REGULAR TMEETING OF THE TOWN BOARD, TOWN OF 11AMARONECK
HELD OCTOBER 159 1947
In the Council Room of the Weaver Street Fire House, Town of
Mamaroneck, New York.
The meeting was called to order by Supervisor Mandeville
at 8 ®15 P.M. ( Eastern Standard Time) .

The presence was also noted of Town Clerk Gronberg, Town
Attoney Delius and Accountant Finson.
The Town Clerk presented and read a petition from the
residents of Zlinthrop Avenue & Plymouth Street for permission to turn
these two streets into one-way traffic, with traffic being permitted
only from Weaver Street through Plymouth Street and Winthrop Avenue
onto the Boston Post Road. It was pointed out that these two streets
are used by many drivers to avoid the traffic light at 7j"Veaver Street
and Boston Post Road and consequently traffic is heavier than is either
usual or necessary on a purely residential street.
The Supervisor suggested that the Town comply with the wishes
of these people and the petition was referred to the Board of Police
Commissioners with the recommendation that their= request be granted,
On motion by Councilman Yills, seconded by Councilman Stiner,
it ryas, unanimously
RESOLVED, that the petition presented by the residents
of Winthrop Avenue and Plymouth Street be referred to
the Board of Polce Commissioners of the Town of
- Mamaroneck with the reconrendction that their request
be granted .
A letter dated September 30, 19470 was received from Edward
Ely Hoxie requesting the Town Board to give consideration to his former
offer for the back land on Yyrtle Blvd.
The matter was discussed by the members of the Board and
no action was taken.
A letter dated September 19, 1947, was received by co-signers
Louis J. Venerose and David F. I4iralia, residing at 10 Leafy Lane and
6 Leafy Lane, respectively, advising that at 11 Leafy Lane there are
three separate tenants residing and requesting that as soon as the
housing shortage is over the premises be restored to a one-family
dwelling in accordance with the Zoning Ordinance .
The letter was referred to Town Attorney Delius for attention.
The To•;-n Clerk requested that in accordance with the provisions
of Section 75 of the Election Law, he be authorized to publish the
Election Notice .
On motion by Councilrr_an Watson, seconded by Councilman Embury,

RESOLVED, that pursuant to Section 75 of the Election
Law being Chapter 17 of the Consolidated Laws, the
Town Clerk be authorized to publish in the Daily
Times, on November 3, 1947, a notice of the Election,
a list of the Polling Places and the dates and hours
of the Election.

Councilman Watson presented petitions received from the Assessor
for the correction of the assessment roll so as to permit the apportion-
ment of taxes®
On motion by Councilman Watson, seconded by Councilman Stiner,
the following resolution was unanimously adopted:
WHEREAS, the Assessor has presented petitions for the
correction of the assessment roll for certain years
pursuant to the provisions of Section 33 of Chapter
105 of the Lags of 1916 as amended, known as the
Westchester County Tax Act , and
MtIEREAS, after- due consideration this Board finds it
desirable to grant said petitions for the correction
of said assessment roll;

Councilman Embury reported that the revised plans for the
Spar Memorial have been completed and that the advertiserent requesting
bids for the construction of this Memorial could now be published.
On motion by Councilman Embury, seconded by Councilman Trills,
it was, unanimously
RESOLVED, that the bids heretofore received for the
construction of the War Menorial be rejected,
FURTHER RESOLVED, that the following notice be inserted
in the Daily Times, the official newspaper of the Town,
at least ten (10) days prior to November 5, 1947:
NOTICE TO BIDDERS
Notice is hereby given that sealed bids will be received
by the Town Board of the Town of Idamaroneck, Westchester County,
New York between 8 and 8:15 o 'clock P .Y. Standard Time on Novem-
ber 5, 1947, in the Council Room at the 'leaver Street Fire House,
and there at a regular meeting of the Town Board will be publicly
opened and read aloud, for furnishing all materials, Tools, Plachin-
ery, Equipment and Appliances of every kind and descriptions what-
soever, and providing the Labor required for construction of:
WAR MEILOR-TAL
At the Larchmont Station Park in the Unincorporated Section of
the Town of Mamaroneck, New York in accordance with the Plans and
Specifications drawn and prepared by Eggers and Higgins, Architect
542 Fifth Avenue New York, and now on file in the office of the
Town Clerk at 15$ Nest Boston Post Road, Mamaroneck, New York.
Copies of Instructions to Bidders, Form of Bid, Form of Contract,
Form of Performance Bond and of the Plans and Specifications may
be inspected at the Office of the Town. Clerk and all information
regarding this work may be obtained from Eggers and Higgins,
Architects .
The principal items of work consist of:
Section 1. Excavating ® Filling and Backfilling
Section 2. Masonry Work
Section 3 . Bronze fork
Each bid must be accompanied by a certified check in the sum
of five per cent ( 51) of the amount of the bid, payable to the
Town of Mamaroneck, drawn upon a State or National Bank or Trust
Company authorized to do business in the State of New York, and
no bidder may withdraw his bid and in case the successful bidder
shall fail or refuse to enter into a contract in accordance with
the proposal, the Proceeds of said check will be retained by the
Town.
The successful bidder will be required within ten (10) days
after awarding of the Contract to furnish and file with said
Town Board, in such form and with such insurer and guarantor as
the Town may approve, policies insuring the Town of Mamaroneck
against any loss and/or damages, resulting either directly or
indirectly from or during the prosecutinn of the work provided
for, under the Contract, and a bond in the amount of the Contract
guaranteeing the faithful performance of the Contract.

The Town Board reserves the right to consider bids for ten
(10) days after receiving same, before awarding the Contract, and
the right is reserved to include or exclude any alternate estimate
called for herein, if any, as may be determined by the Town Board,
to reject any. or all bids, or to accept any bid or bids which the
Town Board may deem advantageous to the Town of Yanaroneck and to
award the Contract to other than the ;owest bidder.

Copies of the Plans and Specifications may be obtained from the
---I Town Clerk, upon payment of Ten ($10) dollars for each set . A
refund of Ten ($10) will be :Wade to each bidder and a refund of
Five ($5) dollars to each non-bidder upon return of such sets in
good condition within thirty (30) days after receipv of bids.

Councilman Embury commended the Highway Department for the
excellent job that was done in connection with the paving work at the
Station.
Councilman Stirrer stated that he had nothing to report for
his Departments .

Councilman I;lills presented a list of claims from the Fire De-
partment totaling $954.80. He stated that he had chedked the bills and
recommended their approval.
The members of the Board sitting as the Board of Fire Commisioner•s
considered the claims and on notion by Councilman 11ills, seconded by
____ Councilman Embury, it was upon roll call, unanimously

The Supervisor presented the list of Town-owned properties that
were recently sold at the public auction held October 7, 1947, and or.
motion by Councilman Stiner, seconded by Councilman Embury, it was, upon
roll call, unanimously resolved:
WHEREAS, the Town. of Ham aroneck, through the institution
of an action in the County Court of Westchester County,
entitled " In the matter of the Foreclosure of Tax Liens
pursuant to Article Vll-A, Title 3 of the Tar, Law by the
Town of Mamaroneck, List of Delinquent Tares for 1947" ,
has become and now is the owner of a number of parcels
of Real Estate situate in the unincorporated section
of the Town of Mamaroneck, and
WHEREAS, the Town of Yamaroneck advertised for and held
on October 7, 1947, a public auction and received bids
on certain of said parcels of real estate now owned by
the Town of Mamaroneck:

FURTHER RE SD LAED, that the Supervisor is authorized
and directed to execute and deliver deeds to these
parcels in accordance with the terms and contract
of sale and the Town Attorney is authorized to take
all steps necessary to complete the sales and transfer
these parcels .
On motion by Councilman Stiner, seconded by Councilman Embury
the following resolution was unanimously adopted:
WHEREAS the Town of Mamaroneck through the institution
of an action in the County Court of Westchester County,
entitled Bi In .the matter of the Foreclosure of Tax Liens
Pursuant to Article V11-A, Title 3 of of the Tax Lam by
the Town of Yamaroneck, List of Delinquent Taxes for 1947",
has become and now is the owner of a number of parcels
of Real Estate situate in the Village of Larchmont and
Town of Mamaroneck, and
7THEREAS' both the Village of Larchmont and Town of
Mamaroneck held tax liens on said parcels of real
property, and
WHEREAS, pursuant to Section 165H- of the Tax Law an
agreement was entered into between the Village of Larch-
mont and the Town of Yamaroneck, which among other things
set forth the interests of said municipalities in the
properties being foreclosed, the manner of the sale of
said. properties ; and the manner of the distribution of
the proceeds received from said sales , and
WHEREAS, the Town of I'amaroneck has, pursuant to an
agreement had with the Village of Larchmont advertised
for and has heretofore received bids on certain pro-
perties owned by the Town of Iviamaroneck, and
WHEREAS, since receipt of said bids this Board has
given careful consideration thereto, and after due
deliberation, it is

FTMTIT;R RESOLVED, that the foregoing acceptance with
respect to each parcel is subject to approval by the
Village Board of the Village of Larchmont;
FURTHER RESOLVED, that upon approval of any or all
bids by the Village Board of the Village of Larchmont,
the Town Attorney is authorized to proceed with the
preparation of contracts, and such other documents as
are necessary to pass title to said properties, and
the Supervisor is hereby authorized to sign such con-
tracts and deeds as are necessary to pass title to

FURTHER RESOLVED, that upon approval of any or all bids

The Town Attorney pointed out that Block 220, Parcel 366,
sold at the auction held October 7, 1947 was subject to a permissive
referendum.
On motion by Councilman Stiner, seconded by Councilman Watson,
it was, upon roll call, unanimously
RESOLVED, that this Board, upon receipt of the sum of
$350. 9 convey to Merrill J. Bunnell, certain property
now owned by the Town ( Commissioners of Sewer District
No . 1) which is bounded and described as follows -
All that Lot, plot or parcel of land lying, being and
situate in the Town of Mamaroneck, Westchester County,
New York, and known and described on the Tax Assessment
Map of the Town of Mamaroneck as Block 220, Parcel 366,
the same being a plot approximately 50 feet in width
on Forest Avenue with a depth of 131 feet, more or less: ,
subject, however, to an easement for storm and sanitary
sewer purposes as shown upon said Assessment Map, and sub-
ject also to any state of facts an accurate survey or an
inspection of the premises will show;
FURTHER RESOLVED! that this resolution is adopted subject
to a permissive referendum as provided in Section 64, sub-
division 2 of the Town Law and that the Town Clerk is auth-
orized and directed to give notice of the adoption of this
resolution as provided in Section 90 of the Town Law;
FURTHER RESOLVED, that subject to a permissive referendum,
such conveyance be made by a Bargain and Sale Deed with-
out covenants, subject to an easement as above described
and that the Town Attorney is hereby authorized to pre-
pare all necessary papers, including a deed, for the
purposes stated in this resolution.
The Supervisor stated that inasmuch .as the Department of Welfare
has been taken over by the County, the need for maintaining separate funds
is no longer required and in accordance with a law passed by the Legislature
it is now permissible to transfer any unexpended welfare funds to the
general Fund.
On motion by Councilman P,lills, seconded by Councilman Watson,
it was, upon roll call, unanimously
RESOLVED, that the Supervisor is hereby authorized
to transfer the seam of $17,311.34 from the Public
,Welfare Fund to the Town of Mamaroneck General Fund.
The Supervisor brought up the matter of the installation of
a pipe line on Cabot Road which wqs discussed at the last meeting . He
advised that both 204 and 411 cast iron pipe is now available but that 211
pipe is more economical to install and would be adequate for services
on this street. He said he had at hand a revised estimate from the
Water Company for installing 211 cast iron pipe amounting to $1,605,21.

Following discussion, it was on motion by Councilman Embury,
seconded by Councilman Stiner, upon roll call, unanimously
RESOLVED, that the Westchester Joint Water Works No.l
is hereby authorized to install 411 cast iron pipe line
on Cabot Road, in accordance with their estimate dated
October 6, 1947, at a cost not to exceed $1,605.21.

Councilman bills suggested that some thought be given to the
installationn of a fire hydrant at the corner of Cabot Road and Myrtle
Boulevard, at the time of installation of this pipe line .
The members of the Board unanimously agreed to leave this
matter to the discretion of Supervisor Mandeville
Ear. James P. Ward, Assistant Town. Engineer, reported that tree
work being done at the Larchmont Veterans Rousing Project is progressing
rapidly and should be completed by Wednesday or Thursday of the following
week.
There being no further business the meeting adjourned at
