HomeMy WebLinkAbout1948_11_15 Town Board Minutes i L1INUTES OF A SPECIAL MEETING OF THE TOWN BOARD OF THE TOWN OF Iv1AMARONECK9 HELD IN THE COUNCIL ROOM OF THE WEAVER STREET FIRE HOUSE, TOWN OF MAMARONECKo NLIAT YORK, ON NOVFMBER 15th, 1948. The meeting was called to order by Supervisor Mandeville at 8:15 o 'clock P.M. ( Eastern Standard Time ) There were present: Supervisor Mandeville Councilmen Embury; Watson, Mills , and McKeever Absent : None Presence was also noted of Town Clerk Gronberg, Town Attorney Delius and Town Accountant Finson® The Town Clerk presented an affidavit of publication of a notice calling for a public hearing to consider certain amendments to the Zoning Ordinance of the Town. The Supervisor asked if there was anyone present who wished to speak in opposition to the proposed Ordinance. Since no one wished to speak, he said he would assume that those present were in favor of the proposed amendment. There being no one who desired to speak, the Supervisor declared the hearing closed. Upon motion by Councilman Embury, seconded by Councilman Mills, it was, upon roll call, unanimously RESOLVED that the Amended Area District Map, which is a part of the Zoning Ordinance of the Town of Mamaro- neck as amended, is hereby amended and corrected so as to show the following described property in Use, Area and Height District AA ( Residence) : BEGINNING at a point in the easterly line of Old White Plains Road where the same is intersected by the boundary line between the Town of Scarsdale and the Town of Mamaroneck; and running thence northeasterly along the said boundary line and through lands now or formerly of Isaac Hall, to a point in the westerly line of lands belonging to the West- chester County Park Commission, known as t1 Saxon Woods Park" ; thence in a southeasterly and southerly direction along the westerly line of "Saxon moods Park" and the easterly line of lands now or formerly belonging to Isaac Hall and Leonore Rosensohn and continuing southerly and southwesterly along the boundary line between "Saxon Woods Park" and the lands now or formerly belonging to Burge M. Seymour, to a point in the easterly line of Old White Plains Road; thence in a north- erly direction along the easterly line of Old White Plains Road, to the point or place of beginning. The Town Clerk presented an affidavit of publication of the ad- vertisement for the sale of one 91 x 28" swing blade snow plow with undercarriage, and stated that he had received the follow- ing bid: Chatsworth Coal and Supply Co. , Inc . $50. On motion by Councilman ldcKeever, seconded by Councilman Watson, it was, upon roll call, unanimously RESOLVED that the bid of Chatsworth Coal & Supply Co. , Inc .in the amount of $50. for one 91 x 2801 swing blade snow plow, with undercarriage, be and it hereby is accepted. The Town Clerk presented affidavits of publication and posting with regard to the sale of certain property owned by the Town of Mamaroneck to Miriam Grant, subject to permissive referendum. A letter dated October 24th, 1948, was received from Donn B. Duffy thanking the Town Board for the honor which had been bestowed upon him by said Board. A letter dated November 12th, 1948, was received from the Larch- mont Fair Trade Association, Inc . , requesting the use of Myrtle Boulevard as an assembly place for the annual free Christmas party for the children of Larchmont® Permission for the use of Myrtle Boulevard was granted by the Town Board. A letter dated November 15th,- 1948, was received from Chief Paul A. Yerick, stating that at a meeting of the Police Commission, held November 10th, 1948, it had been recommended that a con- tract in the amount of $5,294.44 for the new radio communicating system, be awarded to the General Electric Company. made Upon aotion/by Councilman Watson, seconded by Councilman Mills , it was, upon roll call, unanimously RESOLVED that the recommendation of the Police Commission be adopted and that there be included in the 1949 Budget the sum of approximately one-half of the sum necessary to purchase the radio communicating system, from the General Electric Company. A letter dated October 21st, 1948, was received from Mr. Henry Rothman, 22 Lafayette Road, requesting that an electric light or lights be installed on the extension of Lafayette Road. The letter was referred to the Highway Department for recommendation. The Town Clerk reported that he had written to the Department of Public Welfare of the County of Westchester, requesting the cost of the relief load in the Town of P,Tamaroneck as of October 15, 1948. He stated that his letter had been referred to the Commissioner' s office and he is awaiting their reply. A letter dated November 4th, 1948, was received from Mr. Herman G. Reihl, concerning the use of brass pipes in new buildings, stating that the brass pipes in his residence are becoming, pitted and showing small leaks. The letter was referred to Mr. Foote with the suggestion that he contact Mr. William E. Thrasher, Superintendent of the local Joint Dater '111orks. A petition was presented by the Town Clerk, signed by eight resi- dents of Vglley Place, requesting that,that area be changed from Class "C"(Business) to Class "A1° (Residence). The petition was referred to the Zoning Board of Appeals for recommendation. The Town Clerk presented contracts for the rental of three voting machines used in the past election. On motion by Councilman Mills, seconded by Councilman Embury, it was upon roll call, unanimously RESOLVED that the Supervisor be and he hereby is authorized to sign the contract with the Auto- matic Voting Machine Corporation of Jamestown, New York, for the rental of three voting machines at $150. each. The Town Clerk presented the report of the inspection of the Town Lockup, received from the State Commission of Correction. The report was ordered received and placed on file. The following reports were ordEred received and placed on file;: Building Inspector' s report for the month of October, 1948; Town Clerk' s report for the month of October, 1948; Report of Receiver of Taxes and Assessments for the month of October,1948; Report of the Westchester Shore Humane Society Inc. , for the month_ of October, 1948; Attendance report for the month of October, 1948; Statement of bank balances as of November 1st, 1948; Summary of receipts and disbursements, January 1st, 1948 to October 31st, 1943; Analysis of budget appropriations and expenditures, January 1st, 1948 to October 31st, 1948; Analysis of estimated revenues, January lst, 1948 to October 31st, 1948. I Councilman 'Natson reported that everything at the Incinerator is in fine shape. He stated that there will be a meeting, November 16,1948; concerning the proposed Community House in Larchmont, which meeting, he will attend. Councilman Embury stated that he had nothing to report for his departments . Supervisor Mandeville presented a resolution received from the Village of Mamaroneck approving the sale of certain properties acquired by the Village in its foreclosure proceeding In Rem. The Supervisor recommended that the Town Board also approve this sale . Upon motion by Councilman Embury, seconded by Councilman McKeever, the following resolution was unanimously adopted: FTHEREAS, the Village of Mamaroneck through the insti- tution of an action in the County Court of Westchester County, entitled " In the Matter of the Foreclosure of Tax Liens pursuant to Article VII-A, Title 3 of the Tax Law by the Village of Mamaroneck, List of Delin- quent Taxes for 194581 , has become and now is the owner of a number of parcels of real estate situate in the Village of Mamaroneck and Town of Mamaroneck; and WHEREAS, both the Village of Mamaroneck and the Town of Mamaroneck hold tax liens on said parcels of real Property; and `iHEREAS, pursuant to Section 165H of the Tax Law, an. agreement was entered into between the Village of Mamaroneck and Town of Mamaroneck, which, among other things, set forth the interests of said muni- cipalities in the properties being foreclosed; the manner of the sale of said properties ; and the manner of the distribution of the proceeds received from said sales ; and WHEREAS, the Village of Mamaroneck has, pursuant to an agreement had with the Town of Mamaroneck, advertised for and has heretofore received bids on certain pro- perties owned by the Town of Mamaroneck as well as on - certain properties owned by the Village of Mamaroneck, in the Town of Mamaroneck; and WHEREAS, the Board of Trustees of the Village of Mamaroneck have given consideration thereto and after due deliberation accepted the bids hereinafter listed as to price and terms therein set forth; and i 'I l 76HEREAS, since receipt of said bids, this Board has given consideration thereto, and after due deliberation, it is RESOLVED that the bids hereinafter listed be accepted at the price and terms therein set forth LIST OF BIDS ACCEPTED IN SECTION 8 Total Village Town Assessed Blk. Lyons 4,000. cash 5 & 6 The Supervisor presented the list of Town-owned properties which had been sold at public auction on October 27th, 1948 On motion made by Councilman Watson, seconded by Councilman Mills, the following resolution was unanimously adopted: WHEREAS, the Town of Mamaroneck, through the institution of an action in the County Court of Westchester County, entitled B°In the matter of the Foreclosure of Tax Liens pursuant to Article VII-A, gh�xmattgx��xt§: x�xxxs��xuxa Title 3 of the Tar. Supervisor Mandeville requested a resolution authorizing an auction for the sale of property .acquired by the foreclosure --- proceeding In Rem. On motion by Councilman Embury, seconded by Councilman McKeever, it was unanimously RESOLVED that' the next public auction for the sale of property acquired by the foreclosure proceeding In Rem ,, be held .-on, tie 3rd day of January, 1949 at 3:15 oAclock E .M. at the -'?leaver Street Fire House. 1 The Supervisor stated that he had on hand, an agreement in tri- plicate from the Westchester County Park Commission, which pro- vides for the extension of the lease dated October 13th, 1945, covering vacant land known as Parcel 45 and a portion of Parcel 1B, Sheet 9, Pelham Port Chester Parlujay. On motion by Council- man Embury, seconded by Councilman Watson, it was unanimously RESOLVED that the Supervisor be and he hereby is authorized to sign the extension agreement which provides for the extension of the lease dated October 18, 1945 with the Town of Mamaroneck, cover- ing vacant land on the Pelham Port Chester Parkway, known as Parcel 45 and a portion of Parcel 1B, Sheet 9, for a period of one year, ending October 31st, 1949, at the same annual rental of $1. and subject to the terms of the original lease. The Supervisor presented a letter dated November 5th, 1948, from rlr. James C . Harding, Commissioner of Public Works, advi- sing that the County has extended for another year, its contract with the State Department of Public Works for the removal of snow and ice from the State Highways in Tfidestchester County. On motion by Councilman 'McKeever, seconded by Councilman Embury, it was unanimously _RESOLVED that the Town of Mamaroneck extends its contract, dated November 8th, 1946, for an addi- tional year, with the County of Westchester, for the removal of snow and ice ffom State Highways within the Town, in accordance with Section 12 of the Highway Law, as amended. The Supervisor requested a resolution to transfer $5,612.02 from Surplus , General Town, to pay for the cost of paving Doris Road ( Prince Willows) . Upon motion by Councilman McKeever, seconded by Councilman Miils, it was, upon roll call, unanimously RESOLVED that for the purpose of paying for the paving of Doris Road (Prince ?pillows ), the sum of $5, 612.02 be transferred from Surplus, General Town, to the Highway Budget for the year 1948, Item IV Miscellaneous . Councilman McKeever stated that he had nothing to report for his department. Councilman Mills presented a list of claims for Fire Department expenditures and stated that he had checked the bills and recom- mended approval and payment. The members of the Town Board, sitting as the Board of Fire Commissioners, considered the claims and on motion by Councilman Mills, seconded by Councilman McKeever, it was, upon roll call, unanimously RESOLVED that the following described claims be and they hereby are approved and the Supervisor and Comptroller be and they hereby are authorized to pay the same out of the budget for the Fire Department : Bonnie Briar Country Club $614.05 George Burton 97.25 The Mungle Engineering Co. 23 .85 G.W. He stated that the Town Engineer and Superintendent of Highways triad approved the streets for paving, in accordance with the resolution here- tofore adopted by this Board at its meeting held June 30th, 1948. made On motion/by Councilman Watson, seconded by Councilman Mills, it was unanimously RESOLVED that the Town accept a deed to the streets known as Fairway Drive and Doris Road, as shown on a sub- -_-- division map entitled " Subdivision Map of Section One, Prince Willows" in the Tovan of Llamaroneck, Westchester County, New York, " made by Ralph Cronquist, Civil Engineer, Mamaroneck, New York, dated May, 1948, and filed in the Register ' s office on June 7, 1948, as 1dap No. 6574, together with a release of mortgage covering the same premises. FURTHER RESOLVED that the Town Attorney is hereby instructed to record said deed and release. The Town Attorney presented a letter from Henry R. Dillon, Redeiver of Taxes, stating that certain taxes for the years 1899 and 19002 now shown as open against Block 831, Parcel 30 on the Tax Asess- ment Map, should be cancelled. These taxes in the amount of $3.36 for the year 1899 and in the amount of $3.15 for the year 1900 appear upon the old tax rolls of the Town as "Compromised" and the Receiver of Taxes requests, in accordance with past procedure, that these taxes should be marked "paid" or "cancelled" . Upon motion made by Councilman Embury, and seconded by Councilman McKeever, it was unanimously RESOLVED that the taxes for the years 1899 and 1900 in the sum of $3.36 and $3.15 res- pectively, against property known as Block 831, Parcel 30, on the Tax Assessment Idap of the Town of Mamaroneck, be cancelled. RESOLVED that the Public Hearing thereon as required by Section 113 of the Town Law, be held by - - and before this Town Board on Wednesday, December 1st, 1948, at 3:15 P.M. in the Council Room of the Weaver Street Fire House, Town of Mamaroneck On motion duly made and seconded, it was, unanimously RESOLVED that the Town Clerk give notice of said Public Hearing as required by Section 113 of the Town Law in " The Daily Times" , the official news- paper, published in the Town of Mamaroneck in its issues of November 20th and 27th, 1948.
