HomeMy WebLinkAbout1949_06_01 Town Board Minutes 707 MINUTES OF A REGULAR PEETING OF THE T97N BOARD OF THE T07IN OF MATARONECKD HELD JUNE 1st , 1949, IN THE COUNCIL ROOM OF THE [WEAVER STREET FIRE HOUSE. PRESENT: Supervisor Mandeville Councilmen: Embury, Watson, Mills and McKeever ABSENT. None Presence was also noted of Town Attorney Delius , Town Accountant Pinson and Town Clerk Gronberg. Supervisor Mandeville called the meeting to order at 8:15 o'clock P. M. (Daylight Saving Time) . The Clerk read a letter dated June 1st, 1949, in which Mr. Carnoy requested permission to discount the refund due him from the Water Company, by 25% and receive the refund now, rather than over a period of years. The Supervisor informed Mr. Carnoy that the Board would take this matter up with the Town Attorney and he would be advised of their decision later. i Mr. Hendrick Wolter appeared before the Board with a request that Madison Avenue be closed off at Fifth Avenue in order to prevent through traffic from New Rochelle from using Madison Avenue and Lafayette Road as an outlet to sections of the Unincorporated Area. Mr. Carnoy also addressed the Board in favor of this project and requested a public hearing on it. The Supervisor informed Mr. Wolter and Poor. Carnoy that a date would be set for a public hearing. i The minutes of the meeting of May 4th, 1949 were approved as pre- sented. The Clerk presented a card received from Margaret Barnes , thanking the Board for the expression of sympathy at the time of her mother 's death. The Clerk presented a letter dated May 31, 1949, received from Chief Paul A. Yerick, recommending that the plans for dog control as submitted by Manager William H. Johnson of the Village of P4-amaro- neck, be given a trial. On the advice of the Town Attorney to the effect that a Town cannot spend more for the control of dogs, than it collects from the license fees , the Town Clerk was instructed to inform Chief Yerick of this fact and thank him for his letter. The Clerk was also instructed to inform Manager Johnson of the Board's action. L A letter .dated May 31 , 1949, was received from Chief Paul A. Yerick, advising the Board that the provisional appointment of John J. Welsh as patrolman, will terminate on June 15th , 1949. The letter was received and filed. A letter dated May 31, 1949 , was received from Chief Paul A. Yerick, advising the Board that , at a meeting of the Police Com- mission, held May 23rd, 1949, the following men were appointed patrolmen of the Town of Mamaroneck Police Department, to fill existing vacancies: John M. Leonard, 34 Acker Avenue, Ossining. , effective June lst , 1949 Richard Winkler , '73 Ridgewood Terrace , Chappaqua, N. Y. , effective June 16th, 1949. Following discussion, on motion by Councilman McKeever , seconded by Councilman Mills , it was unanimously RESOLVED that this Board hereby grants vaca- tions to all employees compensated on a per- L diem or hourly basis , not to exceed two weeks in each year , after one year of continuous employment with the Town of Mamaroneck. FURTHER RESOLVED that for those employees who have been employed for more than six months , e ear , one day for each full than 3 but less tha y , month of employment shall be allowed. FURTHER RESOLVED that for the purpose of granting such vacations in the year 19499 the number of months which entitles such employee to such vacation shall be computed as of October It 1949 , and annually thereafter. FURTHER RESOLVED that the resolution adopted by the Town Board on June 17, 1942 , be and it hereby is superseded by the above. Supervisor Mandeville stated that he had received a bid from Robbins and Aitchison in the amount of $245. for the destruction of several trees throughout the Town. On motion by Councilman Mills , seconded by Councilman Embury, it was unanimously RESOLVED that the bid of Robinson and Aitchison in the amount of $245. for the destruction of several trees throughout the Town, be and it hereby is accepted. Supervisor Mandeville reported that since the installation of the new system of purchasing throughout the Town, savings of over $800. have been effected. Supervisor Mandeville requested a resolution granting 90 days ' sick leave to Charles Seufert. On motion by Councilman Mills, seconded by Councilman McKeever , it was unanimously RESOLVED that Charles Seufert, Custodian, be and he hereby is granted a 90-day leave of absence without pay. On motion by Councilman Embury, seconded by Councilman Watson, it was unanimously 71-3 RESOLVED that John Seufert be and he hereby is appointed Custodian during the absence of Charles Seufert , on a temporary basis , at the rate of $2,440. per annum. After discussion, upon motion by Councilman Embury, seconded by Councilman Watson, the following resolution was unanimously adopted: 44MREAS , the Lions Club of Larchmont , heretofore generously offered its aid and assistance to the Village of -- Abbeville , France , in obtaining for its residents , food supplies urgently needed there; and WHEREAS , this Club thereafter organized and directed - a drive for the collection of food supplies , from the residents of the Larchmont Postal District , including the Unincorporated Section of the Town of Mamaroneck' and WHEREAS , this drive was aided and furthered through the efforts of the Boy Scouts , the Cub Scouts , the Fire Department of the Town of Mamaroneck, the Fire Department of the Village of Larchmont , the Merchants of Larchmont, the Merchants of the Unin- corporated Section of the Town of Mamaroneck, the Parent-Teachers ' Association of the Murray Avenue School , the Parent-Teachers ' Asso- ciation of the Chatsworth Avenue School, the Ybthers ' Club of St. Augustine 's Academy, the Parent-Teachers ' Association of St. Augus- tine 's Parochial School , Chelsea Fireproof Storage warehouse , Inc. , Operation of Democracy, New York City, the Police Department of the Town of Mamaroneck, the Police Department of the Village of Larchmont , and Leonard G. Blumenschine , N07.F, THEREFORE, BE IT RESOLVED that this Board expresses its thanks and appreciation on behalf of the citizens of the Town of Mamaroneck, to all of the above mentioned clubs , organizations and individuals , and the Town Clerk is hereby directed to send a copy of this resolution to all who participated in this drive. Councilman McKeever reported that the Town rubbish is being dumped near the Pine Brook drain, off Fifth Avenue , and that the Madison Avenue sewer has been completed. Received call from Chatsworth Place , New Rochelle line , reporting lumber on fire ,upon investigating found old building on fire , which was being demolished. Fire- men Testa & Mueller. (8:06 A. M. to 12:55 A. M.) Box 561. May 28th, Still alarm, Box 412, received call from Police Depart- ment reporting brush fire at Fenimore Road, Avon Road, Fireman Testa, Engine #3 , (3:35 P. M. to 3:50 P. M.) 3 men. May 31st. 4 rounds , Box 555, received call from Alden House , reporting Apartment 5A on fire. Found refrigerator motor burnt out with rags stored in box. Aerial , Engine +2 , Engine #3 , Patrol. Lt. Gallagher , Testa and Mellor. (6:40 P. M. to 7:02 P. M.) 40 men. 9 still alarms 1 2 rounder 1 4 rounder Deputy Chief M. Conte Supervisor Mandeville suggested that the recommendation of Chief Burton, of an amendment to the Building Code , be referred to Mr. Foote and Councilmen Watson and Mills for study. -- Councilman Mills presented a letter from Chief Burton, dated May 31st , 1949, requesting that Joseph Miller be given the maxi- mun salary for truck driver , and also that the vacancy of Fire Lieutenant Patrick Nolan be filled. Supervisor Mandeville suggested that Attorney Delius , Chief Burton and Accountant Finson consult Mr. Denton Pearsall, Personnel Director of Westchester County, regarding the filling of this vacancy and also the holding of an examination for the position. Following discussion, on motion by Councilman Mills , seconded by Councilman McKeever , it was unanimously RESOLVED that the salary of Joseph Miller, Fire Truck Driver , be and it hereby is in- creased to $3 ,100. annually, effective June 1st, 1949. Councilman Mills presented a list of claims for Fire Department expenditures and stated that he had checked the bills and recommended approval and payment. The members of the Town Board, sitting as the Board of Fire Com- missioners , considered the ,claims and on motion by Councilman Mills , seconded by Councilman Embury, it was , upon roll call, unanimously RESOLVED that the following described claims be and they hereby are approved and that the Super- visor and Comptroller be and they hereby are authorized to pay the same out of the budget for the Fire Department: 7 V Roy H. FURTHER RESOLVED, that the Town Attorney is hereby authorized and directed to sign the necessary stipulations to obtain an order of the Supreme Court providing for such reduc- tions and the refund of excess taxes paid,if any® On motion by Councilman Embury, seconded by Councilman Watson, the following resolution was unanimously adopted- WHEREAS , it appears that the records of the Commis- sioner of Finance of the County of Westchester , indicate tax liens or leases owned by the Town of Mamaroneck dated March 10 , 1872, for $5.83 and March 31, 1873 , for $8.68 respectively, which affect property described as Lot No. 91, Map of Grand Park (Brown property) which property is .situated in the Town of Mamaroneck; and WHEREAS , no record of such tax leases or liens appears in the tax or tax arrears records of the Town of Mamaroneck; and YTHEREAS, the owners of the said property have re- quested this Board to indicate its approval of the correction of the records in the office of the County Commissioner of Finance and/or the cancellation of the said tax liens or leases which appear to be owned by the Town of Mamaroneck, NO17p THEREFORE, BE IT RESOLVED that this Board authorizes and approves the cancellation of the tax liens or leases now appearing on the records of the County Commissioner of Finance as follows- March 10, 1872 $5.83 March 319 1873 on property described as Lot 91, Map of Grand Park (Brown property) and requests the County Commissioner of Finance to correct his records accordingly. County Transportation Co. , Mr. Delius reported, had applied to the Public Service Commission, for an increase in their rates. They have submitted alternative propositions to the Commission, one being a straight increase of 20% which would mean a 12¢ fare instead of the present 10¢ fare , and the other would mean a change of zones. Mr. Delius was instructed to take the position of favoring a change in the zoning by a majority of the Board. There being no further business to come before the meeting , it was unanimously resolved to adjourn at 10 o'clock P. M. to meet again on July 6th.
