The meeting was called to order by Supervisor 171andeville , at 8®15
o 'clock P. I . (Eastern Standard Time)

Supervisor Yandeville said that the Board would dispense with the
regular order of business and hear first from the citizens present
who apparently wished to address the Board. He then asked who would
do the talking for the group.
I1Sr. "lilliam S. Brill , an attorney , stated that he represented the
people present , but he thought his statement sr.ould be preceded
by a statement from IFr. Delius , the Town Attorney , with respect to
petitiorscrhich had been filed with him.
Mr . Delius presented the petitions which w ere read by Supervisor
Mandeville.
Mr . Brill then stated that his principal object in appearing before
the Board, was to impress the Board with the necessity of instituting
injunction proceedings against the owners of this property known
on the Tay Assessment Trap as Block 132 , Parcel 73 , for conducting
business in violation of the Zoning Ordinance. Yr. Brill went
on to say that an Assumed Name Certificate had been filed in 1947,
to operate an automobile repair business at Teo. 6 Fifth Avenue ,
which is the address of the premises in question. He also said that
he had written to the Bureau of VTeights and Pleasures of V7estchester
County and they had reported that they had made an inspection of
the gasoline pump located at these premises and inspections are only
made when gas is publicly sold.
Mr . Giacomo stated that he had received permission from Town Engineer
Foote and Fire Chief Burton to store his gas in this pump and that
it was not for sale.
Pictures showing the condition of this property were submitted to
the Board by h1.r. Donald W. Hobbs of 97 Madison Avenue.
I4r. PTilliam J. Idle.Villiams , an attorney , stated that he represented
Piichael and Patsy Giacomo and Joe Ferreira. Mr. Yc7iiliams said
that the Giacomos had done repairing on the Town garbage trucks
as far back as 1920 before there was any zoning ordinance and as
early as 1935, Patsy worked for his father in his garage at that
location. 177hen the tear came , all the boys went into the service
and during the war , there was very little business.
A woodworking shop was put in the tyro-car garage but the old-
timers still brought their cars there , even during the war. There
was never any abandonment of the business.
Mr. IIA0!illiams stated that he had written to Mr. Delius to offer
a suggestion that he hoped might lead to an amicable solution.
His suggestion was that the garage might be moved to land belonging
to Patsy Giacomo and located on the corner of Fifth and Madison
Avenues.
Dir. Patsy Giacomo told the Board that the business had been started
by his father many years ago and had continued up to the _present
date. He said , as a little boy, he �,?orked for his father in the
garage.

Supervisor Piandeville suggested that 11r. ilc':'iilliams and Ir. Brill
try to come to some agreement and then appear again before the
next Board meeting which will be 1,Iarch 16th, The Supervisor said
that no action would be taken on the matter at this present meeting
and assured them that the members of the Board would inspect the
property in question.

to the business:

11r. Robert S. hiacCallum complimented the Board on the very excellent
snow removal job which had been done after the recent snow storm®
Supervisor Mandeville thanked those present for coming.
The Supervisor introduced Yr . Monroe J. Cahn, an attorney , who wished
to address the Town Board on behalf of his clients , Larchmont
Properties , Inc. , Harris Holding Corp. , and Joseph Harris.
INr. Cahn said he had received from hir. Delius , a proposed form of
agreement as to what would be necessary for his clients to do in
order to have the permit reinstated. He said his clients would do
all things mentioned in the agreement but he wished to ask, as a
matter of favor , if the Board would permit wooden doors to be
installed instead of steel doors. He further stated that the
wooden doors would meet all the requirements involved in the fire
--- hazard and would substantially reduce the expense to his clients.
Supervisor, ITandeville said that , in his opinion, the metal doors
as far as fire stops are concerned, are more important than the
stairs , and he felt the proposed agreement should be adhered to,
as written.
Members of the Board asked various questions and discussed this
matter fully and it was the general opinion of the Board that the
agreement , as submitted , should stand.
Er. Cahn thanked the Board members for their consideration.
The minutes of the meeting of January 19th , 1949 , were ap?roved as
amended.
A letter dated February 17th , 1949, was received from Fordhen Tran-
sit Co. , Inc. , together with their check in the amount of $250.69 ,
which represents 3% of the proportion of the gross receipts derived
from their through route of which the Town of Mamaroneck owns a
part. The letter was ordered received and placed on file.
The Town Clerk reported that he had a request from the Village of
Larchmont and one from the Village of Namaroneck for the use of
our election equipment for registration and election days. On

be granted and that they be permitted the use
of the Town' s election equipment for registration

The Town Clerk presented reports received from the County Transpor-
tation Company, Inc. , for the 6 months ending December 31st , 1948 and

a report ending December 31st , 1948, rrepared in accordanceiwith
paragraph 25 of the Franchise granted by the Town.

Councilman 7atson read a letter , dated February 11th , 1949, received
from Yr . H. Gt. Thomas of Yorse-Boulger Destructor Company , congratu-
lating I,dr . Foote and his men on the condition of the Incinerator
Plant.
Councilman Matson reported that ??ith regard to the application of the
Fordham Transit Co. , Inc. , the Pine Brook :Association had sent post
cards to its members , asking them to express their orinion in this
matter. He said to date , they had had 74 replies , - 68 were in favor
of the application, 4 were a.gairst it and 2 were not interested.
Mr. Delius submitted his report on the conference held in his office
between representatives of the Fordham Transit Co. , Inc . and the
County Transportation Company. `7ith his report he also submitted
two petitions which the Fordham Transit Co, had delivered to him. A
copy of I!`T. Delius ' report was furnished to each member of the Town
Board. No action was taken on the application of Fordham Transit
Co. , Inc. , because of the absence of Councilman Embury.
In discussing the reinstatement of the building permit for the so-
called Harris apartments , h1r. 14ink asked the Board to stress the fact
that he is still in charge of the project as Special Building In-
spector for the Town of Mamaroneck. After further discussion, the
following resolution was , on motion made by Supervisor Nandeville ,
seconded by Councilman 1"datson, unanimously adopted:
WHEREAS , on the 29th day of September , 1947, there
were filed with the Building Inspector of the Town of
Mamaroneck, by or on behalf of Larchmont Properties , Inc.
as ovaner , certain plans and specifications for the improve-
ment of apartment house buildings or multiple dwellings
known as Units A-1 , A-3 , B-1 , B-2 , B-3 , B-49 B-K, B-6 , B-79
B-8, B-99 B-109 B-129 B-13 , and B-14, Richbell Road, south-
east corner of Palmer Avenue ,. Town of Mamaroneck, pursuant
to the Building Code of the Town of Mpmaroneck, and appli-
cation made for the issuance of permits under said Building
Code to construct such improvements ; and
VdHERFAS , after due consideration the Build.irF- Inspec-
for of the Town of Plamaroneck did, on the 29th day of Decem-
ber , 1947, duly issue permits dos. 2246 , 22479 2248, 2249
-- and 2250, authorizing the construction of such improvements
in accordance with such plans and specifications; and
?'TEREAS , thereupon such improvements in accordance
with such plans and specifications , were duly proceeded
with by said owner; and

HEREAS , during the course of
such constru.ction,
the Building Inspector , under the direction of this Town
Board, did notify the said ourer that said plans and specifi-
cations did not comply erith the requirements of the Building
Code with respect to the interior stairs , platform and stair
enclosures and demanded that certain changes be made with
respect thereto; and
WHEREAS , at a meeting duly held on the 9th of
February, 19499 the Town Board revoked the permits above
- referred to, pursuant to the provisions of the Building
Code of the Town of Mamaroneck, upon the grounds that the
plans and specifications submitted in connection �,ith the
granting of such permits , failed to comply with the provi-
sions of the Building , Code , and upon the further ground that
these multiple dwellings or parts thereof , had been erected
in violation of the provisions of the Building Code in sr_ite
of notification of such violation, given to the owners
and builders , by Charles F. T;Tink, Special Building Inspec-
tor of the To7:,n of 11,1amaroneck9 and
THERLAS , Larch-raont Properties , Inc. , Harris Holding
Corp. , and Joseph Harris have made an offer in writing to
this Board for its consideration and approval , and for the
purpose of obtaining a reinstatement of the aforesaid
building permits , which offer was submitted to this Board
at its meeting held T4arch 2nd. , 1949 , together with a plan
entitled "Typical Stairhall , Richbell Road and Palmer
Avenue" ,
NOV1, THEREFORE , BE IT
- RESOLVED that this Board does hereby accept
such offer and approve the plan for the
typical stairhall.
FURTHER RESOLVED that the plan is hereby
considered as an amendment or modification
of the plans heretofore filed in connection
with the granting of permits Nos, 2246 ,
2247 , 2248, 2249 and 2250 , and that the
several items set forth in the offer made
by Larchmont Properties , Inc. , Harris Hold-
ing Corp. , and Joseph Harris , be considered
as additional and supplemental specifications
in connection with the said plans and per-
mits , and it is
FURTHER RESOLVED that the resolution hereto-
fore adopted on February 9th , 1949, revoking
permits granted to Larchmont Properties , Inc. ,
is hereby rescinded and the permit as hereby
amended and modified , reinstated upon the
express agreement and condition that fur-
ther construction be strictly in accordance
with the plans and. specifications as hereby
modified and amended , and it is
FURTHER RESOLVED that Charles F. Link,
Special Building Inspector , is authorized,
pursuant to Section 19-a of the Building
Code to modify the requirements of the
Building Code , insofar as the same may
be necessary to permit the construction of
the said multiple dmrellings and the com-

pletion thereof, pursuant to plans and
specifications as hereby amended and
modified, the welfare of the public and
interests of said owner being promoted
thereby, and it is
FURTHER RESOLVED that all construction con-
tine to be supervised by and subject to
the approval of Charles F. Yink, Special
Building Inspector of the Town of Mamaro-
neck, and that he is granted all necessary
power and authority to enforce compliance
with the plans and specifications as hereby
modified and with the terms of this resolu-
tion, and upon completion of the construc-
tion, in compliance with this resolution, a
Certificate of Occupancy with respect thereto
shall be issued.
Supervisor Mandeville thanked 1,1r. Pink for his patience and indul-
gence and asked Chief Burton if he were satisfied with the arrange-
went or agreement. Chief Burton replied that he was satisfied.
Councilman McKeever reported that he had investigated the sewer
project which Mr . Ciancuilli had presented to the Board at its
meeting of February 2nd, Councilman KcKeever said that it was
Pair. Foote 's recommendation that the sewer be installed as ori-
ginally proposed by Yr. Ciancuilli.
Councilman McKeever also reported that he had attended a meeting of
the plumbing inspectors and that they had requested a change in the
Plumbing Code to permit the use of asbestos cement pipe for house
sewers.
Upon motion by Councilman McKeever , seconded by Councilman Mills ,
_ it was unanimously

PUBLIC NOTICE
PLEASE TAKE NOTICE that the Town Board of the Town
of Mamaroneck will hold a public hearing at 8;15 o ' clock P. M.
on P,Iarch 16th, 1949, in the Council Room of the Irieaver Street
Fire House on Weaver Street in the Town of Ida.maroneck, for the
purpose of considering amendments to the Plumbing Code of the
Town of Mamaroneck, which amendments are as follows;
(1) Amending Article IX, Article X and Article
XII , so as to permit the use of asbestos cement pipe for
house sewers from buildings discharging into public sewers ,
cesspools , vaults , or septic tanks and providing for the
connection of such house sewers , where asbestos cement pipe
is used, to cast iron, steel, wrought iron or tile pipe.
(2) Amending Article XII, Section 165, so as
to provide that all house sewers from buildings discharging
into public sewers , cesspools , vaults and septic tanks ,
shall be not less than 4" in diameter instead. of 5' in
diameter.
(3) Repealing Article XII , Section 1719 which
provides that a house sewer in the street shall be laid by
..._._..............._....
the Town at the owner ' s expense and otherwise provides for the
deposit of funds t'rith the Town, to cover the estimated cost.

Councilman Mills presented a list of claims for Fire Department
expenditures and stated that he had checked the bills and recom-
mended approval and payment .
The members of the Town Board , sitting as the Board of Fire Com-
missioners , considered the claims and on motion by Councilman
Mills , seconded by Councilman Watson , it was , upon roll call,
unanimously

Supervisor Mandeville reported that the Town had received the
plow for the F. W. D. truck and a hydraulic lift for the snow
loader.
The Supervisor asked for a resolution transferring 81 ,220.35
to cover the cost of paving Lan cia Lane.
Upon motion made by Councilman 14cKeever , seconded by Councilman
Mills , it was unanimously
RESOLVED that for the purpose of paying for the
paving of Lancia Lane , the sum of $1,220.35 be
transferred from Surplus General Town to the
Highway Budget for the year 1949, Item IV ITis-
cellaneous .
The Supervisor reported that the Receiver of Taxes had requested
the usual resolution which must be adopted at this time of the
year , to provide for the method of collection of taxes .
On motion_ made by Councilman Watson, seconded by Councilman
McKeever , it was , upon roll call ' unanimously
RESOLVED that pursuant to Section 96A of Chapter 60
of the Consolidated Laws as amended, known as the Tax
Law, the Receiver of Taxes and Assessments of the Town
of h1a.maroneck is authorized to collect the 1949 State ,
County , Town and District taxes and grater rents which
become a lien Jan. 1, 1949, in two partial payments ,
each amounting to fifty per cent of the total of said
taxes and water rents ;
FURTHTJR RESOLVED that the Receiver of Taxes and
Assessments is authorized and empowered to receive
such partial payments or instalments of -taxes and
grater rents at any time prior to the sale of tax liens
but subject to the same penalties as are specified
and rrovided in Section 542 of the Westchester County
Administrative Code for the neglect to pay the total
amount of said taxes and water rents ;

The meeting was called to order by Supervisor Handeville at 8015
o 'clock P. P,I. (Eastern Standard Time)

The Supervisor suggested to the members of the Board that they in-
spect the auditorium of the Fire House as it has been completely
redecorated , and that they might visit the Town Offices which have
also been redecorated.
The Supervisor next took up the question of the disposition of
rubbish as 11r. hlacAvoy was present at the meeting in connection
vaith this question, and Mr . Mandeville said he did not wish to
keep him any longer than necessary.
The Supervisor stated that the cost of labor for picking up rubbish ,
has risen from 81 , 578. in 1946 to 55,059. in 1948. He further �
stated that notices had been sent to all residents of the Town in-
forming them that rubbish would be collected on the lst and 15th of
each month and that such rubbish must be on the curb, in containers ,
ready for these collections . The Supervisor went on to state that
at the Present time there are about 30 dwellings where there are
piles consisting of anywhere from two wheelbarrows to two truck-
loads of rubbish, waiting for collection and it would take four
trucks with a loader , about a day to collect all this rubbish.
The members of the Board discussed this situation and it was the
unanimous orinion of the Board that the Town Clerk should write to
Police Chief verick, informing the latter that the Town Board wrishes
the Police Department to enforce the provisions of Chapter VII, Sec-
tion 3 of the General Ordinances of the Town, which provisions Per-
tain to the disposal of rubbish.
It was suggested that a police officer s'-ou.ld visit each of the
violators of the Ordinance and leave with each one , a printed
notice pertaining to the collection of rubbish and also inform
them of the Provisions of Chapter VII , Section 3 of the General
Ordinances .
The minutes of the meeting of February 2nd , 1949 , were approved
as corrected.
The minutes of the meetings of ITarch 2nd and 16th , 1949 , were approved
as Presented.
The Town Clerk presented an affidavit of publication of notice
requesting bids for 58 pieces of 1" steel , varying from 3 ' to 10 '
in length , and weighing approximately 850 pounds .
The Town Clerk reported that one bid had been received from New
Rochelle Construction Co. , Inc . , in the amount of 880.
On motion made by Councilman McKeever , seconded by Councilman
Embury , it was unanimously
RESOLVED that the bid of Few Rochelle Construc-
tion Co. , Inc. , in the amount of x;80. for 58
pieces of 1" steel, varying in length from 3 ' to
10 ' and wreighing arproximately 850 pounds , be
and it hereby is accepted.

Supervisor IMandeville reported that the Town had received the
ploy for the F. W. D. truck and a hydraulic lift for the snow
loader.
The Supervisor asked for a resolution transferring 51,220.35
to cover the cost of paving Lancia Lane.
Upon motion made by Councilman TrcKee-ver , seconded by Councilman
Mills , it was unanimously
RESOLVED that for the purpose of paying for the
paving of Lancia Lane , the sum of $1,220.35 be
transferred from Surplus General Town to the
Highway Budget for the year 1949, Item IV His-
cella.neous .
The Supervisor reported that the Receiver of Taxes had requested
the usual resolution which must be adopted at this time of the
year , to provide for the method of collection of taxes.
On motion made by Councilman Tatson, seconded by Councilman
McKeever , it was , upon roll call , unanimously
RESOLVED that pursuant to Section 96A of Chapter 60
of the Consolidated Laws as amended. , known as the Tax
Law, the Receiver of Taxes and Assessments of the Town
of h.arnaroneck is authorized to collect the 1949 State ,
County , Tolmn and District taxes and vrater rents which
become a lien Jan. 1, 1949 , in two partial payments ,
each amounting to fifty per cent of the total of said
taxes and iwater rents ;
FURTT'p:R RESOLVED that the Receiver of Taxes and
Assessments is authorized and empowered to receive
such partial payments or instalments of -taxes and
grater rents at any tirie prior to the .sale of tax liens
but subject to the same penalties as are specified
and urovided in Section 542 of the V!lestchester County
Administrative Code for the neglect to pay the total
amount of said taxes and water rents ;

FURTHER RESOLVED that the acceptance of any such partial
payment or instalments of the 1949 taxes and crater rents
shall not be deemed to affect in any manner , any right of
the Tocan of !?r .maroneck under any General or Special Law
to enforce collection of any unpaid balance of such taxes
and water rents as may remain due and owing to the Town
of P'amaroneck but such rights and powers shall remain in
full force and effect to enforce the collection of the
unpaid balances of such taxes and water rents together
v,rith interest penalties and other lawful charges .
On motion by Councilman 113atson, seconded. by Councilman McKeever ,
it was , upon roll call , unanimously
RESOLVED that in accordance Frith the provisions of
Section 550 of the Westchester County Administrative
Code , "The Daily Times" , the official newspaper published
in the Village and Town of P1ariaroneck be and it hereby
is designated as the newspaper in which the Receiver of
Taxes and Assessments shall publish the notice of the
collection of State , County, Toren and District taxes ,
and water rents° and be it
FURTFER RESOLVED that said publication be made on
P:Iarch 10, 1949 , in the Daily Times* and be it
FURTHER RESOLVED that in accordance ? ith the provisions
of Section 550 of the Westchester County Administrative
Code , the TO4Yn Board. do and it hereby does direct the
Receiver of Taxes and Assessments to mail to each tax-
paver of the Town of Ya.riaroneck, whose address is known
to said Receiver of Taxes and Assessments , a tax bill
for all taxes and water rents , the expense thereof to be
a town charge.
FURTHER RESOLVED that pursuant to Section 551 of the
T°Testchester County Administrative Code , the Tozrn
Board hereby ap-roves the official form of tax
receipt used by the Receiver of Taxes in the year
1949 for taxes for the year 1949.
Supervisor Ilandeville read a letter , dated February 15th , 1949,
received from the Board of Education, requesting the Supervisor to
borrow and pay to the Treasurer of the Union Free School District
No 1, Town of 'Mamaroneck, the balance of the School taxes due
for the -Tear 1948-1949. He also presented a certificate from the
Receiver of Taxes stating that the amount of taxes remaining
unpaid as of 114 rch 1, 1949 for School District -1 , is $38 .192. 55
and School District No. 2 is 8308.21. He said that it was esti-
mated that $38 ,498.76 should be borrowed.
Councilman Watson introduced the following resolution:

Section 1. In anticipation of the receipt of unpaid school
taxes for the fiscal year beginning July 1 , 1948 and ending June
30, 1949 and for the purpose of providing moneys to pay to the
Treasurers of Union Free School District No. 1 and School Dis-

trict No. 2 , the amount of unpaid school taxes , the Supervisor
is hereby authorized and directed to issue a Tax Anticipation
Note of the Town in a total principal amount not exceeding
$38 ,4998.76 pursuant to Section 555 of Chapter 852 of the Laws
of 1948 of the State of New York, and pursuant to Section 24.00
of the Local Finance Lahr of the State of New York.
Section 2. It is hereby determined and declared:
(a) The total amount of school taxes levied in said Town for

said fiscal year is School District No. 1 - 81,242 ,861.88; School
District Pao. 2 - $18,235.91;
(b) The total amount of said taxes due and unpaid is: School
District No. 1 - $38 ,192. 55; School District No. 2 - 8308.21;
(c) The total amount heretofore borrowed and outstanding in
anticipation of the collection of said taxes is none.
Section 3. The note issued under this resolution shall be dated
April 1 , 1949 and shall mature on September 1 , 1949 , and the date
of maturity of such note or any renezaal thereof shall not extend
beyond the close of the applicable period provided in Section
24.00 of the Local Finance Law of the State of New York for the
maturity of such notes .
Section 4. The Supervisor is hereby authorized to determine the
interest rate and all other matters in connection herewith not
determined by this or subsequent resolution and his signature upon
said note shall be conclusive as to such determination. The note
issued hereunder shall be substantially in the form of "Elodel
Form of Note Pa.vable to Borrower" set forth in Schedule B of the
Local Finance Law of the State of New York and shall be signed
by the Supervisor and countersigned by the Town Clerk and shall
have the seal of the Town affixed thereto.
Section 5. The Supervisor is hereby further authorized to issue
said note and to borrow the principal amount thereof as hereby
determined from the reserve fund resulting from moneys recoeived
from the redemption of transfers of tax liens as provided. in
Section 556 of Chapter 852 of the Laws of 1948 as amended.
Section 6 . The faith and credit of the Town of Mamaroneck are
hereby pledged for the punctual payment of the principal of and
interest on said note and unless otherwise paid or payment pro-
vided for , taxes shall be levied on all of the taxable property in
said Town in an amount sufficient to pay said principal and interest.
The foregoing resolution was seconded. by Councilman PcFeever and
adopted by the follo?wing votes

Chief Burton_ submitted his annual report for the Fire Department.
He stated that the fire equipment is in excellent condition and
that this is the 10th consecutive year that the estimated damage
in the Tovm outside of Villages has been under $10,000.

Following discussion, on motion by Councilman I.Tills , seconded by
Councilman Watson, it i^uas unanimously
�/ PMSOLVFD that the bid of Frank Valle , in the
amount of '975® for painting the auditorium of
_- the Weaver Street Fire House , in accordance with
specifications submitted by Chief Burton, be and
it hereby is accepted.
The Supervisor complimented Chief Burton on the excellent job which
the Fire Department has done during the past year and praised the
men for their attendance at fires and drills .
Councilman Ifills reported that he had talked with Village P;ana.ger
Vi1illiam H. Johnson -�lith regard to the possibility of the Town' s
defraying a part of the cost of dredging certain portions of
the D,'amaroneck Harbor , in order to make more space available
for moorings. He said he would obtain further information
concerning this project and submit it to the Board at its
next meeting.
There being no further business to come before the meeting , it
adjourned at 10:30 P. M. to ,meet again on March 16th.
