HomeMy WebLinkAbout1948_09_29 Town Board Minutes MINUTES OF A SPECIAL MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK HELD IN THE COUNCIL ROOM OF THE WEAVER STREET FIRE HOUSE, TOWN OF MAMARONECK, NEW YORK, ON SEPTEMBER 29th, 1948. The meeting was called to order by Supervisor Mandeville at 8 :15 o 'clock P.M. ( Eastern Standard Time) There were PRESENT: Supervisor Mandeville Councilmen Embury; Watson, Mills, and McKeever ABSENT : None Presence was also noted of Town Clerk Gronberg and Town Attorney Delius. The minutes of the meeting of August 25th, 1948, were approved as presented. A letter dated September 20th, 1948, was received from Mr. David Butler, Sedretary of the Larchmont Gardens Association, thanking Supervisor Mandeville for the excellent job done nn cleaning the brook. The Town Clerk was instructed to acknowledge the letter with thanks. A letter, dated September 25th, 1948, was received from Mr. Oliver Maggard, commending the Fire Department for the splendid work done by the Department at a fire which occurred in his home at 20 Hillside Road, Larchmont. The Town Clerk was instructed to acknowledge the letter with thanks. A letter, dated September 23rd, 1948, was received from Mr. San- tino Pittera, regarding an improved road at Lester Place. The letter was ordered received and placed on file. Town Clerk Gronberg read the following letter: "Larchmont, New York September 24, 1948 Mr. Owen A. Mandeville, Town Supervisor Town Offices 158 West Boston Posit Road Mamaroneck, N.Y, Dear Mr. Mandeville : 'He very much appreciate the courtesy you extended in calling to present your views on the proposed change in loca- tion of the Town Offices, and as you requested we are happy to give you our opinions on this matter. It is understandable that on the part of the Town Council there may be good and numerous reasons why this change is desirable, and we are aware that the handling of the authority to permit use of the Fire House auditorium could be at time a matter of much annoyance. We further very much res- pect and admire your presentation of the matter. But the feeling of the undersigned and those they represent, which numerically goes far beyond the number of names on the recent petition, is that this move is not to our best interests. From a large number of conversations we have had with -- many citizens the principal objections offered have been that they do not desire the Town Offices in the Weaver Street Fire House, and further they do not wish to be deprived of the auditorium as a Public Forum and gathering place. i These statements could be greatly amplified and many other forceful objections offered, but the essence of the feel- ing is as stated. We respectfully suggest - 1. That in the future full authority in the adminis- tration of the auditorium be left in the hands of the Fire De- partment. 2. To accomplish this an impartial committee of representative citizens, four in number, from Fire District #fl, should meet with the auditorium committee constituting three members of the Fire Department for the purpose of drawing up a set of rules and regulations to govern the use of the auditorium. 3. These rules and regulations once adopted would not be subject to deviation or appeal except by revision by both committees mentioned. We trust you will see fit to bring the various points of this letter before your Council for discussion when you next meet on this matter. Morris" The Supervisor stated that it has come to a point where it is unimportant where the Town Offices are located, but he is not satisfied to leave the matter hanging and would like to recom- mend the appointment of the following committee to study the matter and make recommendations: Mr. Andrew Wilson, III, President, The Elkan Park Association Mr. John J. Goldsmith, President, Howell Park Association Mr. George Schuler, President, Larchmont Gardens Association Mr. Robert A. Seidel, President, Larchmont Ridge Association Mr. J. Woods Sweeney, President, Maple Hills Association Mr. George W. Burton, Fire Chief, Town of Mamaroneck Fire De- partment. The Supervisor also suggested that this Committee visit the present Town Offices, and that they confer with Town Attorney Delius who would advise them with regard to the legal aspects of the use of the auditorium of the Weaver Street Fire House. Councilman Embury suggested that they also confer with Police Chief Yerick, concerning traffic hazards at the Weaver Street Fire House. made Upon motion/by Councilman Embury, seconded by Councilman McKeever, it was unanimously - - RESOLVED, that the following residents of the Unincor- porated Section of the Town of Mamaroneck be and they hereby are appointed a committee to study and make recommendations concerning the location of the Town Offices and to confer with Town Attorney Delius as to the future use of the auditorium of the Weaver Street Fire House, and with Police Chief Yerick with re- gard totraffic hazards at the Weaver Street Fire House : Mr. Andrew Wilson, III, President, The Elkan Park Association Mr. John J. Goldsmith, President, Howell Park Association Mr. George Schuler, President, Larchmont Gardens Association Mr. Robert A. A letter, dated September 10th, 1948, was received from Mr. O.F. Gerlach, Superintendent of Sewers of the County of West- chester, requesting an easement through lands of the Town of Mamaroneck, as shown on drawing attached to said letter. The letter was referred to the Town Attorney. The Town Clerk presented a resolution received from the Village of Larchmont, approving the sale of property known as Block 705, Parcel 328, to Raymond A. O 'Brien. The resolution was ordered received and filed. The following reports were ordered received and filed: Report of Westchester Shore Humane Society, Inc. , for August,1948; Summary of Receipts and Disbursements, Jan. 1st, 1948, to August 31st, 1948; Analysis of Budget Appropriation and Expenditures, January 1st, 1948 to August 31st, 1948; Analysis of Estimated Revenues, January 1st, 1948 to August 31st, 1948; Councilman Embury reported on the condition of the Larchmont Gardens Lake and suggested that perhaps the Members of the Board might inspect it during the present dry spell. Council- man Embury stated that the members of the Park Board are pre- paring to in8lude money in the Budget this year, toward repair- ing the banks of the Lake. The Supervisor said that Mr. Foote is getting recommendations from various reputable engineers and ---- will submit these recommendations to the Park Board. Councilman Embury- also reported that he had learned of the death of h?rs. Lillian E. Uessersmith, wife of Judge Wesley M. Ydssersmith, and suggested that flowers be sent in the name of the Town Board. The Town Clerk was instructed to take care of this matter. The Carnoy matter was put over until the next meeting. Upon motion by Councilman Watson, seconded by Councilman Embury, it was unanimously decided to hold the next public auction for the sale of property foreclosed by procedure In Rem, on October 27th, 1948 at 8:15 o 'clock P.M. at the Weaver Street Fire House. The Supervisor reported that the total cost of snow removal for the past season was $219232.30 and that after applying all moneys in the budget and the amount received from the State of New York, there was a present deficit of $12,632.82. Upon resolution made by Councilman Embury, seconded by Councilman Mills, it was unanimously RESOLVED, that there be transferred from 1BSurplus" the amount of $12,632.82, to cover the deficit for the cost of snow removal. The Supervisor reported to the Board that there was available from the collections of State, County and Town Taxes, for the year 1948, the sum of $214,807.30 for the payment of the County taxes, but in addition to this, $35,192.70 was required to make up the deficit between the collection of the County taxes and the amount actually due. _27 Upon motion made by Councilman Embury, seconded by Councilman 147atson, it was unanimously RESOLVED, that there be appropriated from 01 Surplus" the amount of $35,192.70 for the payment of the County tax for the year 1948. Supervisor Mandeville brought before the Board, the matter of countersigning checks, during Mr. Orsino ' s vacation, at which time he will not be available by mail. The Supervisor stated that he had an opinion from Mr. Delius and that he would study the matter further and have some recommendation to submit to the Board at the next meeting. Councilman McKeever stated that he had nothing to report for his departments. Councilman Mills presented a list of claims for Fire Department expenditures and stated that he had checked the bills and recommended their approval and payment. The Town Attorney presented a lease for the court room space at 100 Mamaroneck Avenue, used by the Justice of the Peace. Following dis- cussion, it was, upon motion by Councilman Mills, seconded by Councilman Embury, upon roll call, unanimously RESOLVED, that the Supervisor be and he hereby is authorized to execute a lease between Burton C . Meighan, Jr. and Hunter Meighan and the Town of Mamaroneck, for the period commencing October 1st, 1948 and ending December 31st, 1949, at a monthly rental of $40. for the space used as the justice.° s court room, at 100 Mamaroneck Avenue, Mamaroneck, New York. it The Town Attorney stgted that the Town Engineer had requested an amendment to the Zoning Ordinance with relation to detached garages. Following discussion, it was suggested that a public hearing be held and upon motion made by Councilman McKeever, seconded by Councilman Embury, it was, upon roll call, unanimously RESOLVED, that the following notice be insetted in the Daily Times, the official newspaper of the Towns PUBLIC NOTICE PLEASE TAKE NOTICE that the Town Board of the Town of Mamaroneck, will hold a public hearing at 8.15 o 'clock P.M. on October 20th, 1948, in the Council room of the Weaver Street Fire House on Weaver Street in the Town of Mamaroneck, for the purpose .of considering amendments to the Zoning Ordinance of the Town of Mamaroneck as follows* (1) Article II, Section 6, Subsection 3, is to be corrected to read as follows : 3 . Any non-conforming use of land or structureathat have not been used as such for a period of three or more years, shall be deemed to be abandoned and shall not be continued or used for any non-conforming use without the consent of the Board of Appeals. (2) Article II, Section 79 ( the first paragraph) is to be amended to read as follows: In residence districts AA, and Amt, a private garage for not more than three automobiles owned and used exclusively by an individual resident of the unincorporated part of the Town of Mamaroneck for his private use, shall be permitted in resi- dential districts, if erected at least 75 feet from the front property line, and least 1 feet from tLe rear and side property line, unless said garage is made part of the main dwelling or in case of severe topographical conditions, or where a lot is less than 100 feet in depth, the distance may be less than 75 feet upon the consent of the Board of Appeals. On corner lots, a garage shall also be set back at least 30 feet from a side street unless, upon the consent of the Board of Appeals, a less set-back restriction be permitted.
