaroneck passed a resolution accepting the
offer of William Akston to purchase the property de-
signated on the assessment roll of the Town of Mamaro-
neck as Block 801, Parcel 512, for the sum of $880.00;
and
WHEREAS, on March 6, 1946, title was conveyed to said
William Akston, or his assignees; and

On motion by Councilman Mills, seconded by Councilman
Watson, the following resolution was, upon roll call, unanimously
adopted:
WHEREAS, on December 5, 1945, the Town Board of the
Town of Mamaroneck passed a resolution accepting the
offer of Equity Holding Corporation to. purchase the
property designated on the assessment roll of the
Town of Mamaroneck as Block 942, Parcel 659, for
the sum of $3,600.00, said resolution being con-
ditioned upon the approval of said offer by the
Village of Mamaroneck; and
WHEREAS, on December 10, 1945, the Village Board of
the Village of Mamaroneck, by resolution duly approved
said offer of sale ; and
WHEREAS, on March 5, 1946, title was conveyed to said
Equity Holding Corporation, or his assignee and
and
WHEREAS, the receipts and disbursements in connection
with said property are as follows:

RESOLVED, that in accordance with the percentage above
set forth that there be paid to the Village of Mamaroneck
56.42% of the net proceeds of $1,101.57, or $621.50.
FURTHER RESOLVED, that this disbursement be made from
the receipts of the aforementioned transaction.
FURTHER RESOLVED, that the Supervisor be and he hereby
is authorized to distribute the interest and amortization
payments on the above Purchase Money mortgage when received
to the Town and to the Village in the same ratio as in-
dicated in the above distribution statement.
The Supervisor informed the members of the Board that he
had at hand an offer in the amount of $3,750, received from Reuben R.
Sirlin,Esq. , on behalf of a client, for property known as Block 942,
Parcel 405 A check for ; 375. was attached representing 10% of the
offer .
Following discussion, the members of the Board decided to
advertise the property, and on motion by Councilman Stiner, seconded
by Councilman Embury, the following notice was authorized for pub-
lication in the Daily Times :

ADVERTISEKENT FOR BIDS
The Town Board of the Town of Mamaroneck will accept
bids for the purchase of a parcel of property located in the
Village and Town of Mamaroneck, acquired in tax lien foreclosure
proceedings.
Following is the description of the said parcels
The plot or parcel of land consisting of Lots Nos. 17,
18 and 19, as shown on a map entitled "Map of Eagle Hommocks
Town and Village of Mamaroneck, Westchester County, New York" ,
made by A.J. Foote Engineering Corporation, July 10th, 1929
and filed in the office of the Clerk of the County of Westchester,
Division of Land Records, March 15th, 1930 as Map No. 3571, and
also known and designated on the Tax Assessment map of the Town
of Mamaroneck as Block 942, Parcel 405.
The property is offered subject to any state of facts an
inspection or accurate survey may show, covenants and restrictions
contained in former deeds of record, easement rights of the
Westchester Lighting Company and sewer easements granted to the
Village of Mamaroneck under instrument recorded in Liber 3032
of Conveyances, page : 424 on May 7th, 1930 in the office of the
Clerk of the County of Westchester, Division of Land Records
and terms of a certain agreement for the erection of a dam or
dike recorded in Liber 2799 of Conveyances, page 410, in the
office of the Clerk of the County of Westchester, Division of
Land Records.
All bids must be accompanied by a certified check for 10%
of the amount of the bid,in the event the bid is rejected, such
check will be returned to the unsuccessful bidder.
All bids should be contained in an envelope addressed to
the Town Clerk of the Town of Mamaroneck and should be plainly
marked "Bid for Property" .
Bids must be received by the Town Clerk on or before 5 P.M. on
March 20th, 1946, at the Town Clerk' s office, 158 West Boston
Post Road in the Village and Town of Mamaroneck and thereafter,
from 7:45 P.M. until 8:15 P.M. on March 20, 1946, at the Council
Room in the Weaver Street Fire House, in the Town of Mamaroneck.
The right to reject any or all bids is reserved by the
Town Board.

from Service Men, for the settlement of taxes for the face amount of
the liens.

On motion by Councilman Embury, seconded by Councilman

The Supervisor read a letter from the Receiver of Taxes,
in reference to an open tax on property know as Block 215, Parcel
393, covering a school tax for the year 1919, sale 1920, of which
the total amount of the lien was $2.41. Attached thereto was a re-
ceipt showing the payment of this tax. The Receiver of Taxes in his
letter stated that this tax is shown open on the arrears roils and
that this tax was not properly cancelled due to a possible error when
the new records were filed. He recommended that this tax be can-
celled off the record by a resolution of the Town Board.
On motion by Councilman Stiner, seconded by Councilman
Watson, it vas, upon roll call, unanimously
RESOLVED, that the Receiver of Taxes be and he hereby
is authorized, empowered and directed to cancel the
folllowing tax lien on his records:

On drainage and sanitation, Councilman Stiner reported
that the Department is planning on cleaning out the sewers and catch
basins earlier this year if the weather permits. He added that the
work on the two catch basins at Myrtle Blvd . and. Madison Avenue has
been completed and that they are now in good working condition.
Councilman Mills presented a list of claims from the Fire
Department, totaling $589.44. He stated that he had checked the bills
and recommended their approval .
The members of the Board sitting as the Board of Fire
Commissioners considered the claims, and on motion by Councilman
Mills, seconded by Councilman Embury, it was, upon roll call, unani-
mously
RESOLVED, that the following described claims be and
they hereby are approved and the Supervisor and comp-
troller be and they hereby are authorized to pay same
out of the budget for the Fire Department:

Councilman Mills informed the members of the Board that
a testimonial dinner to Ex Deputy Chief Conte would be held on March
27, 1946 at 8:30 P .M. at Washington Inn, Mamaroneck. He asked that
as many of the Board members as possibly could to attend this function.
Councilman Mills reported that he had received a letter
from Fire Chien Burton in which be urged that the Town Board go on
record as favoring the proposed bill affecting the retirement of
paid firemen. If enacted, this bill would reduce the number of years
for. retirement from thirty-five to twenty-five years.
The Supervisor stated that the Town Attorney would talk
about this when making reports.

The Town Attorney explained that this lien covers property
known as that of Colonial Rubber Company on Mount Pleasant Avenue,
in the Village of Mamaroneck, to which the Village of Mamaroneck ob-
tained title by deed in lieu of foreclosure and which property is
under contract of sale by deed in lieu of foreclosure and which pro-
perty is under contract of sale made by the Village of Mamaroneck
and approved by the Town Board.
He stated that the Attorney for the Village had submitted
these papers to him with the request that the Town Board act pur-
suant to Section 54 of the Westchester County Tax Act, so that a dup-
lieate` lien can be issued which can be submitted with the satisfaction
to the Receiver of Taxes, so that the lien can be cancelled.
On motion by Councilman Embury, seconded by Councilman
Stiner, it was, upon roll call, unanimously
RESOLVED, that a duplicate lien be issued to cover
Lien No. 427, dated May 23, 1934, covering Section 9,
Block 10, Lot 1B, such lien to be issued to Ethel
Hirshman, so that the same may be delivered with a
satisfication, to the Receiver of Taxes for cancellation.
The Supervisor reported that some of the members of the
County Board of Supervisors had requested that he bring before the
Town Board ,a resolution endorsing the bill now before the Legis-
lature extending the term of office of all Supervisors, Town Clerks
and Superintendents of Highways to four years.
The following was presented;
WHEREAS, there will be a substantial saving to the tax-
payers of our community and other communities resulting
from the elimination of a biennial election therefor by
extending the terms of office of various officials; and
WHEREAS, a longer term of office permits the elected in-
cumbent a fairer opportunity to render better public ser-
vice by reason of longer experience acquired in the
position; and
WHEREAS, by law, the terms of office of the Supervisors,
Town Clerks and Town Superintendents of Highways is es-
tablished for a two year period; and
WHEREAS, the terms should be, in our opinion, extended
to provide for a four year tenure of office;
NOW, THEREFORE, BE IT
RESOLVED, that we, the members of the Town Board of
the Town of Mamaroneck, Westchester County, New York,
do hereby express our firm belief that it would be
beneficial to extend the terms of office of all Super-
visors, Town Clerks and Superintendents of Highways,
which said extension would be the result of appro-
priate action by the legislature of the State of New
York and be effective at the expiration of the
present terms and at the next election, and be it
further
RESOLVED, that we solicit the cooperation of our
neighboring communities by requesting their active
participation in this recommendation and by recommend-
ing to them the adoption of a similar resolution and
the transmission ,of the said resolution to the members

of the Assembly and Senate from the respective districts,
and by further having them endorse the appropriate legis-
lation; and be it further
RESOLVED, that the Town Clerk of ,the Tmon of Mamaroneck
be directed to send to the governing bodies of--the
Counties of Westchester, Putnam, Dutchess, Rockland
and Orange and to the members of the Assembly and
Senate from the County of Westchester, and to the
Association of Towns, a copy of this resolution;
and be it further
RESOLVED, that the Supervisor of the Town of
Mamaroneck transmit to Assemblyman Theodore Hill Jr.
and Senator Pliny W. Williamson, a copy of this re-
solution with our earnest request that they forthwith
introduce bills in the Legislature of the State of
New York to give legislative effect to the extension
of the said term of office .
The foregoing resolution was , on motion by Councilman
