Presence was also noted of Town Attorney Delius and Town Accountant
Finson, Town Clerk Gronberg being confined to his home because of
illness.
In the absence of 2,Tr . Gronberg, 11r. Finson served as Acting Town
Clerk.

A letter dated December 2nd. , 1948 , was received from Dr. Elsworth
Smith , advising the Board that he is now living in 11adison , Connec-
ticut and, therefore , will be unable to serve on the Board of Plumb-
ing Examiners after the expiration of his present term.
The Town Clerk was instructed to acknowledge the letter with regret.

I am sorry that I have not been able to answer
sooner your highly treasured letter . I am deeply grateful , both to
you personally and to the members of the Town Board for your most
kind and generous remarks .
It is difficult to tell y ou hog.* proud I am of the
letter and to learn that you and your board held me in such high
esteem. I am harpy to knoi�,r that my s°rvices while with The Daily
Times ,1Tere of some value. I fully realize , however , that whatever
I did accomplish was not without the unstinted cooperation f rom
you and the members of the Board..
In the many assignments that I covered I cannot
think of any that gave me more pleasure or VTas more enjoyable. I
deem it an honor and a privilege to have been so closely associated
with you.
The Town of 11amaroneek, in my opinion, is indeed
fortunate in having an outstanding and untiring leader such as your-
self as well as a board comprised of the Totr,n' s ablest men. I think
that the spirit , character and ability of the Town Board is reflected
throughout the various departments of the To,rrn and it was also my
pleasure and privilege to have worked ??ith many of the department
heads and personnel.
While the Town of Mamaroneck is undoubtedly the
finest in all of 7,1estchester , I must admit that it does not quite
compare :rrith the charm and beauty of Bermuda. I hope you will
forgive me for slipping in this 'plug ' for Bermuda., but after all
that ' s what I am here for. na
May I again express my thanks to you and the boas/
though belatedly , Trish you all a very Yerry Christmas and a Happy
New Year.

from the said Fordham Transit Co. , Inc . , pursuant to Article V of the
Transportation Corporations Law of the State of Nets,' York, for the
-right , consent and permission to operate omnibuses in the Town of
Pamaroneck , F. Y. , over , upon and along certain streets in the
Town.

TAKE NOTICE that a public hearing will be held by the

19499 at 8:15 o 'clock in the evening of that day in the Council
room of the Pdeaver Street Fire House , 17eaver Street in the Town
of Aamaroneck, for the Purpose of considering the application of
Fordham Transit Co. , Inc. , for the consent of the Town of D:Tamaro-
neck, under the provisions of Sections 66 and 67 of the Transpor-
tation Corporations Law of the State of New York, for the opera-
tion of motor buses or omnibuses for transportation of passengers
and property carried by said passengers for hire , in, upon, along
and across certain streets , avenues and highways in the Town of
Mamaroneck, along the following routes:
BEGINNING at the bound.ary line of the City of
New Rochelle and the Tom of Mae,aroreck on Palmer
Avenue; thence along Palmer Avenue to the boundary
line of the Town of Mamaroneck and the Village of
Larchmont , and return over the same route to the
point or place ofleginning.
BEGINNING at the boundary line of the Village of

Avenue; thence along Chatsworth. Avenue through the
Mamaroneck Town Park, along Vine Street , Myrtle

The above being parts of a through route

lic hearing is to consider the granting of such consent for the use

the members of the Town Board that after December 31st , 1948, mrs .
Katherine Dolan would no longer be associated -vaith the 1.11amaroneck
Health Center as Public Health Nurse .
The report of the December , 1948, meeting of the Examining Board
of Plumbers of the Town of 1,1amaroneck was received and ordered
placed on file .

Supervisor Mandeville presented the bids and -ter discussion, they
were referred to Councilman 7,atson for study.
A letter , dated December 8 , 1948, was received from the Superintendent
of Highways, h1r. A. J. Footer ecommendirg the purchase of a Hough Pay
Loader . An affidavit of publication of notice given in compliance with
Section 142 of the Highway Law and affidavit of publication re notice
to bidders for the purchase of a Hough Pay Loader were presented.

A letter , dated December 28 , 1948 ,was received from Gillette-Bell
Industrial Corporation, offering to sell to the Town of Iviamaroneck,
one Hough Pay Loader , No. 15332 , complete with bucket , set of bucket
teeth and blade and crane hook, complete andcblivered for the sum of
$5,500.
Following discussion, on motion by Councilman NTcKeever , seconded
by Councilman Embury , u„on roll call , the following resolution was
unanimously adopted:
WHEREAS , the Town Superintendent of Highways did, on
December 8, 1948 , duly recommend the purchase of certain highway
equipment , pursuant to the provisions of Section 142 of the High-
way Lava, and a notice of such recommendation has been duly pub-
lished as provided in such section,

RESOLVED that , pursuant to Section 142 of the High-
way Law, the Town Superintendent of Highways is hereby
authorized to purchase one Hough Pay Loader , No. 15332 ,
complete with bucket , set of bucket teeth and blade
and crane hook, complete anddelivered for the sum of
$5,500.
Councilman 7atson , reporting on the re-zoning of Valley Place , stated
that he and Councilman R.TcKeever had inspected this area. He said
that one side of Valley Place is located in the Town of T:Tamaroneck
and the other side is in the City of New Rochelle , the New Rochelle
side being zoned for two-family houses to within 100 feet of Fifth

The Supervisor presented his annual report of highway moneys for the
year 1948. On motion made by Councilman Embury, seconded by Council-
man Watson, it was , upon roll call , unanimously
RESOLVED that the Supervisor ' s Annual Report of
Highway Yoneys for the year 1948 be and hereby is
approved.
A letter dated. December 27, 1948, was received from Comptroller
Orsino, requesting authorization to transfer funds within the 1948
Budget and from Surplus Funds. Following discussion, it was , upon
motion by Councilman Embury , seconded by Councilman tlgills, upon roll

Supervisor landeville requested a resolution authorizing the
e:ttension of the street lighting contract with the '";estchester
Lighting Company , upon its present terms except that commencing
November lst , 1948 , any street light which the Town authorizes
installed. , shall be the property- of the Town of Mamaroneck and
will be paid for by the Town although the installation will be made
by the Lighting Company at the price prevailing at the time of
the installation. It is estimated that the street light installa-
tions will cost the Town $35. per light.
After discussion, on motion by Councilman McKeever , seconded by
Councilman 17atson, it was unanimously
RESOLVED that the present contract with the
"Testchester Lighting Company be extended for
one year from November lst , 1948, with the
aforementioned modifications as to fixtures
installed subsequent to November lst , 1948.
The Supervisor stated that he wished to proceed with the matters
of organization.
Councilman _F.mbury moved the adoption of a resolution to approve
the salaries of all Town officials and employees and to appoint
officers and employees for the year 1949. This motion, being
seconded by Councilman 11ills , w as duly adopted as follows :
RESOLVED:
Section 1. That the salaries of all elected
officials and appointed. Town officers of the
Town of Mamaroneck for the year 1949 are to be the
salaries stated and appropriated in the annual
Budget or Estimate for the year 1949 as follows :

Section 3 . That the employment of the last named

with the classifications made by the County Personnel
Officer , under the provisions of the Civil Service Latiu
of the State and any vacancies which now exist or which

Supervisor Yandeville asked Councilman hTills and Chief Burton if
there are any claims outstanding at the present time. Both answered
that there are none except for current bills and the American La.
France bill for aerial repairs.
The Supervisor stated that he had on hand an agreement in triplicate
from the 'Nestchester County Park Commission ,,?hich provides for the
extension of a lease dated- February 13th , 1948 , covering vacant
land situate on Sheet 9 , Pelham Port Chester Parkway , . to be used
by the Town of hTamaroneck for recreational purposes only. On motion
by Councilman Embury , seconded. by Councilman T.JcKeever , it was un-
animously
RESOLVED that the Supervisor be and he hereby is
authorized to sign the Extension agreement which
provides for the extension of the lease dated
February 13 , 1948 , with the Town of Plamar. oneck,
covering vacant land situate on Sheet 9 , Pelham
Port Chester Parkway, known as Parcels 5, 6 , 79 47,
48,57 and portions of Parcels 4 and 46 for the
period of one year beginning January 1st , 194-9 , at
an annual rental of $1, and subject to the terms
of the original lease.
The Town Attorney presented the proposed easement agreement between
the Town of TTa.maroneck and the Town Board- of the TOT-in of Yamaroneck
acting as Commissioners of Sewer District No. 1 and the County of
Tiestchester . Mr. Delius stated that this was intended for a force
main running into the sewer pumping plant ^,Thick originally was a
Town installation but had been conveyed to the Count-, of TJest-
chester9 that this force main had been there for some time but for
some reason the County had never obtained the proper easement.
Upon motion by Councilman Embury , seconded by Councilman '"atson,
it was unanimously
RESOLVED that the Supervisor and Board , acting as
Sewer Commissioners , execute anddeliver to the
County of Tiestchester , the sewer easement as presented.
The Town Attorney presented the claim of Elsie Stein which he stated
had been verified October 16th , 1948 and was made for damages due
to personal injuries caused by her falling in Holly Place , directly
in front of her residence at ITO. 58 Holly Place , The amount of the
claim was 51,200. He stated that the Comptroller had examined the
claimant under the provisions of the Town Law and it appeared she
had lived in the house for 15 years. He also exhibited photographs
of the pavement shoving it to be broken due to erosion , to the extent
that the blacktop had been washed away and the surface is extremely
uneven due to protruding rock, stone , etc. He stated that the
attorney for the claimant had indicated his willingness to settle
the claim upon payment of $600. and after some discussion, the
Board informed Mr. Delius that this offer was not acceptable and no
further action was taken.
Yr. 'Tdallace T.Tiller of Tarrytown, New York and Pair. A. J. Eaves of
Lar.�hmont , New York, representing Motorola , Inc. , asked rermission
to address the Board with reference to their rolice radio equipment.
They explained their equipment and its operation and answered-
numerous questions asked by Councilman Watson. Supervisor Yandeville
informed them that the Town Board was taking no action at this meet-
ing , pending a stud17 of the equipment covered by all of the bids re-
ceived.
Chief Burton appeared and stated that he wished to extend, on behalf
of the Fire Department , congratulations on the snow removal job which
had been done.

Supervisor R?andeville thanked the Chief for his kind remarks .
The Supervisor requested that Chief Burton obtain estimates on paint-
ing the auditorium of the Fire House and expressed himself well-
pleased with the painting which had been done to the lower floor of
the Fire House .
I"r . Alan. Carnoy appeared before the Board in connection with the
development of York Road. He stated he proposed to build 10 or 12
houses and- will put up a bond insuring the Town that he will build 12
houses or in the event that he does not , the Surety Company will pay
to the Town , the cost of the installation of utilities . Supervisor
Mandeville read an estimate of costs in the amount of 817,029. in
connection ievith improvement of York Road as prepared by Town Engineer
A. J. Foote.
Supervisor Mandeville thanked I-Jr . Carnoy and told him that the Town
Board would discuss this matter .
The Supervisor read a letter , dated December 28th, 1948, received.
from Police Chief Paul A. Yerick, in which it is stated that the
Board of Police Commissioners recommend the purchase of a 1949
eight cylinder special police Ford , two door sedan for a price of
;1 ,907.17. The letter further states that a 194-2 Ford sedan would
be traded in, for which an allowance of 5500. would. be made. On
motion made by Councilman T9ills , seconded by Councilman Embury , it
was unanimously
RESOLVED that the Board authorizes the purchase of a
1949 eight cylinder special police Ford, two door sedan
upon the terms stated in Chief Yerick' s letter .
Supervisor Izandeville stated that it had been recommended by Town
Engineer A. J. Foote and Police Chief Paul A. Yerick that a new
street light should be installed on Westchester Lighting Company
Pole No. 2 on Beresford Lane. On motion by Councilman ITcKeever ,
seconded- by Councilman Embury , it was unanimously
RESOLVED that A. J. Foote , Town Engineer , is authorized
to have a street light installed on 71restchester Lighting
Company Pole No. 2 , on Beresford Lane in the Town of
Mamaroneck.
The Board then. discussed informally Mr. Carnoy ' s proposal and amended-
proposal and unanimously decided that they are un?Failling to take any
step which might open the door to expenditures which might jeopardize
the Town' s finances and establish a- new precedent.

The Town Attorney stated that ITr . C . C'I. Moody had indicated a willing-
ness to dedicate to the Town, a so-called "Reserve Strip" about 10
feet wide which has been used as an access drive from Rouken Glen
West Drive to the properties of Kramer , 17heelock and IForris . This
strip originally was assessed to 71heelock but recently , the Assessor ,
upon further investigation, which showed that title remained. in Pock-
ledge Holding Corporation, has assessed it separately against Rock-
, ledge Holding Corporation, and. , thereupon, Mr. Moody made his offer
to deed it to the Town for a street . The Town Attorney stated further
that the strip was not of sufficient width to justify its acceptance
for street purposes but that the Town Engineer had reported that
there was a sewer lire in it . He , therefore , suggested that the Town
might take an easement from I!r. Moody; or the Rockledge Holding Cor-
poration for sewer purposes which would make the property virtually
exempt from tax. Such easement , he suggested, must be made subject
to the rights of passage over the strip. After some discussion,
during which P.Tr. Embury stressed the fact that it must be subject
to the rights of passage to the three property owners who now use it ,
the Town Attorney was instructed to contact P,rr. IToody and report at
the next meeting of the Board., on this matter .
