1948 , IN THE COUNCIL ROCTF AT THE 11;EAVER STREET FIRE uOUTSE.
The meeting was called to order at 8:15 o ' clock P. LT.
There were PRESENT: Supervisor TJhndeville
Councilmen: Embury , Watson, McKeever and

ABSENT : None
Presence was also noted of Toxin Clerk Gronberg, Town Attorney
Delius and Town Accountant Finson.
Supervisor Mandeville said he felt it would be in order to
receive the report of Mr. J. hoods Sweeney , Chairman of the
Committee appointed to study the re-location of the Town Office
and the future use of the auditorium in the "leaver Street Fire
House , whereupon Air. Sweeney submitted the report , which the
Supervisor read to the meeting.
i:Tr. Sweeney said the Committee suggested that the application
blank, attached to the report , was tentative and, if approved
by the Town Board , would probably be studied and possibly altered
to some extent , by the Town Attorney.
Supervisor 15andeville thanked Mr. Sweeney and his Committee on
behalf of the Town Board and said that , though it would now be
- in order to discharge the Committee , he w as not going to dorso,
as the Board would very probably have future work for the Com-
mittee.
Mr. Sweeney said he was sure they would be very happy to co-
operate.
The minutes of the meetings of October 20th and November 15th,
1948 , were approved as presented.
The Town Clerk reported that h-7r. A. J. Foote ,, Town Engineer ,
had recommended the installation of a 1000 Lumens light on
Lafayette Road , as requested by hjx. Rothman in a letter
presented at the last Board. meeting.
On motion by Councilman Embury , seconded by Councilman Mills ,
it was unanimously
RESOLVED that A. J. Foote , Town Engineer , be
authorized to have installed on lighting pole
No. 2 , on Lafayette Road in the Town of Mamaro-
neck, a 1000 Lumens light.
A letter , dated November 26, 1948 , was received from Yr. Munn
Brewer , Chairman of the Zoning Board. of Appeals , with reference
to a petition to re-zone Valley Place , which petition had been
referred to the Zoning Board by the Torn Board. Yr . Brewer
stated that it was not the function of his Board to recomrr.end
or consider changes in zoning but only to pass upon applications
pursuant to the Town Law and the Ordinance . The Supervisor
requested Councilman r,atson and Councilman Tii'_CKeever to look
into this matter and make recommendations at the next Town
Board meeting.

The Town Clerk read a resolution prepared by Town Attorney
Delius , pertaining to the death of the honorable Wesley L.T.
Messersriith. On motion by Councilman Emburv , seconded by
Councilman Pii_ills , the following resolutionvns , upon roll
call, unanimously adopted:
!JUHEREAS , on November 5, 1948, death claimed the
- Honorable IS'esley M. Messersmith; and
t".FTERFAS , he so ably served the Town of 1Samaroneck
for nineteen years - as Justice of the Peace , prior to 1934
a member of the Town Board , and as Yagistrate and Judge of
its Court of Special Sessions , earning a well-deserved
reputation as a just and impartial Judge; and
74FREAS , he gave generously of his time and
efforts for social betterment of the community in which he
lived , through his work with the Boy Scouts , his Church
and his fraternal organizations , and was widely known as a.
friend of the people of the Town,
NOW t THEREFORE , BF IT
RESOLVED , that this Board, in appreciation
of the service rendered by the Honorable
Wesley 11. 14essersmith to the Town of
1,Iamaroneck as one of its public officials
and to its people as a private citizen,
hereby expresses deep feeling of its loss
and that of the people of the Town of
1Tamaroneck, caused by his death , and
be it
FURTHER RESOLVED , that this Board extends
to his family , its sympathy in their be-
reavement and in token thereof, instructs
the Town Clerk to certify and send to them,
a. copy of this resolution.
Supervisor Mandeville suggested that when this meeting ad-
journed, it would do so in respect to the late Judge Wesley
1% Messersmith.
The Town Clerk submitted contracts received from the County
of i"estchester v,;ith regard. to snow removal on County Roads.
Following discussion, it was , upon motion by Councilman
Embury , seconded by Councilman Watson, unanimously
RESOLVED that the Supervisor be and he
hereby is authorized to sign the contract
with the County of 177estchester for the re-
moval of snow from County roads within the
Town of ➢4ama.roneck.
The Town Clerk reported that he had on file , acertificate of
water arrears rom the Westchester Joint 'rater works , No. 1.
The statement of bank balances as of December lst , 1948, was
ordered placed on file.
Supervisor Mandeville suggested that it would be in order for
the Board to dispense with the regular order of business and
proceed with the hearing on the 1949 budget.
The Town Clerk presented the affidavit of publication and the affi-
davit of posting with reference to the public hearing on the budget.
There being no response to the Supervisor ' s inquiry as to whether
anyone wished to have the notice read., the Board proceeded to go
over the budget , page by pa&e , as has been the custom in the past.
At the completion of the discussion of the budget , the Supervisor
thanked those present for appearing at this hearing- The follow-
ing resolution w as moved by Councilman Watson:
THEREAS , this Board has heretofore made , compiled and
filed with the Town Clerk, a preliminary tax budget containing the
estimated probable revenues and estimated expenditures for the
several departments , offices and other town and special district
purposes for the year 1949; and
WHEREAS , notice of the completion and filing of said
tax budget and calling a public hearing thereon has been duly pub-
lished on November 20th and 27th, 19489 in the Daily Times , Mamaro-
neck, and posted in the manner required by law; and
WHEREAS , a. public hearing upon said tax budget was
duly held this day in accordance with the notice so published;
and
THEREAS , all persons present were afforded an oppor-
tunity to be heard; and
WHEREAS , this Board has reviewed the items in said pre-
liminary tax budget as required. by Section 113 of the Town Law,
NOW, THEREFORE , BE IT
RESOLVED , that the final estimates as completed
by the Town Board and filed in the office of the
Town Clerk, be and the same hereby are adopted as
the budget for the year 1949 , pursuant to the pro-
visions of the Town Lao..*, and that said estimates , as
soadopted , be entered in detail in the minutes
of the Board as follows :

and it is further
RESOLVED , that the annual budget estimates of the
expenditures of the Town of Mamaroneck for the fiscal
year 1949, be adopted and confirmed and that the Town
Clerk be and he hereby is directed to enter the same
upon the minutes ; and that the sums of money hereinafter
stated are hereby appropriated from the current revenues ,
as provided by law, for the offices , departments , boards ,
commissions and purposes hereinafter enumerated for
expenditure in the manner directed by law, to writ:

FURTHER RESOLVED, that for the fiscal year 1949, the sum
hereinafter set forth and for the purposes listed below,
be levied , assessed and collected upon the taxable pro-
perties in the Town of Laraaroneck outside of the Villages

RESOLVED , that pursuant to the provisions of Chapter
654 of the Laws of 1927 as amended and the provisions
of Article 12 of Chapter 61 of the Consolidated Laws ,
known as the Town Law as amended , there be levied
against the several lots and ^a.rcels of land con-
tained upon the statement hereto annexed and marked
Exhibit "A" , the several sums set opposite each
such parcel or lot of land on , such statement as
and for unpaid water charges due upon said lots
or parcels , which said sums shall be placed in a
separate column of the Tax Roll of the Town of
fiTamaroneck, under the name "'.Pater Rents" ; and
it is
FURTHER RESOLVED, that the Town Clerkre and he
hereby is authorized and directed to deliver to
the Supervisor , a copy of said tax budget and a
transcript of the minutes of this meeting, duly
certified and to transmit to the Clerk of the
Board of Supervisors of Vlestchester County ,
duplicate copy of said tax budget and transcript
of the minutes of this meeting , also certified ,
as provided by Section 116 of the Town Law.
After being seconded by Councilman Embury , a vote was taken upon
the foregoing resolution and after roll call, the vote was
announced as follows :

The members of the Board decided to hold the next meeting , which
will be a statutory meeting , on lFednesday , December 29th, 19489
at 8:15 o'clock P. M.
The Supervisor reported that he had on hand aiesolution from the
Village of Larchmont , approving the sale of property ec quired
by the Village at its foreclosure proceeding In Rem. It was his
recommendation that the sale be approved. Upon motion made by
Councilman Tatson, Eeconded by Councilman Mills, the following
resolution was , upon roll call, unanimously adopted:
17nREAS , the Village of Larchmont , through the institu-
tion of an action begun on February 13 , 19946 in the County Court
of ?°Westchester County , and entitled "In the Matter of the Foreclo-
sure of Tax Liens Pursuant to Article Seven-A, Title 3 of the Tax
Law by the Village of Larchmont (List of Delinquent Taxes for
1946) " , has become and now is the owner of a number of parcels of
real estate situate in the Village of Larchmont and Town of
Mamaroneck by virtue of a judgment in said foreclosure action made
and entered in pursuance of said judgment ; and
1AMEREAS , both the Village of Larchmont and Town of
Mamaroneck held tax liens for unpaid taxes on said parcels of
real property; and
YWHEREAS , pursuant to Section 165-a of the Tax Law, an
agreement dated May 20 , 1946 , was entered intotetween the Village
of Larchmont and the Town of Mamaroneck which , among other things ,
set forth the interests of said municipalities in the properties
being foreclosed , the disposition of said tax liens and unpaid
taxes and the manner of the distribution of the proceeds received
from said. sales ; and

WHEREAS , the Village Treasurer , pursuant to authoriza-
tion of the Village Board of the Village of Larchmont , on March
1 , 1948 , accepted the following offer of the upset price on
said property:

BE IT RESOLVED that the sales prices bid for the
parcels of real property listed above are hereby
approved , and that all consents and approval by
the Town Board of the Town of Marr_aroneck, for
the sale of the aforesaid parcels of real property
by the Village of Larchmont , required under the
provisions of the aforesaid agreement between the
Village of Larchmont and the Town of Mamaroneck,
dated May 20 , 1946 , are hereby granted and allowed.
The Supervisor also submitted a request for approval of a sale of
property by the Village of Mamaroneck, which property had been
acquired by the Village of Iv?amarcneck in its foreclosure proceed-
ing In Rem. On motion by Councilman YcIieever , seconded by Council-
man Embury , the following resolution was , upon roll call, unani-
mously adopted: '
7HEEREAS , the Village of Llariaroneck_, through the insti-
tution of an action in the County Court of 71estchester County,
entitled "In the Yatter of the Foreclosure of Tax Liens pursuant
to Article VII-A , Title 3 of the Tax Laid, by the Village of Ylamaro-
neck, List of Delinquent Taxes for 194511 , has become and now is
the owner of a number of parcels of real estate situate in the
Village of Mlamaroneck and Town of Mamaroneck; and
WHEREAS , both the Village of Mamaroneck and the Town of
Iamaroneck hold tax liens on said parcels of real property; and
?THEREAS , pursuant to Section 165H of the Tax Law, an
agreement was entered into between the Village of Mamaroneck and
the Town of Mamaroneck , which, among other things , set forth the
interests of said municipalities in the properties being foreclosed,
the manner of the sale of said properties , and the manner of the
distribution of the proceeds received from said sales; and
7HEREAS , the Village of 11aroaroneck has , pursuant to an
agreement had with the Town of Mamaroneck, advertised for and has
heretofore received, bids oncertain properties owned by the Town
of 174amaroneck as well as on certain properties owned by the Vil-
lage of Mamaroneck, in the Town of Mezraroneck; and
WIMREAS , the Board of Trustees of the Village of 17amaro-
neck has given consideration thereto and after due deliberation
accepted the bids hereinafter listed as to price and terms therein
set forth; and
�NHEREAS , since receipt of said bids , this Board has given
consideration thereto, and after due deliberation, it is
RESOLVED that the bids hereinafter listed, be
accepted at the price and terms therein set

Supervisor Miandeville requested a resolution to transfer 82 ,400.
from Surplus , General Town, to pa.y for the cost of paving Durham
and York Roads . On motion made by Councilman Embury, seconded by
Councilman P+tcKeever , it was , upon roll call , unanimously
RESOLVED , that for the purpose of paying for the
cost of paving Durham and York Roads , the sum of
$2 ,400. be transferred from Surplus , General Town
to the Highway Budget for the year 1948, Item IV
Miscellaneous.
Supervisor Yandeville stated that hew as pleased to offer the
name of Yr. 10-inn Brewer to fill the vacancy of Justice of the
Peace , at the salary provided in the Budget. Councilman Embury
said he would like the pleasure of moving the resolution appoint-
ing P,ir. Brewer , and upon its beingseconded by Councilman l"atson,
it was , upon roll call, unanimously
RESOLVED that Liunn Brewer is hereby appointed
Justice of the Peace of the Town of Mamaroneck
to serve the unexpired term of the late Honorable
111esley TV% Yessersmith and until the general
election to be held in the year 1949.
FURTHER RESOLVED that the appointment be made as
of December lst , 1948 and that the salary be paid
him in accordance with the appropriation for IgUesley
T.'. ETessersmith , Justice of the Peace , in the budget
of 1948 and the budget of 1949.
The Town Clerk was instructed to notify tir. Brewer , who will take
office as of December let , 1948.
Councilman 41atson reported that he had visited the incinerator
on the previous Saturday and had found a few small items which
needed policing but aside from these , the operation of the plant
seems to be going very well, a marked improvement over its operation
of six months ago.

Councilman Watson also reported that he had attended a meeting held
by the Committee to study the possibilities of erecting a community
house . He stated that the minutes of that meeting , together with
a questionnaire , have been sent to 30 different organizations , and
the next meeting of this-group will be on January 14th , 1949. Super-
visor Mandeville said he would appreciate it if Councilman Watson
would keep in touch with this matter .
Councilman Embury stated he had nothing to report for his depart-
ments.
Councilman 1tcKeever stated he had nothing to report for his depart-
ments .
Councilman Mills presented a list of claims for Fire Department
expenditures and stated that he had c},ecked the bills and recom-
mended approval and payment .

The members of the Torn Board , sitting as the Board of Fire
Commissioners , considered the claims and on motion, by Councilman
Mills , seconded by Councilman Embury , it was , upon roll call ,
unanimously

Lack of any fire resisting material on walls of garage . Faulty
installation of sheetrock on ceiling. Building Inspector will
insist upon corrections.
Residence built by John Merritt , Sheldrake Avenue.
Lack of any fireproofing on wall of garage connected to house by
breezeway. Building Inspector will order installation of sheet-
rock on this wall.
q'2 Lookout Terrace , Chatsworth Heating Co. ordered to place
sheetrock on ceiling above new oil burner installation.
Park ''lines & Liquors. Cellar inspected and found ineFcellent con-
dition.
Larchmont Acres , second notification to check and lubricate all
standpipe valves and connections.
Emerson Furniture Shop, Owner notified to fireproof furnace room,
check and clean oil burners and clean up premises directly ad-
joining building.
Cake Haven Superintendent given final warning regarding storage
of papers in cellar. Standpipes checked and lubricated in accor-
dance with previous orders.
Recommendation for alarm box in front of Larchmont Hills Apart-
ment presented to Town Council and requested amount of $750. for
installation approved. Location surveyed with representatives
of Gamewell and Telephone Company.
All apartments in good condition.

Town Attorney Delius reported that Mr. Foote was ready to approve
Lancia Lane and , therefore , it would now be in order for the Board
to accept the deed tosaid street . Upon motion made by Councilman
Embur = , seconded by Councilman 'Ua.tson, it was , upon roll call , un-
animously
RESOLVED, that the Town of Mamaroneck accept
by dedication deed or release , the 1-and lying
with the bed of Lancia Lane shown on map en-
titled , "Subdivision of Plot 12 and part of Plot
-- 10 , TJap of Fenimore Coorer Park, Inc. , Section A,
Town of Mamaroneck, Westchester County , N. Y.",
made by A. J. Foote , C. E. and Surveyor and
filed in the County Clerk's Office as Lap
Plumber 6550, and will pave suchstreet to a
width of 25 feet with 18 inch gutters on each
side , provided, however :
(1) That no such dedication shall be accepted and no paving com-
menced until the portion of Lancia Lane to be paved, shall have a
sub-grade approved by the Town Engineer;
(2) That gas , electricity and water services have been installed ;
(3) That sewerage disposal systems have been constructed and
approved by the Building Inspector of the Town of Tamaroneck, and
by the ';Testchester County Board of Health;
(4) That houses have been or are in process of being constructed. ,
which require access over Lancia Lane;
FURTHF..R RESOLVED that the acceptance of the deed
is made subject to the approval of the title by
the Town Attorney.
Town Attorney Delius discussed with members of the Board, various
pending certiorari proceedings. Tar. Delius was instructed to
contact T.r. Charles L. Daymon and 1,?r. Barney Epstein in order to
obtain appraisals , and further , was instructed to plane all of the
certiorari proceedir_gs brought in the year 1948 , upon the calendar
for trial.
Chief Burton appeared before the Board and stated that he had taken
the liberty of obtaining estimates on painting the ceiling and walls
of the main floor of the Fire House. He said he had obtained three
bids , the lowest of which was 8325. and asked that he be authorized
to proceed with this work, which he believed was necessary. The
bids were as follows;

Upon motion made by Councilman T,Iills , seconded. by Councilman
Embury , it was unanimously
RESOLVED, that the bid of Otto Plaue in the amount
of $325.00 be accepted and that the Chief of the
-- Fire Department be instructed to notify Otto Plaue
accordingly so that he may proceed with the work.
Supervisor Mandeville recommended approval of that portion of the
report submitted by ITr. J. Vi?oods Sweeney and his Committee , which
delegated to Chief Burton , responsibility of granting permits for
the use of the auditorium of the Weaver Street Fire House. On
motion made by Councilman Tlills , seconded by Councilman T.1cKeever ,

NOTICE TO BIDDERS
NOTICE is hereby given that sealed bids inrill be received by
the Police Commission of the Town of Mamaroneck, 7estchester
County , New York, between 8:00 and 8 :15 o ' clock P. P.I. on
December 21st; 1948 , at the Weaver Street Police Station,
11 Edgewood Avenue , Larchmont , New York, and there , at such
meeting of said Police Commission , will be rublicly orened
and read aloud , for supplying material and equipment and
installing a. radio communication system for the Town of
Mamaroneck Police Department , including
(a) Central station equipment to be located at
the V,'eaver Street Police Station , 11 Edgewood
Avenue , Larchmont , N. Y. ;
(b) Station antennae with accessaries and new
cable , including removal of the present
antennae;
(c) 7 mobile units with accessaries ;
(d) Frequency monitor;
(e) Signal generator.
All work and materials to be in accordance with written
specifications now on file in the office of the Chief of
Police of the Town of Vlamaroreck, 11 Edgewood Avenue ,
Larchmont , N. Y. , cobies of which may be obtained from the
Chief of Police of the Town of P.Iamaroneck.
The successful bidder will be required, 7vithin 10 days after
the award made by the Town Board , to enter into a written con-
tract with the Town of D.Iamaroneck, to be approved by the Town
Attorney.
The Town Board reserves the right to consider bids for 10 days
after receipt of the same by the Police Commission, before
awarding the contract and the right is reserved toreject any
or all bids or to accept any bid or bids which the Town Board
may deem advantageous to the Towwn of Hamaroneck and to award the
contract to other than the lowest bidder.
