MINUTES OF A REGULAR PTTETING OF THE TO1`'TT BOARD OF THE TOTUIT OF
ITAYF ROYECK, HELD JULY 6th , 19499 IN THE COUNCIL ROOM OF THE
TEAVER STREET FIRE HOUSE.
PRESENT: Supervisor Mandeville
Councilmen: 1"Tatson, Mills and McKeever
ABSENT: Councilman Embury
The minutes of May 18th and those of June 1st were approved as
corrected.
The Town Clerk read a letter dated July 6th, 1949, received from
Mr. Alan L. Carnoy, showing a balance due him from the Westchester
Joint 7ater lgorks No. 1, of $2 ,177.29 , and requesting a 75% refund
of that amount at this time instead of 100% over a period of years,
which Mr. Carnoy stated, would mean a saving to the Torn of
$544.33• The matter was referred to Town Attorney Delius for
study and recommendation.
Mr. Carnoy who was present , then advised the Board that he had con-
sulted with the owners of premises adjoining property known on the
Tax Assessment Map as Block 133 , Parcels 186 , 199 , 204, 209, 256 ,

264, 267, 2699 229 and 242 , on which property Mr. Hendrick 7.olter
had made the successful bid at the recent auction and had deposited
10% of the purchase price , and these owners had assured him that
they would oppose any re-zoning of the property for apartment house
purposes. Under these conditions , said Mr. Carnoy, Mr. 7 olter has
decided against purchasing these lots and requests that his deposit
be returned to him. Supervisor Mandeville informed Mr. Carnoy that
the Board would consider the matter and notify him of its decision.
The Clerk read a letter dated July 5th , 1949, from Yrs . Ely Hoxie ,
asking that , in view of Mr. Hoxie 's death and the fact that the
- Zoning Board of Appeals had not granted the variance sought by
Mr. Hoxie in connection with the property on which he had made a
bid and which is known as Block 1259 Parcel 60 on the Tax Assess-
ment Map of the Town, the 3140. deposit be returned. On motion
duly made and seconded, it was unanimously
RESOLVED that the sum of 3140. be re-paid to the
Estate of Edward Ely Hoxie or to Mrs. Hoxie , his
widow, upon approval of the Town Attorney.
A letter dated June 2nd. , 1949, was received from Mr. H. T.
Hotchkiss , Chairman of the Maintenance Committee of the Pine Brook
District Property Owners ' Association , Inc. , requesting a review of
the lighting conditions existing on Harrison Drive. The Town Clerk
informed the members of the Board that this matter had been re-
ferred to Mr. Foote upon receipt of the letter and he., in turn,
had written a letter recommending that a 1000 lumens light be
placed on pole NYT No. 12, which is almost opposite Shadow Lane.
On motion made by Councilman 1';atson, seconded by Councilman Mills ,
it was unanimously
RESOLVED that a 1000 lumens light be installed
on Pole R>i'T No. 12 , on Harrison Drive.
The Town Clerk read a letter dated July 1st , 1949, addressed to
Supervisor Mandeville by Chief Paul A. Yerick, relative to noise
made by patrons of the local taverns at closing time. The Chief
stated that the noise seemed more noticeable at this time of the
year as most windows are kept open. He further stated that the
officers under his command have been instructed to pay particular
attention to this matter of taverns , particularly at closing time.

The Board discussed this situation and Town Attorney Delius stated
that the closing hour could be controlled in any place where there
was eating and drinking. He further stated that it would necessarily
apply to all places in the Town where food or drink was sold. The
Board members felt that if the condition continues , it will be
necessary to take some definite action regarding an earlier closing.
A letter dated June 24th , 1949 , was received from Messrs. Karnes &
Schechter , attorneys for Modern Swimming Pool Co. Inc. in which
they stated that unless the zoning of Block 501, Parcels 1 and 4
could be changed from "Atl to "C" as heretofore informally requested ,
their client wished to cancel its conditional sales contract and
have its deposit returned.
Mr. Delius informed the Board of what had occurred at the Zoning
Board meeting with reference to this application and the Town Board
agreed unanimously that the deposit should be returned to Modern
Swimming Pool Co. Inc. Upon motion made by Councilman T atson,
seconded by Councilman IIills , it was unanimously
RESOLVED that the request of Modern Swimming Pool
Co. Inc. for refund of $300.50 being the amount of
deposit on bid for Block 501, Parcels 1 and 40,
which bid was made upon condition that a variance
be obtained from the Zoning Board of Appeals
allowing commercial or business use (which variance
has beer_ refused) be granted , and
FURTHER RESOLVED that the Comptroller be and he
hereby is authorized to audit and pay the claim of
Modern Swimming Pool Co. Inc. for $300.50.
A letter dated June 6th , 1949 was received from Home Builders '
Association of 7iestchester , Inc. regarding the Westchester Home
Show of 1950. It is the purpose of the Association to have each
member build a permanent home on a tract of land which will be set
aside for the show. The Association has made no definite plans as
to the location of the show and Mr. H. H. Wolter who is committee
chairman and a resident of the Town of Mamaroneck, would like to
bring this show here. No action was taken by the Board.
The Clerk read a letter dated June 30th , 1949, from the Police
Commission stating that they had appointed Raymond Borho, 68
Revolutionary Road, Ossining,and David YcClintock, 22 New Broad-
way, North Tarrytown, to the position of probationary patrolmen
in the Town of Mamaroneck Police Department. Upon motion made by Coun-
cilman Mills , seconded by Councilman 7atson, it was unanimously
RESOLVED that the Board approves the appoint-
ment of Raymond Borho and David McClintock as
probationary patrolmen in the Mamaroneck Town
Police Department , their appointments to be as
of June lst and July 11th respectively.
FURTHER RESOLVED that there is hereby appro-
priated from the item in the 1949 budget
"Salaries , Patrolmen" , the sum of $1,350. as
salary for Raymond Borho and $1,273.80 as
salary for David McClintock for the balance
of the year 1949.
The letter also advised the Board that the Board of Police Com-
missioners have approved the attendance of Chief Yerick at the
Conference of New York State Police Chiefs , to be held at Niagara
Falls on July 26th , 27th and 28th; estimated expenses to be
approximately $85. Upon motion made by Councilman Watson,
seconded by Councilman McKeever , it was unanimously

RESOLVED that Police Chief Yerick be and he hereby
is authorized to attend the Police Conference to be
held at Niags Falls , New York, July 26th, 27th and
28th , 1949 and that the expenses , not to exceed X85.
be paid out of the budget item in the Police Depart-
ment.
- A letter dated June 28th , 1949 .^ras received from Mr. Joseph Lanza,
President of the Mamaroneck Soft Ball League , requesting assistance
with the financial problem of conducting the League. Supervisor
-- Mandeville informed the Board that a similar request had been re-
ceived from the Larchmont Soft Ball League . Upon motion made by
Councilman McKeever , seconded by Councilman Wills , it was unani-
mously
RESOLVED that the Town purchase soft ball equip-
ment in an amount not to exceed $300. from the
appropriation in the 1949 budget , "General Town,
Miscellaneous- Recreation" , and
FURTHER RESOLVED that this equipment be placed
at the disposal of the soft ball leagues of the
Village of Mamaroneck and the Village of Larchmont.
The Clerk presented a letter dated June 24th , 1949 , received from
Mrs . Helen f!iegers , together with a petition signed by residents
of Colonial Avenue , relative to making Colonial Avenue a "safe
street" . Supervisor Mandeville informed the members of the Board
that Chief Yerick has been investigating this matter , and he
appointed. Councilman Mills a committee of one to study the matter
with Chief Yerick.
The Town Clerk ,presented a letter dated Jily 5th, 1949, received
from Hr. William J. Galione , together with a petition signed by 20
residents of Forest Avenue , requesting completion of the installa-
-- tion of curbs on this street. The Clerk was instructed to acknowledge
receipt of the letter and petition with thanks , and to inform the
residents of Forest Avenue , through Mr. Galione , that this matter
would be attended to as soon as work on Holly Place is completed.
The Town Clerk presented a petition received from the Assessor ,
requesting approval of a number of pages of the assessment maps
showing corrections made by the Town Assessor as of June lst , 1949 ,
said corrections being due to the sale or transfer of lots or plots
and the filing of maps in the Department of Land Records , Thite
Plains. Upon motion made by Councilman Watson, seconded by Council-
man McKeever , it was unanimously
RESOLVED that the Board hereby approves of the
changes in the assessment maps of the Town of
Mamaroneck as of the lst of June , 1949 , and
said maps are hereby corrected and rectified as
of June 1st , 1949 in the following places!

The Town Clerk reported that , pursuant to the provisions of the
Election Law, the Chairman of each major political party had filed
his list of recommendations for the appointment of Election Inspectors.

Supervisor,Town of Mamaroneck
Councilman Watson reported on the progress of his study of the pro-
posed amendment to the Building Code with regard to the installa-
tion of oil and gas burners. He reported that he had met with
Mr. Foote and Councilman Yills and studied the matter. The pro-
posed amendment would mean that oil and gas burners would be in-
stalled only by people licensed by the Town of Mamaroneck. Mr.
77atson further stated that the Committee was inclined to be
doubtful whether it would be wise to require this license. It
would have to be on the same basis as plumbers and would require
a board of examiners. He went on to say that it seems as though
the present setup is a good one. It requires any person in-
stalling a burner , to first get a permit from the Building In-
spector and later an inspection is made to see that it meets with
the requirements of the Building Code. It was Mr. Watson's recom-
mendation that the Town should not go in for this licensing at
the present time. He added that if the Board felt it wise to
continue on the present basis, he and his Committee might go further
and see what improvements could be made in the Code. The Board
was unanimous in its decision that fir. Watson and his Committee
continue their study.
Supervisor Mandeville presented two resolutions received from the
Village of Mamaroneck approving bids they had received for the
sale of property foreclosed by the foreclosure in rem, which
are subject to approval by the Town Board'. Following discussion
and on motion by Councilman McKeever, seconded by Councilman Mills ,
the following resolution was , upon roll call, unanimously adopted:
71HER.EAS the Village of Mamaroneck, through the institu-
tion of an action in the County Court of 7estchester County, en-
titled "In the Fatter of the Foreclosure of Tax Liens pursuant
to Article VII-A, Title 3 of the Tax Law by the Village of Mamaro-
neck, List of Delinquent Taxes for 1945" , has become and now is the
owner of a number of parcels of real estate situate in the Vil-
lage of Mamaroneck and Town of Mamaroneck; and
°IHEREAS both the Village of Mamaroneck and the Town of
Mamaroneck hold tax liens on said parcels of real property; and

=REAS pursuant to Section 165H of the Tax Law, anagree-
ment was entered into between the Village of Mamaroneck and the
Town of Mamaroneck which, among other things , set forth the inter-
ests of said municipalities in the properties being foreclosed,
the manner of the sale of said properties , and the manner of the
distribution of the proceeds received from said sales ;and
117HEREAS the Village of Mamaroneck has , pursuant to an
agreement had with the Town of Mamaroneck, received bids from
one Vitina Sposito for a portion of property known and described
as section 8, Block 77, Lot 11, on the Village of Mamaroneck Assess-
ment Map, and known as Block 831, Parcel 341 on the Town of Mamaro-
neck Assessment Map, and the rear one-half portion of property known
as Section 8, Block 79 , Lot 19A on the Village of Mamaroneck
Assessment Map and known as Block 819, Parcel 422 on the Town of
Mamaroneck Assessment Map; and also received a bid from Maria
Rositi for the front one-half portion of Section 8, Block 79,
Lot 19A, as follows:

The Supervisor requested a resolution authorizing the transfer of
funds within the 1949 budget and from surplus funds , in the amount
of $5,814.17 in order to pay for the repairs to the Police building,
which repairs were not included in the budget, and the balance due
on the purchase of the police communications system. On motion
made by Councilman McKeever , seconded by Councilman Watson, it
was unanimously

Supervisor Iiandeville reported that Mr. Carnoy had appeared at the
last meeting and requested a public hearing on the closing of
Madison Avenue. The Supervisor further stated that he had since
received similar requests from other people who wished the same things
He stated that in view of the interest displayed, a public hearing
should be held. A hearing date ,gas, therefore, set for September
14th, 1949 and it was decided to insert notices of such hearing in
the Daily Times on August 29t1i, September 6th and September 13th.
The Toun Cleric was also instructed to have notices printed and
delivered to the homes of the residents surrounding this area.
On motion by Councilman ILIcKeever, seconded by Councilman Mills,
it was unanimously

PIIBLIC NOTICE
PLEASE TAKE NOTICE that the Town Board of the Town of Mamaro-
neck will hold a public hearing on September 14th , 1949, at 8*15
P. M. , in the Council Room of the Weaver Street Fire House , corner
of Weaver Street and Edgewood Avenue in the Town of Mamaroneck,
for the purpose of considering a proposition to close a public
street known as Madison Avenue (formerly Monroe Avenue) in the
Town of Mamaroneck as originally shown on the Map of Chatsworth,
filed in the Register 's Office on April 27th, 1857 as Map No. 333 '
and accepted by resolution of the Joint Town Board , adopted June
lst , 1910 , on a line running across Madison Avenue between the
northwest corner of Fifth Avenue and Madison Avenue and the south-
west corner of Garfield Street and Madison Avenue which will
result in making Madison Avenue a deadend street east from this
point to Fifth Avenue and west from this point to Lafayette Road.
TAKE FURTHER NOTICE that all persons attending this public
hearing will be given an opportunity to be heard.

Councilman McKeever stated that he had nothing to report for his
departments.
Councilman Mills presented a letter dated July 2nd, 1949 , received
from Chief Burton, in which the Chief expressed the appreciation of
the paid men and himself, to the Supervisor and Town Council for
their cooperation in assigning John Pendergast to nrork in the Fire
Department as a temporary driver during the vacation period.
Councilman Mills submitted the following reports:

Exaggerated complaint from undisclosed resident of Stonecrest
Apartment , regarding Mr. Carpino burning tree trimmings , investigated
immediately. Mr. Carpino requested to burn this brush when there is
no wind.

Inspector 's Report for June 1949
Complaints from residents regarding soot conditions in vicinity of
Alden House investigated. Present burner using #5 oil to be
replaced py installation of entirely new unit. All chimneys to be
cleaned. Incinerator covers cleaned and tightened up to prevent
burned paper escaping.
Fork now in progress on top floor at Bonnie Briar. All requests to
be complied `.pith. In addition , present beaver board partitions used
for dividing top floor will be removed and dormitories will be
constructed of fireproof material including fireproofing of floor.
Hydrant situation referred to Mr. Thrasher via Supervisor. No
notification of progress received as yet.
Superintendent of Gables notified to remove cartons from attic.
Cooperation from tenants regarding installation of antennae satis-
factory, same being placed on outside walls or chimneys.
Superintendents requested to prohibit tenants from smokir:g. on roofs.
All conditions good.

Councilman Mills presented a list of claims from the Fire Depart-
ment totaling $446.48. He said he had checked the bills and recom-
mended their approval.
The members of the Town Board , sitting as the Board of Fire Commis-
sioners , considered the claims , and on motion by Councilman Mills ,
seconded by Councilman Watson, it was , upon roll call , unanimously

The members of the Board discussed the request of Mr. Alan Carnoy
that the deposit made by air. Hendrick 7?olter for the purchase of
property known as Block 133 , Parcels 186, 199 , 2049 209 , 256 , 2649
267, 269 , 229 and 242, be refunded.. Town Attorney Delius was in-
structed to notify Mr. 71olter that his deposit is forfeited.
Town Attorney Delius brought up the matter of Mr. Grassi ° s deposit
on purchase of land from the Town, which purchase was made at the
first auction held in 1947. The property is located in the Village
of Larchmont and Mr. Delius stated that Mr. Grassi has an application
for a variance pending before the Larchmont Zoning Board. The Town
-- Board decided to give Mr. Grassi an adjournment ,until July 14th.
Mr. Delius discussed with the members of the Board, the pending cer-
tiorari proceedings brought by His Eminence Cardinal Spellman, Arch-
bishop of New York. Following discussion and on motion by Council-
man McKeever , seconded by Councilman Mills , the following resolu-
tion was unanimously adopted:
?'WHEREAS , heretofore writs of certiorari were obtained by
His Eminence , Francis Cardinal Spellman, Archbishop of New York,
owner of property described on the assessment map and assessment
roll of the Town of Mamaroneck as Block 957, Parcel 11, to review
the assessments for the years 1942 , 1943 , 1944, 1945, 1946 , 1947 and
1948 (taxes of 1943 , 1944, 1945, 1946, 1947, 1948 and 1949) ;and
'7HEREAS , the Assessor and Board of Review of the Town of
Mamaroneck, duly filed returns to said writs ; and
T REAS , the Town Attorney and Assessor recommend to this
Board that the proceedings be settled and discontinued upon the
reduction of the assessments ,

by the Bank for Savings in the City of New York. Following discus-
sion, and on motion by Councilman Mills seconded by Councilman
