HomeMy WebLinkAbout1949_01_19 Town Board Minutes 55T MINUTES OF PUBLIC HEARINGS AND A REGULAR IEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK,' HELD JANUARY 19th, 1949 , IN THE COUNCIL ROOM OF THE WEAVER STREET FIRE HOUSE. The meeting was called to order by Supervisor I+Iandeville at 8 :15 o' clock P. N. (Eastern Standard Time) PRESENT: Supervisor Mandeville Councilmen: Embury, Watson, Mills and McKeever ABSENT: None Presence was also noted of Town Attorney Delius , Town Clerk Gronberg and Town Accountant Firaon. Supervisor Mandeville stated that the Board would proceed with the matter of the public hearing on the application of Fordham Tran- sit Co. for a franchise to operate buses over certain streets in the Town. The affidavit of publication of the notice of public hearing was presented and read to the Board. Letters were read from the following, who were in favor of granting the franchise : Mrs . Ruth Green, 9 Cliff Way, Larchmont; N. Y. P>Irs . Richard T. Vandewater , 7 Cliff Way, Larchmont, N. Y. Mr. James M. Lynch, Chatsworth Coal & Supply Company, Larchmont, N. `L. . The Supervisor asked if there was anyone present in opposition to this application. PIr. Frank J. Zwick, Counsel for the County Transportation Company' said he wished to register a protest on behalf of the County Transportation Company, The Supervisor then asked if there was anyone present who wished to register support of the application. The following spoke in favor of the application: Mr . Stanton B. Fisher , 76 Harding Drive, New Rochel-l6 , N. Y. Mr. Lucien Theyskens , Shadow Lane, New Rochelle-, N. Y. Mr, Luther Hawley, Harding Drive, New Rochelle, N. Y. Mr, Lewis H. Mayer , New Rochelle, N. Y. Mr. Sol Paseltiner , Attorney for Fordham Transit Co. . Mr. Burnett, a member of the New Rochelle Transit Commission. Supervisor Mandeville asked Mr. Zwick if he would withdraw his objection if the Fordham "Transit Co. would stipulate to operate their buses with closed doors from the intersection of Palmer Avenue with Larchmont Avenue , to the Larchmont Station. Mr, Zwick stated that he would still wish to register a protest. The Supervisor then stated that, with the permission of the Board, he would like to reserve decision and would suggest that a conference be arranged between Mr. Zwick, Pir. Paseltiner and Mr. Delius , the Town Attorney; P,Lr. Delius to report to the Board — at its next meeting. The Board next proceeded to the public hearing on the matter of re-zoning Valley Place. The public notice was read and the affidavit of publication of the notice was presented to the Board. The following registered their approval of the change in zoning from Class C, to Class A-2: 5 William DeAlleaume, 22 Valley Place, Larchmont -rsa -Gertrude DeAlleaume Joseph DeAlleaume , 20 Valley Place, Larchmont Lacey Irving and wife, 59 Pleasant Street, New Rochelle Joseph Barr and wife , 24 Valley Place, Larchmont No one appeared in opposition to this change. After discussion by the Board, upon motion made by Councilman Watson, seconded by Councilman McKeever , it was 9 upon roll call, unanimously RESOLVED that the Amended Area District Map which is part of the Zoning Ordinance of the Town of Mamarc- neck as amended, is hereby amended and corrected so as to show the following described property in Use, Area and Height District A-2, Residence: All that lot, plot or parcel of land designated as Lots 193 , 192, 1917 190, 189 188 , 187, 1869 185, 184, 183 , 182 and parts of Lots Al and 180 on Map entitled, "Map of Fifth Avenue Park in the City of New Rochelle, N. Y. , belonging to Frederick Lcrenzen" , surveyed August, 1906 by W. L. Mr. Roark representing the General Electric Company and Mr. Eaves representing Motorola Corporation, appeared before the Board in connection with the purchase of a radio communication system for the Police Department. 555!, The Supervisor thanked both for coming. Mr. Gordon Bradford, representing General Fireproofing Company, appeared before the Board and stated' in connection with his bid to supply new furniture for the Torn Offices , that he was not in a position to make an allowance for the old furniture which is to to taken in trade, but that he would offer his personal check in the amount of $250. for the old furniture. The Board then proceeded with the regular order of business. The minutes of the meeting held December lst, 1948, were approved as presented and the minutes of the meeting held December 29th, 1948 were approved as corrected. A letter, dated January 18th, 1949, was received from Chief Paul Yerick, requesting approval of permission granted by the Police Commission, to Sergeant Louis Boivin to attend a two-day conference of the Associated Police Communications Officers . On motion made by Councilman Embury, seconded by Councilman McKeever , it was unanimously RESOLVED that Sergeant Louis Boivin be and he hereby is authorized to attend a two-day conference of the Associated Police Communications Officers ; to be held at Elizabeth, New Jersey, on January 21st, and 22nd. FURTHER RESOLVED that the Comptroller is hereby authorized to audit the claim for the expenses of the trip in an amount not to exceed $25. said amount to be paid out of the Police Department Budget. A letter dated December 3ldt, 1948 , was received from Mr. Edward F. N. Uthe, Executive Secretary of the Association of Towns of the State of New York, giving notice of the annual meeting which will be held in New York City on February 16th, 17th and 18th. Also en- closed was a Certificate of Designation for the Town' s voting dele- gate and alternate at this meeting. On motion made by Councilman Mills , seconded by Councilman Watson' it was unanimously RESOLVED that Town Attorney Delius , Town Clerk Gronberg , Town Accountant Finson, Comptroller Orsino, and Town Engineer Foote or his designee be and they hereby are designated and authorized to represent the Town of Mamaroneck at the annual meeting of the Association of Towns of the State of New York, to be held in New York City on Febru- ary 16th' 17th and 18th, 1949; and be it i FURTHER RESOLVED that the Comptroller is hereby authorized to audit their claims for the expenses of the trip , said amounts to be paid out of the items in the respective budgets for "travelling expenses" . A letter dated January 3rd, 1949' was received from Miss Lillian E Ravenscroft, 121 Fisher Avenue , White Plains , N. Y. Supervisor Mandeville suggested that a copy of this letter be sent to the members of the Board. Councilman Fmbury stated he had nothing to report for his depart- ments. Supervisor P,Tandeville requested a resolution approving the Town' s sale of property at the auction held January 3rd. , 1949. The Supervisor stated that he had an offer from PIr. Tibor H. l"all 802 West 19th Street , Nei,', `fork City, for the purchase of property known as Block 614, Parcel 407 on the Tax Assessment Yap , this being one of the parcels acquired by the Toren of Namarcneck in the fore- closure proceeding in rem (List of Delinquent Taxes , 1947) . He. stated that 11r. Wall had recently purchased the property adjacent to this small strip and had , at the time , been under the impression that it was part of the property which he purchased. For this reason, he desired to purchase the same from the Toyrn and made an offer of �>50. On motion by Councilman Embury, seconded by Councilman Watson, it was unanimously RESOLVED that the offer of Tibor H. Wall to purchase property known as Block 614 , Parcel 407, on the Tax Assessment Map of the Town of L1a ,aroneck for X50. , be accepted and that the Tovrn Attorney is hereby directed to prepare the necessary papers and the Supervisor is hereby authorized to execute and deliver the same to Tibor H. ':'Tall upon payment of 550. Supervisor- Mandeville requested approval of the Town' s continued membership in the Association of Towns. On motion by Councilman ?;Matson, seconded by Councilman Mills , it was unanimously RESOLVED that the Town of 1Ianraroreck continue its membership in the Association of Towns of the State of New York, for the year 1949 , and that the annual dues of $107. be paid out of the item set aside for this purpose in the 1949 Budget. The Board took up the matter of awarding the contract for the purchase of radio equipment for the Police Department ,bid.s for r7hich were sub- mitted to the Police Commission and opened by them and then referred to the Tovm Board for action, at its last meeting. Councilman `;atson suggested the purchase of an emergency generator as standby equipment , to be used in case of power failure . Bradford , salesman) After detailed discussion by the Board of relative prices and quality of the equipment , it was , on motion by Councilman McKeever , seconded by Councilman Embury, upon roll call, unanimously RESOLVED that the Town purchase the equipment set out in the estimate of Olson & Gordon, for a total sum of $2 ,455.10. The Supervisor presented bids for painting the exterior of the Police Station as follows : Frank Valle $ 550.00 Otto Plaue 560.00 R. A. Braithwaite 650.00 Bloes Bros . 1,243.00 On motion by Councilman Mills , seconded by Councilman T",'atson, it was , upon roll call , unanimously RESOLVED that the contract for painting the exterior of the Police Station on Edgewood Avenue in the Town of Mamaroneck, be awarded to Frank Valle at a total price of X550. for which he has furnished his esti- mate to this Board-. Councilman IcKeever reported that they are now dumping the residue from the Incinerator on property located on the Boston Post Road. The Town Attorney stated that after a trial before Judge _Young , in People ex ref Westchester Religious Institute v. Smith, he had made a decision and findings that the property of the Westchester Reli- gious Institute , known on the Tax Assessment Map of the Town of IJamaror.eck as Block 953, Parcel 1, Block 947 , Parcel 1 , and Block 948 , Parcel 73 , is exempt from tax on the ground that it is occupied and used , or intended to be used for re7_igious and educational purposes. This applies to all taxes other than the Eamaroneck Valley Sever Tax. Mx. Delius also discussed with the Board , the situation with re- gard to the proceedings affecting the assessment on the Colony Apartment (People ex rel Hummel , et al v. Smith , et al) and recom- mended that an appeal be taken from the decision of Judge Young_ affecting the years 1942 to 1947 inclusive , which reduced the i assessed valuation of the Colony Apartment to X327,795. He stated further that he believed the rroceedings to reduce the 1948 assessed valuation could not be successfully prosecuted. unless the Appellate Division, on an appeal , would fix a higher valuation than that found by Judge Young for those preceding years. After some discussion, during which P?r. Delius stated that the cost of printing the record on appeal would a-r)Troximate 5900. , the Board instructed him to abandon the appeal but to proceed with the trial of the 1946 proceeding. 1..7ith respect to other pending certiorari proceedings for 1948 , the Attorney was authorized to expend up to 550. per parcel for pre- liminary appraisals. The Town Attornev Presented an easement agreement between Rock- ledge Holding Corporation and the Town Board , acting as Sewer Commissioners in Sewer District N1o. 1. This is an agreement covering a 10-foot strip :which has been used as an access drive from Rouken. Glen West Drive to the property of Creamer , Wheelock I 077 i and Morris . He stated that the Town Engineer had reported to him, after investigation, that there had been constructed in this strip , an &-inch sanitary sever ripe and he , therefore , considered. it ad- visable for the Town to enter into this easement agreement 7ith Rockledge Holding Corporation, the owner of this strip. He pre- sented a form of agreement which had been signed, by C . W. P%oody as President of Rockledge Holding Corporation, and recomrend.ed its approval. Upon being duly moved and seconded, it was unanimously RESOLVED that this agreement be approved a.nd that the Supervisor and 1_embers of the Town Board acting as Commissioners of Sewer District No, 1 , be and. they hereby are authorized to sign this agreement® At 11:05 P.
