M. (Eastern Standard Time) . PRESENT: Supervisor Mandeville Councilmen: Embury, Watson, Mills and McKeever ABSENT: None Presence was also noted of Town Attorney Delius, Town. Accountant Finson and Town Clerk Gronberg. The minutes of July 6th, August 3rd, August 31st and September 6th were approved as presented. The Town Clerk read a letter dated October 4th, 1949 from Police Chief Yerick, advising the Board that at a meeting of the Police Commission of the Town, held October 3rd, Officer Philip M illheiser had been appointed to the position of Sergeant to fill the vacancy caused by the retirement of Sergeant Louis Boivin, and a new patrol- man, George L. Potter,had been appointed to fill Officer Millheiser' s place; both these appointments to become effective as of October 15th, 1949 - On motion by Councilman Embury, seconded by Councilman Mills, it was unanimously RESOLVED that this Board ratifies the action of the Board of Police Commissioners of the Town. of Mamaro- neck in the appointment of Philip Millheiser as Ser- geant of the Town of Mamaroneck Police Department, effective October 15th, 1949, at an annual salary !i of $41080. I. FURTHER RESOLVED that George L. Potter be and he hereby is appointed to the position of probationary patrolman of the Town of Mamaroneck Police Depart- ment at an annual salary of $2,700. effective October 15th, 1949 • The Town Clerk read a letter dated October 4th, 1949, received from Chief Yerick advising the Board that the Police Commission had approved Detective Smith' s attendance at the National Identifica- tion Association Conference to be held in Albany on October 10th, and 11th, his approximate expenses to be between $30. and $40. On motion by Councilman Embury, seconded by Councilman McKeever, it was unanimously RESOLVED that Detective Chauncey Smith be and he hereby is authorized to attend the conference of the National Identification Association at Albany, New York, on October 10th and 11th, the expenses not to exceed -440. to be paid out of the budget item in the Police Department Budget. Was A letter dated October 4th/received from Chief Yerick, together with a bid from the Chatsworth Valet in the amount of $826.05 for uni- forms . The Town Clerk stated to the Board that Chief Yerick had informed him that bids had been requested from two other local merchants but to date the enclosed bid was the only one received . The Board was also informed that the Board of Police Commissioners recommended the purchase of these uniforms . j On motion by Councilman Embury seconded by Councilman McKeever, it was unanimously RESOLVED that the bid of Chatsworth Valet in the amount of $826.05 for the purchase of winter uni- forms for the Police Department, be and the same hereby is accepted. The Town Clerk informed the members of the Board that it has be- come necessary, because of the smallness of the quarters, to change a polling place in the Second Election District from the C . & B. Construction Co. office at 632 Fenimore Road to the Jeryco Plastics Corporation building at 431 Fayette Avenue . On motion by Councilman Mills, seconded by Councilman McKeever, the following resolution was unanimously adopted: WHEREAS, this Board, by resolution adopted August 3rd, " 1949, designated polling places for the purposes of primary, registration and election days in the 16 Election Districts of the Town of Mamaroneck, which designation is for the election year October 12 1949 to September 30, 19509 and WHEREAS, it has become necessary to change the location of the polling place in the Second Election District from its present location at No. 632 Fenimore Road, Mamaroneck, New York, to the Jeryco Plastics Corporation building at No . 431 Fayette Avenue, Mamaroneck, New York, NOW, THEREFORE, BE IT RESOLVED that the polling place in the Second Election District of the Town of Mamaroneck, be -- changed from No. 632 Fenimore Road, Mamaroneck, New York, to the Jeryco Plastics Corporation Building at No. 431 Fayette Avenue, Mamaroneck, New York. The following reports were received and ordered placed on file: Report of Receiver of Taxes and Assessments, September, 1949 Report of Bank Balances as of October 1st, 1949 List of Claims audited and paid by the Comptroller, September 14th to October 5th, 1949 Sumpary of Receipts and Disbursements from January lst to August 31st, 1949 Analysis of Budget Ar_propriation Expenditures, January lst to August 31st, 1949 Analysis of Estimated Revenues, January lst to August 31st, 1949 Councilman Watson stated that he had nothing to report for his departments . Councilman Embury stated that he had nothing to report for his departments , Supervisor Mandeville stated that he had received a. letter from Mr . William H. Johnson, Village Manager of the Village of Mamaro- - neck, together with certified copies of the resolution passed by his Honorable Board, covering a sale of a piece of property acquired by the Village through its foreclosure proceeding in rem, to Mr. Henry Z eiger of No. 6 Hawthorn Road, Larchmont, New York. Mr. Johnson further stated that Mr. Zeiger plans to erect a housing project on the site under Federal and State Authority. Following discussion and on motion byCouncilman Mills, seconded 1119 i by Councilman Embury, the following resolution was, upon roll call, unanimously adopted: WHEREAS, there has been presented to this Board, a certified copy of a resolution adopted by the Board of Trustees of the Vil- lage of Mamaroneck at a meeting held October 3rd, 1949, approving ,a sale to Henry B. Zeiger of a certain parcel of real property owned by the Village of Mamaroneck and described on its 1948 Assessment Roll as Section 8, Block 54, Lots 1A-113,10A, 1F_-123 2 A, 2B and 3, which property is known and described on the Town Assess- ment Roll as Block 820, Parcel 85; and WHEREAS, the property thus owned by the Village of Mamaro- neck, was acquired by it in foreclosure proceedings brought under Article VII-A of the Tax Law, in which an agreement was *made between the Town and Village providing for the re-sale of pro- perty acquired by the Village in these proceedings, free and clear of taxes but which also provided that all offers to pur- chase this property so acquired upon re-sale by the Village, must be approved by this Board; and WHEREAS, the resolution of the Board of Trustees of the Village accepted the offer of Henry B. Zeiger subject to cer- tain restrictions and conditions set forth in said resolution which were based on the proposal made by Henry B. Zeiger to the Board of Trustees for such purpose, i NOW, THEREFORE, BE IT RESOLVED that this Eoard approves the sale by the Village of Mamaroneck to Henry B. Zeiger of the property known and described as Block 820, Parcel 85 on the Tax Assessment Roll of the Town of Mamaroneck, for the sum of $4,000. upon the same restrictions and conditions -- which are contained in the resolution adopted by the Village of Mamaroneck on October 3rd, 1949. FURTHER RESOLVED that ail the restrictions and conditions numbered "1 to 12" inclusive as contained in the resolution adopted by the Village are hereby made a part of this resolution and that this resolution shall be null and void and of no effect unless such conditions and restrictions are complied with by Henry B. Zeiger in connection with the purchase of said property. Supervisor Mandeville requested a resolution approving the Townis sale of property known as Block 133, Parcel 707 to Rose M. Walker in the amount of $500. This property was sold at the auction held October 3rd, 1949 . On motion by Councilman Watson, seconded by Councilman McKeever, the following resolution was, upon roll call unanimously adopted: WHEREAS, the Town of Mamaroneck, through the institution of an action in the County Court of Westchester County, entitled "In the Matter of the Foreclosure of Tax Liens pursuant to Article --- VII-A, Title 3 of the Tax Law, by the Town of Mamaroneck, List of Delinquent Taxes for 1947", has become and now is the owner of a number of ;oarcels of real estate situate in the Unincorporated - Section of the Town of Mamaro eck; and WHEREAS, the Town of Mamaroneck advertised for bids and held a. public auction on October 3rd, 1949, and received bids on certain of said parcels of real estate now owned by the Town of Mamaroneck; and WHEREAS, since the receipt of said bids, this Board has given careful consideration thereto, and after due deliberation, it is I I RESOLVED that the bids hereinafter listed, be accepted at the price and terms therein set forth* LIST OF BIDS ACCEPTED IN SECTIONS 1 to 5 INCLUSIVE B1k. Purchaser Final Sales Price Terms - 133 707 Rose Walker $SOO✓ cash FURTHER RESOLVED that the Supervisor is authorized and directed to execute and deliver a deed to this parcel in accordance with the terms and contract of sale and the Town Attorney is authorized to take all steps neces- sary to complete the sale and transfer this parcel. The Supervisor reported to the members of the Board that $34 ,864 .78 was recuired to make up the deficit between the collection of County taxes and the amount actually due the County of Westchester on the 19.49 County tax. On motion by Councilman McKeever, seconded by Councilman Embury, it was, upon roll call, unanimously RESOLVED that there be appropriated from surplus, the amount of $34,864..78 for payment of the balance due the County of Westchester on 1949 County tax. The Supervisor reported that the bids for the new motorcycles, which had been received at the last meeting of the Board, had been referred to Chief Yerick whose recommendation was that the order be given to James R. Ransome of Larchmont, the low bidder. On motion by Councilman Embury, seconded by Councilman Watson, it was, upon roll call, unanimously RESOLVED that the bid of James R. Ra.nsome, dated September 14, 1949, for the purchase of 3 motor- cycles in the amount of $2,365 .40, be and it hereby is accepted. Supervisor Mandeville recommended the appointment of Mr. Arthur E. Wullschleger, Hommocks Road, Larc'_nmont, to fill a vacancy on the Zoninro Board of Appeals, created by the resignation of Mr. Clifford Cross . On motion by Councilman Embury, seconded by Councilman Watson, j it was, upon roll call, unanimously RESOLVED that Arthur E. Wullschleger be and he hereby is appointed a member of the Zoning Board of Appeals of the Town of Mamaroneck, to serve the unexpired term of Clifford Cross, ending February 19th, 1952. Burton Chief Councilman Mills presented a list of claims for Fire Department expenditures and stated that he had checked the bills and recom- mended their approval and payment. The members of the Town Board sitting as the Board of Fire Com- missioners, considered the claims and on motion by Councilman Mills, seconded by Councilman Embury, it was, upon roll call, unanimously RESOLVED that the following described claims be and they hereby are approved and that the Supervisor and Comptroller be and they here- by are authorized to pay the same out of the budget for the Fire Department: New York Telephone Co. $49.68 Goldies A. & N. Vetter, Inc . 31.72 $338.02 I Councilman Mills stated that he understood the Town Attorney to have a report on the status of the Volunteer Firemen with regard to insurance coverage® Following discussion by the members of the Board, this matter was referred to a meeting of the Fire Council at which the Town Attorney was requested to attend and explain this sub- ject. The members of the Board discussed the settlement of a cer- tiorari proceeding brought in the name of Abe Adler. Mr . Delius was instructed to submit his recommendation at the next meeting . After discussion, upon motion made by Councilman Embury, seconded by Councilman Mills, the following resolution was, upon_ roll call, unanimously adopted: WHEREAS, heretofore writs of certiorari were obtained by DOROTHY V. C. SCHAAL, owner of property described on the assessment map and assessment roll of the Town. of Mamaroneck as Block 613, Parcel 242, to review the assessments for the years 1940, 1941, 1942, 1943, 1944, 1945, 1946 and 1947 (taxes of 1941, 19422 19439 1944, 1945, 1946, 1947 and 1945) ; and i WHEREAS, the Assessor and Board_ of Review of the Town of Mamaroneck, duly filed returns to said writs, and no further proceedings have been had; and WHEREAS, the Town Attorney and Assessor recommend to -- this Board that the proceedings be settled and discontinued upon the reduction of the assessment, I NOW, THEREFORE, BE IT RESOLVED that the assessments for the years 1940, 1941, 1942, 1943, 1944, 1945, 1946 and 1947 (taxes of 1941 1942, 1943; 1944, 1945) 1946, 1947 and 1948, upon property owned by DOROTHY V. G. I FURTHER RESOLVED that the Town yttorney is hereby --- authsrized and directed to sign the necessary stipulat-zon to obtain an order of the Supreme Court providing for such reduction and. the re- fund of excess taxes paid, if any.
